JAEGER December 3, 2018 In accordance with Section 54-03-03 of the North Dakota Century Code, I certify the enclosed list is a true and correct record of members of the House of Representatives elected in the General Election held on November 6, 2018. The State Canvassing Board certified the results of the election on November 16, 2018. As specified in Section 16.1-15-45 of the North Dakota Century Code, Certificates of Election were then prepared by the Secretary of State and signed by the Governor, the Clerk of the Supreme Court (as the designated representative of the State Canvassing Board), and the Secretary of State. Each newly elected member of the Legislative Assembly was then issued their Certificate of Election (copies enclosed), as specified in Section 16.1-15-46 of the North Dakota Century Code. Is that your choice? Sen. Heckaman: Somewhat from other states so. I looked at retired judges, etc. that I thought would be non-partisan. L.C. looked at other states and seeing how they formed their commission. Urbans are growing and rural not. My district may be absorbed. The AML Program was established to enable the states and tribes to protect their citizens from the dangerous and costly impacts of coal mines left unreclaimed prior to SMCRA. The AML fee that funds the AML Program will expire September 30, 2021, unless Congress reauthorizes legislation to extend it. The Public Service Commission administers the Abandoned Mine Lands (AML) Program on behalf of the State of North Dakota. A federal fee on coal production funds the AML Program. Our funding has been used exclusively to reclaim high priority abandoned coal mines and our administrative costs have remained low. The federal Office of Surface Mining has consistently commended the North Dakota PSC for its efficient and effective AML Program. The attached Fact Sheet summarizes our AML program and accomplishments. Some of our most important AML work has been stabilizing undermined roads and residential areas.

Minutes: timony#1, 2 Chairman Weisz: Opened the hearing on HB 1176. Rep. Kathy Hogan: Introduced and testified in support of the bill. (See Testimony #1) 0:00:33 - 0:03:16 The same situation could be charged as a felony in one court and with a deferred sentence in another court and there are significant differences in sentencing because this becomes a lifetime ban and that is one of my concerns. Some courts and judges are significantly more aggressive than others. Because of the severity of the band the consequence of the band on SNAP and TANF is almost more debilitating than some of the sentences. I am concerned about the mythology in which the information is obtained. Currently applicants are asked to ask if they have a felony band when they apply. If they lie they can get benefits. If they tell the truth there is a lifetime band. If the system catches them then they will have a lifetime violation but because we have a significant number of people who come from other states and there is no cross reference information, the people who are really having the lifetime band are the people who are being honest. The intent of this bill is to modifythe lifetime ban to recognize that a convicted drug felon has gone at least five years without an additional felony conviction.
