Following to discussions with Members, Stow Maries Parish Council is not qualified to accurately answer this question. Its Members are not familiar with the precise details of the Town and Country Planning Regulations 2012. However, on behalf of the Council, I draw your attention to: • Letter to Directorate for Sustainable Communities of 13th March 2018, in which "… Stow Maries Parish Council has been completely excluded from all stages of that consultation process …", and • similarly, letter of 28th March 2018, "… at its meeting on 19th March 2018 Stow Maries Parish Council considered its position about the Chelmsford Local Plan and failure by Chelmsford City Council to have consulted through any stage of its development …". From the beginning, Stow Maries Parish Council was precluded from the process of influencing a plan that involves development right up to its parish boundary and with severe consequential impact on the environment and amenities of this district. In the Main issue of Matter 1 paragraph "…-whether the relevant procedural and legal requirements have been met …", the answer is definitely NO. Stow Maries Parish Council considers that under section 1, Chelmsford City Council has not met the duty to cooperate or clearly identified the relevant strategic matters. Concerning Chelmsford Local Plan's Statement of Community Involvement (SCI) March 2016, then Stow Maries Parish Council considers there has been no community involvement, in particular as it is a Neighbouring Council. Under Section 2.9, Chelmsford City Council has not consulted with Stow Maries Parish Council. If I can assist further, then please do not hesitate to contact me. Yours sincerely,

Chelmsford Local Plan Examination Hearing Sessions

Stow Maries Parish Council states that the appropriate statutory procedures were not followed by Chelmsford City Council in its consultation on the Chelmsford Local Plan. It is a requirement that all neighbouring Councils are properly consulted. Stow Maries Parish Council was not.

The first correspondence received by Clerk of Stow Maries Parish Council was on 3rd February 2018.

The onus is on Chelmsford City Council to prove that the appropriate information was sent to Stow Maries Parish Council at the appropriate time and was received by it either with a recorded delivery receipt or a follow-up email and an appropriate response from the recipient. Stow Maries Parish Council has not seen any of this.

Chelmsford City Council by its own admission sent information to an old email address and to a Clerk who at the time no longer worked for Stow Maries Parish Council.

When the old email address was tested in February 2018, it had an automatic response telling the sender that it was no longer in use and giving the correct one. If Chelmsford City Council had taken note of the automatic response, then this lack of consultation situation would not have arisen.

Stow Maries Parish Council insists that the proceedings are stopped forthwith, and the process is restarted.
