    SHAW.TOPRINTER (DO NOT DELETE) 11/15/2017 3:32 AM Beyond the Bully Pulpit: Presidential Speech in the Courts Katherine Shaw* Abstract The President’s words play a unique role in American public life. No other figure speaks with the reach, range, or authority of the President. The President speaks to the entire population, about the full range of domestic and international issues we collectively confront, and on behalf of the country to the rest of the world. Speech is also a key tool of presidential governance: For at least a century, Presidents have used the bully pulpit to augment their existing constitutional and statutory authorities. But what sort of impact, if any, should presidential speech have in court, if that speech is plausibly related to the subject matter of a pending case? Curiously, neither judges nor scholars have grappled with that question in any sustained way, though citations to presidential speech appear with some frequency in judicial opinions. Some of the time, these citations are no more than passing references. Other times, presidential statements play a significant role in judicial assessments of the meaning, lawfulness, or constitutionality of either legislation or executive action. This Article is the first systematic examination of presidential speech in the courts. Drawing on a number of cases in both the Supreme Court and the lower federal courts, I first identify the primary modes of judicial reliance on presidential speech. I next ask what light the law of evidence, principles of deference, and internal executive branch dynamics can shed on judicial treatment of presidential speech.

This trend is compounded by a rise in politically slanted news alternatives. This work will seek to uncover what impact this new media environment, particularly the ability it has given people to selectively choose their news consumption, has on cross-cutting political exposure, ideology and willingness to compromise. I argue that the ability to selectively choose which news outlets and what articles a person will read will cause ideologues to choose those that seem to fit their political point of view.

This does not reflect what Occupy Wall Street looks like, but it does reflect the problem of why people don?t know. Beholden to revenue-generating forces, even well-respected news establishments aren?t above commercializing resistance or viewing current events through green-tinted lenses. With banks annoying people into becoming their customers with a deluge of well-funded advertisements about what is ?priceless? or ?what?s in your wallet,? and media outlets unafraid of losing their financial support from OWS because, frankly, there isn?t any, it?s easy to see why most people aren?t getting a fair portrayal of who the Occupiers and supporters really are. And the banks aren?t just purchasing the influence of politicians?they are purchasing influence among law enforcement. Large donations were made to NYPD, including the recent donation from J.P. Morgan of $4.6 million, have no doubt exacerbated the already aggressive posture of NYPD towards the protesters.

Dear Fellow Republicans, It is a great time to be a Republican in Cuyahoga County! 2014 was an exciting and busy year as we worked to re- elect our incumbent statewide candidates and further develop our voter engagement efforts with the creation of the Advocacy Council. While the work is constant, it builds a foundation for continued Republican success, such as the 70% of Republican endorsed candidates that were elected to local office in 2015. In 2014, Ohio Governor John Kasich won Cuyahoga County in his gubernatorial re-election; this was the first time Cuyahoga County voted Republican since Senator George Voinovich’s 2004 re-election to the U.S. Senate. Cuyahoga County was a regular campaign stop for many of our incumbent Republican officeholders, including a rally for Governor Kasich with U.S. Senator Rob Portman and New Jersey Governor Chris Christie. In the end, winning Cuyahoga County was the icing on the cake for Governor Kasich who won a historic 86 out of 88 Ohio counties.

The Rules of #MeToo Jessica A. Clarke† ABSTRACT Two revelations are central to the meaning of the #MeToo movement. First, sexual harassment and assault are ubiquitous. And second, traditional legal procedures have failed to redress these problems. In the absence of effective formal legal pro- cedures, a set of ad hoc processes have emerged for managing claims of sexual har- assment and assault against persons in high-level positions in business, media, and government. This Article sketches out the features of this informal process, in which journalists expose misconduct and employers, voters, audiences, consumers, or professional organizations are called upon to remove the accused from a position of power. Although this process exists largely in the shadow of the law, it has at- tracted criticisms in a legal register. President Trump tapped into a vein of popular backlash against the #MeToo movement in arguing that it is “a very scary time for young men in America” because “somebody could accuse you of something and you’re automatically guilty.” Yet this is not an apt characterization of #MeToo’s paradigm cases.
