The 14th Annual General Assembly of the Operational Transfrontier Mission (Mission Opérationnelle Transfrontalière - MOT) was held on the 16th June 2011in Reims. It brought together all of the partners of MOT: French and neighbouring public authorities, States, cross- border cooperation structures, large private companies and various observers concerned by cross-border issues.

To date, the association counts 59 members.

Michel Delebarre thanks Jean-Paul Bachy, President of the Conseil Régional Champagne- Ardenne and Adeline Hazan, Mayor of Reims, for the warm welcome of the General Assembly of the Transfrontier Operational Mission in Reims. He also thanks the representatives of the DATAR and Caisse des Depots. He then welcomes the numerous participants that came to participate in the exchanges, and particularly, the representatives of Member States of the Platform of Budapest (Hungary, Netherlands, Portugal) and the representative of IMEG, the German network cross-border metropolitan regions. He also welcomes the presence of Dr. Hans-Günther CLEV, former DG of MOT, Jean PEYRONY that succeeds him since May 2011 and Olivier DENERT, Secretary General of MOT since January 2011.

He then emphasises his wish to consolidate MOT, to improve its quality and functioning for the benefit of a better governance of cross-border cooperation in France. He also invites MOT to continue its European opening in partnership with other countries in order to give more weight to local authorities in the European context.

He announces that MOT has 59 members in 2011. He states that MOT is engaged in a strategic partnership with DATAR which consists particularly in identifying the aspects on which MOT can meet the needs of the populations. He recalls that one should not forget that cross-border territories are territories of experimentation. He explains that MOT is working with the Ministry of Interior and the Ministry of Foreign and European Affairs on monitoring European Groupings of Territorial Cooperation (EGTC) and ongoing projects. He regrets that cooperation with the Ministry of Ecology has slowed in 2010 and recalls that MOT should work with all ministries. He hopes that the structure is embarking on an ambitious 2012-2014 programme, but also that state officials will be attentive to the evolution of MOT, consistent with the conclusions of the parliamentary report, one of which is the transformation of the MOT in Public Interest Group (GIP). He thanks the DATAR for its support in the progress of this project which he hopes will by achieved in 2012.

3. Activity Report for 2010 presented by the Director General

Jean PEYRONY gives an account of the major elements of the 2010 Activity Report of MOT. The report given to participants is exposed according to four points:

At the end of 2010, the association of the Transfrontier Operational Mission had 59 members.

Three new organisations have become full members in 2010:

‐ The Ministry of Regional Development and Public Works of Bulgaria, ‐ The Association of the Conference Atlantic Transpyrenees, ‐ The Regional Agency for Planning and Development of Guyana (ARUAG, now AUDeG).

A member suspended its membership in 2010: ACFCI

MOT has introduced a new service to its members: the "service voucher".

Communication and networking The communication tools have been renewed as MOT adopted a new logo and a new visual identity. The Members’ section on the MOT website has been completed and has been a great success.

European activities During the year 2010, MOT has strengthened its role in promoting cross-border cooperation at the European level by participating in the creation of two networks: CECICN, a network of local urban authorities, and the Platform of Budapest, a network of the support institutions for cross-border cooperation at the national level.

Operational assistance to projects MOT assisted in the establishment of EGTCs or other legal structures to facilitate cross-border cooperation. For MOT the strategic fields are: transport, mobility, employment and territorial territories.

Studies carried out in 2010 ‐ Comparative study and statistical monitoring of cross-border agglomerations, DATAR ‐ Establishment of an EEIG for the cross-border CCI Bihartean ‐ Contribution to the Handbook for cross-border cooperation in West Africa, OECD ‐ Study for the development of cross-border transportation services of regional and transnational interest between Midi-Pyrenees and the Iberian Peninsula, Conseil Régional Midi-Pyrenees. ‐ Assistance to the partner universities of the future EGTC "Euro-Mediterranean campus", University of Nice Sophia Antipolis

2010 results The year was highlighted by a better identification of members’ services, and stronger support of the Caisse des Dépôts and the partner ministries of MOT in a multi-level logic.

4. Financial report presented by the Treasurer

Marthe STEFFANN, treasurer of the association presents the accounts for the fiscal year 2010 and notes a positive result of 4056 Euros. She then proceeds to read the report of the external auditor.

The Bureau of MOT proposes to the General Assembly to allocate the surplus of the year 2010 to the balance carried forward of the association.

The 2010 Financial Report presented by Martha Steffann is unanimously approved by the General Assembly.

The Auditor's Report is adopted unanimously by the General Assembly.

The allocation of the 2010 surplus is adopted unanimously by the members of the General Assembly.

Election of the Auditor The candidature of the Cabinet Beth Doucet & Associates for the position of Alternate auditor is approved unanimously by the members of the General Assembly.

Christiane ECKERT points out that the Board of Directors is elected by the General Assembly for a period of three years renewable.

8. Presentation of the objectives for 2011 - debate and vote; presentation of the reflections of transforming MOT in Public Interest Group (GIP) by Jean PEYRONY

Objectives for 2011 Jean PEYRONY, Director General of MOT, presents the 2011 annual goals, validated by the Bureau held the same day. cf. For details, see the 2011 objectives of MOT.

Created by an Interministerial Committee for Space Planning and Development (CIADT) in 1997, the Transfrontier Operational Mission is a pioneer structure in Europe dealing with the multi-level governance involving local, regional and national levels and able to understand complex, wide- range, and cross-cutting cross-border issues at the French borders.

The associative solution implemented in 1998 helped to establish a technical team and develop expertise on cross-border cooperation recognised at the national and European level, making MOT a centre of resources and analysis, at the service of both the State and the members of its network (59 members in 2011). MOT has also established many partnerships at the European level (Council of Europe, Committee of Regions, Association of European Border Regions, etc.), and even beyond (programme of the African Union borders, etc.).

The parliamentary report of June 2010 issued by the Mission Blanc-Keller-Sanchez Schmid confirmed this vocation and identified courses of sustainable actions to strengthen the national border policy.

The interministerial work engaged as a result of this report confirmed the vocation of MOT to support various players in cross-border cooperation, particularly with respect to the observation of the evolution of cross-border territories and the training of the administration personnel. They also reiterated the need for a transformation of MOT in GIP, as originally decided by the March 1997 CIADT and as envisioned by the current Bylaws of the association (Article 2).

It seems difficult to implement these recommendations and at the same time maintaining the current legal form of MOT: the relationship between the State and MOT is currently set through grants awarded by the ministries. But the very nature of these subsidies prohibits the "funders" to be at the initiative of the actions of MOT and to directly benefit from the actions taken.

It will allow the transformation of MOT from association into GIP.

Such a transformation will have the advantage of: ‐ building capacity of MOT for monitoring and analysis of cross-border policies and projects in order to contribute to a better governance related to cross-border issues in France, ‐ clarifying the respective roles of ministries and members of the network within MOT, while maintaining its foreign members, with the exception of foreign states, and gaining national and European visibility by becoming the first structure of its kind in Europe. ‐ acquiring a GIP status with constant human and financial means, by the transfer of the technical team and its activities: cross-border expertise, website, publications, database of best practices across borders, thematic analysis, training seminars, cartographic and legal resources.

This transformation, whose principle was officially recorded at the last Board of MOT, has already received support from major funders of the MOT: DATAR and Caisse des Dépôts.
