EPPING FOREST DISTRICT (ON – STREET PARKING) (AMENDMENT No 1) ORDER 2004

Epping Forest District Council (hereinafter referred to as "the Council") pursuant to arrangements made under Section 19 of the Local Government Act 2000 with the Essex County Council as the highway authority in exercise of its powers under Sections 1-4, 32 and 35, 45, 46, 49, 51 and 53 and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 (“the 1984 Act”) (as amended by the Road Traffic Regulation (Parking) Act 1986) and section 43 and schedule 3 of the Road Traffic Act 1991 (“the 1991 Act”) and of all other enabling powers, and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 of the 1984 Act, hereby makes the following Order:-

1. This Order may be cited as the Epping Forest District (On Street Parking Places) (Amendment No 1) Order 2004 and may be construed as one with the Epping Forest District (On Street Parking Places) Order 2002 (hereinafter referred to as the ‘2002 Order’.) and additional restrictions detailed within this order are subject to the same provisions applying to Schedule 14 of the 2002 Order.

2. In addition to those roads shown in Schedule 14 of the 2002 Order there shall be included the roads or lengths of road specified in Schedules 1 and 2 to this order.

3. In addition to the list of definitions outlined in Article 3 of the 2002 order there shall be added the following definition:

“ ‘Commercial Vehicle’ means a motor vehicle having a gross weight of 5 tonnes or more”

This Order shall come into operation on -- and may be cited as the Epping Forest District (On – Street Parking) (Amendment No 1) Order 2004.

Statement of Reasons for Making the Order

To protect residential streets from overnight and weekend parking by commercial vehicles EPPING FOREST DISTRICT (ON – STREET PARKING) (AMENDMENT No 1) ORDER 2004

NOTICE IS HEREBY GIVEN that the Epping Forest District Council (hereinafter referred to as “the Council”) pursuant to arrangements made under Section 19 of the Local Government Act 2000 with the Essex County Council in exercise of the powers of the said County Council, propose to make an Order under Sections 1(1) and (2), 2(1) to (3), 3(2) and 4(2), 32, 35, 45, 46 and 49 of the Road Traffic Regulation Act 1984.

The effect of the Order will be to restrict parking by Commercial vehicles having a gross weight of 5 tonnes or more from parking in the streets or parts of streets listed below during the hours 8.00 p.m. to 7.00 a.m. Monday to Friday and not at all on Saturday and Sunday:
