CONSTRUCTION PROJECTS COULD BE HALTED UNDER BUDGET REDUCTION PLAN

Many government agencies in likely will struggle to deliver services after being hit with a fourth consecutive year of mandatory spending cuts, state Revenue Secretary Bob Kiss said Tuesday. The agencies are expected to postpone construction and renovation projects, eliminate vacant positions and stop non-essential travel following a 4 percent budget reduction announced by Gov. Earl Ray Tomblin earlier this week. A projected $250 million shortfall in revenue collections — mostly blamed on an “unprecedented” drop in coal and natural gas severance taxes — prompted Gov. Tomblin to order the spending cuts. In two of the past three years, Gov. Tomblin directed government agencies to cut spending by 7.5 percent. The governor ordered additional “targeted cuts” last year. “You’re looking in the range of more than 20 percent in reductions for some of these agencies,” Kiss said.

“Some of the agencies are going to have a difficult time with it.” Kiss described this year’s cuts as a “different animal” because West Virginia’s Medicaid program and public school funding won’t be spared from the governor’s budget ax, as in previous years. K-12 public schools face a 1 percent cut — or about $16 million. The state hadn’t cut school spending since the early 1990s. The Medicaid program, which provides free health care for the poor and disabled, must reduce its $3 billion budget by 4 percent. “There’s much more being exposed in these cuts than was exposed in the prior cuts,” Kiss said.

Department of Administration officials called the 4 percent cut a “manageable reduction” that’s not expected to lead to employee layoffs. “There are several different options under consideration, including the elimination of vacant positions, prohibiting non-essential travel, postponing capital improvement projects and spreading cuts among different programs or divisions,” said Diane Holley-Brown, the department’s spokeswoman. To balance the budget, the government will have to come up with the remaining $150 million — most likely by shifting around revenue and tapping the Rainy Day Fund, an action that requires lawmakers’ approval.

Kiss said Mountain State coal and natural gas industries have been hit especially hard in recent months. For the first three months of the budget year, the state’s revenue collections were $60 million behind estimates. Last month’s severance tax collections alone were $23.4 million below estimates. “We have never seen this level of severance tax revenue at this rapid pace,” Kiss said. “It’s unprecedented.” Declining energy prices also led to a significant drop in income tax and sales collections last month, said Mark Muchow, deputy revenue secretary. Personal income tax collection was down $28.1 million.

The CAWV will be meeting this week in an attempt to determine the impact the budget reduction will have on construction spending. Any construction cuts will further drive up West Virginia’s construction unemployment rate. In August 2015, construction employment was down 15.1% from August 2014, the largest percentage decline of any state in the nation. That equates to about 5,400 less people employed in the construction industry today versus a year ago.

AGC CHAPTER LEADERS MEET IN WASHINGTON

AGC of America chapter leaders, including CAWV Senior Vice President C.R. Neighborgall, The Neighborgall Construction Company, Huntington, and CAWV Vice President Scott Pierson, Pipe Plus, Nitro, joined chapter leaders in Washington, D.C. last week to discuss best practices and to meet with Congress to address AGC’s top legislative issues. The annual AGC National and Chapter Leadership Conference included speakers from Capitol Hill and breakout sessions to discuss the industry’s most pressing issues, including federal initiatives for infrastructure funding, multi-employer pension plan reform and environmental regulatory issues.

Speakers included Frank Luntz, on Fox News Channel as a frequent commentator and analyst. Luntz, who is widely respected as a political pollster and prognosticator, spoke at the 1999 CAWV Annual Meeting at The Greenbrier. Members remember Luntz for his comments on why contractors should be involved in the political process. “There is a lot of power in this room,” he told CAWV members 16 years ago. “Don’t be afraid to use it. You must donate your time and money to help increase the efforts of the construction industry.”

Rep. Charlie Dent, R-PA, and Rep. Derek Kilmer, D-WA, spoke about their efforts to develop a bi-partisan effort to provide funding for infrastructure investment. The chapter leaders also reviewed best practices for membership retention, non-dues revenues, state infrastructure initiatives, emerging trends for associations, and developing future construction workforces. Particular seminars were held the benefits of having strong and vibrant young contractors forums.

FEDERAL APPEALS COURT BLOCKS "WATERS OF THE UNITED STATES" RULE NATIONWIDE

Earlier this morning, the court issued a nationwide order blocking the United States Environmental Protection Agency’s (EPA) “Waters of the United States” rule from going into effect until “further order of the court.” While there is no timeline on how long the order will last, it is yet another encouraging sign that the court’s feel EPA has overreached with their rule.

Currently, ARTBA and 13 other trade associations recently sued EPA over the rule in a federal district court based in Texas. While preliminary motions have been filed, that suit is still awaiting a decision over jurisdictional matters. At issue is how EPA’s attempts to define the types of bodies qualifying as “waters of the United States” and therefore subject to federal authority

West Virginia Attorney General Patrick Morrisey has been a national leader in challenging the WOTUS rule. These efforts have included drafting rulemaking comments opposing the rule, taking a leadership role in litigating against the rule, and seeking the stay from the Sixth Circuit.

“This decision is a critical victory in our fight against this onerous federal overreach,” Attorney General Morrisey said in a news release today. “We have said from the beginning that this new rule does not pass legal muster, and had it been allowed to remain in effect, homeowners, farmers and a host of other entities across our state would have found themselves subject to a costly regime of new, complicated federal regulations. The Sixth Circuit’s decision today saves these individuals and businesses from this hefty burden.”

“In granting the stay, the Court described the rule as ‘facially suspect.’ This solidly reaffirms our belief that we have a strong case on the merits and that the courts will ultimately strike down this burdensome regulation,” Attorney General Morrisey said. “We look forward to continuing to challenge this rule’s legality in court and are confident we will prevail.”

CAWV PROMOTES CAWV MEMBERS AT THE OIL AND GAS EXPO

CAWV staff traveled to the fifth annual Oil and Gas Expo at Mylan Park in Morgantown to promote association members. The Expo gave the CAWV the opportunity to let business owners and industry leaders in the oil and natural gas industry know that we are a one-stop- shop for finding qualified and experienced construction, engineering, materials and products suppliers. The event was well attended with over 220 exhibitors. Next year’s Expo is scheduled for October 5, 2016.

GOVERNOR TOMBLIN APPOINTS MARTIN 'RICK' ATKINSON III TO 11TH DISTRICT HOUSE OF DELEGATES SEAT

Governor Earl Ray Tomblin announced the appointment of Martin “Rick” Atkinson III to represent residents of the 11th District in the West Virginia House of Delegates. Atkinson’s appointment fills the vacancy created when former Delegate Bob Ashley was appointed to the on Sept. 15. The governor’s appointment is effective immediately. Atkinson, a West Virginia University graduate, retired from BPB-Stella Jones in 2013 and currently serves as director of sales for Mountain State Log Homes.

Governor Earl Ray Tomblin announced the appointment of Kara Cunningham Williams to the West Virginia Public Service Commission (PSC), effective immediately. Williams will fill the vacancy created by the resignation of Commissioner Jon McKinney. During her time at Steptoe & Johnson PLLC, she served on the Recruiting and Ethics Committees, while practicing commercial litigation before state and federal courts and agencies. Williams has also served as an adjunct lecturer at West Virginia University College of Law, teaching courses in Payment Systems and Appellate Advocacy. In addition to appointing Williams, Gov. Tomblin reappointed current Commission Brooks McCabe to a term that expires June 30, 2021.

WVDOH PLANNING P3 PROJECTS FOR MULTIPLE HEADQUARTERS FACILITIES

The West Virginia Division of Highways (WVDOH) will be advertising for nine maintenance headquarters building projects that are being developed as Public-Private Partnership (P3) projects. Currently the plan is to bid the nine facilities as one project and have the contractor be responsible for design and construction of the project, as well as the maintenance of the facility for 20 years. It is estimated that the average cost of a new facility will be $1.8 million and the projects could include office buildings, gas facilities, salt sheds, storage facilities and brine tanks. There will be six new headquarter buildings constructed, two new sub stations constructed, and one headquarters remodel.

The WVDOH has hired a Quality Assurance Manager for the projects and expects to solicit Statements of Qualifications (SOQ) in December 2015. Project award is projected for April 2016. The planned construction time line will be approximately two years once the project is bid.

HOUSE PASSES AGC-BACKED PROCUREMENT REFORMS

On Oct. 1, the House approved the conference report for the National Defense Authorization Act for Fiscal Year 2016, which includes several AGC-supported procurement reforms. These reforms would:

 Help prevent fraud in the federal construction surety bond market by requiring that individual sureties back their bonds with real, easy to value assets—like U.S. Treasury bonds and instruments. A number of individual sureties were using hard-to-value, over-valued or difficult to liquidate assets—like coal mine refuse, vacation homes and other real property—to back their bonds. Many such sureties declared bankruptcy upon contractor default, leaving subcontractors without any means of payment.  Mandate that DOD agencies—including the U.S. Army Corps of Engineers and Naval Facilities Engineering Command—consider the past performance of the individual companies in joint venture/teaming arrangements that include a small business, not merely the past performance of the joint venture. Many federal agencies demand that the small business and its joint venture/teaming partners only submit past relevant experience that they perform together or otherwise be disqualified from consideration.  Address a recent court decision that would require small business construction contractors to only purchase their materials and supplies—i.e., steel, furniture and equipment for the project— from other small businesses. Consequently, the legislative reform provides an exclusion for construction contractors from what is called the “non- manufacturer rule” meant to prevent small business manufactures from merely acting as fronts for large manufacturers through small business set-aside contracts for goods.

AGC testified in support of these reforms earlier this year before the House Small Business Committee. AGC has also led a coalition of 15 national construction trade associations in an effort to push such construction procurement reforms through Congress. The Senate will likely consider the NDAA conference report in the next few weeks. The president is threating to veto the NDAA conference report because it does not address defense budget cuts under the 2011 Budget Control Act.

SENATE SMALL BUSINESS COMMITTEE ADVANCES ANTI-REVERSE AUCTION BILL - PROHIBITS REVERSE AUCTIONS FOR CONSTRUCTION SERVICES CONTRACTS

This week, Sens. David Vitter (R-LA) and Jeanne Shaheen (D-NH) introduced and passed legislation out of the Senate Small Business and Entrepreneurship Committee that would help prohibit federal agencies from conducting reverse auctions for construction services contracts. A reverse auction is a procurement process through which contractors bid down price—and can see others’ bids—for a good or service contract in real time. Many federal agencies use reverse auctions to procure non-variable commodities like pens and paper. However, several federal agencies also use reverse auctions to procure construction services, which are inherently variable based on the project, site location and construction professionals.

The Small Contractors Improve Competition Act, S. 2139, received unanimous, bipartisan support from the committee. AGC sent a letter to Sens. Vitter and Shaheen thanking them for their leadership on this issue, as they are the Chairman and Ranking Member, respectively, of the committee. The bill may now be considered for a vote on the Senate floor.

Sens. Rob Portman (R-OH) and Mazie Hirono (D-HI) introduced a more comprehensive AGC- backed construction procurement bill in June as a result of the AGC co-chaired Construction Industry Procurement Coalition. That legislation also includes a provision that would help prohibit reverse auctions for construction services.

OSHA ISSUES LETTER OF INTERPRETATION ON EXTENSION CORDS

On September 28, 2015, the Occupational Safety and Health Administration issued a letter of interpretation (LOI), which has not yet been posted to the OSHA website, in response to a question regarding electrical cords. The questioner asked if a contractor must use an extension cord in accordance with a manufacturers warning tag affixed to the cord. The question was specifically referencing a warning contained on the tag stating “Do not plug one extension cord into another.”

OSHA responded by saying the agency will continue to enforce the listing, labeling, or certification requirements as outlined in 19263.403 (b) (2) – Installation and Use – which requires that listed, labeled, or certified (i.e. approved) equipment be used in accordance with the instructions included in the listing, labeling, or certification. OSHA assumes that the extension cord is already approved by a Recognized Testing Laboratory (NRTL) and includes a tag that has all the warnings and limitations associated with that cord. This tag must be attached to the cord and be substantially tear resistant. If an employer disregards such a warning tag, it would be using the cord in a manner outside of its intended application. This would be a violation of 29CFR 1926.403 (b) (2).

At this point, there is very little understanding as to why this new label exists or if it was mandated by UL. It is a violation of UL 817, Standard for Cord Sets and Power Supply Cords, to remove or alter the tag in any way. In case of tag damage the employer must replace the tag with one that is substantially identical to the example below.

SIGNS OF PROGRESS – BUT STILL NO HIGHWAY BILL IN HOUSE

This week there were encouraging reports out of the House Transportation & Infrastructure Committee that they plan to finalize and move their long-term highway and transit bill before the end of October. Committee Chairman Bill Shuster (R-PA) and Ranking Democrat Peter DeFazio (D-OR) met this week to continue negotiations with the goal of announcing a mark-up the week of Oct. 26. It is unclear what funding levels the House bill will provide, due in large part to the breakdown in negotiations last week between Ways & Means Chairman Paul Ryan and Senator Charles Schumer, who had been negotiating a bipartisan compromise on how U.S. corporations are taxed on their overseas assets and using that revenue to fund a transportation bill.

Although there seems to be more clarity on when the House will mark up their bill, the fact remains that the current extension of federal highway and transit program expires on Oct. 29 and it appears that another extension will be necessary in order for the full House to consider a bill and for differences to be resolved with Senate, who passed the DRIVE Act in July.

It is imperative that the House move their bill and start negotiations with the Senate as soon as possible. AGC members need to use the upcoming Columbus Day recess to contact and meet with their representative and encourage them to move as quickly as possible in passing a transportation bill.

WVDOH DBE AND ADA UPDATE

The WVDOH methodology used for determining the state’s new DBE goal has not been approved but the agency has officially adopted their new three year goal. According to Drema Smith, Director WVDOH EEO Division, the new goal of 8.77% is a slight increase over the previous goal of 8.66%. Ms. Smith told contractors attending the October 8 meeting of the CAWV/WVDOH Construction Subcommittee that the agency will still focus on meeting the majority of the goal through race neutral means. Ms. Smith reminded contractors that any change to their DBE participation plan must be submitted to the agency for approval and documentation. Changes, for example, include substitution of subcontractors, elimination of a bid item or under running an item.

The Americans With Disability (ADA) program is a focus area nationally, as well as, locally Ms. Smith told contractors. She explained that any alteration to the roadway requires bringing curb ramps up to standard. She acknowledged that terrain can make this challenging at times but that we must try to the “greatest extent feasible” to comply. Ms. Smith said compliance help is available from her office and District ADA Coordinators, including training for contractor and designer personnel. Ms. Smith said the DOH and the Department of Justice are aggressively monitoring compliance activities on all projects. She suggested contractors pay close attention to all projects, but especially Design Build projects.

The West Virginia Division of Highways announced upcoming changes to the Kerens to US 219 Connector project. The project will be deferred to a Special Letting on October 29th. The new schedule will be:
