CLOSURE ORDER WITH DISCONNECTION OF ELECTRICITY.

WHEREAS a public complaint was received by the West Bengal Pollution Control Board (hereinafter will be referred to as the `State Board'), first on 17­06­2004 and subsequently several times and in recent past on 29­12­2011, 24­01­2012 and 25­04­2012 against a gate grill manufacturing unit namely M/s Raghunath Steel Works, located at Ichapore Prantik, P.O. Ichapore­ Nawabganj, North ward no.: 5, P.S. Noapara, Dist.: North 24 Parganas, alleging noise pollution and other environmental hazards due to manufacturing and welding activities

AND WHEREAS the unit was called for hearing several times since 24­07­2004 by the State Board to attend with all statutory licenses, including ‘Consent to Establish/Consent to Operate’of the State Board. Sri Aswini Kr. Ghosh, owner of the unit and Sri Sujit Modak, on behalf of the complainant, appeared time to time in the hearings held at Head Office of the State Board.

AND WHEREAS the unit was inspected by the state Board officials on several occasions. However, during inspection of the unit first time on 25­08­2004, it was observed that the unit was engaged in manufacturing M.S. gate, grill, rolling shutter, collapsible gate etc. which falls under Orange Categories of Industry. The unit obtained ‘Consent to Establish’ (NOC) of state Board on 12­01­2004 but was running without obtaining ‘Consent to Operate’.

AND WHEREAS, in the hearing held on 18­03­2006, the unit was directed to operate as per the statutory norms fixed up by the state Board and explore the possibility to shift its manufacturing process only from the present location within eight weeks from hereof. Even after the shifting of the gate­grill etc. manufacturing process, the unit was allowed to use the said premises for office purpose and for godown purpose or for any other manufacturing process as approved by the siting policy of the state Board.

AND WHEREAS the unit was called again for hearing on 22­05­2009 as per the direction of the Hon’ble Pollution Control Appellate Authority (W.B.). Considering the siting policy of state Board along with potentiality of the pollution load of the gate grill manufacturing activities, the shifting of the said unit was recommended immediately in accordance with the observations of Kankinara Circle Office of state Board.

AND WHEREAS the State Board issued an order on 17­05­2011 directing the unit for shifting the manufacturing activities from its present location within 6(six) months from this date, positively.

AND WHEREAS the unit was called for hearing of let on 30­05­2012 by the State Board due to non compliance of earlier directions of state Board. ­2­

NOW THEREFORE, considering present siting policy of State Board that this type of unit can not run within any municipal area in West Bengal and for non­compliance of the directions of state Board, the unit M/s Raghunath Steel Works, is hereby directed to close its all kinds of operation at the present location with immediate effect.

Electricity connection of the said units is ordered to be disconnected forthwith.

The Director (HR), WBSEDCL, is requested to take necessary steps to disconnect the electricity connection of the unit immediately.

Closure order will take immediate effect and the Officer­in­Charge, Noapara Police Station, under Barrackpore Police Commissionarate is requested to execute the closure order against the aforementioned units and submit the compliance report to the State Board within seven days from the receipt of this memo.

This direction has been issued to the Officer­in­Charge, Noapara Police Station and the Director(HR), WBSEDCL, in conformity with the order of the Hon'ble High Court, Calcutta, dated 21­08­1998 and 28­04­1999 respectively.

The Environmental Engineer, Barrackpore Regional Office of the State Board is requested to take necessary steps for proper execution of the closure order and ensure the disconnection of electricity of the said units. He is also requested to visit the units involving the local police authority, if situation demands.

This direction has been issued in exercise of the powers conferred under the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981 and Environment (Protection) Act, 1986 and Rules made thereunder.

This order has the approval of the Competent Authority.
