APPLICANT: Mr H MacLellan

Part APPROVED and part REFUSED as set out below:

PART TO BE APPROVED: Deadwooding and removal of hanging branches from the canopy of 1 Larch of Tree Preservation Order 44/2011/

Subject to the following Conditions;

1 The deadwooding hereby permitted shall also extend to include the cleaning out of any stumps, hung up branches and climbers, the removal of sucker growth and trunk cleaning to a height of 2.5metres above ground level. All works shall be carried out by an appropriately experienced and qualified tree surgeon and so as to conform to British Standards 3998: 2010 Recommendations for Tree Works.

Reasons for Conditions:

1 In the interests of good arboricultural practice.

PART TO BE REFUSED:

Removal of limb from 1 Sycamore of Tree Preservation Order 25/2014.

Reasons for refusal:

1 The proposal to remove a limb from the sycamore tree, T1 of Tree Preservation Order 25/2014, is considered excessive and will imbalance the tree to the detriment of its natural form. The loss of the limb is unlikely to reduce honey dew deposits on the conservatory and the branch appears to be healthy and well connected to the tree. The removal of the limb would therefore conflict with the objectives of policy EQ2 of the Harrogate District Core Strategy DPD (adopted 11th February 2009).

INFORMATIVES

1. You are advised the following comments have been received from the Environment Agency:-

This site lies in Flood Zone 2 (medium probability) on our Flood Map. Our records also show that this area may have previously flooded from a river source.

Whilst we have no objection to the proposed change of use, we recommend that the developer uses this opportunity to reduce the potential impact of flooding by raising floor levels wherever possible and incorporating flood proofing and resilience measures. The design of these measures should be informed by past flooding events. Physical barriers, raised electrical fittings and special construction materials are just some of the ways to help reduce flood damage.

Guidance on how to reduce flood damage can be found at the following websites:- • Communities and Local Government: `Improving the flood performance of new buildings' - http://www.communities.gov.uk/publications/planningandbuilding/improvingflood; • Environment Agency: How to reduce flood damage - www.environment-agency.gov.uk/homeandleisure/floods/105963.aspx; • Department for Communities and Local Government: Preparing for floods - www.communities.gov.uk/publications/planningandbuilding/improvingflood; • Ciria: What to do if your property is flooded and how to minimise the damage from flooding - www.ciria.com/flooding/; • National flood forum- www.floodforum.org.uk/index.php?option=com_content&view=article&id=8&Itemid=4

To reflect the change of use, you should consider asking the developer to produce/update a flood evacuation plan. We recommend that you consult with your emergency planners to help you assess any flood evacuation plan. The Environment Agency don’t normally comment on or approve the adequacy of flood emergency response procedures accompanying development proposals, as we don’t carry out these roles during a flood. The Technical Guide to the National Planning Policy Framework (paragraph 9) also states that those proposing developments should take advice from the emergency services when producing an evacuation plan.

2. There is a history of ground instability in the area. This sometimes arises from the presence of peat, sometimes from gypsum and sometimes a combination. You are advised to satisfy yourself that there is no such problem on this site, or that any problem can be overcome by taking appropriate measures, before works commence.
