Dear Secretary Phillips,

On April 18, 2013, the New York State Public Service Commission (the “Commission”) issued to Champlain Hudson Power Express, Inc. and CHPE Properties, Inc. (together, the “Applicants”), a Certificate of Environmental Compatibility and Public Need (“Certificate”), pursuant to Article VII of the Public Service Law (“PSL”), to construct and operate an electric transmission project known as the Champlain Hudson Power Express Project (the “Project”). The Project is a buried, High Voltage, Direct Current (“HVDC”) transmission line extending approximately 330 miles from the New York/Canada border to a converter station in Astoria, Queens. On June 4, 2021, the Applicants filed a petition to amend the Certificate and hereby provide proof of service and publication as required by each section of PSL § 122.

Attached as Exhibit 1 is an affidavit of service attesting to proof of service of the Petition on each municipality in which any portion of such facility is to be located (See PSL § 122 [2][a][i]). Exhibit 1 also attests to service of the Petition on the following agencies in satisfaction of PSL § 122 (2)(a)(ii):

1. NYS Department of Environmental Conservation; 2. NYS Economic Development; 3. NYS Secretary of State; 4. NYS Department of Agriculture and Markets; and 5. NYS Office of Parks, Recreation and Historic Preservation. In satisfaction of PSL § 122 (2)(iii) and (v), Exhibit 1 also attests to service upon each member of the legislature through whose district the facility or any alternate proposed in the application would pass and the Adirondack Park Agency.

Exhibit 2 contains affidavits of publication in the following newspapers along the entire project route in satisfaction of PSL § 122 [2][b]:

1. Daily News; 2. Journal News; 3. Newsday; 4. Post Star; 5. Poughkeepsie Journal; 6. Press Republican; and 7. Times Union.

Exhibit 3 contains an affidavit of service attesting to service of notice of the Petition on each landowner of land on which any portion of the Project is to be located (See PSL § 122 [2][c]).

On April 18, 2013, the NYS Public Service Commission (Commission) issued to Champlain Hudson Power Express, Inc. (CHPE), a certificate of environmental compatibility and public need (Certificate), pursuant to Article VII of the Public Service Law (PSL), to construct and operate an electric transmission project known as the Champlain Hudson Power Express Project (Project). On or about June 4, 2021, CHPE will file an Application with the Commission to amend the Certificate. In response to recent certain New York State initiatives including the Climate Leadership and Community Protection Act, a goal of which is to increase delivery of energy from upstate renewable generators to New York City through development of new transmission, CHPE is proposing to construct an additional converter station in the Town ofNew Scotland, New York. As currently certified, the Project is an approximately 339 mile High Voltage, Direct Current("HVDC") transmission cable beginning at a converter station in Quebec, Canada, and terminating at a converter station in Astoria, Queens. The new converter station in New Scotland will provide a direct path from the Capital Region to NYC for in-state generated renewable energy. As part of the Application, CHPE will also propose to amend the Certificate to allow for an overhead connection between the Astoria converter station and the Astoria Annex GIS Substation.

As you are probably aware, on April 18, 2013, the New York State Public Service Commission (the "Commission") issued to Champlain Hudson Power Express, Inc.("CHPE"), a certificate of environmental compatibility and public need ("Certificate"), pursuant to Article VII of the Public Service Law ("PSL"), to construct and operate an electric transmission project known as the Champlain Hudson Power Express Project (the "Project").
