440. MINUTES

Resolved that the Minutes of the Meeting of 20th July 1989 be approved as a correct record and signed by the Chairman, subject to:-

(a,) Para.7 of Minute 426 reflecting a third reason for refusal, namely Policy H14 of the Rochford District Local Plan regarding resistance to loss of residential accommodation.

(ii) Minutes 428 and 429 (i) and (ii) being amended to read as Resolutions.

In response to the Member concerned the Chairman accepted that the Note under Paras.1 and 2 of Minute 426 recording his declaration of a non- pecuniary interest should finish at the phrase "remained in the Meeting".

441. MONITORING OF PERFOR}ANCE - MEETINGS OF 2ND AND 23RD FEBRUARY, 20TH APRIL AND 18TH MAY 1989

The Committee were satisfied that all necessary action had been taken. Minutes 533/88 Para.23(DD), 131/89 Para.26(SEC) and 231/89 Para.28(SEC) were carried forward.

442. THE TOWN AND COUNTRY PLANNING (CONTROL OF ADVERTISEMENTS) REGULATIONS 1989

The Director of Development reported on two breaches of the above Regulations as follows:-

(i) Unauthorised Advertisement at Yous Hairdressers, 13 London Road, Rayleigh

NOTE: Councillors C.J.B. Faherty and C.R. Morgan declared a non-pecuniary interest in this item by virtue of knowledge of the premises and son's employment respectively but remained in the Meeting and participated in the discussion and voting thereon.

Complaints had been received about the recently painted mural on the end elevation of the above building adjacent to the Creawick Avenue/London Road junction. Following an inspection of the site the occupier had been notified that the mural was considered to be an advertisement which due to the height of the characters thereon was not authorised by the provisions of the Advertisement Regulations, and that he was invited to apply for the necessary consent but had not done so to da e. 4- ii i'uI•['' •I!. r !I 'u'' IIiuI• i ' ''? j'

Planning Services Members were mindful that the authority could exercise its powers under those Regulations only in the interests of amenity and public safety. The County Highways Department considered that the sign did not create any undue distraction to passing motorists. Therefore the factor of public safety would carry far less weight than the effect on the local amenity. In that respect the sign was considered to be detrimental to visual amenity by virtue of its excessive size, garish colouring and unduly obtrusive features within this ares.

Resolved that the Secretary to the Council be authorised to take all necessary action including the issue and service of Notices and action in the Courts to secure the remedying of the breach of advertisement control now reported. (11813) (SEC)

(ii) tinauthorised Sign For The "Station Garage" at the Entrance to R!yieigh Station Car Park at the Junction of Crown Hill/Love Lane, Rayleigh The owner of this garage had been advised last November that permission S was required for the display of the new sign but an application had not been forthcoming and the sign remains unauthorised. Instead the owner advised that he had obtained consent from British Rail as landowner and would be meeting with them on the site to discuss the need for the necessary application. He had also attempted to justify the sign on the basis of comparison with others in the vicinity.

The Director of Development considered that the present sign was visually obtrusive to the detriment of the amenities of this essentially residential area, did not satisfy the requirements of Policy SAT7 of the Rochford District Local Plan and in its present form would be unlikely to secure planning permission.

Resolved That the Secretary to the Council be authorised to take all necessary action including the issue and service of Notices and action in the Courts to secure the remedying of the breach of advertisement control now reported. (29659)(SEC)

443. UNAUTHORISED CARAVAN ON LAND AT THE JUNCTION OF TRENYERS AVENUE AND S VANDERBILT AVENUE, RAYLEIGH

The Director of Development reported that in May a caravan was moved on to a plot of land fronting Vanderbilt Avenue which had been double fenced, that a number of vehicles, containers, gas cylinders and other materials had been deposited within this plot of land and that the result was visually obtrusive.

No consent had been sought for the structures and uses on this site and it was unlikely that a planning application would receive favourable consideration. The site was within the Metropolitan Green Belt and the use of the land for this purpose was considered to be inappropriate and contrary to the policies applicable to the area as defined in Policy 59 of the Approved Essex Structure Plan and Policy GB1 of the Local Plan. The Environmental Services Department had attempted to establish contact with the occupants but without success.

The Director of Development reported that following complaint8 from neighbours about light commercial vehicles at the above residential premises, investigations had confirmed that they were being stored there and that with the associated activities of sales, hire, cleaning and renovation, their presence was giving rise to noise and disturbance.

The occupants had been informed that there was no authority for this use and that a planning application was unlikely to receive favourable consideration. The site was within the Metropolitan Green Belt and the use of the land for this purpose was considered to be inappropriate and contrary to the policies applicable to the area as defined in Policy 39 of the Approved Essex Structure Plan and Policy CR1 of the Local Plan.

The Director of Development reported that one of the conditions under which planning perinisaion had been granted under reference ROC1351189 required the surfacing of the additional car parking spaces and access to be subject to prior agreement in writing by the local planning authority. The applicants had neglected to fulfill that requirement although the surfacing method, details of which were noted, was regarded as satisfactory and the Committee agreed that the situation should be regularised.

Members noted that there did not appear to be any substance to coraplainta regarding the opening hours at the Surgery and that the applicants would be supplying a programme for landscaping and planting.

001068 Members may recall that this item was recommended for refusal on the Schedule for the Planning Services Committee Meeting on 20th Wa July, 1989, but deferred at the request of the applicant. The application site is on the south west corner of the junction of Lower Road and Plumberow Avenue. The proposal is for a new agricultural worker's dwelling, which would become the second dwelling associated with New Hockley Hall Farm. The A.D.A.S. report concludes that the farm is a viable enterprise, providing employment for two full—time workers and that the person responsible for the dairy herd needs to live within sight and sound of the farm buildings. The applicant has recently suffered the onset of a medical condition which prevents him from undertaking heavy duties, and th?refore, relies on his son for the day to day management of the dairy herd. Although the proposed dwelling is intended for occupation by the son, who at present lives in the main farm house with his parents, it could in the future, provide accommodation for an employee other than a member of the family. • It has been suggested to the applicant that the dairyman should perhaps occupy the main farmhouse, and for other workers to live further afield, which would satisfy the "sight and sound" requirements of the A.D.A.S. report. In response, the applicant has suggested that to refuse permission for this additional unit of accommodation would prejudice the viability of the farm, which may threaten its continued use as one large holding in the future. Although some sympathy is felt in this case the A.D.A.S. report, whilst supporting that the farm provides employment for two full- time workers, states "the person responsible for the dairy herd should live within sight and sound of the farm buildings." This does not suggest that both workers need, to live within "sight and sound". In response to consultations, no adverse comments have been received. Members views are invited on this proposal.

The applicants agents have now confirmed in writing that their clients proposal is for a full sheltered housing scheme and that they are prepared to enter into a legal agreement regulating the minimum ages of occupants. They also explain that their clients prefer the description of caretaker rather than warden. The role of the caretaker will be identical to the usual interpretation of warden in that the person will be responsible for the walfare of the inhabitants as well as the building. I I

22 S ODIOSS REPORT: Members will recall refusing an application for four detached houses and garages (ROC/611/88) in December last year. The principle concern being the two houses then proposed at the rear of the site on plots 3 and 4.

This current application seeks to overcome the main objections of overlooking and loss of privacy by siting bungalows to the rear of the site. Three letters of objection have been received from two adjacent properties. One concerning the objection to backland development and the loss of privacy and overlooking caused by the elevated position of the neighbour's dwelling (No. 298 Eastwood Road) in relation to the low lying bungalows proposed. The objector sug'gests plot rio. 3 to be sited further east and is further pivoted. If permission were to be granted a condition should be imposed requiring a 2m. high screen fence, along the sites' northern boundary, to be erected. The other objector (300a Eastwood Road) has objected to the increased use of the private right of way which he claims ownership of. Whilst the latter point is a private matter the Committee may wish to be informed that there is some 30m. 98' isolation (minimum) between the rear of no. 298 and the nearest part of the bungalow proposed. To pivot the bungalow further and move it further eastwards would result in an unsatisfactory relationship with the existing house (300a) close by. The developer has indicated his willingness to increase screening along the site's northern boundary by screen fencing and planting of fast growing evergreen trees. Having regard to the Council policy on "brackland" development and bearing in mind the various other examples of similar development nearby (although comprising two storey development as opposed to single storey dwellings as in this case) and the improvements achieved over the earlier refused scheme the proposal is considered to be acceptable.

i) the possible use of some of the land for agricultural purposes and ii) the sale of a small parcel in order to recover some of the losses he has incurred. Members should be reminded that the present proposal involves solely the replacement of stables and no increase in the actual number. There is no legal agreement in force for the present buildings. In addition the proposed buildings will improve the appearance of the site due to the removal of the present structures and the requirement for further landscaping. In these circumstances it would seem unreasonable to now press for such an agreement.

This development was allowed on appeal following a refusal for two chalets on 20th May, 1988 (ROC/129/8a refers). The neighbouring occupier at "Holly Trees", 16, Hillside Road has written expressing concern at possible loss of privacy from flank wall windows and potential foul drainage problems. He states that "the private sewerage system, that has previously supported properties 12,14,16,18 and 20, a total no. of persons of the order of 10, will shortly be supporting approximately 20 people, with the erection of the properties on 18 and 20 Hillside Road if the present proposal is granted. There are problems with this failing sewerage system every year through blockage caused by ground subsidence, these additional residences will undoubtedly exacerbate the problem." The Head of Environmental Serices has been consulted on the drainage issue and has no adverse comments to make subject to stated condition 9. The general drainage matter in this area was addressed by the Inspector who dealt with the appeal at Squirrels. He noted that Anglian Water raised no objection and

REPORT: Members will recall the long planning history associated with this site. Following an appeal to the Secretary of State planning permission was granted for the change of use of the land to a golf driving range subject to a number of conditions including the approval or the design and position of the golf driving bays. A set of bays of timber construction was erected.

During the storm of 1987 these suffered considerable damage and were subsequently demolished to be replaced by the bays the subject of this application. The owner considered initially that there was no requirement to submit a new planning application believing that the previous consent was sufficient. The bays are constructed using a steel frame with roof and walls in plastic colour coated profile metal and are sited at right angles to and within 9 metres of the rear boundaries of the residential properties fronting Aldermans Hill. The structure is 3m. high at the rear wall rising to 4m at the front and is 24m. long by Sm. in depth. The substantial nature of the structure and its relatively close proximity to the neighbouring properties inevitably means that it imposes unreasonably on the residential and visual amenity of those occupiers. Objections to the erection of the bays were received from the occupiers of 19,25,27 and 29, Aldermans Hill. All the objectors stressed the impact the structure makes on the residential and visual amenity of their properties.

REPORT:

Planning permission exists for a similar building (ROC/646/84) on this site in conjunction with the recently completed doctors' surgery. This present proposal seeks to alter the elevational treatment from that already permitted. Negotiations have taken place to produce the latest set of revisions to this application and further consultations are now taking place. Reaction to the original set of plans was mainly unfavourable with criticisms being made of the inappropriate treatment to the elevations - particularly that facing King George's Park. Attempts have now been made to take account of these criticisms in the latest revisions and the County Planner's Specialist Adviser on Listed Buildings and Conservation Matters has verbally indicated his initial satisfaction with them. However, he has now suggested further improvements which could be made to achieve a totally satisfactory design. The Rayleigh Civic Society's response to the original scheme were that: I) the park elevation would have a very uninteresting and severe visual impact on its surrounding and the area of brickwork- would have to be "broken up" by a cornice or insert, etc.

2) the front elevation's windows should not be of a uniform size.

3) the rear appearance was most commendable. In addition to the new current application outlined above a request has also been made to consider minor amendments to the earlier permitted scheme ref ROC/646/84. The amendments involve a 700mm. (2.2') increase to the front projection with a 300mm (1' approx.) increase to the rear. Otherwise there will be no alteration to that scheme and in view of the minimal changes to the proposal it is suggested that these be accepted as minor amendments to the permitted scheme without the need for a further application to be made. it is understood that there is an urgent need to commence work on this building which is proposed to house staff from a local branch of a well known bank.

The additional slowing and turning movements of vehicles associated with this proposal would lead to further conflict and interference with the passage of through vehicles to the detriment of highway safety. Furthermore the movement of vehicles would be a source of nuisance and disturbance to adjacent residential occupiers.

2. Insufficient parking spaces have been provided within the site to serve the proposed development together with the residential use and no garaging facilities have been included to serve the domestic dwelling.

REPORT: The applicants are seeking to convert part of what is at present a pair of semi-detached dwellings into a physiotherapy clinic using the balance of the building as a single dwelling. The proposal is unacceptable for the stated reasons the first of which is recommended by the County Surveyor. Three letters of objection have been submitted by neighbouring residents supporting the reasons for refusal.

REFU SAL

1. The proposed development is considered to be inappropriate and alien to the character of Rochford • Conservation Area by reason of its design and cramped appearance on a very limited site This would result in an unsuitable rear garden with little or no privacy being overlooked by adjacent buildings. As such the proposal would be contrary to Policies (JC3 and H9 of the Rochford District Local Plan.

2. The cramped nature of the proposal would be exacerbated by the very close proximity of three pollarded lime trees as well as a holly, all of which are of visual importance within the Rochford Conservation Area and whose health, stability and long term future would be undermined by the erection of the building. For this reason the proposal would be contrary to Policy UC1 of the Rochford District Plan.

3. The parking provision for the proposed development is unsatisfactory, due to the lack of suitable on site hardstanding of 6m. (minimum) in length in front of the proposed garages, and would result in manoevring problems/conflicts with vehicles using the adjoining doctors' surgery car park. Again, this would be contrary to Policy 119 of the Rochford District Local Plan.

REPORT:

Whilst no objections have been received from neighbouring properties this proposal has generated comments as follows:- County Planner's Specialist Adviser on Listed Buildings and Conservation - objects on the grounds that:

1) the site is unsuitable for residential property;

REFUSAL;

1. There is insufficient car parking and servicing facilities within the site to serve the additional industrial floorspace proposed and, if allowed, would result in overspill parking, and congestion within Brook Road and adjacent estate roads.

2. The proposed development, if allowed, would make it difficult for the Local Planning Authority to resist similar proposals at other units with sub—standard parking provision. This would only serve to exacerbate the shortfall in parking facilities and related overspill and congestion within the industrial estate.

1. The proposed bungalow, by reason of its projection will forward of the established line of dwellings and limited isolation for adjoining properties, would unreasonably dominate the fronts of these two adjacent dwellings and form an intrusive and cramped element in the street scene. This would be out of character with the -surrounding development which is generously well spaced and set back from the highway. As such the proposal would be contrary to policy H9 of the Rochford District Local Plan.

REPORT:

When outline planning permission was granted on this limited site for a single dwelling (ROC796/88), an informative was written into the decision notice stipulating that any building larger than that shown on the submitted, indicative drawing would be unlikely to receive favourable consideration. Although the present site is 0.6m. (1.9') wider than the outline site the proposed dwelling is a two instead of one bedroomed property and shows a lo5mscj (345sq.ft..) as opposed to a 72msq. (236sq.ft.) floor area.

Objections have been received from the occupiers of 17, Philbriclc Crescent regarding of the height of the proposal and the limited rear garden area.

REPORT:

This application was considered by the committee at its meeting on the 30th March, 1989 when authority was delegated to the Director of Development to approve in consultation with Ward Councillors on receipt of accurate plans. The Director together with Ward Members subsequently met the applicant on site and visited the adjoining neighbour at no. 40 who has objected to the development. Following this site visit the Director has made suggestions to reduce the bulk and reduce th design of the rear dormer.

The applicant has not been willing to incorporate these amendments but sought to explore minor reductions to the works • undertaken to retain them as permitted development (within 70 cubic metres). The applicant now wishes to have the application determined on the basis of accurate plans of the development as built. The matter is accordingly reported back to the Committee and whilst development of this form would not normally be encouraged it is not felt that in such a well screened position from public viewpoints that the matter could be successfully pursued any further. Members may recall that this application has been submitted following the construction of a single storey rear extension and front and rear dormers. The works were undertaken by the applicant on the assumption that the extensions and alterations would fall within the tolerance of permitted development (70 cubic metres) and therefore, the applicant only submitted plans for Building Regulation approval. Elowever following subsequent site visits by officers and calculations it has since emerged that the extensions to the property exceed the permitted 70 cubic metres and consequently, this Authority requested the submission of a formal town planning application in retrospect of the development that has takent place. The neighbours objection it to the appearance of the rear dormer, loss of light and overlooking.

This sector of the estate was originally considered as a possible site for a public car park but this never materialised because a suitable access could not be secured. have been replaned to maintian the necessary requirement to serve the adjacent flats and this has freed sufficient space to locate a pair of semi-detached one bedroomed bungalows with integral garages. no County Surveyor - objections. I Anglian Water — no objections. Neighbour consultations have attracted representations from the occupier of 7 Bramerton Road who strongly objects on grounds that the area is liable to flooding and the development would aggravate already congested traffic conditions in Hockley. The occupier of 1, Bramerton Road, does not object to bungalows but would be most concerned if the scheme was amended to houses. The occupier is also concerned about the proximity of willow trees and their retention. The trees actually stand on the gardens of the existing dwellings in Bramerton Road. The nearest tree is some 5 metres from the • proposed bungalow but some limited pruning of overhanging branches may be necessary.

Zoning: Residential. - Rochford Parish Council — objects on the increased level of traffic, referring to the current parking problems and the proximity of the ambulance station.

REFUSAL:

- 1. The Local Planning Authority considers that the proposal would be detrimental to the street scene and represents an over—development of the site by reason of : - i) the large bulk of the building and cramped nature of the development out of character with the modest residential buildings in the vicinity; ii) the limited isolation between the building and adjacent dwelling; iii) The minimal amount of useable amenity space, to the rear of the building, which although meeting the authority's normal minimum in terms of area • would be of little practical use to the flats' occupants due to it's narrow shape and position. As such the proposal would be contrary to the authority's adopted policy on flats.

2. If granted permission this development would creaEe a precedent for other similar development elsewhere in the locality making it difficult for the Local Planning Authority to resist such development which cumulatively, would adversely affect the street scene.

REPORT: This proposal involves the demolition of the existing church and hall in a residential area immediately adjacent to a health centre, ambulance station and youth centre. 1 I

Anglian Water — objects on sewage "embargo" grounds stating that ti-xe sytem is overloaded. Rochford Hundred Amenities Society — considers that there are too many flats for the site. One letter of objection has been received from a doctor at no. 11 Rociheway remarking that:

1) the buildings would be unlikely to blend in;

2) there would be parking problems and these could interfere with the ambulances nearby and his own "call outs". The above recommendation is made on balance bearing in mind the site's allocation for residential purposes, it's close proximity to an ambulance station, etc. and the compliance with the authority's minimum standard for amenity space. Members may wish to consider the above application with the following item.

5.43 ROC/532/89 ROCHFORD EVANGELICAL CHURCH, ROCHEWAY, ROCHFORD OUTLINE APPLICATION TO DEMOLISH EXISTING CHURCH BUILDINGS AND ERECT ONE DETACHED HOUSE AND TWO SEMI-DETACHED HOUSES. Applicant: Union of Evangelical Churches.

Frontage 23.4m. (76.7') Depth: 33.8m. (110.89') Zoning; Residential. Rochford Parish Council - has objected to this application for the same reason as the preceeding item. REFUSAL:

1. The Local Planning Authority considers the proposal to be an overdevelopment of the site by reason of the cramped nature of the development which is out of character with the adjacent residential properties. Furthermore the site frontage is below the Authority's adopted policy minimum for such development which requires at least 9.15 metres (30') for a single detached dwelling and 15.24 metres (50') for a pair of 1 I III '! REPORT: This proposal is not in conflict with the Council's adopted Local Plan Policy SATI4 and other nearby first floor business uses already exist. A neighbouring occupier Mr. S. Cooper of 27b Ulfa Court (flat) has submitted a letter stating that he has no objection to the principle of the office use but is concerned about car parking.

The applicants have submitted a letter confirming that "each shop tenant has use of the area immediately behind his shop for parking and servicing, in the case of this appliction, the width of the area in question is approximately l2.2m. (40') which would reqpresent the space the tenants at ground and first floor level would use." This produces about five spaces. No extra car parking space is proposed. The proposal is consistent with a previous application at 7a, • Eastwood Road which was recently granted planning permission without any additional parking space. Furthermore permission was recently granted to use part of the first floor of the present application premises to a beauty salon (ROC/389/89) with no additional parking but has not been implemented.

Zoning Town Centre. Primary Shopping Frontage.

Hockley Parish Council comment as follows:—

1. The proposal would facilitate the creation of workshop facilities in an area designated as prime retail.

2. As you are aware, the Council has suggested that the area behind the shops from Bramerton Road to Gateways supermarket should be considered as a possible area for creating a much needed shoppers car park and they understand that both the Essex County Council and the

The District Council are actively considering this. The Council are therefore concerned about the length of proposed extension to the rear which could prejudice the creation of a car park. 3. There were two storage sheds on the site of the proposed extension and that is no justification for replacing them with a permanent structure.

4. The Council would however welcome the creation of a well designed, substantial building of two storeys in the area of the existing permanent buildings excluding the proposed rear extension."

REFUSAL:

1. The proposed asymetrical roof design, alien dormer window features, size, elevational detailing and depth of the building will produce an incongruous three storey feature which is insensitive on this prominent site within Spa Road to the detriment of the visual amenity of the street scene and the attraction of the Hockley town centre generally.

2. The proposed car parking provision within the site is not adequate to serve the development. Furthermore the parking bays shown on the plan, namely A,B,C,D,E and F do not show sufficient manoeuvring area to allow vehicles to enter and leave the parking spaces shown independently of each other.

3. The proposed mixture and scale of uses (retail, industrial and residential) are considered to be imcompatible and constitute an inappropriate overdevelopment of the site within this primary shopping frontage.

4. The parking and amenity areas are considered to be poorly sited for effective use by the future occupiers of the residential accommodation on the second floor. Furthermore the proposed amenity space is considered to be inadequate in size.

REPORT: The proposal is unacceptable for the stated reasons a view shared by Hockley Parish Council.
