Minn. Stat.§ 5B.12. The Office of the Secretary of State is required to report by January 15 "the total amounts received in the preceding calendar year, the sources of those funds, and the uses to which those funds were or will be put. Any contributions from program participants must be aggregated, and the names of program participants must not be reported." Id. As required by section 5B.12, the Office of the Secretary of State reports that it did not apply for, accept, or receive any grant or individual funds authorized by section 5B.12 in calendar year 2019. Legislative Update: March 25, 2019 MN Association of Watershed Districts What happened last week (March 18-22)? • The drainage work group bill was amended in the Senate to include a 5-year sunset on the portion of the bill that included the repair cost apportionment option. • The Senate introduced their environmental policy omnibus bill (SF 835) that includes the drainage work group bill and our coordinated watershed management and carp bills. • The Clean Water Fund appropriations bill was amended in the House. Some of the changes from the Clean Water Council recommendations include: technical assistance and research funds were zeroed out for the Department of Agriculture, money for conservation drainage projects ($3M) was zeroed out, the MPCA budget for intensive monitoring was decreased by $1.2M, and the Conservation Reserve and Enhancement Program (CREP) saw a decrease of $12.5M. Increased budgets went to Forever Green ($6.7M), the Targeted Wellhead Protection Program ($5.25M), and the Drinking Water Contaminants of Emerging Concern Program ($7.542M). • The watershed planning modification bill (HF 2011) has a second hearing in the House. • Several bills for flood hazard mitigation bonding were heard in the House. What’s happening this week (March 25-29)? • The second policy committee deadline is March 29th. In order to be considered, all policy bills are supposed to be heard in both the House and Senate by this day. • The Outdoor Heritage Bill, HF340, has been added to the House Legacy Finance Division schedule for Wednesday, March 27, 2019. • The environmental policy omnibus bill (SF 835) will have a hearing in the Senate of Monday. -

STATE OF MINNESOTA Journal of the Senate NINETY-SECOND LEGISLATURE FIRST DAY St. Paul, Minnesota, Tuesday, January 5, 2021 This being the day designated by the Constitution and Laws of the State of Minnesota for the assembling of the Legislature, the Senators-elect met in the Chamber of the Capitol and were called to order at 12 o'clock noon by the Lieutenant Governor, Peggy Flanagan. Prayer was offered by the Chaplain, Pastor Mike Smith. The Lieutenant Governor and the Senators-elect gave the pledge of allegiance to the flag of the United States of America. The Lieutenant Governor appointed Mary Kiffmeyer as Clerk Pro Tem. The Clerk Pro Tem called the roll by legislative districts in numerical order, and the following Senators-elect presented proof of their eligibility to be seated as members of the Senate. AGRICULTURE Farmers with revocable trusts won’t have to file report Corporate entities that own farmland must file annual reports regarding potential land contamination. But only farmers who own agricultural land in revocable trusts of which they are beneficiaries are liable as individuals for criminal penalties under the law if they don’t file the reports. A new law will end the reporting requirement for an estimated 3,600 revocable trusts, many of whose owners may be unaware of their duty. The law, sponsored by Rep. Dennis Smith (R-Maple Grove) and Sen. Scott Newman (R-Hutchinson), adds this sentence to statute: “The trustee of a revocable trust with respect to which either the settlor, the settlor’s spouse, or both, are the primary beneficiaries during the settlor’s lifetime shall not be required to file with the commissioner a report under this section during any period that the trust is revocable.” HF22*/SF50/CH36 BUSINESS AND COMMERCE Companies can limit life insurance to beneficiaries of suspected terrorists A new law will give insurance companies the go-ahead in limiting life insurance payouts to beneficiaries of suspected terrorists. -

The attached document describes each award anticipated to be received by state agencies from the ARP and the estimated spending by fiscal year. Some of these estimates are based on formulaic estimates from Federal Funds Information for States, others are based on the agency’s analysis of the percentage of the total federal funds allocation that Minnesota received in the past. Additionally, some of the federal funds listed have legal authority to spend outside the LAC process in M.S. 3.3005. These funds are presented for information purposes. In those cases, the relevant legal citation for spending authority is provided. The federal awards included in the attached document that are subject to the LAC review process in M.S. 3.3005 will be approved for spending in 20 days unless an LAC member requests further review or provides a negative recommendation for a specific grant in writing by April 8, 2021. AGRICULTURE Omnibus agricultural policy law Sponsored by Rep. Jeanne Poppe (DFL-Austin) and Sen. Bill Weber (R-Luverne), the omnibus agriculture policy law makes a number of technical and policy changes to regulations surrounding aquaculture, pesticides, nurseries, food handlers, eggs, milk, cheese, loans, open-air swine basins and other provisions. The law includes the following changes and clarifications: • creating a custom exempt food handlers license for custom processing businesses handling meat and poultry products that are not for sale; • amending how long eggs may be held past their pack date before they must be removed from sale (31 days for Grade AA and 46 days for Grade A); • amending milk storage requirements, allowing the Department of Agriculture to waive the 72- hour time -

Nelson Chair, State Government Finance and Policy Chair, State Government Finance and and Elections Committee Elections Committee 3103 Minnesota Senate Building 585 State Office Building St. Paul, MN 55155 St. Paul, MN 55155 Re: HF1952 Omnibus State Government bill - Office of Administrative Hearings contested case language Chairs and Conferees: The Senate Version of the State Government Omnibus Bill contains a provision regarding contested case hearing disposition before the Office of Administrative Hearings that would drastically alter the way Veterans Preference Enforcement Cases are handled by the Minnesota Department of Veterans Affairs (MDVA). Currently, a Veteran who has been denied their Veterans preference rights in public employment may submit a Petition for Relief to the Commissioner of MDVA under Minn. Stat. §197.481. A Contested Case Hearing is held before an Administrative Law Judge (ALJ), who makes a recommendation to the Commissioner, who is the final decision maker. Language in HF1952, Article 2, Section 28 (see UEH1952-1, starting at line 35.28) would eliminate the key role of the Commissioner of MDVA, rendering the ALJ’s Recommendation the final decision. It is important to emphasize that the Commissioner of MDVA is not a party to these Contested Cases; they are between an individual Veteran and a public employer, such as a City, County, School District, or a State Agency. In those rare cases where a MDVA Employee is the individual submitting a Petition for Relief, the Commissioner delegates the decision to the Deputy Commissioner in another MDVA Division, who has no conflict of interest in the outcome of the case. -

INTRODUCTION 1. Former Commissioner Myron Frans violated Minnesota law when he unilaterally imposed the collective bargaining agreements (“CBAs”) negotiated between the State and public sector labor unions despite not receiving Senate approval. Commissioner Schowalter continues those illegal actions by continuing to implement the un-ratified CBAs. 2. Under Minnesota law, both houses of the legislature must approve, or ratify, any CBAs for state employees before they can formally take effect. 3. Under this process, the Legislature has the authority to accept or reject any CBA proposed by the Respondent Commissioner. Unless the Legislature formally approves a CBA, it does not take effect. If the Legislature adjourns before acting on a proposed CBA, any wages or benefit increases in that CBA “must cease to be paid.” 4.
