Stern Abstract Navigating the Boundaries of Political Tolerance: Environmental Litigation in China by Rachel E. Stern Doctor of Philosophy in Political Science University of California, Berkeley Professor Kevin J. O’Brien, Chair This is a dissertation about lawyers, judges, international NGOs and legal action in an authoritarian state. The state is contemporary China. The type of legal action is civil environmental lawsuits, as when herdsmen from Inner Mongolia sue a local paper factory over poisoned groundwater and dead livestock or a Shandong villager demands compensation from a nearby factory for the noise that allegedly killed 26 foxes on his farm. Empirically, this is a close-to-the-ground account of everyday justice and the factors that shape it. Drawing on fifteen months of field research in China, along with in-depth exploration of four cases, legal documents, government reports, newspaper articles and blog archives, this dissertation unpacks how law as litigation works: how judges make decisions, why lawyers take cases and how international influence matters. -

The following is a re-telling of the making of that statue, originally published in the book Children of Dragon, by a sculptor named Cao Xinyuan: Nothing excites a sculptor as much as seeing a work of her own creation take shape. But although I was watching the creation of a sculpture that I had had no part in making, I nevertheless felt the same excitement. It was the "Goddess of Democracy" statue that stood for five days in Tiananmen Square. Until last year I was a graduate student at the Central Academy of Fine Arts in Beijing, where the sculpture was made. FENG Chongyi Abstract: The creation of a new administrative institution known as the "Stability Preservation Office" at the central level, which is overseen by the Chinese Communist Party (CCP) Central Committee and has branches at every local level, from streets and townships to enterprises, and has extraordinary powers to override other regular institutions and branches of government, is a clear indication that the Chinese govern- ment's efforts to preserve stabüit)' are not limited to the conventional business of crime control or public security. This paper traces the origin of the discourse and practice of preserving stability and the rights de- fence movement in China, investigating the interplay or interaction be- tween the two. It examines the end and the means of stability preserva- tion, explores whether the measures taken by the government to pre- serve stability or the rights protection actions taken by citizens are the root cause of social unrest, and whether the suppression of discontent or the improvement of human rights and social justice is the better way to achieve social stability in contemporary China. PEOPLE’S REPUBLIC OF CHINA NINE YEARS AFTER TIANANMEN - STILL A “COUNTER-REVOLUTIONARY RIOT" ? INTRODUCTION The 4th of June 1998 will mark the ninth anniversary of the massacre of hundreds of unarmed civilians in Beijing on 4 June 1989, when heavily armed troops and hundreds of armoured military vehicles stormed into the city to clear the streets of pro-democracy demonstrators, firing at onlookers and protesters in the process. In the aftermath of the massacre, thousands of people were detained throughout China. Some received long sentences and are still imprisoned. Amnesty International maintains records of over 250 people who are still imprisoned in connection with the 1989 pro-democracy protests and believes the real number is much higher than the cases it has identified. Every year, new cases of political prisoners imprisoned since 1989 have come to light. Nine years after the massacre and the massive arrests which followed, the Chinese authorities still appear unwilling to reassess the official “verdict” passed at the time that the protests were a “counter-revolutionary riot”. So far, the authorities have taken no step to publicly investigate the killings and bring to justice those found responsible for human rights violations, or to review the cases of those still imprisoned for their activities during the protests. This official “verdict” was used in 1989 to justify the brutal suppression of the protests, despite clear evidence that the seven-weeks protests, starting in mid-April 1989, were overwhelmingly peaceful and drew wide popular support. Several million people took part in the demonstrations, demanding an end to official corruption and calling for political reforms. -

The People's Republic of China (PRC) is an authoritarian state in which, as directed by the Constitution, the Chinese Communist Party (CCP or Party) is the paramount source of power. Party members hold almost all top government, police, and military positions. Ultimate authority rests with the 24-member political bureau (Politburo) of the CCP and its 9-member standing committee. Leaders made a top priority of maintaining stability and social order and were committed to perpetuating the rule of the CCP and its hierarchy. Citizens lacked both the freedom peacefully to express opposition to the Party-led political system and the right to change their national leaders or form of government. Socialism continued to provide the theoretical underpinning of national politics, but Marxist economic planning has given way to pragmatism, and economic decentralization increased the authority of local officials. The Party's authority rested primarily on the Government's ability to maintain social stability; appeals to nationalism and patriotism; Party control of personnel, media, and the security apparatus; and continued improvement in the living standards of most of the country's 1.3 billion citizens. The Constitution provides for an independent judiciary; however, in practice, the Government and the CCP, at both the central and local levels, frequently interfered in the judicial process and directed verdicts in many high-profile cases. -

We urge the latter to allow Wang Xiaoning to lead a normal life and spare him the surveillance and intimidation to which many dissidents are subjected after they leave prison. “We repeat our appeal for the release of the 67 netizens and journalists still in prison in China for their reporting activities. In particular, we would like to draw attention to the case of the dissident Chen Pingfu, whose trial is due to open on 5 September. The charges against him must be dropped and he must be released as soon as possible. “As regards the leadership of Yahoo!, it would be best if they communicated more clearly how they deal with requests from the Chinese authorities for personal data and other possible instances of collaboration with China’s censors which may not have been made public up to now. It is also vital that the company uses its influence in China to obtain the early release of the journalist and cyber dissident Shi Tao.” Wang was arrested in September 2002 and sentenced the following September to 10 years’ imprisonment and two years’ deprivation of his civil rights for “incitement to subversion”. -

International JournalRights of Defence China LawyersStudies as Dissidents in Contemporary China 325 Vol. 3, No. 3, December 2012, pp. 325-344 Rights Defence Lawyers as Dissidents in Contemporary China Feng Chongyi*, Colin Hawes** and Gu Ming*** University of Technology, Sydney Abstract Rights defence lawyers in contemporary China have attracted tremendous attention. Their supporters take them as a leading force for social and political change toward justice, the rule of law and democracy, whereas the hardliners of the ruling Chinese Communist Party regard them as a dangerous hostile force of political dissent. In this article, we will trace the resumption and development of the legal profession in China since the 1980s after its forced disappearance for three decades. Then we will explore the emergence of a group of “rights defence lawyers” in the context of recent economic, social and political changes. The article will end with a discussion about the potential role of rights defence lawyers in China’s social and political transformation. We argue that the name “rights defence lawyer” reflects the current politically charged environment for the legal profession in China and the dual identities of socially concerned lawyers as both legal professionals and rights advocates. We also argue that lawyers in China become political dissidents when defending clients whose rights are violated by the party- state and power holders, and that, in response to political persecution, rights defence lawyers have interacted with other lawyers, other rights activists and the wider society to advance their causes of bringing about justice, the rule of law and democratic political reforms in China. -

They are the practitioners of Falun Gong (or “Falun Dafa”), and at great personal risk have labored to right a tremendous wrong. Part of the Falun Gong’s effort has been to provide the outside world, on a daily basis, with priceless eyewitness accounts from inside China. These accounts tell of a suppression that permeates every facet of Chinese society. What emerges is a uniquely candid look at how the suppression of Falun Gong, as with the group’s determined resistance, impacts the Chinese people and nation, if not larger world. This edition of Compassion tells a tale at once sobering and hopeful. As the distinguished historian Ar- thur Waldron points out in his introductory essay, the campaign, for all its brutality, is failing to crush the Falun Gong. The campaign has seen new, horrific twists in recent times, however, as argued in unsettling detail by David Matas; chief among them is organ harvesting from living Falun Gong adherents. Sarah Cook sheds much-needed light, meanwhile, on the little-known entity charged with executing the nation- wide suppression—the 6-10 Office. Yet we have occasion for optimism, in spite of all this, in the movement of astounding size and vigor that has emerged in China among the Falun Gong, as described in “Righteous Resistance.” And this, de- spite enormous, yet seldom described, legal challenges set before the Falun Gong; Clive Ansley unravels for us the dubious system that is China’s courts. -

Facts: Tiananmen Square is located in the center of Beijing, the capital of China. Tiananmen means “gate of heavenly peace.” In 1989, after several weeks of demonstrations, Chinese troops entered Tiananmen Square on June 4 and fired on civilians. Estimates of the death toll range from several hundred to thousands. It has been estimated that as many as 10,000 people were arrested during and after the protests. Several dozen people have been executed for their parts in the demonstrations. Timeline: April 15, 1989 – Hu Yaobang, a former Communist Party leader, dies. Hu had worked to move China toward a more open political system and had become a symbol of democratic reform. April 18, 1989 – Thousands of mourning students march through the capital to Tiananmen Square, calling for a more democratic government. In the weeks that follow, thousands of people join the students in the square to protest against China’s Communist rulers. May 13, 1989 – More than 100 students begin a hunger strike in Tiananmen Square. The number increases to several thousand over the next few days. May 19, 1989 – A rally at Tiananmen Square draws an estimated 1.2 million people. General Secretary of the Chinese Communist Party, Zhao Ziyang, appears at the rally and pleads for an end to the demonstrations. May 19, 1989 – Premier Li Peng imposes martial law. June 1, 1989 – China halts live American news telecasts in Beijing, including CNN. -

THE LEGACY OF TIANANMEN: 20 YEARS OF OPPRESSION, ACTIVISM AND HOPE CHRD Chinese Human Rights Defenders (CHRD) Web: Hhttp://crd-net.org/H Email: [email protected] THE LEGACY OF TIANANMEN: 20 YEARS OF OPPRESSION, ACTIVISM AND HOPE Chinese Human Rights Defenders June 1, 2009 Twenty years since the Tiananmen massacre, the Chinese government refuses to accept responsibility, much less apologize or offer compensation, for killing, injuring, imprisoning and persecuting individuals for participating in peaceful protests. The number of the victims, and their names and identities, remain unknown. Families continue to be barred from publicly commemorating and seeking accountability for the death of their loved ones. Activists are persecuted and harassed for independently investigating the crackdown or for calling for a rectification of the government’s verdict on the pro‐democracy movement. Many individuals continue to suffer the consequences of participating in the pro‐democracy movement today. At least eight individuals remain imprisoned in Beijing following unfair trials in which they were convicted of committing “violent crimes”. Those who were released after long sentences have had difficulty re‐integrating into society as they suffer from continued police harassment as well as illnesses and injuries resulting from torture, beatings and mistreatment while in prison. Many of those injured have had to pay for their own medical expenses and continue to struggle as the physical and psychological scars leave them unable to take care of themselves or to work. Some who took part in the protests still find it difficult to make ends meet after they were dismissed from comfortable jobs or expelled from universities after 1989. -
