Overall Purpose

You have overall responsibility for the delivery of court services in both the Sheriff and courts throughout the Sheriffdom in a manner that (i) provides responsive service, at best value, to the judiciary and all court users, and (ii) fully supports the Sheriffs Principal in discharging their statutory responsibility for securing the efficient disposal of business.

You will represent the Scottish Courts and Tribunals Service (SCTS) in discussions with justice partners on the improvement of operational delivery across the justice system, negotiating and influencing to achieve effective outcomes.

You have direct line management of the senior executive officers within the Sheriffdom: the Sheriffdom Legal Advisor; and the Executive Support Manager. You will maintain an efficient working relationship with the , supporting her fully in the discharge of her statutory responsibilities. You will also develop and maintain effective relationships with senior colleagues in , Crown Office and Service, and the Police to ensure effective resolution of operational issues and justice system development.

 Works closely with and supports the Sheriff Principal in discharging their statutory responsibility for the speedy and efficient disposal of business in both the Sheriff and Justice of the Peace court  Overall responsibility to the Director of Operational Delivery (Sheriff and JP courts) for service delivery across the Sheriffdom, which is responsive to the needs of the judiciary and court users  Overall responsibility for service delivery across the Sheriffdom in a manner that delivers the best possible services to customers, while delivering best value  Contributes to the development of SCTS Policy and is proactive in communicating SCTS strategy positively to staff and external stakeholders

Organisational

 Drives business improvement through analysis of performance management information and future business trends  Understanding and researching management information within the Justice system and preparing position papers on business performance and forward planning including developing operating protocols for improved business management  Acts as a key member of the Sheriffdom Criminal Justice Board  Drives business planning across the Sheriffdom ensuring a link between strategic aims, corporate plan, business plans and individual objectives  Ensures corporate governance in line with delegated authorities, setting internal control of budgets, accommodation and staff resources, while identifying efficiencies and securing best value at all times  Ensures core services and targets are achieved or improved upon  Ensures management vocational training and development strategy is aimed at producing properly trained staff to meet business needs and individual career development and aspirations  Works in partnership with other Sheriffdom Business Managers  Lead in an allocated area of business on behalf of all Sheriffdoms, ensuring clear communication with Director of Operations and other Sheriffdom Business Managers

Employment Checks

If successful, common citizenship staff and internal SCTS staff will be given a conditional offer which is dependent on pre appointment checks. These checks will confirm if the successful applicant’s performance, conduct or attendance has been the subject of formal disciplinary, capability or absence warning which is still in effect at the closing date for the vacancy. Informal warnings and expired warnings will not be considered. If an individual receives a subsequent live formal warning after the closing date for the vacancy this may mean the offer is withdrawn on the grounds of suitability.

For staff transferring from other Government Departments/Agencies a further Disclosure Scotland check may be needed to satisfy the standard level check required by the Scottish Courts and Tribunals Service.

Some posts may also be subject to “secure check” security clearance:

Secure check Some posts at Sheriff Clerk, Sheriff Clerk Depute level and senior staff posts may require a higher level of security clearance (“Secure Check”). This arises out the implementation of the disclosure provisions in terms of Part 6 of the Criminal Justice and Licensing (Scotland) Act 2010 and allows a civil servant to have access to top secret and secret papers relating to court hearings and information gathered by covert surveillance or infiltration by the security services, drug enforcement agencies, into serious organised crime units. This is to ensure that the court can discharge its function of being able to process all types of criminal business which may come before it.

In larger courts the responsibility may also apply to the post which normally covers the Sheriff Clerk. In the Supreme Courts the responsibility may also apply to a small number of posts (sufficient for operational capability related to the average volume of cases where higher level security is required) graded at HEO and SEO and above.

If an individual’s “Secure Check” status is not confirmed the individual may, subject to operational feasibility, be given a period of 18 months in which to achieve the “Secure Check”

The Scottish Courts and Tribunals Service processes data which is sensitive and deals with matters of a private nature, this often can result in staff interacting with vulnerable members of society or having access to personal and confidential information. As a result, the Scottish Courts and Tribunals Service is exempt from the Rehabilitation of Offenders Act (1974) which means that we cannot employ individuals with certain unspent and/or spent convictions.
