SOCIAL NETWORKING

POLICY:

It is the policy of the Corporation to set forth and identify the care with which the Corporation expects its Staff Members to conduct their activities relating to social networking and other public internet usage, as well as to set forth the consequences of any such activities that may, in the sole discretion of Corporation, damage the operation of the Corporation’s business or its reputation in the community.

COMMENT:

1. Purpose a. To prohibit the use of company time for social networking and other online activities; b. To reduce the risk to the operation and reputation of the Corporation through Staff Members’ activities relating to social networking and other public online activities; c. To set forth the rules and regulations for Staff Members with respect to the use of social networking and other public online activities; and d. To apprise all Staff Members of the Corporation of the consequences associated with misuse of social networking and other public online activities as they relate to the business of the Corporation. 2. Definitions a. Social networking is defined as any interaction in online communities of people. This interaction includes, but is not limited to, browsing other users’ profiles, browsing other users’ photos, reading messages sent through social networking forums and engaging in online communities’ instant messaging services, including, but not limited to, internet websites such as ®, ®, MySpace®, Flickr®, ®, Classmates.com®, LinkedIn®, Xanga® and ® , and other similar types of websites, the number and type of which is ever-growing due to the nature of the Internet. b. Social networking activities is defined as any and all use of a social networking website that is in any way publicly accessible - public accessibility is measured by the level of access of recipients, viewers, and/or other users of the social networking website or the general public, and may involve both passive and active communication depending of the individual circumstances. c. Passive communication is defined as social networking communication not directed at a specific and closed set of individual recipients, such as the posting of information to a user’s “wall” or “profile” – even if such information is only viewable by a user’s “friends” or other such designation. d. Active communication is defined as communication through a social networking website that is directed to a specific, narrow, and closed set of individual recipients, such as a private message, email, or other private communication. e. Social networking profile is defined as a specific user’s personalized Web page within a certain social networking site, usually containing personal information such as name, birthday, profile photo, interests, etc. f. Micro-blogging is defined as the practice of publishing your recent whereabouts, thoughts or activities on a social networking site for other users to see, such as the use of Twitter®, and other regular “status update” features of other social networking websites. 3. Prohibited Use a. Staff Members may not use social networking services or websites in a manner that is in any way detrimental to the operation of Corporation’s business, or that may be detrimental to the reputation of the Corporation, including, but not limited to: i. The use of social networking websites and activities during work hours, regardless as to the ownership of the device through which such social networking activities are conducted; ii. The use of social networking activities to talk about, discuss, update, comment, and/or otherwise reveal non-public information about the operation of Corporation; iii. The use of social networking activities in any way that is criminal in nature, or that violates one or more statutes, laws, and/or regulations of the Commonwealth of Pennsylvania and/or the United States; iv. The use of social networking activities that in any way subjects the Corporation to civil and/or criminal liability for such activities; v. The use of social networking activities that violate, undermine, or otherwise diminish any and all policies and/or provisions of the Corporation’s Policy Manual; vi. The use of social networking activities that in any way violates the Privacy rights of fellow Staff Members, supervisors, customers, Individuals, and Board Members of the Corporation; vii. The use of social networking activities that in any way discloses confidential business information, including, but not limited to, the identities, contracts, business relationships and arrangements of any and all entities associated with Corporation; viii. The use of social networking activities that publicly defames, defaces, criticizes, undermines, insubordinates, or is in any way personally or professionally detrimental to fellow Staff Members, supervisors, customers, Individuals, and Board Members of the Corporation; ix. The posting of pictures, videos, or other interactive or non- interactive text-based information that may reveal the identities of any Individuals served by the Corporation, or which reveal any HIPAA protected information of such Individuals or fellow Staff Members and supervisors; and x. The use of social networking activities and any associated applications that in any way endangers any Staff Members or Individuals, such as that which discloses the actual or approximate location of any group home or other facility of the Corporation. b. PRIVACY i. Staff Members should be aware that Social Networking Activities are not private by nature, and that Staff Members may not have a reasonable expectation of privacy in any such communication or activities, particularly when accessible by fellow Staff Members, supervisors, or other persons associated with the Corporation. ii. Staff Members have an obligation to report any and all social networking activities or other online communication of a Staff Member that may violate this or any other policy of the Corporation to their immediate supervisor. c. DISCIPLINE i. Because a Staff Member’s social networking activities may have a detrimental effect on the operation and reputation of the Corporation, such activities may subject that Staff Member to disciplinary action up to and including termination. ii. Upper Executive Management shall determine, at its sole discretion, whether a Staff Member’s social networking activities has or may have a detrimental effect on the operation and reputation of the Corporation.
