APPLICANT’S MOTION TO DISMISS

The Notice of Opposition filed by opposer Karma Automotive LLC (“Opposer”) alleges

“Opposer sells its goods and services under a family of marks,” but fails to allege the requisite elements to rely on such a family of marks. Accordingly, applicant Alchemy Factory

(“Applicant”), pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure and

Trademark Trial and Appeal Board Manual of Procedure (“TBMP”) § 503, hereby respectfully requests that the Opposition be dismissed for failure to state a claim.

This Motion is made on the grounds that Opposer alleges that it “sells its goods and services under a family of marks, including but not limited to its ‘KARMA’ and ‘MY KARMA’ marks (collectively the ‘Karma Marks’)”; however, Opposer fails to allege the requisite elements in order to rely on this ostensible family of marks, namely, that: (1) the Karma Marks share a recognizable common characteristic that is distinctive (i.e., not descriptive or highly suggestive or so commonly used in the trade that it cannot function as the distinguishing feature of any party’s mark); and (2) the Karma Marks have been used and advertised in such a manner as to create common exposure and thereafter recognition among the purchasing public, such

that any common characteristic is itself indicative of a common origin of the goods or

services. This Motion is supported by the accompanying brief and Declaration of Meredith

L. Williams (“Williams Decl.”) in support, and such other papers and argument as may be

presented to the Board.

BRIEF IN SUPPORT OF MOTION TO DISMISS

I. FACTUAL AND PROCEDURAL BACKGROUND

Applicant filed an application to register the mark CARMA (“Applicant’s Mark”) for

goods and services in International Class 9, 35, 42 and 45, Application Serial No. 88/040,943 (the

“Application”), on July 17, 2018. The Application published for opposition on February 26, 2019.

On March 22 and June 26, 2019, Opposer filed a first request for an extension of time to oppose

the Application and a further request for an extension of time to oppose. On August 23, 2019,

Opposer filed the Opposition.

The Opposition alleges that “Opposer sells its goods and services under a family of marks,

including but not limited to its ‘KARMA’ and ‘MY KARMA’ marks (collectively the ‘Karma

Marks’).” (1 TTABVUE, Opposition, ¶ 9.) The Opposition also alleges that Opposer has

“engaged in extensive advertising and promotion of the Karma Marks . . . and, as a result, the

Karma Marks have become identified with and are widely recognized as representing the goods

and services of Opposer among the relevant consuming public.” Id., ¶ 13. The Opposition does not allege that Opposer’s Karma Marks share a recognizable common characteristic that is distinctive (i.e., not descriptive or highly suggestive or so commonly used in the trade that it cannot function as the distinguishing feature of any party’s mark), or have been advertised in such a manner as to create common exposure and thereafter recognition among the purchasing public of that characteristic itself indicative of a common origin of the goods or services.

There are currently over a dozen live registrations or applications for “CARMA” or

“KARMA” marks for car-related goods and services, which Opposer did not oppose or seek to

cancel, as well as at least 24 websites reflecting third party use of “carma” or “karma” for car-

related goods and/or services. Williams Decl., ¶¶ 2-5, Exs. 1-14.

II. LEGAL STANDARD

A motion to dismiss for failure to state a claim “is a test solely of the legal sufficiency of a

complaint.” See TBMP, § 503.02. Under FRCP 12(b)(6), the Board must dismiss an opposition if it fails to state a claim that is “plausible on its face.” T.B.M.P. § 503.02 (citing Bell Atl. Corp. v. Twombly, 550 U.S. 544, 570 (2007)). “Threadbare recitals of the elements of a cause of action, supported by mere conclusory statements, do not suffice.” Ashcroft v. Iqbal, 556 U.S. 662, 678

(2009). The purpose of FRCP 12(b)(6) “is to allow the court to eliminate actions that are fatally

flawed in their legal premises and destined to fail, and thus o t spare litigants the burdens of

unnecessary pretrial and trial activity.” Advanced Cardiovascular Sys. Inc. v. SciMed Life Sys.

Inc., 26 U.S.P.Q.2d 1038, 1041 (Fed. Cir. 1993).

When ruling on a motion to dismiss, the Board shall accept factual allegations pled in the

opposition as true, but “[c]onclusory allegations of law and unwarranted inferences of fact do not

suffice to support a claim.” Bradley v. Chiron Corp., 45 U.S.P.Q.2d 1819, 1822 (Fed. Cir. 1998).

Deciding a Rule 12(b)(6) motion is a “context-specific task” th at requires an analysis of the pled

facts in light of the specific elements of the cause of action alleged. In re Bill of Lading

Transmission and Processing System Patent Litigation, 103 U.S.P.Q.2d 1045, 1059 (Fed. Cir.

2012) (quoting Iqbal, 556 U.S. at 679).

To assert ownership of a family of marks a party must allege, and ultimately prove: (1) prior use of marks sharing a recognizable common characteristic; (2) that the common

characteristic is distinctive (i.e., not descriptive or highly suggestive or so commonly used in the

trade that it cannot function as the distinguishing feature of any party’s mark); and (3) that prior to

the defendant’s use, plaintiff’s marks have been used and advertised in promotional material or in

everyday sales activities in such a manner as to create common exposure and thereafter recognition

among the purchasing public such that the common characteristic is itself indicative of a common

origin of the goods or services. Wise F&I, LLC et al. v. Insurance Co., 120 U.S.P.Q.2d

1103 (T.T.A.B. 2016) (citing, e.g., Truescents LLC v. Ride Skin Care, LLC, 81 U.S.P.Q.2d 1334,

1337-38 (T.T.A.B. 2006)). “Simply using a series of similar marks does not of itself establish the existence of a family.” J&J Snack Foods Corp. v. McDonald’s Corp., 18 U.S.P.Q.2d 1889, 1891-

92 (Fed. Cir. 1991); see also Truescents, 81 U.S.P.Q.2d at 1337-38.

The existence of a family of marks is a question of fact based on the distinctiveness of the common formative component, the extent of the family’s use, advertising, promotion, and its inclusion in a number of registered and unregistered marks. See McDonald’s Corp. v. McBagel’s

Inc., 1 U.S.P.Q.2d 1761, 1763 (S.D.N.Y. 1986); see also Wise F&I, LLC et al. v. Allstate Insurance

Co., 120 U.S.P.Q.2d 1103 (T.T.A.B . 2016) (dismissing opposition fo r failure to state a claim upon

which relief can be granted) (“O pposers’ claim is factually def icient because Opposers have failed

to plead that the common element ‘WISE’ is distinctive” and “th at their marks, or a number of

them, have been used and advertised in such a manner that the p ublic associates not only the

individual marks, but the common c haracteristic of the putative family, with a singl e source.”).

The marks must be alleged, and ultimately proved, to create rec ognition of “common

ownership based upon a feature common to each mark” and that co mmon feature must be the

distinguishing feature of each mark, not a merely descriptive o r suggestive portion of the mark.

American Standard Inc. v. Scott & Fetzer Co., 200 U.S.P.Q 457, 461 (T.T.A.B. 1978).

III. ARGUMENT

Opposer refers to its “family of marks, including but not limited to its ‘KARMA’ and ‘MY

KARMA’ marks (collectively the ‘Karma Marks’),” but Opposer does not specify the other marks in that purported family and has not properly pled its ownership of the family of marks. Because

Opposer’s claims for likelihood of confusion rely on this alleged family of marks without alleging the requisite elements to establish Opposer’s ownership of a family of marks, the Opposition should be dismissed.

A. The Opposition Fails To Plead that the “Karma Marks” Share A Distinctive

Common Characteristic, So As To Rely on Those Marks As a Family.

The first element required to rely on a family of marks is “prior use of marks sharing a recognizable common characteristic, and the second element is that “the common characteristic is distinctive (i.e., not descriptive or highly suggestive or so commonly used in the trade that it cannot function as the distinguishing feature of any party’s mark).” Wise F&I, LLC et al. v. Allstate

Insurance Co., 120 U.S.P.Q.2d 1103 (T.T.A.B. 2016) (citing,e.g. , Truescents LLC v. Ride Skin

Care, LLC, 81 U.S.P.Q.2d 1334, 1337-38 (T.T.A.B. 2006)). A party that fails to plead that the common element is distinctive fails to allege claims based on afamily of marks. Id. (“Opposers’ claim is factually deficient because Opposers have failed to plead that the common element

‘WISE’ is distinctive.”) (citing, e.g., Land-O-Nod Co. v. Paulison, 220 U.S.P.Q. 61, 65-66

(T.T.A.B. 1983); Truescents, 81 U.S.P.Q.2d at 1338 (quotingLand-O-Nod Co.)).

It is somewhat unclear what marks Opposer intends to fall within the definition of its family of marks and/or the “Karma Marks” per paragraph 9 of the Opposition. Whether or not Opposer’s claimed “family” extends beyond its “KARMA” and “MY KARMA” marks, the Opposition did not allege a common element between the marks. More importantly, the Opposition fails to allege

that any such common element is distinctive, meaning “not descriptive or highly suggestive or so commonly used in the trade that it cannot function as the distinguishing feature of any party’s mark.” Wise F&I, LLC, 120 U.S.P.Q.2d 1103 (T.T.A.B. 2016) (citing,e.g. , Truescents LLC v.

Ride Skin Care, LLC, 81 U.S.P.Q.2d 1334, 1337-38 (T.T.A.B. 2006)).

To the extent Opposer argues that the “KARMA” component of its mark is the common element, that common element is descriptive and weak, as “kar”- or “car”-ma marks immediately describe or at best suggest “car”-related goods and services. See id.; see also In Re Lc Trademarks,

Inc., 121 U.S.P.Q.2d 1197 (T.T.A.B. 2016) (rejecting family of mark s) (citing In re Abcor Dev.

Corp., 588 F.2d 811, 200 U.S.P.Q. 215, 217 (C.C.P.A. 1978) (“The major reasons for not protecting [descriptive] marks are: (1) to prevent the owner of a mark from inhibiting competition in the sale of particular goods; and (2) to maintain freedom of the public to use the language involved, thus avoiding the possibility of harassing infringement suits by the registrant against others who use the mark when advertising or describing their own products.”) (citation omitted)).

Opposer’s Karma Marks also exist within a crowded field of third party use and registration of “CARMA” and “KARMA” marks used for car-related goods and services, as shown in the evidence submitted herewith. Williams Decl., ¶¶ 2-5, Exs. 1-14. This crowded field of third party use and registration shows the term “CARMA” or “KARMA” to be “commonly used in the trade,” and so not able to function as a distinguishing feature. Wise F&I, LLC, 120 U.S.P.Q.2d 1103

(T.T.A.B. 2016) (citing, e.g., Truescents LLC v. Ride Skin Care, LLC, 81 U.S.P.Q.2d 1334, 1337-

38 (T.T.A.B. 2006)); see also 2 MCCARTHY ON TRADEMARKS AND UNFAIR COMPETITION (5th ed.),

§§ 11.85 (discussing “Crowded trademark markets”) and § 11.68 ( discussing the “Competitors’ need test”) (“If the message conveyed by the mark about the goo ds or services is so direct and

clear that competing sellers would be likely to need to use the term in describing their goods in

advertising and promotion, then this indicates that the mark is descriptive.”).

In short, Oppoer fails to plead a non-descriptive, common characteristic among the Karma

Marks that can function as the distinguishing feature of that family. For this reason, too, the claims

of confusion with the Karma Marks fail, and the Opposition must be dismissed.

B. The Opposition Fails To Plead that the Karma Marks Have Been Advertised

In a Manner To Create Recognition of Any Common Characteristic.

The third element required to rely on a family of marks is that prior to the defendant’s use,

“plaintiff’s marks have been used and advertised in promotional material or in everyday sales

activities in such a manner as to create common exposure and thereafter recognition among the

purchasing public such that the common characteristic is itself indicative of a common origin of

the goods or services.” Wise F&I, LLC et al. v. Allstate Insurance Co., 120 U.S.P.Q.2d 1103

(T.T.A.B. 2016) (citing, e.g., Truescents LLC v. Ride Skin Care, LLC, 81 U.S.P.Q.2d 1334, 1337-

38 (T.T.A.B. 2006)). The existence of a family of marks requires that the public associate not only the individual marks, but the common feature of the family of marks with “the trademark owner.”

J & J Snack Foods Corp. v. McDonald’s Corp., 18 U.S.P.Q.2d 1889, 1891 (Fed. Cir. 1991). The marks must create recognition of “common ownership based upon a feature common to each mark.” American Standard Inc. v. Scott & Fetzer Co., 200 U.S.P.Q. 457, 461-62 (T.T.A.B. 1978); see also McDonald’s Corp. v. McBagel’s Inc., 1 U.S.P.Q.2d 1761, 1763 (S.D.N.Y. 1986).

The statements in the Opposition regarding the Karma Marks and their recognition are nothing more than conclusory statements. See Ashcroft v. Iqbal, 556 U.S. 662, 678 (2009);see also (1 TTABVUE, Opposition, e.g., ¶ 13: “Opposer has engaged in extensive advertising and promotion of the Karma Marks in connection with the Karma Goods and Services and, as a result,

the Karma Marks have become identified with and are widely recognized as representing the goods

and services of Opposer among the relevant trade and consumers.”). These conclusory statements

are not plausible and should not be accepted, including because the scope of the “Karma Marks”

and/or Opposer’s “family of marks” is not clear. More importantly, even taking Opposer’s

assertions regarding its marks as true, such allegations do not establish that these marks constitute

a family. Mere ownership of a number of marks having a common feature does not establish that

the registrant can rely on a “family of marks”; as such, mere ownership of a number of marks lacking any common feature is all the more unavailing. Burroughs Wellcome & Company (U.S.A.)

Inc. v. Mezger Pharmacal Company, Inc., 108 U.S.P.Q. 130, 131 (C.C.P.A. 1955); Lauritzen &

Company, Inc. v. The Borden Company, 112 U.S.P.Q. 60, 61 (C.C.P.A. 1956). Nor does the alleged fact that the marks have been used in the marketplacen andi of itself establish that Opposer is entitled to such relief as may be afforded under the theoryof “family of marks”. The Creamette

Company v. Porter-Scarpelli Macaroni Co., 128 U.S.P.Q. 130, 131 (T.T.A.B. 1961).

Instead, Opposer must allege that its marks have a recognizable common characteristic, wherein the marks are composed and used in such a way that the public associates not only the individual marks, but the common characteristic of the family, with Opposer as the trademark owner. J & J Snack Foods Corp. v. McDonald’s Corp., 18 U.S.P.Q.2d 1889, 1891 (Fed. Cir.

1991). The common characteristic must be distinctive, not descriptive or highlysuggestive or so commonly used in the trade that it cannot function as the distinguishing feature of any party’s mark. American Standard Inc. v. Scott & Fetzer Co., 200 U.S.P.Q. 457, 461-62 (T.T.A.B. 1978).

Here, Opposer fails to plead that it has advertised all of the Karma Marks in a manner leading to recognition of any common characteristic as indicative of source. Opposer has not made any allegations regarding the distinctiveness of a common feature or consumer recognition of that

feature as indicating a common owner. For this reason, too, the claims of confusion with the

Karma Marks fail, and the Opposition must be dismissed.

IV. CONCLUSION

Opposer claims it owns a “family of marks” including KARMA and MY KARMA

(potentially among other marks), without stating the further necessary allegations to support the distinctiveness or recognition of any such purported family. Because the Opposition fails to properly allege a family of marks, it makes no plausible claim of likelihood of confusion with the

Karma Marks and must be dismissed.

“CARMA” marks, despite the fact that most of the registrations were issued after Opposer obtained its earliest registration for KARMA on March 27, 2012 (U.S. Reg. No. 4,118,804).

4. Additionally, my review of third party websites revealed dozens of third party uses of the specific term “karma” or “carma” in relation to goods and services for cars. Specifically, I reviewed all of the websites at the following URLs incorporating “carma” or “karma” and note that this term is being used in conjunction with car-related goods and/or services:
