FEBRUARY2016 SERVINGTHENATURISTCOMMUNITYFOROVER14YEARS VOL.15NO.2 SO CAL CLUBS RALLY TO SUPPORT NITOC AND FIGHT THE HUNTINGTON BEACH BAN

By Gary Mussell and Rolf Holbach An estimated 35 members of Naturists in the OC (NitOC) club, SCNA, the Bares and others made their feelings known to the City Council of Huntington Beach over the cancellation of the monthly nude swims in the city’s gym. City law forbids nudity in public places, but nudist speakers pointed out this was a private party and the city staff who were on site were volunteers. In addition, the gym’s windows were covered and the doors locked so that the public could not attend or see anything should they walk by the building. Last September, the new city attorney decided the public law extends to private events on public property and refused to SCNA President Rolf Holbach addresses Huntington Beach City Council allow the pool parties. There was no warning to Sunday, Feb 7, Noon – 7 pm the change in policy, no public hearing, and even the city Super Bowl Party, Chili Cook-off, Best Soup Contest, Victorville, CA council knew nothing about the change. All NitOC received Friday, Feb 12, 7:30 pm was a letter denying the use of the gym and its pool. The CCC supports public access to the trail, and the trail fulfills a Coastal Act goal of establishing beach access for everyone. If the trail is again vandalized the CCC will certainly be informed and most likely would take strong action. “I want to thank everyone who helped, especially our attorney. HOLIDAY GREETINGS FROM MAUI

Houses of the HOA can be seen on bluffs overlooking nude beach at Pirate’s Cove, San Luis Obispo. HILLSIDE HOA THREATENED PIRATES COVE BEACH ACCESS We received this email from Brian of Pirate’s Cove Beach just before we went to press. Edited for space: “The trail [above Pirate’s Cove] was in serious jeopardy during the first week of 2016. The Bluffs Homeowners’ Association (HOA) hired a private security guard firm, whose primary duty was to prevent people from getting to the bluff top, and to our trailhead. If people ignored his warnings, he called the Pismo Beach Police Dept., who, in turn began issuing a number of ‘trespassing’ citations. “Additionally, I was informed…[the HOA]…was preparing a bid to remove all the remaining steps of the trail to the beach. Member Helen O’Neill sent us some beautiful snapshots from her in Maui as she visited several of the nude “During 2015, additional ‘no trespassing’ and ‘private beaches there. The photo above is of Red Beach at sunset. property’ signage began to appear along the HOA Thanks for sharing! property. The situation soon escalated with reports of harassment by individual HOA members. Finally, the upper portion of the beach trail was vandalized [twice]. . Therefore, I contacted an attorney for help, who then sent a complaint letter to the California Coastal Commission (CCC). “The key point to understand is that the on the official Parcel that established the HOA, lots have a specific easement condition where the developer/owner states: “We hereby dedicate to the public a blanket easement for public pedestrian recreational access and all uses incident thereto, over those portions of Lot 25 lying outside of the street [everything seaward of the HOA street] and also as shown on this map [specific portions of the street].” “On Jan 8 of this year, the Coastal Commission sent an Enforcement Letter to the HOA, recognizing our right to access any portion of property seaward of the HOA street, and that ‘it is not ‘trespassing’; ‘therefore, the Pismo PD can/will NOT issue citations for that offence’ when we access the coast and beach through that area. Further, ‘neither a private security guard nor any “No Trespassing” signs are allowed,’ and the letter warned the CCC could impose fines up to $11,250 per day for each violation not corrected. “I am happy to report the security guards are no longer there and the “No Trespassing” signs will be coming down. The Pismo PD has stopped issuing citations.
