Approve a CAMS proposal to American Honda Foundation’s STEM/STEAM Pipeline Collaborative: Changing STEM/STEAM Outcomes for Young Men of Color Initiative. The proposal includes three major outcomes: (1) Increase the frequency of work based learning (WBL) opportunities at grades 9-12 so that all students have work based learning experiences that are building in complexity over the four years; (2) Recruit and maintain an active advisory board that meets regularly to operationalize the WBL activities in support of the pathway themes; (3) Create and implement a formalized process to regularly gather input from industry and postsecondary partners regarding the quality of student WBL experiences, labor market trends, and additional WBL opportunities. The proposal seeks $50,000.

3. APPROVE MIGRANT EDUCATION SERVICE AGREEMENT

Approve LBUSD’s District Service Agreement for the Migrant Education Program for 2017-18. The Migrant Education Program (MEP) is a federally funded program and is authorized by Part C of Title I. MEP is designed to support high quality and comprehensive educational programs for migrant children to help reduce the educational disruption and other problems that result from repeated moves. The proposal’s budget is $ 281,700, which includes interventions during the regular school year and summer school, activities for school readiness, parent involvement, identification and recruitment, parent advisory council, and other education, health, nutrition and social services.

CONSIDER ADOPTION OF RESOLUTION DENYING ROBERT BOOKER- LONG BEACH CHARTER PETITION

BACKGROUND:

Sections 47600 through 47616.7 of the California Education Code provide for the establishment of charter schools and further provide that petitions for charter schools are to demonstrate certain specific elements in order to be approved.

The governing board of the Long Beach Unified School District received a proposal for establishment of a charter school for Robert Booker- Long Beach at its regularly scheduled Board Meeting on April 5, 2017. In accordance with Education Code 47605, a public hearing was conducted on May 3, 2017 for the purpose of considering the level of support for the charter petition by teachers employed by the district, other employees of the district, parents, and community members.

Pursuant to Education Code section 47605(b), the governing board of a school district shall not deny a petition for the establishment of a charter school unless it is not satisfied that granting the charter is consistent with sound educational practice and it makes written factual findings, specific to the particular petition, setting forth specific facts to support one or more of the following findings: -The charter school presents an unsound educational program for the pupils to be enrolled in the charter school. -The petitioners are demonstrably unlikely to successfully implement the program set forth in the petition. -The petition does not include the required number of signatures. -The petition does not contain required affirmations. -The petition does not contain reasonably comprehensive descriptions of required elements. -The petition does not contain a declaration of whether or not the charter school shall be deemed the exclusive public employer of the employees of the charter school.

District staff has been given the responsibility of providing the Superintendent a recommendation regarding the charter proposal. Staff has been carefully and thoroughly reviewing the charter proposal. The proposal has been assessed against the standards and requirements, as set forth in the Education Code, in order to develop final recommendations.

District staff has noted a number of issues and concerns. Several of the most significant of the concerns noted are included as proposed findings in Resolution No.051717-D. The specific factual findings in the recommended Resolution are within the following statutory findings for denial of the Charter:

The petitioners are demonstrably unlikely to successfully implement the program set forth in the Petition. [Education Code Section 47605(b)(2)]

The Petition does not contain reasonably comprehensive descriptions of all of the elements required by law. [Education Code Section 47605(b)(5)]

The Charter does not contain the required number of signatures. [Education Code Section 47605(b)(3)]

The Petition presents an unsound educational program for the pupils to be enrolled in the Charter School. [Education Code Section 47605(b)(1)]

The Petition does not contain an affirmation of each of the conditions described in Education Code Section 47605(d). [Education Code Section 47605(b)(4)]

RECOMMENDATION:

The Superintendent of the Long Beach Unified School District recommends that the Board of Education adopt Resolution 051717-D, which denies the Robert Booker-Long Beach charter petition, based on findings enumerated in said Resolution.

TALB informed the District on April 7, 2017 that their membership had ratified the Tentative Agreements providing for the modification of the K-12 and CDC/Head Start contracts through June 30, 2018.

Ratification resulted in revisions to the K-12 and CDC/Head Start bargaining unit contracts, including a 2% increase in all salary schedules for bargaining unit members and a one-time “off schedule” 1 percent increase, retroactive to July 1, 2016. The tentative agreement makes some adjustments to language in the contract categories of health and welfare plans, adjunct duties, replacement services during conference periods, electronic grading and communication, class size and staffing ratios, evaluation procedures, Head Start days and hours, and Educare job specifications.

In compliance with collective bargaining agreement public disclosure requirements of Government Code, Section 3547.5, the “Public Disclosure of Collective Bargaining Agreement” forms for TALB K-12 Unit and CDC/Head Start Unit have been displayed for public review since April 14, 2017. CSEA informed the District on May 1, 2017 that their membership had ratified the Tentative Agreements providing for the modification of the Units A and B contracts through October 31, 2018. Ratification resulted in revisions to the California School Employees Association Long Beach Chapter #2, Units A and B contracts, including a 2 percent ongoing salary increase and one-time “off schedule” 1 percent increase. Lactation Accommodation

The Governing Board recognizes the immediate and long-term health advantages of breastfeeding for infants and mothers and desires to provide a supportive environment for any district employee to express milk for her infant child upon her return to work following the birth of the child. The Board prohibits discrimination, harassment, and/or retaliation against any district employee who chooses to express breast milk for her infant child while at work.

The district shall provide a reasonable amount of break time to accommodate an employee each time she has a need to express breast milk for her infant child. (Labor Code 1030) To the extent possible, such break time shall run concurrently with the break time already provided to the employee. Any additional break time used by a non-exempt employee for this purpose shall be unpaid. (Labor Code 1030; 29 USC 207) The employee shall be provided a private location, other than a restroom, which is in close proximity to her work area and meets the requirements of Labor Code 1031 and 29 USC 207, as applicable.

Employees are encouraged to notify their supervisor or other appropriate personnel in advance of their intent to make use of the accommodations offered for employees who are nursing mothers. As needed, the supervisor shall work with the employee to address arrangements and scheduling in order to ensure that the employees' essential job duties are covered during the break time.

Lactation accommodations may be denied only in limited circumstances in accordance with law. (Labor Code 1032; 29 USC 207)

Before an employee's supervisor makes a determination to deny lactation accommodations, he/she shall consult the Superintendent or designee. In any case in which lactation accommodations are denied, the Superintendent or designee shall document the options that were considered and the reasons for denying the accommodations.

BACKGROUND:

Pursuant to Request for Qualifications (RFQ) #1617/01, staff has compiled and is requesting that the Board approve a pool of Pre-Qualified Geotechnical Engineering Consultants to provide services for various bond program facilities improvement projects. This list will supersede the former pre-qualified list established by Request for Qualifications #1011/03.

Geotechnical Engineering Consulting Services includes the review of existing geotechnical data, site investigation, gathering samples, laboratory testing, data analysis, special inspections, and development of the Geo-Hazards and Geotechnical Investigation Reports as required by the California Geologic Survey and the Division of the State Architect.

The Geotechnical Engineering Consulting Services RFQ was advertised on the Press Telegram, posted on the Long Beach Unified School District website and posted on the California Coalition for Adequate School Housing website. Transmittals and the RFQ document were sent via electronic mail to notify each firm that is on the existing pre-qualified list.

The District received a total of nineteen (19) Statements of Qualifications (SOQ’s). Each SOQ was reviewed and evaluated based on the selection criteria included in the RFQ. The evaluation team selected eight (8) firms for the Pre-Qualified List for Geotechnical Engineering Consulting Services. Two (2) of the eight (8) firms are located in Long Beach and Signal Hill. The inclusion of these two firms fulfills the District’s Local Hire Procedure to provide economic opportunities and support local businesses in cities of Long Beach, Lakewood, Signal Hill and Avalon.

While a pre-qualified list is not required, in the event State funding becomes available this will allow the District to qualify for those funds. A pre-qualified list allows staff to expeditiously select, via a Request for Proposal process, from a highly qualified list of consultants when services are required.

RECOMMENDATION:

Recommend approval of Pre-Qualified Geotechnical Engineering Consultants.

Pursuant to Request for Qualifications (RFQ) #1617, staff has compiled and is requesting that the Board approve a pre-qualified pool of Lease Leaseback (LLB) Preliminary and Construction Services firms to provide construction services for various bond program facilities improvement projects. This list will supersede the former pre-qualified list established by Request for Qualifications #1011/25K.

LLB Preliminary and Construction Services includes general construction activities and coordination during the preconstruction, pre-bid, bidding, construction and project completion phases of capital improvement projects working with the project team to ensure budgets are maintained and schedules are met.

The LLB Preliminary and Construction Services RFQ was advertised in the Press Telegram, posted on the Long Beach Unified School District website, posted on the California Coalition for Adequate School Housing website and two trade journals. The RFQ document was sent via electronic mail to notify each firm that on the existing pre-qualified list and all firms on the interested vendor database.

The District received a total of fifteen (15) Statements of Qualifications (SOQ’s). Each SOQ was reviewed and evaluated based on the selection criteria included in the RFQ, adopted by the Board per Resolution No. 030117-B Procedures for Evaluating Qualifications of Lease Leaseback Contractors. The evaluation team selected the seven (7) most qualified firms for the Pre-Qualified List for Preliminary and Construction (Lease Leaseback) Services.

A pre-qualified list allows staff to expeditiously select, via a Request for Proposal process, the most qualified firm to construct future projects on the district’s bond program. Individual contracts will be brought to the Board for approval for each project.

RECOMMENDATION: Recommend approval of Pre-Qualified Lease Leaseback Preliminary and Construction Services Firms.

Whereas, Jon Meyer is a member of the Board of Education of the Long Beach Unified School District; and,

Whereas, Jon Meyer was unable to attend the Board meeting of May 3, 2017, due to illness as referenced in Education Code Section 35120,

BACKGROUND:

Since 2001, the District has participated in the California Statewide Delinquent Tax Finance Authority (JPA) for disposition of its receivables related to delinquent property taxes. Under this JPA structure, the District, when financially beneficial, has sold or transferred its rights to general purpose (1% ad valorem) delinquent property taxes to the JPA. The District has received annually an amount equal to the full amount of its share of property tax delinquencies and a premium. The premium amount received for the last sale in December 2016 was 10% or $77,350.

If approved, the attached Resolution assigns the delinquent tax receivables to the JPA for fiscal years through June 30, 2019.

A RESOLUTION OF THE GOVERNING BOARD OF THE LONG BEACH UNIFIED SCHOOL DISTRICT APPROVING ASSIGNMENT OF DELINQUENT TAX RECEIVABLES TO THE CALIFORNIA STATEWIDE DELINQUENT TAX FINANCE AUTHORITY FOR FISCAL YEARS ENDING JUNE 30, 2017, 2018 AND 2019, AND AUTHORIZING EXECUTION AND DELIVERY OF RELATED DOCUMENTS AND ACTIONS

WHEREAS, under Section 6516.6(b) of the Government Code of the State of California (the “Law”), a school district, community college district or other local educational agency is authorized to sell and assign to a joint powers authority any or all of its right, title, and interest in and to the enforcement and collection of delinquent and uncollected property taxes, assessments, and other receivables that have been levied by it or on its behalf for collection on the secured, unsecured, or supplemental property tax rolls, in accordance with such terms and conditions as are set forth in an agreement with the joint powers authority; and

WHEREAS, the California Statewide Delinquent Tax Finance Authority (the “Authority”) has been formed as a joint powers authority for the purpose of purchasing delinquent ad valorem property taxes in accordance with Section 6516.6 of the Law upon terms and conditions which are acceptable to local educational agencies in Los Angeles County; and

WHEREAS, under the Law the amount of property tax receipts to be reported in a fiscal year for revenue limit purposes is equal to 100% of the local educational agency’s allocable share of the taxes distributed to it for the fiscal year, and any additional amounts will not be reported and will be provided directly to the local educational agency; and

WHEREAS, the Board has previously adopted its resolutions approving the participation by the Long Beach Unified School District (the “District”) in the delinquent tax finance program of the Authority with respect to prior fiscal years; and

WHEREAS, the Authority has requested the District to consider selling it certain delinquent tax receivables arising with respect to the fiscal years ending June 30 in each of the years 2017, 2018 and 2019 (collectively, the “Tax Receivables”), at a purchase price which is at least equal to 110.0% of the amount of Tax Receivables; and

WHEREAS, in order to provide funding for the purchase of the Tax Receivables, the Authority has made arrangements to issue and sell a certificate of participation for each fiscal year to a designee of Tower Capital Management, LLC, a Delaware limited liability company; and

WHEREAS, the Governing Board of the District (the “Board”) wishes to take its action at this time approving the sale of the Tax Receivables to the Authority, and approving related documents and actions;

NOW, THEREFORE, BE IT RESOLVED by the Governing Board of the Long Beach Unified School District as follows:

Section 1. Sale of Tax Receivables to Authority. The Board hereby approves and authorizes the sale of the Tax Receivables to the Authority, at a purchase price at least equal to 110.0% of the amount of Tax Receivables.

Section 2. Approval of Purchase and Sale Agreements. The sale of Tax Receivables shall be accomplished under a Purchase and Sale Agreement (the “Purchase and Sale Agreement”) between the District and the Authority, in substantially the form executed by the District in connection with previous sales of tax receivables to the Authority.

The Purchase and Sale Agreement is hereby approved in substantially the form on file with the Clerk of the Board, together with any changes therein or modifications thereof approved by the Superintendent (or other chief executive officer) or the Chief Business and Financial Officer of the District (each, an “Authorized Officer”). The Authorized Officer is authorized and directed to execute and deliver each such Purchase and Sale Agreement on behalf of the District, and the execution and delivery of each such Purchase and Sale Agreement by the Authorized Officer shall be conclusive evidence of the approval of any such changes and modifications. The Board hereby authorizes the delivery and performance of the Purchase and Sale Agreements.

Section 3. Official Actions. The Authorized Officer and any and all other officers of the District are hereby authorized and directed, for and in the name and on behalf of the District, to do any and all things and take any and all actions, including execution and delivery of any and all assignments, certificates, requisitions, agreements, notices, consents, instruments of conveyance, warrants and other documents, which they, or any of them, may deem necessary or advisable in order to consummate the sale of the Tax Receivables to the Authority and the other transactions described herein. Whenever in this resolution any officer of the District is authorized to execute or countersign any document or take any action, such execution, countersigning or action may be taken on behalf of such officer by any person designated by such officer to act on his or her behalf in the case such officer is absent or unavailable.

Section 4. Effective Date. This resolution shall take effect from and after the date of approval and adoption thereof.
