WMFP(TV) (Fac. ID 41436) Form 2100, Schedule A - Modification of a Licensed Facility for DTV Application

DEMONSTRATION OF COMPLAINCE WITH COMMUNITY OF LICENSE COVERAGE RULES

This application proposes a channel sharing arrangement between WMFP(TV), Lawrence, Massachusetts (Fac. ID 41436) and WWDP(TV), Norwell, Massachusetts (Fac. ID 21671), whereby WMFP will broadcast using WWDP's transmission facilities.

Under Section 73.625(a) of the Commission's Rules, a full power high VHF 's DTV transmitter must provide a 43 dBu contour over the station's entire principal community to be served. As demonstrated in the attached technical statement of engineering consultant Kevin Fisher, WWDP's 43 dBu contour does not cover WMFP's principal community of Lawrence, Massachusetts. However, in the Incentive Auction Report and Order, the Commission determined that proposed sharees "may propose licensed community changes if they cannot satisfy signal coverage requirements from their new transmitter sites, provided that the new communities meet the same allotment priorities as the current ones and are located in the same Designated Market Areas." In the Matter of Expanding the Econ. & Innovation Opportunities of Spectrum Through Incentive Auctions, Report & Order, 29 FCC Rcd. 6567 1111 27,374-77 (2014). The Commission further stated that "[i)n the unlikely event that the sharee cannot identify any community that meets the same or a higher allotment priority at its new shared site, it must choose a new community of license to which it will provide the next highest priority." Id. 11376 n. 1117.

Upon commencement of channel sharing, WMFP proposes to change its community of license to Foxborough, Massachusetts. Foxborough has "a (2010) U.S. Census population of [16,875) persons, its own local government, police and fire departments and educational institutions, as well as numerous religious institutions and businesses." See In the Matter of Amendment of Section 73.622(1), Post• Tronsition Table of OTV Allotments, 26 FCC Rcd. 32 (MB 2011). Foxborough and Lawrence are both located in the , Massachusetts Designated Market Area. Moreover, as demonstrated in the attached technical statement of Kevin Fisher, WWDP's 43 dBu contour covers Foxborough in its entirety.

Finally, Foxborough meets the same allotment priority as Lawrence. The Commission's allotment priorities are to: (1) provide at least one television service to all parts ofthe country; (2) provide each community with at least one television broadcast station; (3) provide a choice of at least two television services to all parts of the country; (4) provide each community with at least two television broadcast stations; and (5) assign any remaining channels to communities based on population, geographic location, and the number of television services available to the community from stations located in other communities. Amendment of Section 3.606 of the Commission's Rules and Regulations, Sixth Report and Order, 41 FCC 148, 167 (1952). As demonstrated in the attached report from BIAjKelsey, WMFP currently provides a first local service to Lawrence, placing it in the allotment priority 2. With the proposed change, WMFP would provide a first local service to Foxborough, placing it in the same allotment priority. Accordingly, the proposed change is consistent with the Incentive Auction Rules and Section 307(b) of the Communications Act. SMITH AND FISHER

ENGINEERING STATEMENT

The engineering data contained herein have been prepared on behalf of NRJ TV

BOSTON LICENSE CO., LLC, licensee of digital full-power television station WMFP-DT,

Channel 18 in Lawrence, Massachusetts, and EVINE LIVE, INC., licensee of digital full-power television station WWDP-DT, Channel 10 in Norwell, Massachusetts, in support of its channel- sharing arrangement, whereby WWDP-DT will transmit the programming of WMFP-DT and the latter will relinquish its use of Channel 18 in the market. Both WMFP-DT and WWDP-DT operate in the Boston, Massachusetts, market or DMA.

One of the stipulations of this arrangement is that WMFP-DT be allowed to change its from Lawrence to Foxborough, Massachusetts. It is important to note that the town of Foxborough is also spelled “Foxboro” on some maps, and the names are interchangeable.

In Exhibit B, we provide a map on which we have plotted the licensed 43 dBu city- grade coverage contour of WWDP-DT. We also include on the map the location of Lawrence,

Massachusetts, the current city of license for WMFP-DT. As shown, the present WWDP-DT 43 dBu contour does not extend over the community of Lawrence.

Exhibit C is a more detailed map showing the 43 dBu contour of WWDP-DT. As shown, the newly proposed city of license, Foxborough (Foxboro), Massachusetts, is contained within this city-grade contour.
