The report is based on information as of February 2017. 4 Enhancing Public Sector Performance: Malaysia’s Experience with Transforming Land Administration Foreword Franklin D. Roosevelt once said: “We think of our land and water and human resources not as static and sterile possessions, but as life-giving assets to be directed by wise provisions for future days.” Those words continue to ring true today. Land represents one of the key sources of wealth for a country with economic, social and environmental dimensions. Transparent and efficient land administration and management systems allow land assets to be maximized for economic growth, sustainable development, food security and social cohesion. Providing for secure land rights is embodied in the Constitution. Land- related investments have enabled Malaysia’s transformation over the past three decades in both the rural and urban areas. Realizing efficient delivery of land administration services is a strategic goal for Malaysia and for the Ministry of Natural Resources and Environment. Providing reliable and affordable access to information on land rights and technical cadastral aspects have allowed the land market to grow and function as an economic driver for the country. Malaysia offers lessons for other countries seeking to transform their economies using land. Coordination though the National Land Council and a strong focus on consensus have facilitated technical, legal and institutional solutions, despite the challenges that Malaysia faces with the division of responsibilities for land administration between the State and Federal level. In addition, the adoption of digital technology for land information has transformed service delivery, as evidenced in the World Bank Doing Business Rankings. Malaysia moves forward to be amongst the top countries in the world in economic development, citizen well-being, and innovation by the year 2050. The Prime Minister said recently in the Global Transformation Forum: “The National Transformation Program aims to generate benefits for all Malaysians. It is key that no Malaysian gets left behind; that the needs of all our people are met; and that all communities, whether large or small, are able to contribute to and share the wealth of the country.” In this process, a highly concerted effort between the Federal Government and the State Government is crucial to bring about a total revamp in land administration. Gone are the days when archaic statutes and intricate procedures were part-and-parcel of Malaysia’s land administration. Current land policies are dynamic and visionary, trying to take into account the needs of a globalized economy. It is an honor that the World Bank is documenting lessons from the progress Malaysia has made with reforms for land administration. I believe the experiences and solutions will be instructive for other countries facing many of the same issues. YBhg.     Governing the ungovernable: contesting and reworking REDD+ in Indonesia Abidah B. Setyowati1 Australian National University, Australia Abstract Reducing Emissions from Deforestation and Forest Degradation plus the role of conservation, sustainable forest management, and enhancement of forest carbon stocks in developing countries (REDD+) has rapidly become a dominant approach in mitigating climate change. Building on the Foucauldian governmentality literature and drawing on a case study of Ulu Masen Project in Aceh, Indonesia, this article examines the practices of subject making through which REDD+ seeks to enroll local actors, a research area that remains relatively underexplored. It interrogates the ways in which local actors react, resist or maneuver within these efforts, as they negotiate multiple subject positions. Interviews and focus group discussions combined with an analysis of documents show that the subject making processes proceed at a complex conjuncture constituted and shaped by political, economic and ecological conditions within the context of Aceh. The findings also suggest that the agency of communities in engaging, negotiating and even contesting the REDD+ initiative is closely linked to the history of their prior engagement in conservation and development initiatives. Communities are empowered by their participation in REDD+, although not always in the ways expected by project implementers and conservation and development actors. Furthermore, communities' political agency cannot be understood by simply examining their resistance toward the initiative; these communities have also been skillful in playing multiple roles and negotiating different subjectivities depending on the situations they encounter. Summary For over 30 years, Indonesia’s central government controlled its forests, the third largest area of tropical forests in the world. Driven by serious political, administrative, and economic demands for reforms, the central government has begun to decentralize, transferring new powers to the district and municipal levels. Decentralization in the forestry sector has included transferring income from permits, logging and reforestation fees, as well as the right for these lower levels of government to issue logging permits. This sudden, new access to Indonesia’s lucrative timber market has led local peoples and governments to rush to take advantage of a resource to which they previously had little right. The result has included the proliferation of permits with little regard for the effect on forest resources. Large areas, including some protected areas, are being destroyed and threatened with conversion to other uses. Local peoples, however, appear not to have been the ones receiving the primary benefits; they have been taken instead by those who have the required capital for permits and logging.

In essence, no human being has any right to rule over others. The rule and control of God is the only type of guardianship and authority that complies with human reason and intellect. Every mandate of authority and governance (hakimiyyah) for a human being requires a definitive proof. In its absence, therefore, no one has authority over another person, any other existent in the universe, or over nature, including over one’s own life and property.
