Sl. Information Sought 1. Whether Plans have been approved for construction at the properties mentioned above. 2. Date on which plans have been approved along with name and designation of the officer approving it? 3. Whether above constructions were inspected by the JE and AE? Provide date on which inspections Page 2 of 4 were carried out. 4. Whether such JEs or AEs found construction as per Plan? 5. Date on which construction at the properties started? 6. What is the current status of the construction as per record? 7. What is the height approved for each construction? 8. How many stories have been approved. 9. What action area JE has taken against the constructions those not as per plan. Provide date of action taken. 10. If no action has been taken by JE provide the reason for not taking action? 11. How much percentage of the building is illegal and as per paln? 12. Provide names of JE,AE and other officer responsible for construction in these areas. 13. Provide role of JE in above constructions. 14. Whether JE has done his duty as per rules. 15. Whether JE and AEs have used their powers illegally. 16. Provide copies of approved layout plan. 17. How many constructions have defined BBL (Building Byelaws)? 18. How many construction as per plan. 19. Provide area of each plot approved for construction. 20. Provide name of owners of the above properties/constructions. 21. How many constructions have been given completion certificate provide copy of the completion certificate? 22. How many constructions were given permission for basement, their area and total percentage of area permitted for construction of basement? 23. How many basements are not as per permission? 24. If any action has been taken against illegal basement provide details of actions taken. If no action has been taken provide reasons for not taking action. 25. How many constructions have been given commercial/shop approvals? 26. Whether such commercial/shops were given permission in the plan and whether they are as per plan. 27. Provide information on each queries separately and in question-answer format. 28. Whether permissions were given for builder floors and plans were passed? 29. Provide copy of construction watch register for above properties. 30. Whether above constructions are as per FAR of the layout plan.

PIO’s reply: The PIO has provided point wise information to the Appellant. The PIO had also asked the Appellant to inspect the records.

Grounds for the First Appeal: The PIO has not provided information which has been sought. The PIO has also not stated how much amounts need to be paid for copies of CWR.

Order of the First Appellate Authority (FAA): As per the PIO reply has already been supplied to the Appellant as per records. The Appellant was also asked to inspect the records and whatever copies of documents he needs would be supplied after payment of additional fee. The Appellant had not visit the office for inspection of the records. He can visit the office for inspection of the records from 03.00PM to 5.00PM on any working days.

Ground of the Second Appeal: The applicant is not satisfied with the PIO reply and unsatisfactory order was passed by the First Appellate Authority. The PIO has deliberately concealed the information on queries 4,6,9,10,11,14,16,17,29 & 30. Page 3 of 4 Relevant Facts emerging during Hearing: The following were present Appellant : Mr. R. H. Bansal; Respondent : Mr. A. K. Meena, EE and Mr. P. K. Sharma, AE on behalf of Mr. Naurang Singh, PIO & Superintending Engineer-I; The PIO has given certain information but is now directed to give the following specific information: 1- Query-4: The PIO will inform the Appellant whether the CWR shows the construction as per sanctioned plan or not for all the properties. 2- Query-29: The PIO will give the attested photocopies of the construction watch register to the Appellant.

Decision: The Appeals are allowed. The PIO is directed to provide the information as directed above with respect to all the properties before 15 February 2012.

This decision is announced in open chamber. Notice of this decision be given free of cost to the parties. Any information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.
