Respondent: The Assistant Executive Engineer Electrical Sub Division, Chathannoor. ORDER 1. Grievance of the petitioner is as follows. This petition was filed by one Smt.Prabhavathiamma, with various allegations against the respondent. Even though the registered consumer is Mr.Suresh Kumar Pillai, Santhosh Bhavan, 1/258, Kurumandal, the petition was filed by Smt. Prabhavathiamma without mentioning the relation with the registered consumer. The main allegation in this petition is that the respondent disconnected and dismantled the service connection even without making any default in payment of the dues payable to the licensee by the petitioner and there after demanded huge amount as dues. The petitioner contented that the energy charges were paid as advance. The last payment was Rs 500/- remitted on 16/2/2016 but the respondent disconnected the energy for default of payment of bill amount. The petitioner requested to conduct an enquiry about the malpractices committed in the respondent’s office.

2. The opposite party filed a version as follows. The respondent filed a version stating that energy connection with con: No. 21961 belongs to one Mr. Suresh Kumar Pillai, Santhosh Bhavan, 1/258, Kurumandal with the connected load of 280 watts. The energy bills for the period from 16/1/2014 to 16/9/2014 was not remitted. Hence the electric connection was disconnected and dismantled, after prior intimation to the consumer. But the consumer has never approached the respondent to settle the dues. So RR steps were initiated for the recovery of the dues amount. Meanwhile on 16/2/2015, after, more than four month of initiation of RR steps, consumers representative approached the respondent’s office and raised objection against the dismantling of the energy connection. All other allegations in the petition is baseless , hence denied. 3. This case was posted for hearing on 6.06.2016. Even after serving notice to the petitioner for hearing, the petitioner not turned up but respondent present and heard. 4. The only question to be considered is whether the petitioner is coming under the definition of consumer as defined in Section 2(15) of Electricity Act 2003. The petitioner is not supplied with electricity for her own use by the licensee. She is not a person whose premises are for the time being connected for the purpose of receiving electricity. The person who is supplied with the electricity by the licensee is Sri. Sureshkumar Pillai. There is nothing to show that the petitioner is tenant of the said premises or relation with the registered consumer nor any electricity connection has been given in her name. Thus the petitioner is not a consumer in terms of Section 2(15) of the Electricity Act 2003. He is not entitled to any notice as provided under Reg.100 of Kerala Electricity Supply Code,2014 before disconnection of supply of electricity from the residential house of Sri. Sureshkumar Pillai. Hence the forum decided to dismiss the petition due to lack of maintainability. No order as to cost. - 4 –

If the petitioner is not satisfied with the above order of this Forum, he is at liberty to prefer appeal before the Electricity Ombudsman within 30 days from the date of receipt of this order.
