6 2019 Town of Bracebridge Delegation to Gol kommune, Norway May 13, 2019 to May 21, 2019

7 8 9 History of Relationship with Gol kommune

• A formal Friendship Agreement between the Town of Bracebridge and Gol kommune was initially executed in 2010 and then subsequently reconfirmed in 2017. • The agreement commits the two communities to fostering a sustained friendship and positive relationship by engaging the people of Bracebridge and Gol in projects, activities and exchanges and programs. • In 2013, a group of nine youth travelled from Gol to Bracebridge for a ten day visit. The youth delegation stayed with Bracebridge families and participated in a number of events and activities so they could learn about our history and the wonderful community in which we live, work and play.

10 History (continued) • In 2015, the Town of Bracebridge sent a delegation of ten (10) youth and two (2) adults leaders to Gol for twelve days(12) days to further develop the relationship between the two communities and to gain knowledge and insight into the culture and history of Gol. • In 2017, the Town of Bracebridge hosted five (5) Gol kommune delegates. The activities and meetings surrounding their visit focused on an exchange of information related to business attraction and retention, culture and recreation programming and service delivery and local and regional tourism development and to celebrate the 150th anniversary of Canada.

• On February 11, 2019 the Mayor of Gol kommune, in a letter to Mayor G. Smith, formally invited the Mayor and a delegation from Bracebridge to Gol in May, 2019 to strengthen the bond and to work on the exchange of knowledge and insight that was started in 2017. • In response, a delegation of six (6) representatives, recommended by the Gol Friendship Committee and approved by Town of Bracebridge Council, visited Gol kommune from May 13, 2019 to May 21, 2019.

12 13 14 15 Purpose of the Delegation • The agenda for the delegation was created based on topics of interest for both the Town of Bracebridge and the Gol kommune Friendships Committees and included: – Tourism/Sport Tourism in Norway and Muskoka, festivals, publications, services; – Tour of Pump Track Tour and other Recreation Facilities; – Education - School /Municipal partnership in Norway; – Governance/planning/best practices; – Service Club-Rotary connection-initiatives, exchanges, fundraising, structure;

16 Purpose of the Delegation • Chamber of Commerce/BIA - business supports, programs, services and communications (public and internally); • Economic Development initiatives; • Environmental Protection / Water quality / Climate Change; • Visit to Golsfjellet, Vesle ; and • Visits to other Gol and Norway sites.

17 18 Culture • Residents of Norway are proud of their heritage and continue with traditions which celebrate their heritage. • National Day - all Norwegians wear their traditional clothing, some which are handed down from generation to generation. • Sheep skin ink art connects people with sun, love, water and animals • Volunteers coordinate and teach art classes in the repurposed Town Hall which is now an Arts and Crafts Centre.

19 Culture (continued) • Historical treasures, such as the Skaga Farm which was built in early 1800’s, have been gifted to the Town and is managed by volunteers. • Vesle Skaugum, Golsfjellet is best known as "Little Norway" and is now a holiday resort for veterans, servants and former employees of the Air Force with family and friends.

20 21 22 23 24 25 26 Education • The Gol School, grades 1 to 10, has 540 students and 87 staff members and is centrally located in the Town. • Children begin learning English in grade one. • Cooperative learning and student leadership is a key focus of instruction. • Technology plays a key role in instruction. The schools are equipped with modern industrial arts, visual arts, culinary arts and computer labs to name a few. Each child is provided with a laptop which is theirs to keep. • There is strong connection between the school and the community.

• Outdoor education is a key component of the curriculum in Norway’s schools. Students are provided with opportunities to participate in outdoor activities year-round. They have a saying in Norway “there are no bad days, only bad clothing”.

• For recess, the students assist with coordinating a variety of outdoor games and activities which meet the needs of all students as inclusion is the key to the success.

28 29 30 31 32 Tourism • “Skagahogdi” is a new ski resort that is under construction. In addition to the ski facilities, new accommodation units are also planned. In order to ensure the on-going viability of the commercial resort, the required mix of units is 70% residential and 30% commercial. • A recent study projected that the Gol area would need approximately 1200 new “cabins” (seasonal residences) to meet demand over the next 10 years. In order to ensure that these cabins remain recreational and seasonal in nature, a number or use restrictions are in place, including size and height restrictions, and requirements for an alternate primary address. No services such as school buses are provided. The Town is also facilitating meetings with cabin organizations in the area to determine how they can better work together to address local priorities.

33 Tourism (continued) • The natural beauty of Gol combined with the extensive regional trail system for hiking, cross country skiing, and backcountry skiing makes Gol a prime tourist destination. • Camping in Gol is very popular and they have a number of campgrounds where people park their trailers for the season. • The population of Gol is 4,600 and with this influx of seasonal population the population increases to 14,000 to 16,000. • As Gol is the cross road for their region of Hallingdal, Gol is working with regional representatives on projects such as cross promotion, expansion of regional trails systems, and the development of regional mountain bike trails.

• The Visitor Information Centre/Tourism is ran by a Board made up of businesses, stakeholders and a council member and is a membership driven organization much like the Chamber in Bracebridge. They struggle to get larger businesses to participate and are working to improve relations with these businesses by showing them the value of partnerships. The Municipality gives money and businesses match the money for initiatives. Currently they offer a Sheep festival, Ski festival for women only and Gol Days - July Festival and are looking for ways to expand festivals and celebrations.

35 36 37 38 39 Recreation • Hiking , cross country skiing, mountain biking, and walking are well supported throughout the urban and rural areas. • Sports facilities include: a pump track; skateboard park (in development); an outdoor artificial turf soccer/track complex; and a Sports Complex. • The facilities are all centrally located in Town and are close to the schools. The schools use these spaces during the day for their activities and the students walk to the facilities from their respective schools. • The Sports Complex and Soccer/Track facility is owned by the Town and operated by the Gol Sports Guild. The Town pays for the majority of the maintenance of the facility and the Guild contributes through income derived from facility rentals.

• The Youth Centre (Klubb 1), owned and operated by the Town, is also centrally located and is open two evenings a week. The youth organize the activities, with the assistance of two (2) adult leaders/supervisors. • Obesity rates in Gol are very low as the majority of residents of Gol are active year round and the schools promote and make physical activity a priority.

41 42 43 44 45 46 Environment • Gol is involved in a number of environmental initiatives: • Floodplain maps are being developed which will map various frequencies of future storms, up to the 200 year and even 1000 year storms, based on modeling techniques. • Climate change research and planning is focused on what the community can do, rather than on what others must do. Central to their planning is the promotion of densification in the town. • Similar to Ontario, staff acknowledged that people want to live in the rural areas; however, services are more effectively provided within the town. An effort is being made to make the lifestyle in town as attractive as possible to encourage more density in the existing settled area.

47 Environment (continued) • Fragmentation of habitat is also an issue in the Gol area. However, the perspective on this concern is somewhat different than in Muskoka. In Norway, concern exists that forests will overtake meadows and efforts are being made to protect grassland and meadow areas for the unique ecosystems and habitat they provide. • The Town is also focusing on purposeful bicycling within the town, and are trying to facilitate outdoor spaces and places for people to meet. A concept plan for the downtown includes “hot spots”, “connections” and “natural areas”.

• Gol is supported by a small, however, strong Rotary Club of which many members have a personal connection: – The Club is focused on individual’s business designations. – Recent projects include the development of a sensory garden at the senior’s lodge which is home to dementia patients. The sensory garden includes: walking paths, sensory gardens, vegetable gardens, a chicken coop, secure fencing, an outdoor covered area with table and they have plans to expand the stone area for more accessible seating.

53 54 55 Public Engagement • Gol has a unique approach to public consultation. Gol acknowledged that very few people attend town hosted stakeholder / public meetings. As a result, they are focusing on consultations through social media, outreach to schools, seniors groups and other organizations in order to ensure that the public is heard. • Gol has a Youth Council and the Mayor of Gol attends their meetings and brings issues and areas of interest to Council. The Youth Council are chosen by their peers at schools. The youth advocate for youth projects such as the pump track, and potential new skate park.

56 Future Initiatives • Supporting the national heritage of Canada and Norway by keeping the historical connection of Little Norway and Vesle Skaugum relevant to our communities and ensuring the heritage pieces are preserved. • Working with local public and catholic schools on creating grade 2 curriculum projects which provide opportunities for Gol and Bracebridge children to simultaneously connect and learn about each other’s history and culture.

57 Future Initiatives (continued) • Working with local public and catholic schools and the recreation department in the development of a pen pals, email pals and or Skype-pals program that: – provides an opportunity for Gol children to practice their English speaking skills; generates friendships between the counties; and provides a venue for youth and children to share experiences and compare cultural similarities and differences.

58 Future Initiatives Continued • Working with the Bracebridge Rotary Club, the District of Muskoka and the Town of Bracebridge to coordinate and offer a summer youth work or volunteer placement exchange program. • Coordinating annual Skype meeting with the Friendship Committees and quarterly meetings with staff. • Creating opportunities that link the communities through communication tools such as joint media releases on important dates, projects and cultural events. • The two Visitor Information Centers would like to explore innovative ways to connect public with each community. • Sharing water quality monitoring and modeling approaches and related land use planning policies.

59 Future Initiatives (continued) • Sharing approaches to tourist commercial and resort development in the context of environmental protection and character preservation. • Sharing master plans and designs for recreation facilities, parks and trails.

2. That the Director of Public Works be granted delegated authority to approve Final Acceptance of the municipal road and services in accordance with the Subdivision Agreement with Loon Call (Muskoka) Inc.

3. This memorandum has been prepared to share information resulting from the delegations trip to Gol kommune, Norway from May 13, 2019 to May 21, 2019 and to share future potential initiatives that could be undertaken in partnership with the two Friendship Committees and their potential partner organizations.

Background Information

A formal Friendship Agreement between the Town of Bracebridge and Gol kommune was initially executed in 2010 and then subsequently reconfirmed in 2017 and is attached hereto as Appendix “A”. The agreement commits the two communities to fostering a sustained friendship and positive relationship by engaging the people of Bracebridge and Gol in projects, activities and exchanges and programs.

In 2013, a group of nine youth travelled from Gol to Bracebridge for a ten day visit. The youth delegation stayed with Bracebridge families and participated in a number of events and activities so they could learn about our history and the wonderful community in which we live, work and play.

In 2015, the Town of Bracebridge sent a delegation of ten (10) youth and two (2) adults leaders to Gol for twelve days(12) days to further develop the relationship between the two communities and to gain knowledge and insight into the culture and history of Gol.

In 2017, the Town of Bracebridge hosted five (5) Gol kommune delegates. The activities and meetings surrounding their visit focused on an exchange of information related to business attraction and retention, culture and recreation programming and service delivery and local and regional tourism development and to celebrate the 150th anniversary of Canada.

On February 11, 2019 the Mayor of Gol kommune, in a letter to Mayor G. Smith, formally invited the Mayor and a delegation from Bracebridge to Gol in May, 2019 to strengthen the bond and to work on the exchange of knowledge and insight that was started in 2017.

A delegation of six (6) representatives, recommended by the Gol Friendship Committee and approved by Town of Bracebridge Council, visited Gol kommune from May 13, 2019 to May 21, 2019.

Details and Purpose of the Delegation

The delegation was comprised of: Councillor Steve Clement; CAO, John Sisson; Director of Recreation, Cindy O’Regan; retired educator, Robin Hiltz; District of Muskoka Commissioner of Community and Planning Services, Samantha Hastings; and Executive Director of Bracebridge Chamber of Commerce and President-Elect of the Rotary Club of Bracebridge, Brenda Rhodes. Travelling independently with the delegation was local craft artist, Henrike Clement.

The agenda for the delegation was created based on topics of interest for both the Town of Bracebridge and the Gol kommune Friendships Committees and included:

• Development of Tourism and Sport-Tourism events, activities, and programmes in Norway and Muskoka (including festivals, publications, services);

• Development of Recreation Facilities (including tours of Gol’s new Pump Track Tour and other Recreation Facilities;

• Formulation of Education Programmes and Identification of Instructional Best Practices (including School/Municipal partnership in Norway);

• Examination of Local and Regional Governance and Land-Use Planning best practices;

• Development of connections between Gol Rotary Club and Bracebridge Rotary Club (including connection-initiatives, exchanges, fundraising, governance, etc.);

• Development of connections between Gol businesses and representative organizations with Bracebridge Chamber of Commerce, the Downtown Bracebridge BIA and local businesses (including business supports, programs, services, external/public communications, etc.);

• Exchange of information of economic development initiatives in Gol and Bracebridge;

• Exchange of information on local environmental protection, water quality maintenance, climate change adaptation and mitigation, etc.; and

• Visits to Golsfjellet, Vesle Skaugum and other locations of interest in Gol and throughout the Hallingdal region.

Key Findings

1. Culture:

Gol sponsors and supports a wide array of cultural programs, services and activities:

a. Residents of Norway are proud of their heritage and continue with traditions which celebrate their heritage.

b. On National Day all Norwegians wear their traditional clothing, some which are handed down from generation to generation. There are 3 parades throughout the day and two of these are focused on the youth. Grades 1 to 12 march through the streets, dressed in traditional costume during the morning and this is followed by a celebration in the school square where traditional games are played and traditional cake is eaten. The second youth parade is a celebration for those youth graduating from High School. They move through the streets, in decorated vans, playing loud music and being silly.

c. Sheep skin ink art. Youth and adults alike participate in creating sheep skin ink art which they hang in their home or use as seat cushions or duvets. Each piece of art is created by stamping the hides of sheep with ink with the common themes of sun, love, water and animals. Volunteers coordinate and teach classes in the repurposed Town Hall which is now an Arts and Crafts Centre.

d. Historical treasures, such as the Skaga Farm which was built in early 1800’s, have been gifted to the Town and are well maintained and celebrated through tours offered by local volunteers.

e. Vesle Skaugum, Golsfjellet is best known as "Little Norway" and is now a holiday resort for veterans, servants and former employees of the Air Force with family and friends. Its history dates back to the Second World War when the Norwegian Air Force established a training center for aircraft and ground crews in Toronto and Muskoka. After the war, Vesle Skaugum in Muskoka was sold. The sale made it possible to finance a new Vesle Skaugum in Norway.

2. Education:

Gol provides comprehensive educational programmes, services and facilities:

a. Outdoor education is a key component of the curriculum in Norway’s schools. Students are provided with opportunities to participate in outdoor activities year-round.

b. They have a saying in Norway “there are no bad days, only bad clothing”.

c. For recess, the students assist with coordinating a variety of outdoor games and activities which meet the needs of all students as inclusion is the key to the success.

d. Cooperative learning and student leadership is a key focus of instruction.

e. Children begin learning English in grade one.

f. Technology plays a key role in instruction. The schools are equipped with modern industrial arts, visual arts, culinary arts and computer labs to name a few.

g. The Gol School, grades 1 to 10, has 540 students and 87 staff members and is centrally located in the Town.

h. There is strong connection between the school and the community.

3. Tourism:

Gol offers and supports a wide variety of tourism development initiatives:

a. “Skagahogdi” is a new ski resort that is under construction. In addition to the ski facilities, new accommodation units are also planned. In order to ensure the on-going viability of the commercial resort, the required mix of units is 70% residential and 30% commercial.

b. A recent study projected that the Gol area would need approximately 1200 new “cabins” (seasonal residences) to meet demand over the next 10 years. In order to ensure that these cabins remain recreational and seasonal in nature, a number or use restrictions are in place, including size and height restrictions, and requirements for an alternate primary address. No services such as school buses are provided. The Town is also facilitating meetings with cabin organizations in the area to determine how they can better work together to address local priorities.

c. The natural beauty of Gol combined with the extensive regional trail system for hiking, cross country skiing, and backcountry skiing makes Gol a prime tourist destination.

d. Camping in Gol is very popular and they have a number of campgrounds where people park their trailers for the season.

e. The population of Gol is 4,600 and with this influx of seasonal population the population increases to 14,000 to 16,000.

f. As Gol is the cross road for their region of Hallingdal, Gol is working with regional representatives on projects such as cross promotion, expansion of regional trails systems, and the development of regional mountain bike trails.

g. The Visitor Information Centre/Tourism is ran by a Board made up of businesses, stakeholders and a council member and is a membership driven organization much like the Chamber in Bracebridge. They struggle to get larger businesses to participate and are working to improve relations with these businesses by showing them the value of partnerships. The Municipality gives money and businesses match the money for initiatives. Currently they offer a Sheep festival, Ski festival for women only and Gol Days - July Festival and are looking for ways to expand festivals and celebrations.

4. Recreation:

Gol is provides a large number of recreation programmes, services and facilities:

a. Hiking, cross country skiing, mountain biking, and walking are well supported throughout the urban and rural areas. Trails are plenty, well-marked and many link neighbouring Towns and Villages.

b. Sports facilities include: a pump track; skateboard park (in development); an outdoor artificial turf soccer/track complex; and a Sports Complex which includes a multi-use hard surface field house, gymnastic centre, climbing wall, meeting rooms, concession, fitness studio, weight room, and spaces leased to health care specialist including a physiotherapist and personal trainer.

c. The facilities are all centrally located in Town and are close to the schools. The schools use these spaces during the day for their activities and the students walk to the facilities from their respective schools.

d. The Sports Complex and Soccer/Track facility is owned by the Town and operated by the Gol Sports Guild. The Town contributes $850,000 to the operating costs and the Gol Sports Guild contributes $150,000 (rental income). The Sports Guild has 1700 members comprised of a variety of sporting groups.

e. The Youth Centre (Klubb 1), owned and operated by the Town, is also centrally located and is open two evenings a week. It has a kitchen, dance area, DJ system, stage with musical instruments, fooseball, table tennis, video gaming area and hang out area.

f. The youth organize the activities, with the assistance of two (2) adult leaders/supervisors.

g. Obesity rates in Gol are very low as the majority of residents of Gol are active year round and the schools promote and make physical activity a priority.

5. Environment:

Gol is involved in a number of environmental initiatives:

a. Floodplain maps are being developed which will map various frequencies of future storms, up to the 200 year and even 1000 year storms, based on modeling techniques.

b. Climate change research and planning is focused on what the community can do, rather than on what others must do. Central to their planning is the promotion of densification in the town. Similar to Ontario, staff acknowledged that people want to live in the rural areas; however, services are more effectively provided within the town. An effort is being made to make the lifestyle in town as attractive as possible to encourage more density in the existing settled area.

c. Fragmentation of habitat is also an issue in the Gol area. However, the perspective on this concern is somewhat different than in Muskoka. In Norway, concern exists that forests will overtake meadows and efforts are being made to protect grassland and meadow areas for the unique ecosystems and habitat they provide.

d. The Town is also focusing on purposeful bicycling within the town, and are trying to facilitate outdoor spaces and places for people to meet. A concept plan for the downtown includes “hot spots”, “connections” and “natural areas”.

6. Service Clubs:

Gol is supported by a small, however, strong Rotary Club of which many members have a personal connection:

a. The Club is focused on individual’s business designations.

b. Recent projects include the development of a sensory garden at the senior’s lodge which is home to dementia patients. The sensory garden includes: walking paths, sensory gardens, vegetable gardens, a chicken coop, secure fencing, an outdoor covered area with table and they have plans to expand the stone area for more accessible seating.

7. Public Engagement

Gol community engagement and stakeholder consultation initiatives:

a. Gol has a unique approach to public consultation. They acknowledged that very few people attend town hosted stakeholder / public meetings. As a result, they are focusing on consultations through social media, outreach to schools, seniors groups and other organizations in order to ensure that the public is heard.

b. Gol has a Youth Council and the Mayor of Gol attends their meetings and brings issues and areas of interest to Council. The Youth Council are chosen by their peers at school. The youth advocate for youth projects such as the pump track, potential new skate park.

Future Initiatives

Building on the information, ideas, and successes realized from past Gol kommune and Town of Bracebridge Friendship delegations in 2013, 2015, 2017 and then from this year’s delegation it evident that the bond between Bracebridge and Gol continues to grow.

There is the desire to keep the Friendship Agreement flourishing as both communities have much to benefit culturally and in areas including education, tourism, recreation, housing, environmental, service clubs, and other areas of shared interest.

Future initiatives for consideration by the Town of Bracebridge and Gol kommune Friendship Committee, the Town of Bracebridge, District Municipality of Muskoka, Bracebridge Chamber of Commerce, and the Rotary Club of Bracebridge include:

1. Supporting the national heritage of Canada and Norway by keeping the historical connection of Little Norway and Vesle Skaugum relevant to our communities by enhancing the promotion of the Little Norway Memorial and ensuring the heritage pieces are preserved.

2. Working with local public and catholic schools on creating a grade 2 curriculum unit that connects to the Ontario curriculum that focuses on different cultures and which would provide opportunities for Gol and Bracebridge children to simultaneously connect and learn about each other’s history and culture. Technology in the classrooms would facilitate connections between schools.

3. Working with local public and catholic schools and the recreation department in the development of pen pals, email pals and or skype-pals program that:

o provides an opportunity for Gol children to practice their English speaking skills;

o generates friendships between the countries; and

o provides a venue for youth and children to share experiences and compare cultural similarities and differences.

4. Working with the Bracebridge Rotary Club, the District of Muskoka and the Town of Bracebridge to coordinate and offer a summer youth work or volunteer placement exchange program.

5. Coordinating annual Skype meeting with the Friendship Committees and quarterly meetings with staff.

6. Creating opportunities that link the communities through communication tools such as joint media releases on important dates, projects and cultural events.

7. The two Visitor Information Centers would like to explore innovative ways to connect public with each community.

8. Sharing water quality monitoring and modeling approaches and related land use planning policies.

9. Sharing approaches to tourist commercial and resort development in the context of environmental protection and character preservation.

10. Sharing master plans and designs for recreation facilities, parks and trails.

Next Steps

1. The Town of Bracebridge and Gol kommune, Norway Friendship Committee, in conjunction with members of the 2019 delegation, develop action plans to address key initiatives identified above. Action plans will include:

a. Information on the key initiatives

b. Timeline for implementation

c. Required partnerships

d. Required authority

e. Required technology

f. Required budget and resources

(Section A) WHEREAS, the provision of a full range of core hospital services, including acute care inpatient, emergency, diagnostic and surgical services, at both the South Muskoka Memorial Hospital in Bracebridge and the Huntsville District Memorial Hospital by Muskoka Algonquin Healthcare (MAHC) is vital for all of the communities in the Muskoka region and the East Parry Sound area;

AND WHEREAS, the continued delivery of those core hospital services at both the South Muskoka Memorial Hospital in Bracebridge and the Huntsville District Memorial Hospital is crucial to the long-term sustainability and economic vitality of the communities in the Muskoka region and the East Parry Sound area;

AND WHEREAS, the residents of the Muskoka region and the East Parry Sound area have strongly supported multi-site delivery of a full range of core hospital services, including acute care inpatient, emergency, diagnostic and surgical services, at both the South Muskoka Memorial Hospital in Bracebridge and the Huntsville District Memorial Hospital;

AND WHEREAS, following extensive community consultation and careful study, engagement and evaluation of potential models for the hospital services in the future, the Board of Directors of Muskoka Algonquin Healthcare endorsed the recommendations of MAHC’s Capital Plan Development Task Force for a Two Acute Site model for hospital services;

AND WHEREAS, MAHC is continuing the development of a Stage One Submission to the Health Investment Capital Branch of the Ministry of Health and Long-Term Care for approval for MAHC to continue on to the next stages in the lengthy capital planning process;

AND WHEREAS, the Ministry of Health and Long-Term Care for the Province of Ontario requires a community contribution, or local share, toward the capital costs of hospital expansion or new hospital construction;

NOW THEREFORE THE CORPORATION OF THE TOWN OF BRACEBRIDGE RESOLVES AS FOLLOWS:

1. That the Province of Ontario, through the Ministry of Health and Long-Term Care, be requested to support the continued delivery of emergency health care services and inpatient care at the two acute care sites in Bracebridge (South Muskoka Memorial Hospital - SMMH) and in Huntsville (Huntsville District Memorial Hospital - HDMH).

2. That the Province of Ontario, through the Ministry of Health and Long-Term Care, ensure that the changes to Ontario’s health care delivery system currently being implemented do not negatively impact access to services and the quality of care in Bracebridge, Huntsville, the rest of the Muskoka region and the East Parry Sound area.

3. That the Province of Ontario, through the Ministry of Health and Long-Term Care, ensure that the changes to Ontario’s health care delivery system currently being implemented recognize the unique and important role that smaller hospitals, such as the South Muskoka Memorial Hospital and the Huntsville District Memorial Hospital have in promoting economic development and creating sustainable communities in Ontario.

4. That, consistent with recommendations from the Association of Municipalities of Ontario (AMO), the Province of Ontario, through the Ministry of Health and Long- Term Care, be encouraged to:

4.1. Reform the funding formula to ensure that funding provided to hospitals recognizes the diverse models for hospital operations including small, rural, and multi-site hospitals;

4.2. Tie provincial hospital operational funding at least to hospital inflation annually;

4.3. Provide adequate capital and operational funding to hospitals to support the services that residents need in their communities;

4.4. Remove, or at very least cap, the community contribution, or local share, expected of local municipalities toward the capital costs of hospital expansion or new hospital construction;

4.5. Ensure that the capital planning process for hospitals leverages the significant municipal investments in existing or planned local infrastructure;

4.6. Respect the importance of municipal plans and policies; and

4.7. Recognize key factors such as land use planning, community economic impacts, the ability to raise funds, operational and cost impacts of long- term plans for hospitals, and the direct impact on local health care providers when approving hospital capital plans.

5. That the South Muskoka Hospital Foundation and the Huntsville Hospital Foundation be requested to identify specific targets for fundraising that can be used collectively to support hospital expansion or new hospital construction in Bracebridge and Huntsville and that the funds raised by the local hospital foundations be recognized as a portion of the community contribution, or local share, expected of local municipalities toward the capital costs of hospital expansion or new hospital construction.

6. That, after exhaustion of other funding sources, the provision of a community contribution, or local share, by the Town of Bracebridge toward the capital costs of hospital expansion or new hospital construction be endorsed.

7. That Muskoka Algonquin Healthcare’s “Local Share Working Group” continue deliberations to identify a specific target for the financial or in-kind contribution by The Corporation of the Town of Bracebridge to support the capital costs of hospital expansion or new hospital construction.

8. That the municipalities in the Muskoka region and the East Parry Sound area initiate appropriate internal financial planning to identify appropriate methods to fund the financial or in-kind contributions required to support the capital costs of hospital expansion or new hospital construction to serve the MAHC catchment area. AND WHEREAS the Town has experienced incremental operating and capital costs as a result of the flood emergency;

19-PD-084 Committee Chair, S. Clement called the meeting to order at 7:00 p.m. and advised that the District Planning and Economic Development Committee and Town Planning and (Section A) Development Committee are holding concurrent public meetings for a plan of subdivision, condominium and a zoning by-law amendment on lands proposed for development by Subdivision File No. S2011-5, Condominium File No. C2011-6 and Rezoning Application No. D14-10/19 – 6891535 Canada Inc. (Stonegate).

The Committee Chair advised that District Councillor N. Alcock will be acting as the Chair of the District’s Planning and Economic Development Committee, and introduced District Councillor A. Edwards, District Planning and Economic Development Committee and District staff members L. Marden, Manager of Planning and K. Fior, Planner.

District Planner, K. Fior, confirmed notice was issued in accordance with the Planning Act and presented a brief overview of the proposed subdivision and condominium and Town Planner, J. Rand presented the statement of purpose and effect of the proposed rezoning amendment and advised how the proposed by-law will accomplish the purpose required.

Statement of Purpose and Effect of the Proposed Subdivision, Condominium and Zoning By-law

1. The applications are required in order to facilitate development of a fifty-three (53) lot subdivision, accessed by a condominium road, with each lot to contain one townhouse dwelling (Row Dwelling) unit.

2. The use and number of Row Dwelling units are permitted under the current Residential Type 4 (R4) zone, however the zoning amendment is needed as a result of how the applicant proposes the development to be configured. The proposed configuration requires special provisions related to lot area, lot frontage, and setbacks for some of the lots.

3. The subject property is currently zoned Residential Type 4 (R4) according to Comprehensive Zoning By-law 2016-088. The Residential Type 4 (R4) zone permits the following uses: Semi-Detached Dwellings and Duplex Dwellings in the form of Group Housing, Row Dwellings, Triplex Dwellings, Fourplex Dwellings, Apartment Dwellings, Group Housing and Home Occupation.

4. The proposal would amend Comprehensive Zoning By-law 2016-088 by rezoning the subject lands to”

4.1. Residential Type 4 Special – 35 (R4-35), in part as shown in red on Schedule “A” to the proposed by-law;

4.2. Residential Type 4 Special – 36 (R4-36), in part as shown in yellow on Schedule “A” to the proposed by-law; and

4.3. Environmental Protection One (EP1), in part as shown in green on Schedule “A” to the proposed by-law.

5. With respect to the proposed zoning provisions in the new zone, staff would note the following:

6. The Residential Type 4 Special – 35 (R4-35) zone proposes to permit all uses currently permitted in the Residential Type 4 (R4) zone with the following requested provisions:

6.1. The minimum lot area for a Row Dwelling shall be 205 square metres for Lots 6, 7, 23, to 25 and 46 to 48 as identified on Schedule “A” to the proposed by-law;

6.2. The minimum lot frontage for an end unit Row Dwelling shall be 7.0 metres;

6.3. The minimum front yard setback shall be 6.0 metres for a Row Dwelling for Lots 11, 38, 41 and 42 as identified on Schedule “A” to the proposed by-law;

6.4. The minimum setback from the centreline of a condominium roadway for a Row Dwelling shall be 12.0 metres;

6.5. The minimum exterior side yard setback for a Row Dwelling shall be 1.0 metres;

6.6. The minimum interior side yard setback for a Row Dwelling shall be 2.5 metres;

6.7. The minimum rear yard setback for a Row Dwelling shall be 7.5 metres for Lot 7 as identified on Schedule “A” to the proposed by-law;

6.8. The minimum rear yard setback for a Row Dwelling shall be 2.5 metres for Lot 8 as identified on Schedule “A” to the proposed by-law;

6.9. The minimum rear yard setback for a Row Dwelling shall be 9.0 metres for Lots 48 and 49 as identified on Schedule “A” to the proposed by-law; and

6.10. For the purposes of defining lot frontage for Lots 11 and 42 as shown on Schedule “A” to the proposed by-law, these lots shall be considered to be corner lots.

7. All other provisions of the Residential Type 4 (R4) zone would continue to apply with respect to the lands located within the Residential Type 4 Special – 35 (R4-35) zone.

8. The Residential Type 4 Special – 36 (R4-36) zone proposes to limit uses in this zone to landscaping, patios and other accessory uses that would not impede access to the slope area for the purpose of maintenance. All other applicable provisions of the Residential Type 4 (R4) zone would continue to apply with respect to the lands located within the Residential Type 4 Special – 36 (R4-36) zone.

9. The purpose of the Residential Type 4 Special – 36 (R4-36) zone is to prohibit structural development in this portion of the lands as per the recommendations of the Slope Stability Report by Terraprobe Inc. The Slope Stability Report recommends that a 6.0 metre setback be applied to prohibit structural development in this area in order to allow for future access for maintenance of the slope in the future, if required.

10. The Environmental Protection One (EP1) zone would prohibit structural development within the areas identified below the top of slope on the subject lands.

11. Site Plan Control By-law 2013-042 requires site plan approval prior to development of the property. The site plan will need to address a number of items including:

11.5. Fencing, if required.

A number of technical studies were submitted in support of the development proposal. The submitted supporting studies are in the process of being peer reviewed in order to have the methodologies and conclusions of the reports confirmed by a third party expert.

District staff would recommend that a decision on the above noted zoning by-law amendment be deferred until the peer review process associated with the supporting technical studies have been finalized, comments received from agencies and members of the public have been reviewed and considered, and Council is satisfied that the recommendations of all technical studies and plans will be implemented through the appropriate development control techniques. 12.6. Lakeland Power No concerns with the applications.

Comments from the Owner/Agent

16. Andrew Pascuzzo of Pascuzzo Planning Inc, representing the applicants, addressed the Committee. Mr. Pascuzzo advised the following persons were also in attendance on behalf of the applicants:

Architect: Richard Mateljan – SMDA Designs Ltd.; Engineer: Clayton Capes – Capes Engineering; and Ecologist: Dave Cunningham – Hensel Design Group Inc.

17. Mr. Pascuzzo advised that the zoning by-law amendment application is to rezone from an R4 zone to an R4 special zone and Environmental Protection zone. Additionally, the application is also for a draft plan of subdivision for 53 townhomes and a draft plan of condominium application for a 12 metre wide private road. Mr. Pascuzzo’s presentation is attached as Appendix “A” hereto, dated July 17, 2019.

18. Rick Mateljan of SMDA Designs addressed the Committee and detailed the architecture style of the buildings and the terms of the density for the development by the uniqueness of the buildings. He indicated the client wanted a contemporary softness to the development while creating a community feel. Mr. Mateljan advised of the advantages with this development while looking at the road systems, the townhouses break up into development units, the corridor through the site breaks downs the massing, respecting the setbacks and protection of the creek will create an interesting built form.

19. Mr. Mateljan advised that one of the 7 blocks was in the rendering by Mr. Pascuzzo’s presentation and as was proposed, there was extensive use of glass as part of the contemporary style.

20. Clayton Capes of Capes Engineering addressed the Committee and advised that he had been involved with this proposal since 2010 and there have been some challenges from an engineering review while looking at this from a holistic approach. He noted there was full municipal servicing on Covered Bridge Trail for this development however a challenge with regard to storm water management, Beaver Creek and the steep slopes while ensuring no storm water runoff affects the banks while mimicking the water balance on the site. He noted that this is a low impact development for this site.

21. Mr. Pascuzzo indicated from some of the concerns noted by neighbours, the buildings will not exceed the height or density requirements, a traffic study has been peer reviewed and there are two parking spaces per unit and they will be working through additional parking.

22. Dave Cunningham, Ecologist from Hensel Design addressed the Committee. He noted that 36% of the site will retain the tree habitat, as well as the forest at the top of the bank will be zoned an environment zone and a tree inventory plan will be a condition of the draft plan of subdivision. Mr. Cunningham noted there is no landscape plan at the moment.

23. Mr. Pascuzzo advised the snow will be removed from the site as there is not a lot of capacity on site for storage, the development will occur in phases with each block at a time likely over the next few years. The market for the units will be mid to higher range and not necessarily geared towards seniors due to the number of stairs.

Comments from the Public

24. Michael Kidd of 65 Covered Bridge Trail addressed the Committee and indicated that he is confused why the peer reviews have been left out and he cannot access them. He also indicated his concern with the notification timelines and the response time provided.

25. Mr. Kidd reviewed his letter in detail with Committee which is located under the Agenda for the Planning and Development Committee dated July 17, 2019.

26. Mr. Kidd further indicated that the proposed 3 storey structures with glass and awnings for cars should be facing each other not the neighbourhood back yards. He noted the patios at the top are unrealistic due to the windy conditions in the area. Mr. Kidd also stated the cost for each unit is proposed at between $600,000 and $900,000 which is very unrealistic for this subdivision as the current single family homes are geared for families and seniors.

27. L. Marden, Manager of Planning for the District, advised that the technical studies have been peer reviewed and are available at the District and Town offices. The peer reviews go back to the applicant for further review. She also noted the Notice of Public Hearing date for response is specifically for agencies only. There is no deadline for the public to comment up to the Public Hearing.

28. Shirley Gordon of 56 Covered Bridge Trail addressed the Committee with a concern about the density for this site which was originally 15 to 22 homes to 42 homes in 2011 and now 55. Ms. Gordon noted that where the parkland is indicated is a hill, concern with the increased traffic, emergency services to the site and impacts to fish habitat.

29. Ms. Gordon has a concern with the developer and what their past successes are and are they dependable. She noted Covered Bridge Trail is not completed, that there is no egress proposed with this new development and that the Town does not need another unfinished development. She has a concern with the traffic and who will be responsible for the road into the development.

30. Chris Gibbs of 80 Covered Bridge Trail stated that all the residents live in single family dwellings that are well established and well maintained. There is a lot of wildlife. He noted that the rest of the subdivision should be finished first. He also notes he does not want a reflection of his house into this development and wants to know why this part of Beaver Creek is not protected.

31. Luigi Battista of 60 Covered Bridge Trail has a concern about the laneway going into the development and the potential of 106 cars a day as well as trucks coming in and out. He wants to know how this development can be considered with just a road that is classified as a laneway.

32. Mr. Battista noted that the by-laws are in place for a reason and the Town just did a new comprehensive zoning by-law.

33. Margaret Lancelotte of 44 Covered Bridge Trail questioned when the R4 zoning was put in place and staff advised that the multiple R4 zoning has been in place since 1989. Ms. Lancelotte noted a concern that after all of these years the number of units proposed has not even come close to what has existed in the subdivision.

34. Dave Powley of 53 Covered Bridge Trail questioned whether it is legal to have one exit to Covered Bridge and noted that there are no guarantees if the roadway is blocked. He stated that before this type of development is approved a second roadway into the subdivision should be established. Mr. Powley also noted the speed on the road needs to be dealt with.

35. Kim Schroeder of 49 Covered Bridge Trail advised that Covered Bridge Trail is a community already and this development doesn’t want seniors or families based on the design.

36. Andrew Rajtek of 112 Covered Bridge Trail indicated his concern about what happens to the walking trail, how snow is going to be cleared off the roofed patios and the lack of garages.

Comments from the Committee

37. Committee questioned the timing of this process based on the number of reports and peer reviews. It was asked when would Committee expect a report back.

38. Staff from the District indicated there are a number of peer reviews for the geotechnical report, environmental report, peer review and traffic report. Staff advised that the applicant responds to these which could be a number of weeks so the timing is dependent on the applicant.

39. Committee noted that due to the complexity and number of reviews required, it may be some time before this matter comes back. Committee stated that the public should have sufficient time to look at these documents as they are finalized.

40. Committee questioned if staff would be compiling a report with all of the concerns and answers to those concerns when this matter comes back. Staff advised that there will be a review of all of the comments and the District will do the same.

41. Committee questioned the zoning of this property and notification requirements. Staff advised that at the 2016 Comprehensive Zoning By-law review notification was put in the paper and it was for all properties within the Town.

42. Committee questioned the rear yard setback of 2.5 metres, the surfacing of the driveway and how this will affect the storm water management and the snow removal. Committee also questioned if there are securities in place from the original subdivision to create a second road through to South Monck Drive. Staff advised a report would come back to Committee and Public Works comments would be included.

43. Committee questioned the density required and staff advised medium density is 40 units per hectare and high density is 60 units per hectare.

44. Committee questioned the number of units on the land and the question of 20 dwelling units proposed. Staff advised they are not aware of a formally approved 20 unit development and 42 semi-detached were last proposed in 2011.

45. Staff advised that the traffic study indicates one access point and there are legal concerns with one single entrance which is based on the number of units. District staff advised that this has been flagged by their Engineering Department and the second entrance may be required once the Covered Bridge Subdivision is finished.

46. Committee noted their concern that without professional experience on each of the reports it is difficult to rely on what all of the reports reflect. They noted a concern about the deterioration of the water system and the trail system.

47. Committee questioned how the snow is to be removed and whether this road is declared as a private or public road. Staff advised that these requirements will be written into the Condo Agreement as well as the Site Plan Agreement. The condo road would be a private road not maintained by the Municipality.

48. District Committee indicated that it should be verified how many houses in the subdivision are using the road as 28 cars seems very low. They noted a traffic counter should be set to see how many cars move through the subdivision. They also noted that the condo fees will be high if the snow will have to be moved off site.

49. Town Staff advised that there is approximately 100 to 150 homes in the subdivision.

50. Committee questioned the fire response and access and this should be answered by comment from the Fire Chief at the next meeting.

51. Committee questioned why the rear yard setbacks are smaller. Staff advised this was requested by the applicant and staff would be reviewing further.

52. Committee noted a concern with lack of parkland and could the developer opt out of parkland. Staff advised that the Town takes parkland or cash in lieu of parkland as decided by the Town. Staff would review how much parkland was taken when the original subdivision was established before making a recommendation.

53. District Committee noted that the parking is 2 spaces per unit and can include parking garages as indicated. There is a concern that the proposal is showing canopies and no visitor parking. Staff advised they will review.

54. Committee questioned other opportunities for public input. Staff advised that written comments can be received until a decision is made and there is also a possibility a 2nd public meeting can be held on the authorization of the Committee.

55. District Planning and Economic Development Chair N. Alcock thanked everyone for their comments and advised that the District Planning and Development Committee and Town Planning and Development Committee will be considering all comments prior to making a decision on the proposed applications.

The Residential Type 2 Special – 10 (R2-10) would permit all uses in the Residential Type 2 (R2) zone with a limit of one Second Dwelling Unit in a Duplex Dwelling as well as recognize the existing setback to the centerline of a road. All other provisions in the Residential Type 2 (R2) zone would apply to the lands zoned Residential Type 2 Special – 10 (R2-10).

3. Permitted uses in the Residential Type 2 (R2) zone include Detached Dwelling, Demi- Detached Dwelling, Duplex Dwelling, Home Occupation, Bed and Breakfast and Second Dwelling Unit.

4. A Duplex Dwelling is defined in the Zoning By-law as the whole of a building that is divided horizontally into two separate dwelling units each of which has an independent entrance either directly from the outside or through a common vestibule.

5. The Second Dwelling Unit is proposed to be constructed at the rear of the bottom floor.

6. The Town’s Comprehensive Zoning By-law states a Duplex Dwelling Unit requires 2 parking spaces. The Planning Act states that a municipality cannot require more than 2 parking spaces total for any dwelling unit (including a Duplex Dwelling Unit) combined with a Second Dwelling Unit. Therefore a total of 4 parking spaces would be required on the site for the two Duplex Dwelling Units and the one Second Dwelling Unit.

7. The applicant has indicated that there is sufficient space for more than the 4 parking spaces which are required. The property is not subject to site plan control.

10. Stefan Szczerbak of Planscape addressed the Committee as an agent for the applicants. He noted as set out in the presentation, one additional dwelling unit is proposed and the applicants have proposed more parking then the required 4 spots. He also noted that they took into consideration the character of the area.

11. Mr. Szczerbak advised that they have been fully compliant with building permits and the application conforms to the direction of the Official Plan.

Comments from the Public

12. Peter Elliott of 63 Church Street stated the special designation confuses him as the builders were building a triplex. He noted that there was no building permit noted on the property and the builders should have followed the process. Mr. Elliott noted there are rules in place for a reason. He feels that the duplex plus one more unit makes a triplex and not the definition provided in the staff report.

13. Mr. Elliott also noted that the 4 parking spaces for 3 units does not make sense. There should be at a minimum, 5 spaces. He is concerned with the parking, getting in and out of the property and the narrow street. Mr. Elliott stated that snow removal is difficult on the street and there is no on street parking.

14. Mr. Elliott stated that there is no yard and only a 6 foot strip of land for the use of 3 apartments. He is concerned because the builders knew what they were building. Mr. Elliott contacted the Building Branch and then the Planning Department about the zoning required to change the number of units in an R1 zone.

15. Catherine Lamb of 24 Church Street provided a letter from Doug and Trina MacLean of 46 Church Street and noted she feels the cart is being put before the horse. She noted there was no permits posted and this previously was a dwelling occupied by the owner with a 2nd dwelling unit. She is concerned the applicants did not follow the rules and noted no proper turnaround for snow removal. Ms. Lamb indicated an issue with parking and the fact there is no outdoor space. She feels this type of development can attract problems for the street.

Comments from the Committee

16. Committee questioned when a duplex becomes a triplex. Staff advised that a triplex is defined as 3 units side by side which is not what is proposed on the property. The proposal is 2 units which is 2 units stacked with an additional unit to the rear of the ground floor unit. Staff advised that the second dwelling unit is only permitted if all provisions are met and one exemption being requested is the centerline of the road.

17. Committee questioned how parking is allocated. Staff advised that the requirement is 2 parking spots for the duplex dwelling and 1.5 parking spaces for the second dwelling unit for 4 spaces total. The applicant has indicated they can provide 5 parking spaces.

18. Committee indicated a concern about the conflicting stories. The property should have been rezoned before it was renovated as the zoning approvals have to be in place and a building permit issued for the second dwelling unit.

19. Committee questioned the yard space and staff advised that previously there was a requirement for 250 square feet for each unit, however, the Planning Act states this can no longer be required for a second dwelling unit.

20. Committee noted that it would seem a three unit, 2-bedroom apartment for each, is a triplex, not a duplex with a second dwelling unit. Staff advised that a second dwelling unit can take a variety of different sizes and a triplex is defined as 3 units horizontally side by side and of similar size.

21. Committee questioned if the Building Branch had a problem and if inspections occurred and was everything up to Code. It was noted a building inspector had conducted inspections for renovations.

22. Staff further advised that Mr. Orchard enquired in November and March of the Town when looking to purchase a 3 unit building. Under permit for renovations there was a walk through at one point and it was noted that at one time the building was 3 dwelling units and now used as 2 dwelling units. Under renovations, the walls were opened up and the entire inside was gutted and started from scratch as the owner was proposing 3 units with fire separations. Staff advised if the applicant is approved for a duplex with a second dwelling unit a change of use permit will be required.

23. Staff advised it would be best to have a better definition in order for a clearer understanding of how a triplex and a second dwelling unit in a duplex are defined. Some clarity would make things easier and staff will review this issue as part of an upcoming Housekeeping By-law.

24. Committee questioned how a duplex with a second dwelling unit is permitted. Staff advised the Planning Act requires the opportunity for a duplex and semi-detached to have a second dwelling unit under law.

25. Committee questioned how 2 dwelling units with 4 parking spaces does not require any further parking for a second dwelling unit. Committee questioned how cars move in and out of the property freely. Staff advised that with the 5 parking spaces provided there can be tandem parking in this development, however, 4 parking spaces can park independently and a 5th space has been slotted in alongside. Parking is required to be 3 m x 6 m in size and it is proposed to be a gravel area.

26. Committee asked how this proposal is compatible with others in the neighbourhood and who determines that. Staff advised that they look at use and built form in the area. Additionally, there are no fundamental changes outside of the building other than the parking layout.

27. Committee questioned if approved just as a duplex, what could occur. Staff advised that an R2 zoning supports a duplex to have a second dwelling unit as well and legislation supports this. The Town could be challenged if was not approved. Additionally, each duplex could have a second dwelling unit which would be 4 units in total.

28. Committee questioned if a site plan is required to show snow storage area and staff advised site plan is not required.

29. Committee questioned what the special on the zoning is and staff advised it limits the number of units as well as recognizes the reduced setback to the centerline of the road.

30. Mr. Szczerbak indicated on a plan where the snow storage is proposed on the site

31. Committee questioned what the size of the dwelling unit could be in the dwelling and staff advised that there is no maximum in a dwelling unit.

32. Committee questioned if there is a follow-up with the parking requirements. Staff advised that there is no site plan required and the parking spaces have already been created and the spaces have to be maintained.

33. Staff advised they did not see a spot where the snow is going to go and should require this before a decision is made.

34. Committee questioned why a site plan is not required. Staff advised site plan is not required for the duplex and there are no changes to the exterior of the building.

A BY-LAW OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE FOR THE PURPOSE OF CLOSING THAT PART OF THE OSRA IN FRONT OF LOT 27, CONCESSION 13, FORMER TOWNSHIP OF MACAULAY, NOW IN THE TOWN OF BRACEBRIDGE, IN THE DISTRICT MUNICIPALITY OF MUSKOKA, DESIGNATED AS PART 1 PLAN 35R-25958.

WHEREAS it is expedient to close that part of the original shore road allowance in the Town of Bracebridge described below, and to sell the soil and freehold of it, pursuant to Sections 9 and 35 of the Municipal Act, 2001;

AND WHEREAS pursuant to Section 34(2) of the Municipal Act, 2001, the consent of the Governor General in Council to this by-law is not required as no lands under the jurisdiction of the Government of Canada are affected by this by-law;

AND WHEREAS the notice requirements set out in the relevant municipal by-laws have been complied with;

AND WHEREAS the sale procedures set out in the relevant municipal by-laws have been complied with;

AND WHEREAS by motion 19-GC-091 the Council of The Corporation of the Town of Bracebridge deems it expedient to pass such a by-law;

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE ENACTS AS FOLLOWS:

1. THAT part of the Original Shore Road Allowance in front of Lot 27, Concession 13 former Township of Macaulay, now in the Town of Bracebridge, in the District Municipality of Muskoka, designated as Part 1 Plan 35R-25958 is hereby closed, and the common law rights of passage and access thereto are hereby terminated.

2. THAT the soil and freehold of that part of the said original shore road allowance designated as Part 1 Plan 35R-25958, so closed, shall be sold to the owner of the abutting lands described as PIN 48120-0019;

A BY-LAW OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE TO ACCEPT THE LOWER-TIER MUNICIPAL SERVICES WITHIN THE LOON CALL SUBDIVISION (Phase 1, 2, 3, AND 4) REGISTERED AS PLANS 35M-729, 35M-733, AND 35M-735 AND TO ASSUME LITTLE RYANS WAY WITHIN THIS PLAN OF SUBDIVISION FOR PUBLIC USE

WHEREAS, Section 8 of the Municipal Act, S.O. 2001, (hereinafter referred to as the “Municipal Act”) provides that the powers of a municipality under the Municipal Act or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues;

AND WHEREAS, Section 9 of the Municipal Act provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act or any other Act;

AND WHEREAS, Section 11 of the Municipal Act provides that a lower-tier municipality may pass by-laws respecting matters within the spheres of jurisdiction set out therein including, inter alia, highways;

AND WHEREAS, a Subdivision Agreement was entered into for the development of the land described within Registered Plans 35M-729, 35M-733, and 35M-735, Town of Bracebridge, District Municipality of Muskoka;

AND WHEREAS by motion 18-GC-231 the Council of The Corporation of the Town of Bracebridge deems it expedient to assume the streets within Plans 35M-729, 35M-733, and 35M-735, Town of Bracebridge, District Municipality of Muskoka;

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE ENACTS AS FOLLOWS:

1. That the Corporation of The Town of Bracebridge assume the street described as Little Ryans Way, for public use;

2. That the lower-tier municipal services within Plans 35M-729, 35M-733, and 35M-735, be accepted;

3. That this by-law shall come into force and effect immediately upon passing by Council.

WHEREAS, Section 8 of the Municipal Act, S.O. 2001, (hereinafter referred to as the “Municipal Act”) provides that the powers of a municipality under the Municipal Act or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues;

AND WHEREAS, Section 9 of the Municipal Act provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act or any other Act;

AND WHEREAS, Section 11 of the Municipal Act provides that a lower-tier municipality may pass by-laws respecting matters within the spheres of jurisdiction set out therein including, inter alia, highways;

AND WHEREAS, Section 44(1) of the Municipal Act provides that the municipality that has jurisdiction over a highway or bridge shall keep it in a state of repair that is reasonable in the circumstances, including the character and location of the highway or bridge;

AND WHEREAS Ontario Regulation 239/02 sets out minimum maintenance standards for municipal highways;

AND WHEREAS, Section 55 of the Municipal Act, 2001, imposes responsibility for sidewalks to lower tier municipalities where the roadway is located;

AND WHEREAS by motion 18-GC-231, the Council of The Corporation of the Town of Bracebridge deems it expedient to pass such a by-law;

NOW THEREFORE THE CORPORATION OF THE TOWN OF BRACEBRIDGE ENACTS AS FOLLOWS:

1. That Schedule “A” setting out various classes of highways for minimum maintenance within the municipality be amended and attached to and form part of this by-law.

2. That Schedule “B” as attached hereto forms part of this by-law.

3. That Schedule “C” setting out the winter maintenance schedule for sidewalks within the municipality be attached to and forms part of this by-law.

4. That By-law 2018-003 is hereby repealed in its entirety.

5. That this By-law shall come into force and effect immediately upon passage.

BY-LAW NO. 2019-

A BY-LAW OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE TO REGULATE AND CONTROL TRAFFIC IN THE TOWN OF BRACEBRIDGE (TRAFFIC CONTROL BY- LAW)

WHEREAS Section 8 of the Municipal Act, S.O. 2001, (hereinafter referred to as the “Municipal Act”) provides that the powers of a municipality under the Municipal Act or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues;

AND WHEREAS Section 9 of the Municipal Act provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act or any other Act;

AND WHEREAS Section 11 of the Municipal Act provides that a lower-tier municipality may pass by-laws respecting matters within the spheres of jurisdiction set out therein including, inter alia, traffic on highways;

AND WHEREAS Section 128(2) of the Highway Traffic Act, R.S.O. 1990, provides that the council of a municipality may, for motor vehicles driven on a highway or portion of a highway under its jurisdiction, by by-law prescribe a rate of speed different from the rate set out in subsection (1) that is not greater than 100 kilometres per hour and may prescribe different rates of speed for different times of day;

AND WHEREAS Section 137 of the Highway Traffic Act, R.S.O. 1990, provides that in addition to stop signs required at intersections on through highways the council of a municipality may by by-law provide for the erection of stop signs at intersections on highways under its jurisdiction;

AND WHEREAS The Council of the Corporation of the Town of Bracebridge passed By-law 2018-023 on the 7th day of March, 2018 for the purpose of regulating and controlling traffic;

AND WHEREAS by motion 18-GC-231 the Council of the Corporation of the Town of Bracebridge deems it expedient to enact a new by-law to regulate and control traffic and to repeal By-law 2018-023 in its entirety;

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE ENACTS AS FOLLOWS:

DEFINITIONS

1. In this By-law:

1.1. Highway - includes a common and public highway, street, avenue, parkway, crescent, lane, court, driveway, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof;

1.2. Commercial Motor Vehicle - means any motor vehicle having permanently attached thereto a truck or delivery body and includes ambulances, hearses, fire apparatus, police patrols, motorbuses and tractors used for hauling purposes on highways;

1.3. Heavy Traffic - means a commercial motor vehicle, having a weight when unloaded of ten tonnes or more, or when loaded of fifteen tonnes or more, but does not include a passenger vehicle, an ambulance, a vehicle making a delivery to or a collection from a bona fide destination which cannot be reached via a highway or highways upon which heavy traffic is not prohibited by this By-law, and taking the most direct route to such a destination from a highway or part of a highway upon which heavy traffic is not prohibited by this By-law;

1.4. Official Sign - means a sign in conformity with the Highway Traffic Act regulations or approved by the Ministry of Transportation and Communications or approved by Council;

1.5. Owner - means a person who is registered as the owner of a motor vehicle or a person who is in possession of an Ownership Certificate duly signed by a person so registered;

1.6. Operator - means a person who operates a motor vehicle on a highway.

TRAFFIC CONTROL

2. One-way street:

2.1. The highways set out below in Column 1 between the limits set out in Column 2, are hereby designated for one way traffic only in the direction set out in Column 3.

2.2. Each designation made by Subsection 2.1 shall be upon the erection of official signs.

3. When any highway or portion of highway set out in Schedule “A” (Speed Limits) is marked in compliance with the regulations under the Highway Traffic Act, the maximum rate of speed thereon shall be the rate of speed prescribed in the schedule.

4. When any highway or portion of highway within a public park set out in Schedule “B” (Speed Limits in Public Parks) is marked in compliance with the regulations under the Highway Traffic Act, the maximum rate of speed thereon shall be the rate of speed prescribed in the schedule.

5. Any intersection on a highway set out in Schedule “C” (Intersections for Yield Signs) is designated as an intersection where yield right-of-way signs are erected at the intersection prescribed in the schedule.

6. Any intersection on a highway set out in Schedule “D” (Intersections for Stop Signs) is designated as an intersection where stop signs are erected at the intersection prescribed in the schedule.

7. When any highway or portion of highway set out in Schedule “E” (School Zones) is marked as a school zone, the maximum rate of speed thereon shall be the rate of speed prescribed in the schedule.

8. Heavy Traffic Prohibited:

8.1 When appropriate signs have been erected and are on display, no person shall drive, move or operate “Heavy Traffic” upon or over any of the streets or parts of streets named or described in Schedule “F” of this By-law during the hours prescribed in the schedule.

8.2 The provisions of this subsection shall not extend to the use of the said highways or parts of highways for emergency purposes or deliveries to or removals from any premises abutting thereon.

8.3 That the Town of Bracebridge, Town of Bracebridge contractors, District Municipality of Muskoka, and District Municipality of Muskoka contractors be exempted from this section, when engaged in road maintenance activities.

PENALTIES

9. The penalties provided in the provisions of the Highway Traffic Act shall apply to offences against this by-law.

FORCE AND EFFECT

10. That this By-law shall come into force and effect immediately upon passage.

REPEAL

11. Upon the date of passage of this by-law, By-law 2018-023 is hereby repealed.

SHORT TITLE

12. This By-law may be cited as the “Traffic Control By-law”.

A BY-LAW OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE TO WIDEN OAKLEY CRESCENT AND ESTABLISH SAME AS PART OF THE MUNICIPAL HIGHWAY SYSTEM, BEING THE PROPERTY DESCRIBED AS PART OF LOT 25, CONCESSION 6, BEING PART 5 PLAN 35R-4517, IN THE FORMER TOWNSHIP OF OAKLEY, NOW IN THE TOWN OF BRACEBRIDGE, DISTRICT MUNICIPALITY OF MUSKOKA

WHEREAS, Section 8 of the Municipal Act, S.O. 2001, (hereinafter referred to as the “Municipal Act”) provides that the powers of a municipality under the Municipal Act or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues;

AND WHEREAS, Section 9 of the Municipal Act provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act or any other Act;

AND WHEREAS, Section 11 of the Municipal Act provides that a lower-tier municipality may pass by-laws respecting matters within the spheres of jurisdiction set out therein including, inter alia, highways;

AND WHEREAS by motion 17-GC-285 the Council of The Corporation of the Town of Bracebridge deems it expedient to pass such a by-law.

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE ENACTS AS FOLLOWS:

1. That the Corporation of the Town of Bracebridge widen Oakley Crescent and establish same as part of the municipal highway system, being the property described as Part of Lot 25, Concession 6, being Part 6, Plan 35R-4517, in the former Township of Oakley, now in the Town of Bracebridge, District Municipality of Muskoka.

2. That the said Part 5, Plan 35R-4517 are hereby named Oakley Crescent.

3. That this by-law shall come into force and effect immediately upon final passing thereof.

BY-LAW NO. 2019-

A BY-LAW OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE TO PROHIBIT AND REGULATE THE IDLING OF VEHICLES IN THE TOWN OF BRACEBRIDGE

WHEREAS, Section 8 of the Municipal Act, S.O. 2001, (hereinafter referred to as the “Municipal Act”) provides that the powers of a municipality under the Municipal Act or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues;

AND WHEREAS, Section 9 of the Municipal Act provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act or any other Act;

AND WHEREAS pursuant to Section 11 of the Municipal Act, S.O. 2001 (the Act), a municipality may regulate matters involving the health, safety and well-being of persons;

AND WHEREAS environmental protection has emerged as a fundamental value in Canadian society;

AND WHEREAS pursuant to Section 425 of the Act, a municipality may pass by-laws providing that a person who contravenes a by-law of the municipality passed under this Act is guilty of an offence;

AND WHEREAS pursuant to Section 426 of the Act, no person shall hinder or obstruct, or attempt to hinder or obstruct, any person who is exercising a power or performing a duty under this Act or under a by-law passed under this Act;

AND WHEREAS pursuant to Section 428 of the Act, a by-law may provide that, where a vehicle has been left parked, stopped or standing in contravention of a by-law passed under this Act, the owner of the vehicle is guilty of an offence, even though the owner was not the driver of the vehicle at the time of the contravention of the by-law, and is liable to the applicable fine unless, at the time of the offence, the vehicle was in the possession of another person without the owner’s consent;

AND WHEREAS pursuant to Section 429 of the Act, a municipality may establish a system of fines for offences under a by-law of the municipality passed under this Act;

AND WHEREAS pursuant to Section 436 of the Act, a municipality has the power to pass by-laws providing that the municipality may enter on land at any reasonable time for the purpose of carrying out an inspection to determine whether a by-law of the municipality passed under the Act is being complied with;

AND WHEREAS pursuant to Section 74 of the Highway Traffic Act, R.S.O. 1990, c. H.8, no person shall operate a motor vehicle upon a highway unless the driver of the motor vehicle has a clear view out of the windshield and all windows of the vehicle;

AND WHEREAS internal combustion engines are sources of carbon dioxide, nitrogen oxides, carbon monoxide, sulphur dioxides, volatile organic compounds and fine particulate matter in the Town of Bracebridge’s outdoor air;

AND WHEREAS air pollution is associated with adverse health effects, including deleterious effects on respiratory and cardiovascular health;

AND WHEREAS the Council of the Town of Bracebridge desires to assist in the reduction of adverse health effects by reducing the unnecessary emissions of nitrogen oxides, carbon monoxides, sulphur dioxides, volatile organic compounds and fine particulate matter ;

AND WHEREAS by motion 19-GC-224; the Council of The Corporation of the Town of Bracebridge deems it expedient to amend the said by-law;

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE HEREBY ENACTS AS FOLLOWS:

1. DEFINITIONS

1.1 Actively cleared means the period of time in which an individual is physically engaged with brushing, scraping or otherwise removing snow or ice from a vehicle or clearing snow, ice or frost from the windshield or window areas of a vehicle.

1.2 Electric Vehicle means a vehicle powered only by a battery or batteries.

1.3 Emergency Vehicle means a vehicle operated by a police department, fire department or ambulance/paramedic service.

1.4. Idle or idling means the operation of the engine of a vehicle while the vehicle is not in motion and not being used to operate auxiliary equipment that is essential to the basic operation of the vehicle.

1.5. Mobile work vehicle means a vehicle containing equipment that must be operated inside or in association with the vehicle which includes but is not limited to garbage and snow removal vehicles, or a vehicle serving as a facility for taking measurements or making observations or conducting maintenance or construction.

1.6. Occupied Vehicle means a vehicle with one or more persons and/or dogs or cats inside of the vehicle that are clearly visible from the outside of the vehicle by an Officer.

1.7. Officer means a By-Law Enforcement Officer, a Police Officer or other person appointed by Town Council or otherwise authorized to enforce this by-law.

1.8. Park or parked means the halting of a vehicle, whether occupied or not, except when halted temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.

1.9. Stop or stopped means the halting of a vehicle, even momentarily, whether occupied or not except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control sign or signal.

1.10. Vehicle means a motor vehicle, trailer, traction engine, farm tractor or road building machine as defined in the Highway Traffic Act, R.S.O. 1990, c.H.8, as amended, and any vehicle drawn, propelled or driven by any kind of non-muscular power but does not include cars of electric or diesel electric railways running exclusively upon rails.

2. GENERAL PROVISIONS

2.1. No person shall cause or permit a parked or stopped vehicle to idle for more than:

2.1.1. Three (3) consecutive minutes.

2.2. Subsection 2.1 shall not apply to the following situations:

2.2.1. An emergency vehicle while engaged in operational activities;

2.2.2. A vehicle participating in an emergency activity;

2.2.3. A vehicle that remains motionless because of an emergency or traffic conditions, which includes but is not limited to congestion, traffic control signals, weather conditions or mechanical difficulties over which the driver has no control;

2.2.4. A mobile work vehicle in the course of being used for the function or purpose for which the vehicle was designed;

2.2.5. A transit vehicle while passengers are in the process of embarking or disembarking the vehicle;

2.2.6. An armoured vehicle where a person remains inside the vehicle while guarding the contents of the vehicle or while the vehicle is being loaded or unloaded;

2.2.7. An electric vehicle;

2.2.8. An occupied vehicle with one or more persons, dogs or cats inside of the vehicle for a period not exceeding 60 minutes, when the outside temperature is greater than 20 degrees Celsius as confirmed by Environment Canada;

2.2.9. An occupied vehicle with one or more persons inside of the vehicle for a period not exceeding 60 minutes, when the outside temperature is lower than 0 degrees Celsius as confirmed by Environment Canada;

2.2.10. A vehicle being actively cleared.

3. ADMINISTRATION AND ENFORCEMENT

3.1. ENTRY AND INSPECTION

An officer may enter upon private property at any reasonable time to enforce the provisions of this by-law. The provisions of this by-law apply to all highways, public and private property within the Town of Bracebridge.

3.2. PENALTIES

3.2.1. The operator of a vehicle, not being the owner, who has parked or stopped a vehicle in contravention of this by-law is guilty of an offence and shall be subject to a penalty in accordance with the Provincial Offences Act, R.S.O. 1990 c. P.33.

3.2.2. The owner of a vehicle parked or stopped in contravention of this by-law is guilty of an offence and shall be subject to a penalty in accordance with the Provincial Offences Act, R.S.O. 1990, c. P.33 unless at the time the offence was committed, the vehicle was in the possession of a person other than the owner without the owner’s consent.

3.2.3. Every person who contravenes any provision of this bylaw is guilty of an offence and is, upon conviction, liable to any penalty provided under the Provincial Offences Act, R.S.O. 1990, c.P.33.

3.2.4. A person charged with a parking or stopping offence under this by-law may, within 21 days of the infraction date, pay a set fine amount in accordance with the set fine amount approved by the Ontario Court of Justice.

3.2.5. An Officer may, upon discovery of any vehicle parked or stopped in contravention of this by-law, cause it to be moved or taken to and placed or stored in a suitable place and all costs and charges for the removing, care and storage thereof, if any, are a lien upon the vehicle which may be enforced in the manner provided by the Repair and Storage Liens Act, R.S.O. 1990, c. R.25.

3.3. VALIDITY AND SEVERABILITY

Every provision of this by-law is declared severable from the remainder and if any provision of this by-law shall be declared invalid by a court of competent jurisdiction, such declaration shall not affect the validity of the remainder of the by-law.

3.4. FORCE AND EFFECT

This by-law shall come into force and effect on the date the set fines are approved by the Chief Justice of the Ontario Court of Justice.

3.5. REPEAL

On the date this by-law comes into effect, By-Law 2011-078 shall be hereby repealed.

3.6. SHORT TITLE

This by-law may be referred to as the “Idling By-Law”.

A BY-LAW OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE TO AMEND BY-LAW 2016-088, A LAND USE CONTROL BY-LAW TO REGULATE THE USE OF LAND IN THE TOWN OF BRACEBRIDGE

WHEREAS By-law No. 2016-088 was enacted to regulate land use in the Bracebridge Ward, of the Town of Bracebridge, in the District Municipality of Muskoka.

AND WHEREAS it is deemed necessary to amend the said by-law by rezoning certain lands;

AND WHEREAS by motion 19-PD-088 the Council of The Corporation of the Town of Bracebridge deems it expedient to pass such a by-law;

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF BRACEBRIDGE ENACTS AS FOLLOWS:

1. That Schedule “A” to By-law No. 2016-088 is hereby amended by rezoning the property described as Lot 2, Plan 3, Bracebridge Ward, Town of Bracebridge from the present zone of Residential Type 1 (R1) to Residential Type 2 (R2) Special – 10 (R2-10), which are more particularly outlined in red on Schedule “A” attached hereto.

2. That Section 7.1.1: Residential Zone Exceptions is hereby amended by the addition of the following:

Zone Permitted Uses

R2-10 In a Residential Type 2 Special – 10 (R2-10) zone, the permitted uses are all those permitted uses in the Residential Type 2 (R2) zone and subject to the following provisions:

(i) A maximum of one (1) Second Dwelling Unit shall be permitted; (ii) That the existing setback to the centreline of the municipal road shall be deemed to comply.

All other applicable provision of the Residential Type 2 (R2) zone shall continue to apply in respect to the lands located within the Residential Type 2 Special – 10 (R2-10) zone.

3. That Schedule "A" attached hereto forms part of this by-law.

4. That this By-law shall take effect on the date of passage by Council and shall come into force in accordance with Section 34 of the Planning Act, R.S.O., 1990.
