OFFICIAL RULES FAN APPRECIATION NIGHT STARTING LINE-UP CONTEST PRESENTED BY NBC SPORTS NORTHWEST 1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED. 2. ELIGIBILITY. The Fan Appreciation Night Starting Line-up Contest presented by NBC Sports Northwest (the “Contest”) is open to persons 18 years of age or older at the time of entry who are legal US residents residing in the state of Oregon and Western Washington, except employees of the NBC Sports Northwest (“NBCSNW”), Trail Blazers Inc. (together with NBCSNW, referred to herein as “Sponsors”), Rip City Management LLC, the National Basketball Association (“NBA”) and its Member Teams, NBA Properties Inc., and each of their respective affiliated companies, subsidiaries, and advertising or promotional agencies, and the family members, agents, successors or assigns of, and any persons domiciled with, such employees, are not eligible for entry. 3. ENTRY. The Contest will begin on April 26, 2021 and will end at 11:59 p.m. Pacific Time (“PT”) on May 9, 2021 (the “Entry Period”). To enter the Contest, you will first need to create a video in which you announce your favorite starting five line-up of Trail Blazers players. The allowable length of the video should be :16 seconds, ideally consisting of 3-second buffer of silence, then 10-seconds of the player announcement, with a 3-second buffer of silence at the conclusion of your announcement; a maximum video length of 20-seconds is allowed (the “video entry”). See Representations of Entrants/Restrictions below, and additional information regarding the video format, time limit, and other details can be found under the “Video Requirements” tab on www.trailblazers.com/nbcsports. To submit your entry, go to www.trailblazers.com/nbcsports, enter all required contact information and submit your entry. By entering online, each entrant agrees to be bound by the terms relating to the use of the website, including the Privacy Policy. All entries must be received by 11:59 p.m. PT on May 9, 2021. No mechanical reproductions permitted. LIMIT OF ONE (1) ENTRY PER PERSON. Entries will be judged by a Contest Committee selected by Sponsors (in their sole discretion) based on certain criteria, such as but not limited to, the best player announcement (including correct pronunciation of player names), Trail Blazers’ fan pride, and the level of enthusiasm shown. All video entries become the property of Sponsors and will not be acknowledged or returned. By entering and/or participating in the Contest, each entrant grants full permission to the NBC Sports Northwest, Trail Blazers Inc., Rip City Management LLC, the National Basketball Association and its Member Teams, NBA Properties Inc., and their respective parents, subsidiaries, affiliates, directors, officers, governors, employees and agents to publish, disseminate and use (including altering) such entrant’s name, image, likeness, voice and/or photo (“Likeness”) in any medium, whether known or unknown (including, but not limited to, video, audio, photographic, digital, electronic, hosted media, web based service or any other medium, “Medium”) for any purpose, without any compensation to, permission from or inspection by such entrant. Each entrant represents and warrants that they have full authority to grant this permission and do so with full knowledge of the facts and circumstances surrounding such Likeness in any Medium. In the event of a dispute as to the owner of an entry, all entries will be deemed to have been submitted by the owner of the electronic account from which they were sent. For these purposes, an account holder shall mean the natural person assigned to such electronic account by the Internet access provider, online service provider or other organization responsible for assigning such electronic account. Any questions regarding the owner of an electronic account shall be determined by Sponsors in their sole, reasonable discretion. Sponsors will not be responsible for incomplete, lost, late, misdirected or illegible entries, or for failure to receive entries for any reason, any of the equipment or programming associated with or utilized for an entry, or by any technical or human error that may occur due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with entrant or Sponsors. Adidas is not offering, sponsoring nor administering this Contest in any way. 4. ENTRIES INCLUDING AN IMAGE OF MINOR(S). If any video entry submitted by an entrant includes a Likeness of a person under the age of eighteen (18) (a “Minor”) and the video is chosen to win a prize, the parent or legal guardian of such Minor will be required to sign and return a release in the form provided by Sponsors (the “Minor Release”), before such entrant can receive a prize. Failure to return the signed Minor Release on behalf of such Minor within five (5) business days of receipt will result in disqualification of entrant and another entrant from the remaining entries will be chosen. Page 1 of 4 5. REPRESENTATIONS OF ENTRANTS/RESTRICTIONS ON ENTRIES. By submitting a video entry, each entrant/participant hereby acknowledges and confirms that (i) such person is the original author and creator of the video; (ii) such person owns or has secured all rights to use, publish and copyright the video; (iii) the video is original, has not been previously published and has not previously won any award or contest; (iv) the video does not and will not infringe any third party’s copyright, patent, trademark, trade secret or other intellectual property or proprietary rights or rights of publicity or privacy; (v) the video is not the subject of any actual or threatened litigation or claim; (vi) the video is not obscene, offensive, libelous, pornographic, threatening, abusive, contain illegal content, or otherwise objectionable; (vii) the video does not encourage a criminal offense or otherwise give rise to liability or violate any law; (viii) entrant is the sole and exclusive owner of all rights (including, without limitation, all intellectual property rights) in and to all content and elements incorporated into or used in the entry video or has the express written permission to use such content and elements from the owner(s) of the rights to such content and elements; (ix) the video does not include any disparaging remarks relating to Sponsors or any third party; and (x) the video fully complies with these Official Rules. Each video entry must be in keeping with Sponsors’ image, and may not be offensive, nor can it defame, or invade upon the publicity rights or privacy of any person or otherwise infringe upon any person or entity’s intellectual property, personal or proprietary rights, as determined by Sponsors in their sole discretion. Any entrant whose video entry includes likenesses of third parties or contains content or elements not owned by the entrant (such as, but not limited to proprietary names, trademarks, or logos) must be able to provide written legal releases (in a form that is satisfactory to Sponsors) that permit the entrant to use and exploit such content and elements in the manner used and exploited and that permit Sponsors’ right to use and exploit the content and materials in accordance with these Official Rules before being eligible to win a prize. SPONSORS RESERVE THE RIGHT TO REMOVE AND DISQUALIFY ANY ENTRY THAT THEY DEEM, IN THEIR SOLE DISCRETION, TO BE INAPPROPRIATE, OBJECTIONABLE AND/OR INCONSISTENT WITH THE POSITIVE IMAGE AND/OR GOOD WILL IN THE PROMOTION OF THIS CONTEST. A video shall not have been taken (in whole or in part) by, nor shall it include, individuals who are: (1) represented under a contract (e.g., by a talent agent or manager) that would limit or impair Sponsors’ ability to display the video as permitted by these Official Rules; (2) subject to a contract that would make such individual's appearance in the video a violation of any third-party rights; or (3) under any other contractual relationship, including but not limited to guild and/or union memberships, that may prevent Sponsors from being able to use the video worldwide in all media in perpetuity on a royalty-free basis, without payment or fee obligations. Modifying, enhancing, retouching or altering any videos provided in connection with this Contest in any way may disqualify the entry, at the sole discretion of Sponsors. 6. PRIZE/ODDS. On or about May 12, 2021, five (5) potential winners will be chosen by the Committee from all eligible entries received during the Entry Period. After confirmation of eligibility and verification by Sponsors, each confirmed winner will receive two (2) tickets to the May 16, 2021 Fan Appreciation Night Trail Blazers regular season home game against the Denver Nuggets (exact time of game to be announced by the NBA at a later date); provided, however, if fans are not allowed to attend the May 16 game due to then-current government restrictions or other factors, then each confirmed winner will instead receive a credit for the purchase of two (2) Trail Blazers’ regular season home game tickets to be provided during the 2021-22 NBA regular season. Prize is limited to a maximum of two (2) tickets, regardless of the number of persons featured in any submitted video entry. Approximate retail value (“ARV”) of each prize is $372. ARV of tickets is subject to change based on then-current market value at the time prize is awarded. Prize has no cash value; any difference between the stated value and the actual value and value at time of award will not be provided.
