1 Amending Synthetic Control Act 2 3 4 Summary 5 Amends ineffective law that simply address the problem of synthetic by passing legislation to make 6 specific chemical formulations of synthetic drugs illegal. These specific chemical formulations become 7 dated quickly. This bill goes after broad base formulations that create or mimic the effect of cannabis or 8 certain controlled substances and thereby helps law enforcement to stay ahead of criminal drug activity. 9 Additionally it addresses weakness in the Analog statute that allows clever distributors to cloak products 10 with an innocuous name in order to insulate themselves by marking packages: “Not For Human 11 Consumption.” 12 13 Model Legislation 14 15 Section 1. Short Title. Amending Synthetic Drug Control 16 17 Section 2. Purpose. Adds various synthetic drug compounds including various structural classes of those 18 compounds to the list of Schedule I controlled substances. Deletes from the definition of controlled 19 substance analog the requirement that a substance must be intended for human consumption to be 20 considered an analog of a controlled substance with a chemical structure substantially similar to that of a 21 controlled substance in Schedule I or II, or that was specifically designed to produce an effect substantially 22 similar to that of a controlled substance in Schedule I or II. 23 24 Section 3. Definition. 25 (f) "Controlled Substance" means (i) a drug, substance, or 26 immediate precursor, or synthetic drug in the Schedules of 27 Article II of this Act or (ii) a drug or other substance, or 28 immediate precursor, designated as a controlled substance by 29 30 the Department through administrative rule. 506 (70) Methyl 2-(1H-indazole-3-carboxamido)- 507 3-methylbutanoate with substitution on the nitrogen 508 atom of the indazole ring by alkyl, haloalkyl, 509 alkenyl, cycloalkylmethyl, cycloalkylethyl, aryl 510 halide, alkyl aryl halide, 1-(N-methyl-2- 511 piperidinyl)methyl, or 2-(4-morpholinyl)ethyl, 512 whether or not further substituted on the indazole 513 ring to any extent: including but not limited to AMB, 514 5F-AMB. 515 (e) Unless specifically excepted or unless listed in 516 another schedule, any material, compound, mixture, or 517 preparation which contains any quantity of the following 518 substances having a depressant effect on the central nervous 519 520 system, including its salts, isomers, and salts of isomers 521 whenever the existence of such salts, isomers, and salts of 522 isomers is possible within the specific chemical designation: 523 (1) mecloqualone; 524 (2) methaqualone; and 525 (3) gamma hydroxybutyric acid. 526 (f) Unless specifically excepted or unless listed in 527 another schedule, any material, compound, mixture, or 528 preparation which contains any quantity of the following 529 substances having a effect on the central nervous 530 system, including its salts, isomers, and salts of isomers: 531 (1) ; 532 (2) N-ethylamphetamine; 533 (3) (some other names: 534 2-amino-5-phenyl-2-oxazoline; aminoxaphen; 535 4-5-dihydro-5-phenyl-2-oxazolamine) and its 536 salts, optical isomers, and salts of optical isomers; 537 (4) (some other names: 538 2-methylamino-1-phenylpropan-1-one; 539 Ephedrone; 2-(methylamino)-propiophenone; 540 alpha-(methylamino)propiophenone; N-methylcathinone; 541 methycathinone; Monomethylpropion; UR 1431) and its 542 salts, optical isomers, and salts of optical isomers; 543 (5) (some trade or other names: 544 2-aminopropiophenone; alpha-aminopropiophenone; 545 2-amino-1-phenyl-propanone; norephedrone); 546 547 (6) N,N- (also known as: 548 N,N-alpha-trimethyl-benzeneethanamine; 549 N,N-alpha-trimethylphenethylamine); 550 (7) (+ or -) cis-4-methylaminorex ((+ or -) cis- 551 4,5-dihydro-4-methyl-4-5-phenyl-2-oxazolamine); 552 (8) 3,4-Methylenedioxypyrovalerone (MDPV). 553 (g) Temporary listing of substances subject to emergency 554 scheduling. Any material, compound, mixture, or preparation 555 that contains any quantity of the following substances: 556 (1) N-[1-benzyl-4-piperidyl]-N-phenylpropanamide 557 (benzylfentanyl), its optical isomers, isomers, salts, 558 and salts of isomers; 559 (2) N-[1(2-thienyl) 560 methyl-4-piperidyl]-N-phenylpropanamide (thenylfentanyl), 561 its optical isomers, salts, and salts of isomers. 562 (h) Synthetic . Unless specifically excepted, 563 any chemical compound not including , structurally 564 derived from 2-aminopropan-1-one by substitution at the 565 1-position with either phenyl, naphthyl, or thiophene ring 566 systems, whether or not the compound is further modified in one 567 or more of the following ways: 568 (1) by substitution in the ring system to 569 any extent with alkyl, alkylenedioxy, alkoxy, 570 haloalkyl, hydroxyl, or halide substituents, whether 571 or not further substituted in the ring system 572 by one or more other univalent substituents. 573 574 Examples of this class include, but are not 575 limited to, 3,4- 576 (bk-MDA); 577 (2) by substitution at the 3-position 578 with an acyclic alkyl substituent. Examples of 579 this class include, but are not limited to, 580 2-methylamino-1-phenylbutan-1-one 581 (); or 582 (3) by substitution at the 2-amino nitrogen 583 atom with alkyl, dialkyl, benzyl, or methoxybenzyl 584 groups, or by inclusion of the 2-amino nitrogen atom 585 in a cyclic structure. A violation of this Act with 598 respect to each of the controlled substances listed herein 599 constitutes a single and separate violation of this Act. For 600 purposes of this Section, "controlled substance analog" or 601 "analog" means a substance which is intended for human 602 consumption, other than a controlled substance, that has a 603 chemical structure substantially similar to that of a 604 controlled substance in Schedule I or II, or that was 605 specifically designed to produce an effect substantially 606 similar to that of a controlled substance in Schedule I or II. 607 Examples of chemical classes in which controlled substance 608 analogs are found include, but are not limited to, the 609 following: , N-substituted piperidines, 610 morphinans, ecgonines, quinazolinones, substituted indoles, 611 and arylcycloalkylamines. For purposes of this Act, a 612 controlled substance analog shall be treated in the same manner 613 as the controlled substance to which it is substantially 614 similar. 615 616 Sec. 402 (Regarding Possession of Controlled Synthetic Drugs). 617 Except as otherwise authorized by this Act, it is 618 unlawful for any person knowingly to possess a controlled or 619 counterfeit substance or controlled substance analog. A 620 violation of this Act with respect to each of the controlled 621 substances listed herein constitutes a single and separate 622 violation of this Act. For purposes of this Section, 623 "controlled substance analog" or "analog" means a substance 624 which is intended for human consumption, other than a 625 controlled substance, that has a chemical structure 626 substantially similar to that of a controlled substance in 627 Schedule I or II, or that was specifically designed to produce 628 629 an effect substantially similar to that of a controlled 630 substance in Schedule I or II. Examples of chemical classes in 631 which controlled substance analogs are found include, but are 632 not limited to, the following: phenethylamines, N-substituted 633 piperidines, morphinans, ecgonines, quinazolinones, 634 substituted indoles, and arylcycloalkylamines. For purposes of 635 this Act, a controlled substance analog shall be treated in the 636 same manner as the controlled substance to which it is 637 substantially similar. 638 639 Section 5.
