INTRODUCTION The fighters who compete in the Ultimate Fighting Championship (“UFC”) are currently classified as independent contractors. However, this classification appears to contradict the level of control that the UFC exerts over its fighters. This independent contractor classification severely limits the fighters’ benefits, workplace protections, and ability to unionize. Furthermore, the friendship between UFC’s brash president Dana White and President Donald Trump—who is responsible for making appointments to the National Labor Relations Board (“NLRB”)—has added a new twist to this issue.1 An attorney representing a former UFC fighter claimed this friendship resulted in a biased NLRB determination in their case.2 This article provides a detailed examination of the relationship between the UFC and its fighters, the relevance of worker classifications, and the case law involving workers in related fields. Finally, it performs an analysis of the proper classification of UFC fighters using the Internal Revenue Service (“IRS”) Twenty-Factor Test. II. UFC BACKGROUND The UFC is the world’s leading mixed martial arts (“MMA”) promotion. MMA is a one-on-one combat sport that combines elements of different martial arts such as boxing, judo, wrestling, jiu-jitsu, and karate. Oktibbeha Coun- ty Fire Coordinator Kirk Rosenhan told Rosenhan The Dispatch the Central and Dis- trict 5 volunteer fire departments responded to a structure fire on Oliver Jackson Road shortly after 1:30 a.m. The residence was fully involved upon arrival. Rosenhan said fire- fighters ultimately put out the fire, but the home was a total loss, and two cars were burned up in the blaze. He said no injuries were report- ed in the incident. An investigation is ongoing into the cause of the fire. Lori Carpenter, with Oktibbe- ha-Starkville Emergency Response Volunteer Services, said the agen- cy helped the couple that lived in the destroyed home after Wednes- day’s fire. OSERVS provided the couple with three nights in a hotel, food cards for local restaurants and some money cards from Walmart. Any donations for the couple will likely have to be organized else- Local law enforcement, attorney talk where in the community, as Car- penter said OSERVS doesn’t focus on that aspect of recovery. “We’re not going to turn some- excessive vs. reasonable force in policing one away if they brought something — we’ll get it to them,” she said. The idea was that Holm, a former world boxing champion, would impressively knock out Raquel Pennington, a .500 level fighter who was known for exchanging blows and not taking her down.
