MOTION TO APPROVE an Interlocal Agreement between the Palm Beach TPA and Palm Beach County for Disposition of the TPA Fund Balance and to Authorize Execution by the TPA Chair The attached Interlocal Agreement between the Palm Beach TPA and Palm Beach County compels the County to disburse $100,000 to the TPA and to retain the remaining $320,086 to offset annual County operation and maintenance costs for SR 80 street lighting in Western Palm Beach County. 3. INFORMATION ITEMS A. Federal Update TPA consultants will provide an update regarding Surface Transportation reauthorization (FY 22-26), FY 22 Appropriations, Member Designated Projects, Community Project Funding, and other federal transportation funding opportunities. The draft presentation is attached. B. FY 22-26 Draft Transportation Improvement Program (TIP) The TIP is developed in collaboration with the Florida Department of Transportation (FDOT) and various local agencies and includes transportation projects funded by federal, state and local sources for all modes of transportation. The program reflects revenue expectations for the next five fiscal years and shows phases and funding sources by year for each project. The draft executive summary for the FY 22-26 TIP is attached. The full TIP document and appendices can be viewed at PalmBeachTPA.org/TIP. C. Review of Pedestrian and Bicycle Fatalities for January - March 2021 The TPA Board directed staff to present a map of fatal pedestrian and bicycle crashes on a quarterly basis and to conduct a cursory analysis of each crash to identify potential causes and countermeasures to prevent reoccurrence. TPA staff will present the attached preliminary draft. TPA staff will work with roadway owners, signal maintaining agencies, and law enforcement to review and refine the observations and potential actions. TPA Board input is requested to refine this process. D. Partner Agency Updates Agency staff from Palm Tran, SFRTA/Tri-Rail, FDOT and/or Palm Beach County Engineering may provide brief updates on items relevant to the TPA. 4. ADMINISTRATIVE ITEMS A. Roll Call The recording secretary called the roll. A quorum was present in-person as depicted in the table below.

Modifications to the Agenda The Recording Secretary stated pursuant to state law, a quorum of the Board must be physically present at the advertised meeting site in order to conduct the meeting and take action as a body. However, the Florida Attorney General has previously opined that so long as a quorum is physically present at the meeting site, additional members may participate remotely provided they have a “significant circumstance” that justifies their absence, with significant circumstance being reasonably determined by the physically present members. The Recording Secretary noted Councilmember Reed had car problems and requested to participate remotely. There were no objections to allowing Councilmember Reed to join the meeting virtually. 1.D. General Public Comments Mr. Richard Stowe, Lake Worth Beach resident, provided a virtual public comment attached hereto as Exhibit B.

VICE CHAIR WEINROTH instructed TPA staff to distribute the public comment via e-mail to the Board members following the meeting. A brief member discussion ensued on the public comment. Commissioner Joseph Peduzzi joined the meeting in-person. 1.E. Comments from the Chair and Member Comments VICE CHAIR WEINROTH welcomed Council Member Yvette Drucker from the City of Boca Raton and Commissioner Christopher McVoy from the City of Lake Worth Beach as the new representatives for their respective cities. COMMISSIONER MARINO noted the Board of County Commissioners sent a letter to the Florida Department of Transportation (FDOT) in support of a Tri-Rail planning study to add a stop at the VA Hospital. She noted if FDOT was not in support of this project that she would request the TPA to provide the necessary funding, which should not exceed $250K. COMMISSIONER MCVOY introduced himself and provided summary of professional background. He stated interest in pedestrian/bicycle safety and desire for a study for mini roundabouts and traffic calming on A1A. Also stated his concern with the I-95 Diverging Diamond Interchange and how it will affect foot traffic. COUNCIL MEMBER DRUCKER introduced herself as new member. VICE CHAIR WEINROTH stated the TPA has opportunities when there are resurfacing projects and expressed concerns with A1A and recent accident that resulted in a fatality. He noted the previous meeting’s discussion on a transportation surtax and need for a workshop or conversation to discuss need and next steps. COUNCIL MEMBER THOMSON highlighted safety concerns and a recent Boca Raton crash and talked about a constraint with sea grapes. COUNCIL MEMBER KURETSKI highlighted how A1A was reconfigured in Jupiter, constraints with sea grapes and safety for pedestrians/bicyclists. 1.F. Executive Director’s Report MR. NICK UHREN provided an update on the City of West Palm Beach v. TPA lawsuit and reviewed the Executive Director’s Report that can be viewed at www.PalmBeachTPA.org/Board under “Presentations.” There were no public comments on this item. A Board discussion ensued on Member Designated Project requirements for Surface Transportation authorization, the new RAISE grant and how that impacts TPA projects/funding and what opportunities are available to local projects, and municipal interest in bikeshare. COMMISSIONER SACHS requested consideration of a RAISE grant application for continuous bike lanes and enhanced safety along the entirety of A1A in Palm Beach County. Commissioner Katherine Waldron left the meeting at 9:49 a.m.

2. ACTION ITEMS 2.A. ADOPTED: Resolution approving Amendment #4 to Fiscal Year (FY) 21-25 Transportation Improvement Program (TIP) JASON PRICE, TPA TIP Coordinator, provided a PowerPoint which can be viewed at www.PalmBeachTPA.org/Board under “Presentations.” This presentation indicated the TIP is the five-year funding program for transportation projects in Palm Beach County. Amendment #4 includes modifications to the FY 21-25 TIP as summarized below. • FDOT has requested approval of additional design funds and an increase in project length for I-95 at Lantana Road (FM# 4132581) to support construction as a Diverging Diamond Interchange and include a new connecting roadway under the railroad overpass; • FDOT has requested approval of additional construction funds and an increase in project length for US-27 at CR-827 & Okeelanta Road Intersections (FM# 4399301) to offset increased earthwork cost and accommodate longer auxiliary lanes at intersections; and • The City of Delray Beach has requested cancellation of $860K of TPA-provided funds to purchase trolleys. As these funds have already been flexed to the Federal Transit Administration, this amendment repurposes the funding to the highest transit priority on the TPA’s Local Initiatives List, the Tri-Rail Northern Layover Maintenance Facility (FM# 4297671). There were no public comments received on this item. A Board member discussion ensued on clarification on trolley funds and interest in using electric/autonomous vehicles in West Palm Beach. TPA staff noted that the Resolution included language that “this amendment does not affect or re-adopt any other provision of the TIP.” MOTION to ADOPT a Resolution approving Amendment #4 to FY 21-25 TIP made by Commissioner Marino, seconded by Councilman Napoleone, and carried unanimously 18-0 as depicted in the table below.

DISCUSSED: Florida East Coast Railway (FEC) Quiet Zone Update KIM DELANEY, Treasure Coast Regional Planning Council Director of Strategic Development & Policy, provided a PowerPoint which can be viewed at www.PalmBeachTPA.org/Board under “Presentations.” She reviewed the timeline and safety criteria needed to create Quiet Zones along the FEC from West Palm Beach to Tequesta as part of Brightline Phase II for nearby residents in lieu of train horns sounding when approaching crossings. Implementation of additional safety measures for pedestrian and bicycle traffic was also included. There were no public comments received on this item.

A Board member discussion ensued on train safety concerns, concerns with posted signage for mph/speed hazards, utilizing a RAISE grant for additional gates, and West Palm Beach’s appreciation of Quiet Zones and safety measures implemented and additional items desired. 3.B. DISCUSSED: 561 Plan Overview JAMES RINEHART, TPA Transit Coordinator, provided a PowerPoint which can be viewed at www.PalmBeachTPA.org/Board under “Presentations.” He discussed next steps for the 2045 Long Range Transportation Plan (LRTP) 561 Plan, consisting of five (5) north/south and six (6) west/east corridors identified to create one (1) connected multimodal transportation network. He also reviewed the 2045 Regional Transportation Plan status, US-1 Corridor Study projects, FEC Railway activities, and the Okeechobee Boulevard and State Road (SR) 7 Study timeline. Commissioner Mack Bernard and Councilman Michael Napoleone left the meeting. There were no public comments received on this item. A Board member discussion ensued on the 561 Plan not including the US-1 corridor in Jupiter, and the need to consider first-last mile connections. Commissioner Maria Marino and Shelly Petrolia, Mayor Joel Flores, and Council Member Joni Brinkman left the meeting. 3.C. Partner Agency Updates VICE CHAIR WEINROTH requested an update from Clinton Forbes on legislation Senate Bill (SB) 1014 impacts to Palm Tran. CLINTON FORBES, Palm Tran Executive Director, mentioned SB1014 may have impact on federal funding and unions. COMMISSIONER SACHS expressed the importance on receiving federal funding information and directed staff to provide this to the TPA Board members via e-mail following the meeting. A brief member discussion ensued on SB1014 and impacts to funding. MOTION to draft letter to send to legislation opposing SB1014 made by Commissioner Weiss, seconded by Mayor Grant, and carried unanimously 12-0 as depicted in the table below. An attached letter by Michael Wallwork, a former FDOT District 4 PE, offers detail on the mini-roundabout design.

Fiscal Year 2024 resurfacing project boundaries are from 10th Ave S to 6th Ave N. South of Lake Ave. mini-roundabouts should be considered for 1st, 2nd, 4th, 6th, 8th and 10th Ave S intersections. Mini-roundabouts are not suitable on the Lake and Lucerne one-way couplet. North of Lake Avenue to 5th Ave N, State Road 5 includes a third 12-foot turning lane. North of the 2nd Ave N traffic signal, the middle lane is also utilized by more aggressive drivers as a passing lane. Two rules apply to vehicular drivers utilizing mini- roundabouts: yield to vehicles in the roundabout and with the exception of large trucks, such as SU-30 and WB-50's, always turn right. The latter rule renders the left hand turn lane useless. Installing a medium with native shade trees in between mini-roundabouts in place of the left hand turn lane would be an ideal enhancement. This enhancement would also apply for a stretch of Federal Hwy in College Park south of the C-51 Canal bridge. A resurfacing project is scheduled for the section of Federal Hwy from 6th Ave N to Arlington Ave in West Palm Beach for F/Y 2025 and there is strong support for mini- roundabouts in this section of Federal Hwy.

Upon approving such a design, support also exists to determine if lowering speed limit to 25 miles per hour where it is currently 35 miles per hour is warranted within the project area.

To enable the FDOT to carry out a study to evaluate the suitability of the above traffic calming, safety improvements, we request that the Transporation Planning Agency identify and secure such funding

Resume and Personal Information

I have been a resident of south Florida since 1979 along with my wife of 42 years and now two grown children. Since 1980 I have been a general contractor, now on the verge of retirement. Most of my career was spent building commercial office spaces and the odd building or two. My focus was primarily constructing medical and surgical spaces.

For the past 20+ years I spent much of my off hours riding road bikes in Palm Beach and Broward counties. I have had the good fortune to have ridden in many varied areas of our country, noting differences in relationships between cyclists, motorists and city and town planners. Some areas are clearly safer than others. Some more friendly amongst these factions as well.

I am a past president of the Boca Raton Bicycle Club, now serving as vice president. It has been a rewarding experience as leading a club of some 200+ members in bicycle safety, roadway and cycling safety and charitable giving. We are a 501(C)3 organization and donate bicycles yearly to deserving elementary school children. From time to time we have met with local police and officials discussing road and cycling safety attempting to solve some of the dangerous aspects of south Florida roadways.

I have passed the initial safety course given by the League of American Bicyclists and the Ride Marshall Course administered by the Florida Bicycle Association. I’ve augmented my knowledge of road safety issues by reading such books as Traffic, by Tom Vanderbilt. In 2006 I was the lead plaintiff in Rosenzweig, et al v FDOT in an action to force the FDOT to include bike lanes in the then in progress state road A1A renovation through a roughly 20 mile stretch through Palm Beach County. While we lost on a technicality FDOT did ultimately find itself compelled to most seriously consider including bike lanes in state road renovations. I believe technically changing their “mandate” so that they “shall” rather than “will” (legalese for “most seriously”) install bike lanes as feasible.

As a cyclist, motorist and sometime pedestrian distance walker with my wife I’ve been able to view the roads and walkways from three vantage points. Well aware that south Florida has one of the highest, if not THE highest cycling mortality rates in the country I see a need to address the myriad safety issue that face us out there.

27 INTERLOCAL AGREEMENT FOR DISPOSITION OF TPA FUND BALANCE BETWEEN THE PALM BEACH TRANSPORTATION PLANNING AGENCY AND PALM BEACH COUNTY

This Interlocal Agreement is made as of this ___ day of ______, 2021, by and between the Palm Beach Metropolitan Planning Organization d/b/a the Palm Beach Transportation Planning Agency, an entity created pursuant to the provisions of Chapters 163 and 339, Florida Statutes, (hereinafter referred to as “TPA”) and Palm Beach County, a political subdivision, (hereinafter referred to as “COUNTY”).

WITNESSETH

WHEREAS, the TPA was created by and operates pursuant to Section 339.175, Florida Statutes, and the Interlocal Agreement for Creation of the Metropolitan Planning Organization, recorded on October 26, 2015, in Official Records Book 27885, Page 1538, Public Records of Palm Beach County, Florida; and

WHEREAS, the TPA operated under an agreement for staff services with the COUNTY for the period of time beginning October 1, 1985 and terminating March 31, 2013 and then under a second interlocal agreement for staff and services with the COUNTY for the period of time beginning April 1, 2013 and terminating January 31, 2020; and

WHEREAS, pursuant to the second amendment to the second interlocal agreement for staff and services, the COUNTY ceased to incorporate the TPA into its budgetary system and TPA staff ceased to be employees of the County on or around September 30, 2019; and

WHEREAS, TPA and COUNTY staff worked collaboratively to confirm a final reconciled cash balance of $420,086.00 for Fund 1360, the TPA fund while hosted by the County; and

WHEREAS, the COUNTY desires to disburse $100,000.00 of the final reconciled balance to the TPA and to retain the remaining $320,086.00; and

WHEREAS, the TPA Board, at the request of the Mayor of Belle Glade and the District 6 County Commissioner, has prioritized and endorsed the programming of $14.6M of federal transportation dollars for the installation of street lighting on the SR 80 corridor between SR 15 and CR 880 in unincorporated Palm Beach County, necessitating a commitment by the County for the continued operations and maintenance of the SR 80 street lighting; and

WHEREAS, the Florida Department of Transportation (FDOT) has estimated $315,000 as the annual cost of operations and maintenance for the SR 80 street lighting and has indicated a willingness to reimburse the COUNTY for a portion of the operations and maintenance costs incurred by the COUNTY for the SR 80 street lighting, pursuant to the terms and conditions of the 2004 State Highway Lighting, Maintenance, and Compensation agreement between FDOT and the COUNTY, as it may be amended and/or supplemented from time to time; and

WHEREAS, the TPA agrees to the County’s retention of $320,086.00 from Fund 1360 to be used to offset the COUNTY’s non-reimbursed costs for the operations and maintenance of the SR 80 street lighting, in exchange for a commitment from the County to the continued operations and maintenance of the SR 80 street lighting throughout its useful life, contingent upon annual appropriations for this purpose by the Board of County Commissioners and FDOT extending substantially similar terms and conditions to the COUNTY for the SR 80 street lighting as provided in the 2004 State Highway Lighting, Maintenance, and Compensation agreement between FDOT and the COUNTY.

28 NOW, THEREFORE, in consideration of the mutual terms, conditions, promises, covenants, and obligations set forth herein, the TPA and the COUNTY agree as follows:

Section 1. Incorporation of Facts. The recitals (“WHEREAS” clauses) set forth above, in the preamble to this Agreement, are true and correct and incorporated into and made a part of this Agreement by reference.

Section 2. Responsibilities of the COUNTY.

A. The COUNTY will disburse $100,000.00 to the TPA as its share of the final reconciled balance of Fund 1360. B. In addition to retaining $320,086.00 from the final reconciled balance of Fund 1360 as part of the COUNTY’s general fund, the COUNTY will execute an Interlocal Agreement with FDOT committing the COUNTY to continued operations and maintenance of the SR 80 street lighting throughout its useful life. C. The COUNTY’s responsibility in Section 2.B above is contingent upon annual appropriations for this purpose by the Board of County Commissioners and FDOT extending substantially similar terms and conditions to the COUNTY for the SR 80 street lighting as provided in the 2004 State Highway Lighting, Maintenance, and Compensation agreement between FDOT and the COUNTY. Section 3. Responsibilities of the TPA.

A. The TPA accepts disbursement of $100,000.00 from the COUNTY as its share of the final reconciled balance of Fund 1360. B. The TPA accepts the COUNTY’s retention of $320,086.00 from the final reconciled balance of Fund 1360 in exchange for the COUNTY’s commitment to execute an Interlocal Agreement with FDOT for the continued operations and maintenance of the SR 80 street lighting throughout its useful life, subject to the contingency expressed in Section 2.C above. C. The TPA agrees to facilitate discussions between FDOT and the COUNTY to ensure that the COUNTY is afforded substantially similar terms and conditions for the SR 80 street lighting as provided in the 2004 State Highway Lighting, Maintenance, and Compensation agreement between FDOT and the COUNTY.

Section 4. Representatives. The TPA's representative during the performance of this Agreement is its Executive Director, and the COUNTY’s representative during the performance of this Agreement is its Assistant County Administrator.

Section 5. Effective Date and Term. This Agreement shall take effect upon execution by both parties and shall remain in full force and effect until:

A. The COUNTY has made the disbursement specified in Section 2.A, and B. The COUNTY has either executed an Interlocal Agreement with FDOT as specified in Section 2.B or notified the TPA in writing that it will not execute an agreement with FDOT pursuant to the contingency clause in Section 2.C.

EXECUTIVE SUMMARY

The Transportation Improvement Program (TIP) is the five-year funding program for regionally significant transportation projects covering all modes of travel in Palm Beach County. The TIP is developed through a continuous, cooperative and comprehensive effort involving the Florida Department of Transportation (FDOT), the Board of County Commissioners, the Port of Palm Beach, South Florida Regional Transportation Authority (SFRTA) and municipalities within the County. Consultation is also carried out with the Miami-Dade TPO and Broward MPO during the TIP process. The document complies with the requirements set forth in Section 134 of Title 23, USC and 23 CFR 450.324.

The TIP identifies transportation improvements funded by federal, state and local sources. The TIP is based on the FDOT’s Fiscal Year (FY) 22-26 Work Program, and generally moves forward the projects in the timeframe from previous TIPs. Please note that the identified projects may experience unforeseen changes and the FDOT work program and TIP may be amended throughout the year.

To provide continuity and ease of use, the projects in the TIP have been aggregated by section, as shown in the graph and table below.

Time Frame This document includes a five-year implementation schedule for Fiscal Year 2022 through Fiscal Year 2026 following the federal fiscal calendar beginning October 1st and ending September 30th (i.e. Fiscal Year 2022 addresses the dates of October 1, 2021 to September 30, 2022). Projects utilizing state funds are based on a fiscal year beginning July 1st and ending June 30th.

Certification Review The Palm Beach TPA undergoes a certification review process annually with FDOT and a quadrennial review with Federal Highway Administration (FHWA) and Federal Transit Administration (FTA). The certification review process ensures the TPA is carrying out the metropolitan planning process in adherence with federal and state regulations. The last joint FHWA and FTA Certification Review was completed on October 28, 2019. The last Joint State/TPA Certification Review was completed on July 28, 2020.

Prioritization of Projects The TIP includes specific investment projects that support the TPA’s established goals in the adopted 2045 Long Range Transportation Plan (LRTP). Major projects, Local Initiatives, and Transportation Alternatives are scored based on the goals of the LRTP and prioritized for inclusion in the TIP.

40 The adopted LRTP was prepared using estimates of available revenues and project and program costs and is presumed to be cost feasible. The LRTP is referenced in local comprehensive plans and seeks consistency with these plans to the maximum extent feasible. The TPA adopted a list of Priority Projects from the LRTP in July and transmitted them to FDOT for use in preparing the tentative Work Program – these are included in Appendix B and highlighted in the summary of projects section. FDOT then develops the Draft Tentative Work Program and provides the schedule of projects for creation of the TIP. Major projects are screened through the State’s Efficient Transportation Decision Making (ETDM) review process. This review provides for an early examination of the projects, allowing for timely and effective decision making and early National Environmental Policy Act (NEPA) reviews and approvals.

The LRTP Report Card, below, provides the implementation status breakdown of cost feasible projects identified in the adopted 2045 LRTP. The table summarizes projects by category, number of projects, and their status: underway or complete, programmed through construction in the TIP, programmed but no construction programmed in TIP, and not yet programmed. Specific projects are not identified for Local Initiatives, Transportation Alternatives, and Air, Rail & Sea in the LRTP.

Appendix C provides detailed information on the schedule and outreach opportunities for the public to review the Draft FY 2022-2026 TIP. 41 PROJECT SECTIONS IN THE TIP

The projects in the TIP are presented in major categories that are explained in greater detail below.

SIS Capacity - Strategic Intermodal System projects are prioritized by FDOT to support regional mobility. State Road Modifications - The TPA Governing Board annually prioritizes major highway, transit, freight and additional projects on state roadways based on the Goals, Objectives and Values in the LRTP. Local Initiatives Program - Lower cost, non-regionally significant projects submitted to the TPA annually by local agencies and prioritized using a project scoring system based on the goals, objectives and values in the LRTP and prioritized through the TPA Governing Board. Transportation Alternatives Program - Active transportation projects submitted to the TPA annually by local agencies and prioritized through the TPA Governing Board. Other FDOT and Local Projects - These projects are advanced by agencies other than the TPA with outside discretionary funding sources (e.g. local gas taxes, local impact fees, county incentive grant funds, highway safety program funds, etc.). Major Maintenance - Projects proposed by the maintaining agencies based on the condition of the transportation infrastructure. These are larger projects representing an opportunity to enhance existing facilities through scope modifications or additions. O&M - Roadways - Operations and maintenance projects proposed by the maintaining agencies based on the condition of the transportation infrastructure and the need to operate it efficiently. O&M – Transit - Projects proposed by the transit agencies to continue to operate existing services. Airports, Railroads and Seaports - Projects identified by facility owner/operators consistent with their respective master plans.

FEDERAL PERFORMANCE MEASURES

Performance measures provide is a strategic approach to connect investment and policy decisions to achieve the goals adopted in the TPA’s Long Range Transportation Plan (LRTP). The TPA’s aim is to provide measures that use data-driven, quantitative criteria to set and analyze achievable targets. Using a performance-based method ensures the most efficient investment of federal transportation funds by increasing accountability, transparency, and providing for better investment decisions that focus on key outcomes. The TPA is required to adopt targets for established federal performance measures based on national goals enacted by Congress in Moving Ahead for Progress in the 21st Century (MAP-21). The TPA’s adopted federal performance measures and targets are summarized in the table on the following page. Please refer to Appendix D for more information on the federal performance measures.

FUNDING SUMMARY

The TIP is financially constrained for each fiscal year. Federally funded projects identified in the TIP can be implemented using current proposed revenue sources based on the FDOT Tentative Work Program and locally dedicated transportation revenues. All Projects funded by FDOT with federal or non-federal dollars are included in a balanced 36-month forecast of cash and expenditures and a five-year finance plan supporting the FDOT Work Program. All local government projects (non-federally funded) that are included in the TIP are part of member local government’s capital improvement programs. RE: Comments on Proposed Amendments to the Manual on Uniform Traffic Control Devices (MUTCD)

Dear Secretary Buttigieg and Acting Administrator Pollack:

The Palm Beach Transportation Planning Agency (TPA) serves as the Metropolitan Planning Organization (MPO) for Palm Beach County, Florida and acts as a liaison between local communities, their citizens, and the state and federal departments of transportation. The TPA is committed to vision zero, the systematic elimination of traffic-related fatalities and serious injuries, as it collaboratively plans, prioritizes, and funds transportation projects and services.

However, the TPA’s metro area (Miami-Fort Lauderdale-West Palm Beach) is currently ranked 13th most dangerous for pedestrians in the 2021 Dangerous by Design report developed by Smart Growth America and the National Complete Streets Coalition. Additionally, the approximately 40,000 traffic deaths in the U.S. cry out for a migration away from the MUTCD’s over-emphasis on motor vehicle operations and efficiency at the expense of other modes and contexts.

This MUTCD update represents a unique opportunity for FHWA and the Biden Administration to advance equity and sustainability on a national scale while reducing traffic deaths and serious injuries. The update can and should facilitate investments in transportation projects that increase safety for all transportation system users by removing barriers and limitations due to engineering standards.

To that end, the TPA offers the following comments regarding the MUTCD update:

• Proposed Section 2.B.17 should be modified to include item D: “Manage vehicle speeds to reduce potential crash severity.” • Proposed Section 2.B.21 should be modified to include item E: “Designers of roadway modifications should establish a target speed for the design project based on road context and desired road characteristics. Existing speed distribution of free-flowing vehicles should not inform selection of a target speed or of roadway design elements. Upon construction of the roadway modification, speed limit should be selected target speed.” • Proposed Figures 4.C-5 through 4.C.8 should be revised to use 20 pedestrians per hour as the lower threshold volume to warrant installation of a traffic control signal. This would produce a more appropriate balance between pedestrian safety and motor vehicle efficiency. • Proposed Figures 4.J-1 and 4.J-2 should be revised to use 5 pedestrians per hour as the lower threshold volume to warrant installation of a pedestrian hybrid beacon. This would produce a more appropriate balance between pedestrian safety and motor vehicle efficiency. • Section 8.B.18 (TRAINS MAY EXCEED 80 MPH, sign W10-8) should be revised to instead state the maximum permitted train speed based on the class of track at the railway crossing (e.g., use “TRAINS MAY REACH 110 MPH” for Class 7 railway crossings).

• Generally, the MUTCD update should promote installation of environmentally responsible pedestrian, bicycle and transit infrastructure within urban and urbanizing contexts and reduce or eliminate barriers to implementation for associated traffic control devices to advance investment in multimodal transportation facilities within our nation’s cities. The TPA commends FHWA and the Biden Administration for providing an opportunity for comment on proposed updates to this important document. With collaboration, the MUTCD can provide clear pathways to safe, multimodal accessibility in urban settings.

Please consider the above comments along with the input from the myriad of engaged stakeholders to support cost-effective, sustainable, and equitable city street design and improve safety and accessibility for the most vulnerable users. The Palm Beach TPA stands ready to work with you.

On September 19, 2019, the TPA Board executed an Employment Agreement to engage Nick Uhren to serve as its Executive Director. Section 3.b of that agreement states:

“The TPA Chair or the Chair's designee will conduct an annual performance review and determine if a merit increase is to be granted based upon performance and considering national MPO Executive Director compensation data as well as pay for comparable community positions.”

To conduct the annual review, I have designated a five-member committee comprised of TPA Chair Fred Pinto, TPA Vice Chair Robert Weinroth, Boynton Beach Mayor Steven B. Grant, Palm Beach County Commissioner Maria Marino, and Boca Raton Council Member Andy Thomson.

Because the TPA operates on a July 1 fiscal year, the review will focus on completion of the actions identified in the TPA’s FY 21 Strategic Plan (July 1, 2020 to June 30, 2021). The committee will meet once in mid to late June to perform the review and then I will present the proposed merit increase, if any, to the TPA Board for its approval or disapproval at its July meeting.

To facilitate the review, the committee will receive the following documents: • The FY 21 strategic plan report card and annual report. • A summary of FY 21 activities performed by the TPA. • A summary table of compensation for large Florida MPO Directors.

The committee will also recommend specific updates to the TPA’s FY 22 Strategic Plan for consideration by the TPA Board at its July meeting.

Palm Beach Transportation Planning Agency (TPA) Scheduling Report Florida Department of Transportation - District 4 May 2021

The purpose of this report is to ensure stakeholders are aware of upcoming activities for each project to allow for increased input through the Design phases. The TPA has consolidated the FDOT report to allow for greater focus on TPA priorities and key scheduling activities. The full list of scheduling activities is described below; those bolded are provided on the TPA scheduling report on the following pages. Please note, the dates shown in this Report are a snapshot and dates can change frequently. Updated reports will be requested monthly from FDOT.

Scheduled Activity Description FDOT’s Office of Modal Development (OMD) notifies impacted agencies to enter comments about the project scope. The local agency can confirm Multimodal Scoping Checklist (MMSC) or discuss context class, minor comments about multimodal features. Resolution from Agency (for Off-System If an off-system project is administered by FDOT, the local agency’s governing board must pass a resolution endorsing FDOT’s delivery of the project.
