The APDP was formed in 1994 to organize efforts to seek justice and get information on the whereabouts of missing family members. It presently consists of family members of about one thousand victims. APDP actively campaigns for an end to the practice and crime of involuntary and enforced disappearances at local, national and international platforms. Members of the APDP have been engaged in documenting enforced disappearances in Kashmir since 1989 and have collected information on over one thousand such cases, so far. On the 10th of each month families of the disappeared come together under the aegis of APDP to hold a public protest in Srinagar to commemorate the disappearance of their loved ones and to seek answers from the state about the whereabouts of the missing persons. In light of the recent human rights violation APDP has taken the decision to come forward and bring notice to the current situation. 2 Acknowledgement This report is a result of tireless and bold efforts put in by people from various backgrounds. KASHMIR – SITUATION UPDATE AND ANALYSIS ! On 5 August 2019, the Government of India unilaterally revoked Article 370 of the Indian Constitution. Article 370 guaranteed special autonomy to Jammu & Kashmir and gave it independence over matters excluding foreign affairs, defence and communication. This was followed by the enactment of the Jammu & Kashmir Reorganization Act that aims to bifurcate the state of Jammu & Kashmir into two separate union territories on 31 October 2019. Union territories, as opposed to states, are governed by the central government. All these amendments and changes were made amidst a complete communication clampdown, curfew on movement and mass detentions of political leaders in the region. In September and October 2019, Amnesty International India spoke to the people of Jammu & Kashmir, including those detained in the context of the larger clampdown, as well as with the lawyers representing detained persons; medical professionals working in both government and private hospitals in the capital city of Srinagar; journalists and editors of local media; and representatives of the regional political parties. Amnesty International India reviewed photographs and documents presented as evidence of many specific events described during the interviews. At the time of conducting these interviews, while both mobile phone and landline services were restored in the Jammu region, only landline services were restored in Kashmir. !1 Arbitrary mass detentions “Top leaders are under arrest…At the district level people have been arrested. Photo: Nissar Ahmad The surge of Kashmiri nationalism in the Valley could have been harnessed as social capital. But the recent orgy of violence has put paid to that hope. For any breakthrough to become possible in this situation, all the stakeholders, including the separatists, must agree on the return of peace while simultaneously engaging with the embittered young leadership emerging in the villages and towns of Kashmir, writes Wajahat Habibullah. And so the death of young people in Kashmir continues to rise as do the protests in ever-mounting violence. The killing of Burhan Wani on July 8 this year sparked acrimonious debates on TV channels. Wani was described universally by India as a terrorist and by Pakistan as a martyr. The media, visual, social and print, resounded with argument and indignation. But by the 17th day of the curfew that covered all of Kashmir, there was a pall of silence cloaking the ferment, even though the death toll and injuries continued to mount. Among the earliest to be killed was Yasmina Wani, a resident of a suburb of Kulgam in south Kashmir, whose brother Amir Hussain serves in the Border Security Force in Tripura. Yasmina was killed even as she was fleeing from the street into a side lane with her teenage brother whom she was dragging away from joining the protestors.
