Keeping in view the experience gained in environmental clearance process over a period of onedecade, the MoEFCC came out with Environmental Impact Notification, SO 1533 (E), dated 14 th September 2006. It has been made mandatory to obtain environmental clearance for different kinds of development projects as listed in Schedule-1 of the Notification. Further, In pursuance to the order of Hon’ble Supreme Court dated the 27th February, 2012 in I.A. No.12- 13 of 2011 in Special Leave Petition (C) No.19628-19629 of 2009, in the matter of Deepak Kumar etc. Vs. State of Haryana and Others etc., prior environmental clearance has now become mandatory for mining of minor minerals irrespective of the area of mining lease; And also in view of the Hon’ble National Green Tribunal, order dated the 13th January, 2015 in the matter regarding sand mining has directed for making a policy on environmental clearance for mining leases in cluster for minor Minerals, The Ministry of Environment, Forest and Climate Change in consultation with State governments has prepared Guidelines on Sustainable Sand Mining detailing the provisions on environmental clearance for cluster, creation of District Environment Impact Assessment Authority and proper monitoring of minor mineral mining using information technology and information technology enabled services to track the mined out material from source to destination.
