He was banned because he entered horses trained by Richie Banca and claimed he was the real trainer. As for the legislation in question, he left off two important facts which are as follows: —The legislation only applies to Vernon and Tioga and had a sunset provision; —The legislation required that I have an agreement with the horsemen’s associations at Vernon and Tioga and that the agreement contain a provision that would allow them to revoke the privilege at any time in their sole discretion with no right to appeal other than to a group of horsemen. I am attaching the applicable provision from the signed contract at Vernon where Mr. Faraldo, acting as the attorney for the Vernon Downs Horsemen’s Association, negotiated this provision. It does not seem to make sense to keep a track open that loses money if you are the only person who is not allowed to race there.
