Dredging and Disposal Information

The proposal is for The Shore and Country Club, Inc. to mechanically dredge by clamshell approximately 11,680 cubic yards of material at a private marina located in Charles Creek/Norwalk Harbor at 220 Gregory Boulevard, Norwalk, CT. Maintenance dredging will be conducted to 8 feet below mean low water (mlw) with I foot of overdredging to be allowed to the contractor to ensure the full 8 feet of water depth is obtained. It is proposed to transport the dredged material by barge to either the Western (WLDS) or Central Long Island Disposal Site (CLDS) for disposal, depending on the outcome of the sediment testing. The WLDS is the preferred disposal site since it is the closest disposal site to the dredge site and therefore the most cost-effective site to dispose at. The dredge site conditions and proposed dredging area plans are attached.

Disposal Site Information

The client does not have a sufficient area of upland space needed for containing/dewatering the dredged material. There are no landfills in the area that accept dredged material. Also, there are no known upland locations in Norwalk or the surrounding communities that could accommodate the material. There is a site in North Haven, CT called Tire Pond that is looking for acceptable cover material that would close the site by May 2021. Consultation with the engineer in charge with that site indicates that additional testing would be necessary to satisfy their acceptance criteria. Also, ifwe could meet the site timing requirements which are just 4 months from now, the Shore & Country Club dredging project would need to get authorized before the end of March 2021 so the dredging can be conducted in April 2021, which is beyond the typical Oct-Jan dredge window. Even if the agencies would allow the dredging to occur during April 2021 the cost to dredge, transport the material to New Haven where the material can be offloaded and augmented by mixing in cement powder to stabilize it enough to be trucked to the Tire Pond site would cost in the range of approximately $ I 00 per cubic yard. Based on this scenario, the project would cost at least $1.17 million making it too costly to happen. Due to the lack of feasible upland disposal sites, is proposed for disposal.

Potential Contamination Sources

The marina was last permitted to be dredged in 2007. A search of the Connecticut DEEP spill records from the time the last dredging occurred to the present for the general project area was conducted and there were no reported spills during that period. There is one storm drain pipe in the vicinity of the marina which discharges surface water storm runoff from the immediate area. CENAE-R-PT 1 7 October 2007

SUBJECT: Suitability Determination for Shore and Country Club, Norwalk Harbor & Charles Creek, Norwalk, Connecticut, Application #2007-1196.

1. Project Description: The applicant is proposing to dredge an area of 85,750 sq. ft. to a depth of -8' MLW (plus 1' overdredge), which will produce approximately 14,300 cu. yds. of dredged material. This material is proposed to be mechanically dredged. The proposed disposal site is either Western Long Island Sound Disposal Site (WLIS) or Central Long Island Sound Disposal Site (CLIS).

A sampling plan for this project was prepared on 25 April 2007. The plan called for 4 cores to be taken from the project area and the samples analyzed for the usual contaminants of concern.

2. Summary: This memorandum addresses compliance with the regulatory evaluation and testing requirements of 40 CFR Section 230.60 and 230.61, subpart G under the Clean Water Act 404(b)(l) guidelines. This evaluation confirms that sufficient information was obtained to properly evaluate the suitability of this material for open water disposal under the guidelines and finds the sediments suitable for disposal as proposed.

3. Clean Water Act Regulatory Requirements: The disposal of sediments waterward of the high tide line in Long Island Sound is regulated under Section 404 of the Clean Water Act. Subpart G of the Section 404(b)(l) guidelines describes the procedures for conducting this evaluation, including any relevant testing that may be required.

§230.60 General Evaluation of Dredged or Fill Material

(a) Further testing was necessary as it could not be determined with the present information that the sediment is not a carrier of contaminants. As the sediments are mostly fines, this exclusion form further testing did not apply.

project was last dredged. There are no fuel docks or marine maintenance facilities in the club.

(c) The material to be dredged and the material at the disposal site are not adjacent, composed of the same materials or subject to the same sources of contaminants. Further testing was therefore required.

(d) This subsection states that further testing may not be necessary if the material to be dredged is constrained to reduce contamination within the disposal site and to prevent transport of contaminants beyond the boundaries of the disposal site. As such constraints in handling are not proposed, this subsection does not apply.

§230.61 Chemical, Biological and Physical Evaluation and Testing

(a) This subsection describes the purpose of §230.61 and does not give any criteria for the evaluation of sediments.

(b) Water column and benthic bioassay testing is not needed as it was determined, on the basis of evaluation of §230.61 (c), that the likelihood of contamination is low.

(c) An inventory of the total concentration of contaminants is of value in comparing sediment at the disposal and dredging sites. Four samples were analyzed for grain size, metals, PAHs, pesticides and PCBs (as congeners). The concentrations of metals were all low or below detection limits, which were acceptable, with the sole exception of copper. The copper concentration was elevated, but still "low", when compared to the classification guidelines of the "Interim Plan" ((NERBC, 1980) Copper is therefore not a concern based upon our experience. The concentrations of PAHs were all below detection limits, or lower than the means plus twice the standard deviations for the PAHs at the reference sites. The concentrations of PCBs were all below or slightly higher than the detection limits, which were acceptable. The concentrations of pesticides were all below or slightly higher than the detection limits, which were acceptable. See the attached spreadsheets for details. Based upon this information, I find the sediments suitable for disposal at either of the proposed disposal site.

CENAE and the federal agencies did not think an analysis of biological community structure was needed for this project.

(d) The physical effects of the disposal of the dredged material at the disposal site should be minimal. Although some benthic marine organisms will be buried by the disposal, the disposal site should be rapidly re-colonized.

MEMORANDUM FOR RECORD:

SUBJECT: Suitability Determination Addendum for the Shore and Country Club Inc., Norwalk, CT, NAE-2007-01196

In March of 2020 NAE prepared a suitability determination for the Shore and Country Club Inc., dredging project (NAE-2007-01196). In June of 2020 the applicant collected additional sediment samples and analyzed for chemistry (metals, PAHs, pesticides, and PCBs). This data was submitted to the Connecticut Department of Energy and Environmental Protection (CTDEEP). CTDEEP, EPA Region 1, and NAE assessed this data to further delineate the portion of the proposed dredge footprint that was previously determined to be unsuitable for open water disposal but can be disposed with a cap and the material that is also unsuitable but cannot be capped. The results of this evaluation are presented on Figure 1. This assessment was coordinated with CTDEEP and EPA Region 1.
