Ruder, Chairman of the Commission, will testify before the Subcommittee on Telecommunications and Finance of the House Energy Commerce Committee begin- ning at 9:30 a.m. Subject of the testimony is the Securities Law Enforcement Remedies Act of 1989; room will be announced. TRADING SUSPENDED IN THE SECURITIES OF SHOGUN OIL, LTD. The Commission announced the single ten-day suspension of over-the-counter trading in the securities of Shogun Oil, Ltd., a Utah corporation, for the period beginning at 9:30 a.m. (EDT) on July 10 and terminating at 11:59 p.m. (EDT) on July 19.

The Commission suspended trading in the securities of Shogun in view of questions that have been raised about the adequacy and accuracy of publicly disseminated information concerning, among other things, Shogun's financial statements, financial condition, assets, and business operations. CIVIL PROCEEDINGS

OTIS C. JOHNSON ENJOINED The Regional Office announced that on June 22 Judge Lewis T. Babcock, U.S. District Court for the District of Colorado, signed an Order of Permanent Injunc- tion and Other Equitable Relief against Otis C. Johnson. The Order enjoins Johnson from future violations of the antifraud provisions of the Securities Exchange Act of 1934. The Order directs Johnson to disgorge his profits from sales of N.D. Resources, Inc. (NOR), which disgorgement is waived based upon the truth, accuracy, and complete- ness of Johnson's sworn representations concerning his present inability to pay dis- gorgement. Johnson consented to the Order without admitting or denying the allega- tions of wrongdoing in the Complaint.

The Complaint alleges that Johnson defrauded NOR and its public shareholders by, among other things, providing NOR with a false g'eological report concerning certain mining claims and conspiring to provide positive drilling reports to the company when, in fact, no drilling had been done, and by selling approximately 240,353 shares of the company's scock while the stock price was inflated as a result of press releases concerning the drilling reports. THE BENCHMARK U.S. TREASURY FUND

An order has been issued on an application filed by The Rodney Square Benchmark U.S. Treasury Fund, The Rodney Square International securities Fund, rnc , , The Rodney Square Multi-Manager Fund, The Rodney Square Fund, The Rodney Square Tax-Exempt Fund (collectively, Funds), wilmington Trust Company, Rodney Square Management Corp., and Scudder Fund Distributors, Inc., for approval to permit exchanges of shares among the Funds. HOLDING COMPANY ACT RELEASES

GENERAL PORTFOLIOS CORPORATION

A notice has been issued giving interested persons until July 31 to request a hearing on a proposal by General Portfolios Corporation (GPC) and Energy Initiatives, Incor- porated (Ell), each a subsidiary of General Public Utilities Corporation, to extend the time to December 31, 1989 in which to, among other things, acquire through one or more Delaware limited partnerships, a 50% ownership interest, up to an aggregate amount not to exceed $11 million, in three closely held California corporations (collectively, Energy Companies), each of which is a lessee under a long-term lease of a natural gas-fired cogeneration facility which is a qualifying facility under the Public Utility Regulatory Policies Act of 1978. SElF-REauUTORY ORGANIZATIONS

TEMPORARY APPROVAL OF PROPOSED RULE CBANGE The Commission temporarily approved, under September 30, 1989, a proposed rule change filed by The Midwest Securities Trust Company. The proposal (SR-MSTC-88-8) is designed to enhance MSTC's File Transmission Service (FTS) by allowing Depository Delivery Instructions (001) to be transmitted through FTS. (ReI. 34-26995)

IMMEDIATE EFFECTIVENESS OF PROPOSED RULE CHANGE

A proposed rule change filed by The Stock Exchange has become effective under Section 19(b)(3)(A) of the Securities Exchange Act of 1934. The proposal (SR- Phlx-89-36) relates to foreign currency options trading segments for holidays and days immediately preceding holdings. (Rel. 34-26998)
