3. Briefing from the Chair

Chair McKenzie advised that, due to March break, the deadline for nominations for the Community Recognition Awards has been extended to the end of March. Nominations should be forwarded to Maureen Strittmatter.

The Committee was advised that the Agenda Planning Committee has rescheduled the strategic priority discussion from the March Board meeting to an April meeting.

Chair McKenzie reminded trustees to complete the questionnaire regarding the scheduling of strategic priority discussions not later than 19 March 2014, if they have not already done so. She noted that, to date, only six responses have been received. This issue will be discussed at the next scheduled Agenda Planning Committee meeting on Wednesday.

Chair McKenzie advised that both the trustee member and the alternate member are unable to attend the Parent Involvement Committee meeting scheduled for Wednesday, 9 April at 6:00 p.m. and the meeting cannot proceed without a trustee present. Trustees were requested to contact Committee Coordinator Kelly Sullivan if they are able to attend the meeting. The meeting is scheduled prior to the Audit Committee meeting and dinner will be provided.

Chair McKenzie reported on a discussion held at the last Agenda Planning Committee meeting regarding the Audit Committee membership and that revisions may be required to the current policy. A further update will be provided to trustees when the

Chair Seward requested that staff email the link to the strategic priorities discussion questionnaire to trustees prior to the next meeting of the Agenda Planning Committee.

4. Briefing from the Director

Director Adams advised that a memorandum was issued to trustees on 7 March 2014 providing an update on the changes to the specialized class placement process that is scheduled to begin in January 2015. These changes are in response to concerns raised by the Special Education Policy Ad Hoc Committee, the Special Education Advisory Committee and trustees. Any questions should be directed to Superintendent Jill Bennett.

With reference to agenda item 6 regarding the introduction of Early French Immersion at W.E. Gowling Public School, Director Adams drew attention to a memorandum dated 17 March 2014 that provides an update on the responses received to date.

5. Delegations

a. Danielle Aubin

Danielle Aubin expressed her support for the proposal to introduce Early French Immersion (EFI) at W.E. Gowling Public School. She also noted her concern over the potential separation of siblings as a result of boundary changes contained in the proposed plan. For example, Ms Aubin submitted that older siblings have the option of remaining at Agincourt Public School for EFI while younger siblings, who would be registering for junior kindergarten in 2015-2016, would be directed to W.E. Gowling Public School for EFI. Ms Aubin queried the policy objectives that were considered and requested that the Board ensure that each family has the option of choosing which school is best for them and not force additional transitions or splitting families between schools.

Trustee Fisher, noting that the consultation process has been fast-tracked to this point, queried whether there were other parents with similar concerns. Ms. Aubin noted that the potential for grandfathering siblings was a common issue raised at the consultation and during her informal survey of parents of students in junior kindergarten.

Report 15, Committee of the Whole - 3 - 18 March 2014 (Public) b. Andrea Faulkner and Marilee Pregitzer, Parents for Early French Immersion (EFI) at W.E. Gowling Public School

Speaking on behalf of many parents and students residing in the Carlington community, Andrea Faulkner and Marilee Pregitzer expressed their support for the staff recommendation to establish EFI at W.E. Gowling Public School commencing in September 2014. The presenters noted that a school council survey at W.E. Gowling in November 2013 indicated that of the 47 families who were surveyed, 33 responded that they would enrol their child in EFI if offered in September 2014. JK parents who were previously surveyed were contacted to verify that they would still enrol their children in EFI and 20 responded that they would register their child in EFI. The delegation expressed hope that the Board would support the proposal.

c. Ryan Gideon

Ryan Gideon informed the Committee that he resides close to W.E. Gowling Public School and is a parent of two students currently attending and wishing to remain at Agincourt Public School for EFI, and a third child who would be directed to W.E. Gowling Public School for EFI in the future. He noted the potential difficulties he would have in arranging transportation and meeting his children after school if they are directed to different schools. Mr. Gideon advised that his family purchased a home in the area with the understanding that all of their children would be directed to Agincourt Public School.

Trustee McKenize asked if the provision of school bus transportation to Agincourt Public School would be a factor when selecting schools. Mr. Gideon reiterated the difficulties he would encounter when meeting his children after school if they are directed to different schools.

6. Matters for Action:

a. Report 14-045, Introduction of a New Early French Immersion (EFI) Program at W.E. Gowling Public School for September 2014

Your Committee had before it Report 14-045 seeking approval for the introduction of a new Early French Immersion (EFI) program at W.E. Gowling Public School for September 2014 and associated attendance boundary changes.

Manager Carty Ostafichuk introduced the report and advised that, although the consultation took place within a short timeframe, the information provided was detailed and concise and the meeting was well attended. In consideration of the input received at the consultation, the proposal was revised

Report 15, Committee of the Whole - 4 - 18 March 2014 (Public) to direct all EFI students residing in the Central Park area to Agincourt Public School and move to J.H. Putman Public School for grades 7-8. Students attending W.E. Gowling Public School for EFI would move to Fisher Park Public School for grades 7-8, and EFI students attending Sir Winston Churchill Public School would remain there for grades 7-8.

Regarding the concerns raised during the consultation with respect to siblings, the proposal provides a one-time option for children who would have been directed to Agincourt Public School to choose either Agincourt or W.E. Gowling for EFI. Manager Carty Ostafichuk advised that the number of people moving in and out of the area, the number of years that would be impacted, and the requirement for a sufficient number of students at W.E. Gowling to ensure the program grows and is viable makes it difficult to quantify grandfathering for siblings. In addition, grandfathering siblings would require doubling bus runs for several years.

Moved by Trustee Seward, A. THAT a new JK-6 Early French Immersion (EFI) program be introduced at W.E. Gowling Public School for September 2014 beginning with Senior Kindergarten and adding one grade per year thereafter;

B. THAT Board approve a new EFI attendance boundary for W.E. Gowling Public School and revised EFI attendance boundaries for Agincourt Public School, Fisher Park Public School, J.H. Putman Public School and Sir Winston Churchill Public School as shown in Appendix A, effective September 2014;

C. THAT Board approve revised English program attendance boundaries for Agincourt Public School, Fisher Park Public School, J.H. Putman Public School and W.E. Gowling Public School as shown in Appendix A, effective September 2014;

D. THAT existing 2013-2014 SK-5 students currently attending Agincourt Public School for EFI residing within the new W.E. Gowling Public School EFI attendance boundary remain at Agincourt Public School and feed to J.H. Putman Public School for grades 6 to 8;

Trustee Seward noted that the option of introducing EFI at the under- utilized W.E. Gowling Public School was raised by staff approximately 20 months ago during the near west accommodation review as one potential solution to overcrowding in the near west area. Since that time, parents in the Carlington area have mobilized the community to support the proposal. The public consultation meeting was well-attended by parents from the Carlington, Carleton Heights and W.E. Gowling school communities. With respect to the issue of whether to grandfather siblings, approximately 90 percent of sibling issues would be solved by providing a one-time choice of schools to parents in September 2014. Trustee Seward added that she has only heard from two families who were concerned about younger children who would not start school until 2015 or later and who would not have the option to attend Agincourt Public School with their older siblings.

Speaking in support for the principle of the motion, Trustee FitzGerald expressed concern for parents of students at Agincourt Public School who were surprised by the proposal as they did not participate in the near west accommodation review and have not had an opportunity to plan ahead for child care. Trustee FitzGerald proposed the following amendment and noted that it would grandfather younger siblings for three years.

An amendment moved by Trustee FitzGerald, THAT siblings of 2014-2015 Agincourt Public School students born as of December 31, 2013 be given a one-time option to attend Agincourt Public School.

In response to queries, staff advised that if the amendment is carried, and based on anecdotal information derived from typical yield from census data, approximately 7 students per year from W.E. Gowling EFI would have the option to attend Agincourt, three students from Carleton Heights would have the option to attend Sir Winston Churchill and one student from Central Park East would have the option to attend W.E. Gowling. This would leave five to six students at W.E. Gowling each year and overcrowding at Agincourt would not decrease as quickly.

During discussion of the amendment, the following points were noted:  Extending the one-time option for three years could require two additional buses per year at a cost of $40,000 per bus for a total of $240,000 over three years;  The amendment could jeopardize the viability of the EFI program at W.E. Gowling Public School or result in multi-grade classes if up to half of the future students opt to take advantage of the one-time option; and  Younger siblings that would not start school until after September 2014 may be accommodated through the transfer policy depending on family circumstances.

Trustee FitzGerald expressed the opinion that there will be significant transportation savings arising from the introduction of EFI at W.E. Gowling Public School. She noted that applying the transfer policy is not a reliable method of ensuring that younger siblings of EFI students who opt to remain at Agincourt are able to also attend Agincourt Public School, and that transfer students would not be eligible for bus transportation. Trustee FitzGerald submitted that her amendment would provide busing for younger siblings for three years at a small cost.

In response to a request from Trustees Fisher and FitzGerald, staff agreed to request detailed information from the Ottawa School Transportation Authority (OSTA) on the expected savings in transportation costs arising from the new attendance boundaries, as well as additional expenses that would be incurred if the amendment were to pass. Manager Carty Ostafichuk noted that it would not be possible to provide precise estimates on the additional expenses without knowing how many future students would take the option to attend Agincourt and where they reside.

An amendment moved by Trustee FitzGerald, THAT siblings of 2014-2015 Agincourt Public School students born as of December 31, 2013 be given a one-time option to attend Agincourt Public School.

During discussion of the main motion, the following points were noted:  The impact of directing all English program students from the Central Park area to Agincourt Public School would be minimal;  Staff may be proposing changes to the boundaries for Middle French Immersion (MFI) in Central Park in the fall to direct all students to a single school;  The proposed changes to the boundaries for the English program are a result of input received during the consultation;

Report 15, Committee of the Whole - 8 - 18 March 2014 (Public)  Trustee Campbell expressed concern that the implications for the English program were not made explicit during the consultation. He noted that he would not like to see the rapid timeline for consultation become the norm going forward;  Agincourt Public School would likely need additional portables if EFI is not introduced at W.E. Gowling;  W.E. Gowling is currently underutilized and has space to accommodate an EFI program;  Trustee Scott noted that in her zone, approximately 62 percent of senior kindergarten students are in the EFI program indicating a growth in the program and a need to adjust boundaries, as required; and  Neighbourhood schools that offer program choices strengthen the area and encourage walkability.

During her wrap up, Trustee Seward thanked the communities who were involved in this activity through their initiative, engagement and provision of input and advice, and noted that the introduction of Early French Immersion at W.E. Gowling Public School will be a great benefit for the school, including its English program and EFI students. Trustee Seward expressed the view that the motion has resulted in the strengthening of the Carlington and Central Park communities, and she encouraged those who may be negatively affected to contact her for assistance. Trustee Seward also thanked staff for their feedback and help in finding solutions to concerns raised in the consultation.

b. Referral from Committee of the Whole, 18 February 2014: Report 14-024, Base Rate Increase for Not-for-Profit Leaseholders

Your Committee had before it Report 14-024 seeking approval for escalations to the base rate charges for not-for-profit leaseholders in District facilities for the 2014-2015 school year.

Superintendent Clarke advised that it is staff’s objective to achieve full cost recovery for renting facilities to not-for-profit leaseholders. The majority of these leaseholders are childcare partners. He noted that the increased cost of utilities in the past year has exceeded the CPI increase of 1.23 percent, and staff is therefore recommending a 3 percent increase to $10.00 per square foot in 2014-2015 to cover the shortfall. This rate compares favourably to market rates for unimproved warehouse space without utilities included.

Report 15, Committee of the Whole - 11 - 18 March 2014 (Public) Moved by Trustee Campbell, THAT the base rate charge for not-for-profit leaseholders in District facilities be raised to $10.00 per square foot effective 1 September 2014.

During the ensuing discussion, the following points were noted:  The base rate is not used for community use of schools;  An extensive review of the base rate was conducted in 2010-2011 and, since that time, the rate has been increased based on the Consumer Price Index (CPI);  Utility rates have increased substantially over the past year;  Market rates include a profit component while the District’s base rate is based on cost recovery;  If the Board is contemplating a move away from cost recovery, then a strategic policy decision may be required;  The has indicated that it would agree to an increase of 1.23 percent to the funding it provides to third party daycare providers for leases. The City has not yet responded to the District’s notification that the rate may increase by 3 percent;  32 of the 38 not-for-profit leaseholders are childcare partners; and  Trustee FitzGerald expressed the opinion that daycare centres are struggling because of the loss of four-year-olds who now attend full- day kindergarten and that the District is benefiting from the extended day program. She submitted that daycare centres would need to increase their fees and that the rate should not be increased at this time.

Trustee McKenzie expressed the opinion that the base rate should be increased by the CPI this year and in future years.

Moved in amendment by Trustee McKenzie THAT the base rate be raised to $9.82 per square foot.

Trustee Campbell expressed the view that a 1.23 percent increase violates the principle of cost recovery and could be viewed as a political gesture. Trustee Kavanagh submitted that while the amendment may be symbolic it is important to support the District’s third-party daycare partners. Trustee Seward expressed her support for the amendment and disagreed that it was populist or political in nature.

Moved in amendment by Trustee McKenzie THAT the base rate be raised to $9.82 per square foot.

Report 15, Committee of the Whole - 12 - 18 March 2014 (Public) In response to queries, staff advised that there is no correlation between subsidies provided and space costs, and that an increase to the cost of facility rentals would not decrease the number of subsidized daycare spaces provided by the City of Ottawa. Subsidies are distributed across the District and not concentrated in any particular areas of the City.

Trustee Scott expressed concern for the proposed movement away from the principles of cost recovery, and that the base rate increase would be tied to the CPI which is based on items that have nothing to do with operating space.

Trustee Seward was very supportive of Trustee McKenzie’s amendment of the base rate to $9.82 as there was too large a gap between the inflation rate and the increase to $10.00 and unfair to child care partners.

Moved by Trustee Campbell, THAT the base rate charge for not-for-profit leaseholders in District facilities be raised to $9.82 per square foot effective 1 September 2014.

c. Report 14-048, Academic Staffing for 2014-2015

Your Committee had before it Report 14-048 seeking approval of proposed academic staffing levels, including principals and vice-principals, for the 2014-2015 school year.

The report indicates that, based on current enrolment projections, the total projected staffing requirement for 2014-2015 is 4,680.63 FTE, a net increase of 58.71 FTE elementary teachers, largely attributable to the final year of full-day kindergarten, and a net decrease of 10.83 FTE secondary teachers, attributable to the decline in enrolment. Proposed changes in staffing levels in areas that are subject to Board discretion include increases of 5.0 FTE ESL positions, 4.76 FTE special education positions and a net reduction of 1.0 FTE instructional coach position at the elementary level for a total increase of 8.76 FTE. At the secondary level, an increase of 2.0 FTE ESL positions, 2.67 FTE General Learn Program positions and 2.67 FTE Autism program positions are proposed for a total increase of 7.33 FTE.

Superintendent McCoy advised that an additional 0.5 FTE principal and 4.0 FTE vice-principal positions are proposed at the elementary level, while an

Report 15, Committee of the Whole - 13 - 18 March 2014 (Public) additional central vice-principal is recommended at the secondary level. Principals and vice-principals will be allocated during the staffing process in April.

Moved by Trustee McKenzie, THAT the Board approve the elementary and secondary staffing allocations for 2014-2015 as outlined in Appendices A, B, and C to Report 14-048 to Committee of the Whole, subject to changes in staffing levels that are required (increases and decreases) as a result of fluctuations in projected enrolment to meet Ministry and collective agreement requirements.

In response to a query from Trustee McKenzie regarding the District’s plan to re-engage street youth, Associate Director Piovesan advised that, following discussions with the Youth Services Bureau, student counsellors at Rideau High School and Ridgemont High School would be assigned to spend two afternoons per week at a drop-in centre working with street youth. Should there be any interest in returning to school, the students would be registered at Richard Pfaff Alternate Program.

Trustee McKenzie expressed concern about taking time away from student counsellors who may have competing priorities at Rideau and Ridgemont High Schools. In her opinion, the plan could falter without a dedicated staff member to engage and build relationships with street youth.

An amendment moved by Trustee McKenzie, THAT a 0.5 full-time equivalent (FTE) secondary position be added to serve the needs of street youth.

During discussion of the amendment, the following points were noted:  Several trustees expressed concern with respect to the reallocation of duties for student counsellors at Rideau and Ridgemont High Schools;  Director Adams advised that both the Youth Services Bureau and staff are enthusiastic about the project; however staff does not support the assignment of academic staff to a program that, as yet, has no students. She noted that this is a multi-step project that would begin with establishing a relationship with the Youth Services Bureau. The Alternate Program is well suited to provide services to students at the Youth Services Bureau and, if the proposed model goes forward, staff may, at some point in the future, recommend the addition of a 0.5 FTE as part of a budget process;  Associate Director Piovesan noted that although the student counsellors are housed at Rideau and Ridgemont High Schools, they are deployed across the District. The Youth Services Bureau has child and youth workers and there is flexibility and collaboration between the parties to re-engage students emotionally and academically;

Report 15, Committee of the Whole - 14 - 18 March 2014 (Public)  Trustee Boothby noted the increase in supervised alternative learning (SAL) students at Alternate sites over the past year and the associated requirement for staff time to support these students; and  The Ministry of Education has asked school boards to increase their efforts to reengage students.

In wrap up, Trustee McKenzie expressed the view that in order to reengage street youth, the District must reach out to them during the afternoon or early evening and not wait for them to approach the OCDSB. She noted the importance of building trust and developing relationships and the need for a 0.5 FTE secondary teacher to do this work.

During discussion of the main motion, the following points were noted:  Trustee Fisher noted the importance of reinstating vice-principal positions;  Although the principal is the instructional leader in the school, the number of instructional coaches would not likely decline until student achievement and well-being data demonstrates a narrowing of gap;  In response to Trustee Kavanagh’s support for the need for instructional coaches in the arts, Superintendent Buffone advised that the arts is an area of focus and staff would consider possible reallocations of instructional coaches;  Superintendent Buffone advised that staff is also considering allocating one coach at the elementary level to healthy living to focus on ensuring that students have greater access to physical activity and fighting obesity;  OSSTF representative Dan Maxwell expressed concern about the increase of 1.0 FTE secondary vice-principal position for Business & Learning Technologies while reducing the number of guidance and learning support teachers at a time when the Board is promoting wellness and individual education plans. He submitted that the academic staffing budget should align with the Board’s strategic goals. Superintendent McCoy noted that the vice-principal position would support initiatives that are directly linked to student achievement, for example, the “bring your own device” initiative. She added that the reductions in guidance and learning support teachers are tied to the collective agreement and a decrease in enrolment;  Director Adams advised that staffing numbers for all other employee groups would be presented in the spring as part of the staff

Report 15, Committee of the Whole - 15 - 18 March 2014 (Public) recommended budget. There may be recommended increases to enhance the District’s ability to improve student well-being; and  In response to a query from SEAC representative Beth Doubt with respect to staffing for additional special education system classes under the geographic model, Superintendent McCoy advised that staff is anticipating an increase in classes and would bring forward a recommendation for additional staffing in the fall to address changes in student enrolment.

In wrap up, Trustee McKenzie expressed her appreciation for the comments made regarding the linking of the strategic plan to the budget. She also expressed the view that there is a thirst for curriculum and academic learning in the detention centre and queried whether there is any scope to improve the services provided by the District.

Moved by Trustee McKenzie, THAT the Board approve the elementary and secondary staffing allocations for 2014-2015 as outlined in Appendices B, C, and D, subject to changes in staffing levels that are required (increases and decreases) as a result of fluctuations in projected enrolment to meet Ministry and collective agreement requirements.

d. Report 14-042, Full-Day Kindergarten Capital Work Plan – Year 5 (2014- 2015) Stage 3

C. THAT a methodology be developed and implemented for the 2014-2015 academic year, to associate a category, that would be similar to or the same as Identification Placement Review Committee (IPRC) categories, for students with an IEP who have not been through the IPRC process.

Trustee FitzGerald advised that the Special Education Advisory Committee spent considerable time discussing possible ways of improving the explanation of the IEP process to parents.

Director Adams noted that, as a result of the recommendations of the Special Education Policy Ad Hoc Committee, there have been a number of

Superintendent Bennett advised that the District’s IEP review process is aligned with the Ministry review and, with respect to Parts A and B of the motion, the program evaluators have indicated that this information could be provided. With respect to Part C of the motion, it may not be possible to associate a category if the student has not had an IPRC, has not yet been diagnosed, or if the parents do not wish to have their child “labeled”.

In response to a query from Trustee Campbell regarding the purpose of collecting this information, SEAC representative Beth Doubt advised that SEAC associations wish to identify their exceptionality groupings (i.e., behaviour) in reports, for example, suspension reports, to determine which groups are most impacted.

a. Report 14-044, Play Structures and Outdoor Play Environments in Elementary Schools

Your Committee had before it Report 14-044 providing information on play structures and outdoor play environments in elementary schools.

During discussion of the report, the following points were noted:  Committee members expressed their appreciation for the report which provides options for outdoor play structures and play yards;  Director Adams noted the importance of providing this information prior to the budget process. She asked the Committee to consider the primary purpose of play structures and outdoor play environments, whether the funding should continue to be a shared responsibility of the City, the OCDSB and school councils, and if there is a need to increase the District’s cost sharing amount beyond the current $7,500;  Trustee Fisher advised that he has discussed this issue with the Ottawa-Carleton Assembly of School Councils (OCASC) and they support having a range of options from which to choose. He queried whether the District should continue to ask school councils to raise funds for play structures when they are also being asked to work on student achievement and well-being;  OCASC representative Susan Klimchuk requested that schools councils be advised as soon as possible if the District or Ministry intends to provide funding for play structures or yards as many councils are actively raising money for that purpose. She added that many other projects are put on hold for a number of years while raising funds for play structures. Ms. Klimchuk drew attention to the AODA requirement to provide accessible structures which could increase the cost by two to three times;

 Trustee Scott suggested that staff seek input from school councils through specific distribution of the report or by hosting a consultation afternoon or evening in the spring;  Trustee Holtzhauer expressed support for publicizing the report and uploading the costs of play structures to the District. She also submitted that the general community uses the play structures and the City should share the costs;  Trustee Funiciello drew attention to the significant amount of work required by school councils to raise funds and submit grant applications. She queried whether differentiated funding could be provided depending on the school’s capacity to raise funds;

Report 15, Committee of the Whole - 20 - 18 March 2014 (Public)  Trustee Kavanagh expressed the view that the City should match any funding provided by the District. She noted that many play structures cannot be used in the winter and that she would like more information on costs and how extensively naturalized and green playgrounds are used;  Trustee Campbell queried whether the District should provide funding for play structures and yards when it has dire capital and maintenance needs. He expressed support for differential funding and noted that some playgrounds are locked to the community after hours;  Trustee Boothby queried whether it would take more or less staff time to supervise a play yard rather than a play structure. She expressed support for a policy statement on funding, consulting with school councils, and soliciting funding from the City; and  Trustee Seward expressed the view that the District’s funding contribution should be increased and that consultation with school councils should be undertaken to identify their diverse needs.

Director Adams thanked the Committee for their input. She noted that this item will be brought back to the Committee at a time to be determined by the Agenda Planning Committee.

A By-law for the imposition of education development charges

BACKGROUND

WHEREAS the Education Act, R.S.O. 1990, Chapter E.2, as amended authorizes a school board to pass By-laws for the imposition of education development charges against land undergoing residential and non-residential development in the area of jurisdiction of the board where residential development in such area would increase education land costs;

AND WHEREAS the Board has determined that there is residential development in its area of jurisdiction that will increase education land costs;

AND WHEREAS the Ottawa Carleton District School Board has referred to the Ministry of Education and Training the following estimates for approval:

(1) the total number of new elementary school pupils and new secondary school pupils; and

(2) the number of elementary school sites and secondary school sites used to determine the net education land costs; and such estimates have been approved by the Ministry of Education and Training;

AND WHEREAS the Board has complied with the conditions prescribed by section 10 of Ontario Regulation 20/98;

AND WHEREAS the Board has conducted a review of its education development charge policies, given notice, and held a public meeting on 18 February, 2014, in accordance with section 257.60 and section 257.63 of the Education Act;

AND WHEREAS the Board has permitted any person who attended the public meeting to make representations in respect of the proposed education development charges.

NOW THEREFORE THE OTTAWA CARLETON DISTRICT SCHOOL BOARD HEREBY ENACTS AS FOLLOWS:

PART 1

APPLICATION

Definitions

1. The Definition and terms contained in the Act and Regulations made in accordance with the Act, as amended from time to time, shall have the same meanings in this By-law. In the event of ambiguity, the Definitions contained in this By-law shall prevail.

2. In this By-law,

(1) "Act" means the Education Act, R.S.O. 1990, c.E.2, as amended, or a successor statute;

(2) "Board" means the Ottawa Carleton District School Board ;

(3) "development" means the construction, erection or placing of one or more buildings or structures on land or the making of an addition or alteration to a building or structure that has the effect of increasing the size or usability thereof, and includes redevelopment;

(4) "dwelling unit" means a room or suite of rooms used, or designed or intended for use by one person or persons living together, in which culinary and sanitary facilities are provided for the exclusive use of such person or persons, and shall include, but is not limited to, a dwelling unit or units in an apartment, group home, mobile home, duplex, triplex, semi-detached dwelling, single detached dwelling, stacked townhouse and townhouse;

(5) "education land costs" means costs incurred or proposed to be incurred by the Board,

(i) to acquire land or an interest in land, including a leasehold interest, to be used by the Board to provide pupil accommodation;

(ii) to provide services to the land or otherwise prepare the site so that a building or buildings may be built on the land to provide pupil accommodation;

(iii) to prepare and distribute education development charge background studies as required under the Act;

(iv) as interest on money borrowed to pay for costs described in paragraphs (i) and (ii); and

(v) to undertake studies in connection with an acquisition referred to in paragraph (i).

(6) "education development charge" means development charges imposed pursuant to this By-law in accordance with the Act;

(7) “Existing Industrial Building” means a building used for or in connection with:

(a) manufacturing, producing, processing, storing or distributing something,

(b) research or development in connection with manufacturing, producing or processing something;

(c) retail sales by a manufacturer, producer or processor of something they manufactured, produced or processed, if the retails sales are at the site where the manufacturing, production or processing takes place,

(d) office or administrative purposes, if they are,

i. carried out with respect to manufacturing, producing, processing, storage or distributing of something, and

ii. in or attached to the building or structure used for that manufacturing, production, processing, storage or distribution.

(8) "farm buildings" are defined as a building or structure located on a bona fide farm which is necessary and ancillary to a bona fide farm operation including barns, tool sheds and silos and other farm related structures for such purposes as sheltering of livestock or poultry, storage of farm produce and feed, and storage of farm related machinery, and equipment but shall not include a dwelling unit or other structure used for residential accommodation or any buildings or parts thereof used for other commercial, industrial or institutional purposes qualifying as non-residential development;

(9) "gross floor area" means the total floor area, measured between the outside of exterior walls or between the outside of exterior walls and the centre line of party walls dividing the building from another building, of all floors above the average level of finished ground adjoining the building at its exterior walls and for the purpose of this definition, the non-residential portion of a mixed-use building or structure is deemed to include one-half of any area common to the residential and non-residential portions of such mixed-use building or structure;

(10) "mixed use development" means land, buildings or structures used, or designed or intended for use, for a combination of non-residential and residential uses;

(11) "non-residential development" means a development other than a residential development and includes commercial, industrial and institutional development;

(12) "residential development" means a development comprised of land or buildings or structures of any kind whatsoever, used, designed or intended to be used as living accommodations for one or more individuals and includes land or a building or part thereof used, designed or intended for a use in connection therewith.

Application of By-law and Exemptions

3. Subject to any exemption contained herein:

(1) This By-law applies to all lands located within the City of Ottawa subject to any exemption contained herein and for greater clarity, this By-law applies to all lands within the former Cities of Ottawa, Nepean, Kanata, Gloucester, Cumberland, Rockcliffe and Vanier and the former Townships of Goulbourn, Osgoode, Rideau and West Carleton, as constituted on December 31, 2000. This By-law shall apply to all categories of Residential Development and all related uses of land, buildings or structures thereof, and all categories of Non-Residential Development and all related uses of land, buildings or structures thereof.

(2) This By-law shall not apply to lands that are owned by and are used for the purpose of:

(1) a municipality;

(2) a district school board;

(3) a publicly-funded university, community college or a college of applied arts and technology established under the Ministry of Colleges and Universities Act, or a predecessor statute;

(4) Residential Development on lands designated as Farm Retirement Lots as this term is defined in the Official Plan of the City of Ottawa, as amended from time to time;

(5) a place of worship and land used in connection therewith, and every churchyard, cemetery or burying ground, if they are exempt from taxation under Section 3 of the Assessment Act, R.S.O. 1990, ChapterA.31, c.3. as amended;

(6) farm buildings as defined herein.

Development Approvals

4. In accordance with the Act and this By-law, the Board imposes an education development charge against land undergoing Residential Development, Non-Residential Development, or redevelopment in the City of Ottawa, if the Residential Development, Non-Residential Development, or redevelopment requires any one of those actions set out in sub-section 257.54(2) of the Act (or any successor provision thereto) as follows:

(1) passing of a zoning By-law or of an amendment thereto under section 34 of the Planning Act (or any successor provision thereto);

(2) the approval of a minor variance under section 45 of the Planning Act (or any successor provision thereto);

(3) a conveyance of land to which a By-law passed under subsection 50(7) of the Planning Act (or any successor provision thereto) applies;

(4) the approval of a plan of subdivision under section 51 of the Planning Act (or any successor provision thereto);

(5) a consent under section 53 of the Planning Act (or any successor provision thereto);

(6) the approval of a description pursuant to the provisions of the Condominium Act 1998 (or any successor provision thereto); or

(7) the issuing of a permit under the Building Code Act, 1992 in relation to a building or structure.

PART II

EDUCATION DEVELOPMENT CHARGES

A. Residential Education Development Charges

6. Subject to the provisions of this By-law, an education development charge of $_____ per dwelling unit shall be imposed upon all categories of residential development and all the designated residential uses of lands, buildings or structures, including a dwelling unit accessory to a non-residential use, and, in the case of a mixed-use building or structure, upon the dwelling units in the mixed-use building or structure.

Exemptions from Residential Education Development Charges

7. (1) As required by subsection 257.54(3) of the Act an education development charge shall not be imposed with respect to,

(a) the enlargement of an existing dwelling unit that does not create an additional dwelling unit; or

(b) the creation of one or two additional dwelling units as prescribed in section 3 of Ontario Regulation 20/98 as follows:-

8. Pursuant to Section 4 Ontario Regulation 20/98:

(1) Education development charges under section 6 of this By-law shall not be imposed with respect to the replacement, on the same site, of a dwelling unit that was destroyed by fire, demolition or otherwise, or that was so damaged by fire, demolition or otherwise as to render it uninhabitable.

(2) Notwithstanding section 8(1) of this By-law, education development charges shall be imposed in accordance with section 6 of this By-law if the building permit for the replacement dwelling unit is issued more than 2 years after,

(a) the date the former dwelling unit was destroyed or became uninhabitable; or

(b) if the former dwelling unit was demolished pursuant to a demolition permit issued before the former dwelling unit was destroyed or became uninhabitable, the date the demolition permit was issued.

(3) Notwithstanding section 8(1) of this By-law, education development charges shall be imposed in accordance with section 6 of this By-law against any dwelling unit or units on the same site which are in addition to the dwelling unit or units being replaced.

(4) An education development charge shall be imposed in accordance with section 6 of this By-law where a non-residential building or structure is replaced by or converted to in whole or in part, a dwelling unit or units.

B. Non-Residential Education Development Charges

9. Subject to the provisions of this By-law, an education development charge of $____ per square foot of gross floor area of non-residential development shall be imposed upon all categories of non-residential development and all non-residential uses of land, buildings or structures and, in the case of a mixed use building or structure, upon the non-residential uses in the mixed-use building or structure.

Exemptions from Non-Residential Education Development Charges

10. Notwithstanding section 9 of this By-law, education development charges shall not be imposed upon a non-residential development if the development does not have the effect of creating gross floor area of non-residential development or of increasing existing gross floor area of non-residential development.

11. (1) Education development charges under section 9 shall not be imposed with respect to the replacement, on the same site, of a non-residential building or structure that was destroyed by fire, demolition or otherwise, or that was so damaged by fire, demolition or otherwise as to render it unusable.

(2) Notwithstanding section 11(1) of this By-law, education development charges shall be imposed in accordance with section 9 of this By-law if the building permit for the replacement non-residential building or structure is issued more than 5 years after,

(1) the date the former building or structure was destroyed or became unusable; or

(2) if the former building or structure was demolished pursuant to a demolition permit issued before the former building or structure was destroyed or became unusable, the date the demolition permit was issued.

(3) Notwithstanding section 11(1) of this By-law, an education development charge shall be imposed in accordance with section 9 of this By-law against any additional

gross floor area of any non-residential development on the same site in excess of the gross floor area of the non-residential building or structure being replaced, subject to the following calculation:-

If the gross floor area of the non-residential part of the replacement building exceeds the gross floor area of the non-residential part of the building being replaced, the exemption applies with respect to the portion of the education development charge calculated in accordance with the following formula:-

Exempted portion = [GFA(old) / GFA(new)] X EDC

where,

"Exempted portion" means the portion of the education development charge that the Board is required to exempt;

"GFA (old)" means the gross floor area of the non-residential part of the building being replaced;

"GFA (new)" means the gross floor area of the non-residential part of the replacement building;

"EDC" means the education development charge that would be payable in the absence of the exemption;

(4) Education development charges shall be imposed in accordance with section 6 of this By-law if the non-residential building or structure described in section 11(1) of this By-law is replaced by or converted to, in whole or in part, a dwelling unit or units.

(5) Education development charges shall be imposed in accordance with Section 9 of this By-law where a dwelling unit or dwelling units described in section 11(1) of this By-Law, are replaced by or converted to, in whole or in part with a non- residential development or use.

12. If a development includes the enlargement of the gross floor area of an existing industrial building, the amount of the education development charge that is payable in respect of the enlargement shall be determined in accordance with the following rules:

(a) if the gross floor area is enlarged by 50 percent or less, the amount of the education development charge in respect of the enlargement is zero;

(b) if the gross floor area is enlarged by more than 50 percent the amount of the education development charge in respect of the enlargement is the amount of the education development charge that would otherwise be payable multiplied by the fraction determined as follows:

(1) determine the amount by which the enlargement exceeds 50 percent of the gross floor area before the enlargement;

(2) divide the amount determined under paragraph (i) by the amount of the enlargement.

C. Mixed Use Development

13. The education development charge to be imposed in respect of the Mixed-use development or redevelopment shall be the aggregate of the amount applicable to the residential development component and the amount applicable to the Non-Residential Development component.

14. For the purpose of calculating the education development charge to be imposed in respect of the Mixed-use development or redevelopment, the Gross Floor Area of the non- residential portion of the building shall include a proportional share of the common areas of such building.

PART III

ADMINISTRATION

Payment of Education Development Charges

15. Education development charges are payable in full to the municipality in which the development takes place on the date a building permit is issued in relation to a building or structure on land to which this education development charges By-law applies.

16. The Treasurer of the Board shall establish and maintain an education development charge reserve fund in accordance with the Act, the Regulation and this By-law.

Payment by Services

17. Pursuant to the Act, the Board may, with the consent of the Minister, accept land for pupil accommodation in place of the payment of all or a part of the education development charge. If the Board accepts land, as stated herein, the owner shall be given credit toward the education development charges imposed on the owner by the Board.

Collection of Unpaid Education Development Charges

18. Part XI of the Municipal Act 2001 applies with necessary modifications with respect to an education development charge or any part of it that remains unpaid after it is payable.

Date By-law In Force

19. This By-law shall come into force at 12:01 a.m. on April 1, 2014.

Repeal

20. By-law No. 03-2009 is repealed upon this By-law, this being By-law No. 02-2014, and coming into force at 12:01 a.m. on April 1, 2014.

Severability

21. In the event any provision, or part thereof, of this By-law is found by a court of competent jurisdiction to be ultra vires, such provision, or part thereof, shall be deemed to be severed, and the remaining portion of such provision and all other provisions of this By-law shall remain in full force and effect.

Interpretation

22. Nothing in this By-law shall be construed so as to commit or require the Board to authorize or proceed with any specific school site purchase or capital project at any time.

23. In this By-law where reference is made to a statute or a section of a statute such reference is deemed to be a reference to any successor statute or section.

Short Title

24. This By-law may be cited as the Ottawa Carleton District School Board Education Development Charges By-law No. 02-2014.
