This article aims to describe the urgency of critical studies concerning the regulation of foreign workers by exploring existing legal problems with national commitments to ratify international agreements regarding free trade, with a case study in Indonesia. By using normative and juridical approach with a variety of approaches both the law approach, conceptual approach, case approach and comparative approach, the study found that the regulation there is an inconsistency clause regarding special competencies that must be owned by foreign workers, including the selection and use of terminology in Act No. 13 of 2003 concerning Manpower. Thus, this study offers a constitutional solution due to the regulation of the subordinate foreign workers on international trade commitments which in turn negate the constitutional goals of creating the welfare of domestic workers. The normative consequences that immediately bind Indonesia after integrating itself in the World Trade Organization (WTO) membership are services trade agreements that are contained in the regulations of the General Agreement on Trade in Services (GATS).

We describe the results of our research study on availability of the open data on the example of Poland with particular emphasis on Central Repository for Public Information (CRPI). The comparison of CRPI in Poland and other countries has been discussed. The review of accessible public information has been made with particular focus on data formats. Data formats are an important aspect of open data as they facilitate or impede the reuse of data. The insights from our participant observation in the projects of computerization of public administration are also presented. Although the Open Government Data (OGD) movement can provide a number of benefits, recent study has shown that in Poland it has not achieved its full potential yet.     The Identifi cation of Customary International Law by Austrian Courts August Reinisch and Peter Bachmayer* I. Introduction Customary international law, that venerable bedrock of inter-state law, has received increased attention recently. After the International Law Associ- ation (ILA),1 the International Law Commission (ILC) included the topic ‘Formation and evidence of customary international law’ in its programme of work,2 and subsequently decided to focus on the question of the ‘Identi- fi cation of customary international law’.3 The following contribution aims at analysing how domestic courts in Austria have addressed this issue of identifying custom. Article 38 of the Statute of the International Court of Justice (ICJ) refers to customary international law as ‘evidence of a general practice accepted as law’ and lists it as one of the main sources of international law. Custom is formed by two essential elements: (1) a consistent practice of states as indicated by a state’s external behavior towards other states as well as by internal acts like domestic legislation, government memoranda or judicial decisions if they relate to the international fi eld; and (2) the belief that such a practice has a legally binding effect upon the state (opinio iuris). * August Reinisch is Professor of International and European Law at the University of Vienna and Vice-Dean of the Law School of the University of Vienna.
