(Nasdaq: SBGI) announced today that they have reached a four-year extension to their retransmission consent agreement. The agreement, which expires on March 1, 2011, provides for the continued carriage of the analog and digital signals of 37 stations in 23 markets owned or operated by Sinclair. The agreement also provides for the carriage of digital multicast channels which Sinclair is currently broadcasting in Baltimore and Richmond, as well as certain other multicast channels which the stations located in Comcast markets may broadcast in the future. Some channels have both east and west feeds, airing the same programming with a three-hour delay on the latter feed, creating a backup for those who missed their shows. The three-hour delay also represents the time zone difference between Eastern (UTC -5/-4) and Pacific (UTC -8/-7). All channels are the East Coast feed if not specified. High definition Most high-definition (HDTV) and foreign-language channels may require a certain satellite dish or set-top box. Additionally, the same channel number is listed for both the standard-definition (SD) channel and the high-definition (HD) channel, such as 202 for both CNN and CNN HD. DirecTV HD receivers can tune to each channel separately. This is required since programming may be different on the SD and HD versions of the channels; while at times the programming may be simulcast with the same programming on both SD and HD channels. Part time regional sports networks and out of market sports packages will be listed as ###-1. Older MPEG-2 HD receivers will no longer receive the HD programming. THE ECONOMICS OF RETRANSMISSION CONSENT EXECUTIVE SUMMARY Congress created retransmission consent in 1992 to ensure that broadcasters would be able to negotiate in a free marketplace for fair compensation for their programming. Examining retransmission consent from an economic perspective, this study demonstrates that retransmission consent achieves Congress’ intended purpose of establishing a market based mechanism to ensure that broadcasters receive an economically efficient level of compensation for the value of their signals. This compensation ultimately benefits consumers by enriching the quantity, diversity, and quality of available programming, including local broadcast signals. In particular, the evidence demonstrates that: • The market for television programming is highly competitive. The sellers’ side of the video programming market (broadcasters) is relatively unconcentrated and is becoming less concentrated while the buyers’ side (the multichannel video program distributors market) is experiencing consolidation at both the national and local levels. In 2006, the four MVPDs with the largest shares served 63 percent of all MVPD subscribers, up from 50 percent in 2002. National networks depend on just four purchasers to reach nearly 70 percent of all MVPD subscribers nationwide. Thus, broadcasters do not have monopoly power, and are not in a position to extract excessive retransmission consent fees from cable operators or other program distributors.
