1 The tender document(s), may be downloaded free of cost from the e-Government Procurement(e- GP) website www.etenders.kerala.gov.in No payment is required for downloading the tender documents from the above website. However a bid submission fee, as mentioned in this document, is required to be submitted along with the online bid.

2 Only those contractors having a valid and active registration approved by PWD , on the date of bid submission shall submit bids online on the e-GP website. All bids shall be submitted online on the e-GP website only. No manual submission of bids shall be entertained for the tenders published through e-GP system under any circumstances

3 The e-GP system shall not allow submission of bids online after the stipulated date and time. The tenderer is advised to submit the bids well before the stipulated date and time to avoid any kind of network issues , traffic congestion, etc. In this regard, the The Tender inviting Authority shall not be responsible for any kind of such issues faced by tenderer 4 Ineligible contractors or contractors who do not possess valid and active registration on the date of bid submission, are strictly advised to refrain themselves from participating in this tender. If such instances are noticed, the same shall be treated as “fake bidding” by the respective contractor and such contractor shall be blacklisted as per departmental rules in force.

5 The contractors, who submit their bids for this tender after digitally signing using their Digital Signature Certificate (DSC), accept that they have clearly understood and agreed to the terms and conditions including the Form & Annexure of this tender.

6 Mention of price details at any place other than the designated place , shall disqualify the bid and the bid shall be summarily rejected 7 The items and sub- heads of works to be done are enumerated in the subjoined schedule .Unless otherwise specified, the tender must be for the whole or any individual work and part tenders are liable to rejection. A tenderer may tender for more than one work with earnest money deposit specified in each case, but shall not tender for any part of a work, unless specifically so required.

8 All works shall be done in conformity with the conditions of contract, specifications for the project and as per the state PWD specifications. The rates quoted shall be inclusive ones, covering all the operations contemplated in the specifications and tender schedules and all incidental work necessary for such operations such as shoring, bailing out work , scaffolding, etc. The rates quoted shall be inclusive of all taxes applicable. The tenderer shall quote an overall percentage variation below or at the rate given in the schedule by a single entry at the bottom of the schedule, under the head quoted rate.

9 The overall percentage rates accepted and specified in the agreement shall not be varied on any account whatsoever

10 With a view to curb the tendency to quote low rates and execute the works unsatisfactorily the bidders who quote low rates will have to remit performance guarantee equivalent to the imbalanced price. If the quoted PAC differs the estimate PAC below 25% the bid will be rejected. The performance guarantee will be released only after satisfactorily completion of the work.

11 No interest, under any circumstance, shall be payable by the The Tender inviting Authority to the contractor for the EMD/security deposit/performance guarantee furnished.

12 Tender duly signed using Contractor’s valid Digital Signature Certificate shall be submitted online on e-GP website www.etenders.kerala.gov.in before 19/09/2015 , 05 :00:00 PM and The bids will be opened online at the office of the tender inviting authority on 23/09/2015 , 11 :00:00 AM by the The Assistant Engineer, LSGD subdivision, Panayam Grama Panchayat in the presence of those contractors or their authorized agents who wish to be present. In case it is not possible to open the tenders on the specified date due to any valid reason the revised time and date of opening of tenders will be published on e-GP website. The contractors shall check the e-GP website regularly for such updates. The total amount of each tender will be read out if necessary.

13 There is no provision for correction of bids once submitted online . However, multiple bids can be submitted by the contractor, in case of corrections, till the last date and time of bids submission and the most recent / latest bid submitted before the stipulated date and time of bid submission shall only be considered by e-GP for further processing. Details of individual rates will be treated as confidential and will not be read out. Each online tender should be accompanied by applicable Earnest Money Deposit (EMD)and tender document fees. The EMD have to be remitted online using payment option of e-procurement system only.

14 The bid submission fee is not refundable under any circumstance 15 The tenderer shall submit mandatory to the tender inviting authority an attested copy of his/her valid and active registration certificate, EMD exemption certificate (if any), and original preliminary agreement on or before the date specified in the Notice Inviting Tender (NIT). TheC Department shall not be responsible for any postal/Courier service delay or any other delay. The non receipt of the documents on time or the failure to enclose any of the documents as specified will result in the rejection of the tender. The copy of the registration certificate shall be attested by a Civil Engineer of Government not below the rank of Assistant Engineer.

16 Tender forms and general specifications can be downloaded free of cost from the e-GP website. Tenders not submitted in such prescribed online format or submitted incomplete in any respect whatever such as unattested errors and corrections in specification, rates, quantities, units, amounts figures not expressed in words , totals of contract not entered, etc. shall be summarily rejected. The EMD receipt should be attached to the tender, duly pledged lest the tender will be rejected 17 Selected contractor will be required to produce income tax and sales tax clearance certificates before part payment is made for the work, and before security deposits are released.

18 The tenderer shall study the detailed specification for the work, in every case the materials and workmanship must comply with relevant PWD standards. He shall also carefully study the drawings and all the documents which form part of the agreement to be entered into by the accepted 19 Schedule of quantities, specification of work to be done and conditions of contract to be entered into can be seen on the e- GP website. It shall be definitely understood that the Tender inviting Authority does not accept any responsibility for the correctness or completeness of the schedule, that the schedule is liable to alteration by omission, deduction or additions at the discretion of the competent tendering authority of the Corporation. Any further information like detailed drawings, estimate, etc can be referred with the The Assistant Engineer, LSGD subdivision, Panayam Grama Panchayat before the last date of submission of the bid.

20 The contractor will examine the site condition and satisfy himself of the availability of materials at nearby places, difficulties which may arise during execution etc. before submitting tender for the work.

21 . In consideration of the tenderer being allowed to quote for the work, he should keep the tender firm for a period of two months from the date of opening the tender during which period or till the tenders are decided whichever is earlier, he will not be free to withdraw or modify the tender. Any Such withdrawal will entail forfeiture of the earnest money deposited for the work.

22 Note :-If due to departmental or administrative reasons it is found necessary to keep the tender open for a further period, prior consent of the contractor shall be obtained in writing for every further period of one month. 23 Within a week after the date when the acceptance of tender has been intimated to him , the Tenderer shall deposit unbalanced price if any plus a sum sufficient to make up 5% ( five percent) of contract amount limited to Rs.2 Lakh whichever is less for the works costing up to Rs.2 crore and 10% ( ten percent) of contract amount beyond two crore as bank guarantee or fixed deposit receipt pledged in the name of competent authority which shall be treated as security for the due performance of the contract and shall execute an agreement for the work in the form prescribed by the PANAYAM Grama Panchayat

24 If the Tenderer fails to execute the agreement, the earnest money shall be forfeited to the PANAYAM Grama Panchayat and fresh tenders called for, or the matter otherwise disposed of. 25 If the Tenderer having entered into a contract fails to maintain the rates of progress specified in the agreement schedule,The Assistant Engineer, LSGD subdivision, Panayam Grama Panchayat may at his discretion supplement the work remaining to be done either in full or in part or cancel the contract and rearrange the work at the risk and cost of the selected contractor as per the existing provisions of the P.W.D. Manual and Code. If as a result of such measures due to the default of the tenderer to pay the requisite deposit, sign contracts or take possession of the work any loss to PANAYAM Grama Panchayat results the same will be recovered from him as arrears of revenue, but should it be savings to PANAYAM Grama Panchayat, the original contractor shall have no claim whatever to the difference. Recoveries on this or any other account will be made from the sum that may be due to the contractor on this or any other subsisting contracts or under the Revenue Recovery Act, or otherwise as the Tender Inviting Authority may decide.

26 The acceptance of the tender rests with the PANAYAM Grama Panchayat The Grama Panchayat does not undertake to accept the lowest or any particular tender.

27 The right to carry out the work either in conformity with or in a manner entirely different from the terms of this invitation that may be considered most suitable before or subsequent to the receipt of tenders due to exigencies of work, is reserved with the PANAYAM Grama Panchayat

28 The earnest money deposit of the unsuccessful contractors will be refunded immediately after tabulating tenders, keeping only the earnest money of the first 3 lowest tenders. The Earnest Money Deposit of the remaining unsuccessful contractors will also be refunded within a week from the date of acceptance of the tender as per the existing guidelines and GO’s stream lining e-procurement

29 . Tenderers must also state in their tenders if they are prepared to carry out at their tendered rates such portion or portion of the work as may finally be allotted to them by the officer deciding tenders.

30 Any further information necessary can be obtained at the office of the tender inviting authority on all working days. 31 The tender inviting authority reserves the right to reject any or all of the tenders without assigning any reason thereof. 32 Tenders which are not in conformity with this tender notice are liable to rejection. 33 When the percentage rate quoted in figures differ from that quoted in words, only the rate quoted in words will be taken into consideration in tabulation for accepting the tender. The contractor is bound to accept these rates if the contract is awarded to him . 34 If any correction is made by the contractor in the tender schedule, the tenders are likely to be rejected. Any corrections/ suggestions/remarks etc. to be given by the contractor has to be made only in the “Remarks” page/section of the online bid.

35 Amendment/ Corrigendum publication on e-GP website All amendment(s) / corrigendum(s) shall be published on the e-GP website and contractors are advised to check the website regularly for the same. The department shall not be responsible for contractor’s negligence in checking the website regularly for any updates on this tender.

36 The work should be completed in all respects before 180 days from the date of agreement. 37 If the contractor is hindered in the execution of his work due to genuine reasons so as to necessitate an extension of time allowed for its completion, he shall apply in writing to the The Assistant Engineer, LSGD subdivision, Panayam Grama Panchayat who shall, if reasonable ground be shown authorize such extension of time. If any, as may in his opinion be necessary and without such written authority of The Assistant Engineer, LSGD subdivision, Panayam Grama Panchayat the contractor shall not be exempted from the damages leviable if the work or any part or parts thereof be not completed within the prescribed time. The date fixed by The Assistant Engineer, LSGD subdivision, Panayam Grama Panchayat for the commencement and completion of work as entered in his agreement shall be strictly observed by the contractor who shall pay damages as per the latest provisions of the P.W.D. Manual and /or relevant orders of Government in force for every month that the work remains uncommenced or unfinished after the proper date. All damages payable under the provisions of this clause shall be considered as liquidated damages to be applied to the use of the PANAYAM Grama Panchayat without reference to the actual loss sustained owing to the delay.

38 The contractor is bound to carry out items of works which are not included in the tender schedule and agreement but which are found necessary for proper completion of work during execution. The rate to be paid for such extra items shall be arrived at based on the schedule of rates adopted for the preparation of estimate and tenders invited or negotiations made and applying the percentage excess or deductions agreed to in the agreement. The rate so worked out shall be entered on a supplemental slip, signed and dated by, the Contractor andThe Assistant Engineer, LSGD subdivision, Panayam Grama Panchayat and this supplemental slip shall be attached with and form part of the agreement.

39 In the event of the Contractor failing to agree on a rate for such additional work as per clause above then The Assistant Engineer, LSGD subdivision, Panayam Grama Panchayat may employ other parties to carry out the additional work.

40 The Contractor is bound to carry out all the excess over and above the agreed quantities as directed by the departmental officers. Such excess will be paid for only at the agreed rates and at the discretion of the concerned authority.

41 Payment will be made (unless otherwise specified) based on final measurement at unit rates.

42 It shall be accepted as a condition of the contract that the payment of the final bill to the contractor less the withheld amount and his acceptance thereof shall constitute a full and absolute release of the PANAYAM Grama Panchayat from all further claims by the contractor under the contract.

43 The contractor shall not without the previous sanction in writing of the authority accepting the tender, execute any power of attorney in respect of any matter touching this contract and any such power of attorney executed without such sanction shall not be recognized by or be binding up on the PANAYAM Grama Panchayat or their officers. It shall be entirely within the discretion of the authority accepting the tender either to grant such sanction or to refuse it or to revoke a sanction once given. 44 No part of the contract shall be sublet without written permission of The Assistant Engineer, LSGD subdivision, Panayam Grama Panchayat nor shall transfer be made by power of attorney authorizing others to receive payment on the contractor’s behalf. 45 In making payment the total amount of the bill shall be rounded off corrected to the nearest Rupee.

46 The contractor will provide his own tools and plant, store-sheds to store his own materials as well as those supplied by the department and will be entirely responsible for proper use and safe custody of the latter and also for any loss, from damage, theft, mishandling, weathering or any cause what so ever. 47 It shall be the contractor’s responsibility to protect the public and his employees against accident from any cause related to execution of the tendered work and he shall properly indemnify the department and Government against any claims for injury to person for damage or loss to property resulting from any such accident. 48 The contractor shall be responsible for the safety of the laborers employed by him and he shall be liable to pay the necessary compensation in case of accidents, as per the Workmen’s Compensation Act. He shall also comply with the rules laid down in the CPWD contract regulations regarding fair wages.

49 If the PANAYAM Grama Panchayat undertakes to supply particular materials, no claim for extra-payment on account of delay in the supply of these materials will be entertained.

50 The Contractor should take a license under the current explosive rules to enable him to manufacture and/or possess the quantity of explosives required by him for blasting, if necessary. 51 This tender notice with the conditions stated herein will form part of the contract documents. Not withstanding anything specified in the foregoing conditions, the relevant provisions of the PWD Manual, PWD Code and Kerala Standard Specification shall be applicable for the arrangement and execution of this work. 52 Income Tax, KVAT, Employer’s contribution to Kerala Construction Workers Welfare Fund Board, all other Cesses, rates, duties, taxes etc. leviable as per rules and orders in force shall be deducted at applicable rates from the Bills for the value of works done and the contractor shall abide by such deductions. The amounts due in this regard shall be deducted proportionately from the part bills and the final bill for the works. The rates quoted for various items of the works remain unaffected by any changes that may be made from time to time in the rates at which the above levies are to be made.

53 Before awarding the work, the credibility of the contractor, his performance in the execution of works and his capacity to undertake and complete the work of the specified amount will be ascertained including works already executed in PANAYAM Grama Panchayat

54 All these conditions and those stated in the notice inviting tender for works will form part of the documents and shall form part of the Agreement
