Pursuant to Section 18-200 of the Fairfax County Zoning Ordinance, the Applicants, the Fairfax County School Board and Milestone Tower Limited Partnership IV ("Milestone") requests approval of a rezoning application to amend the proffers associated with PCA 89-D-007.

Background

Herndon High School was constructed in 1962. The School property was rezoned to the R-3 District with Rezoning Application RZ 89-D-007 approved by the Board of Supervisors on June 26, 1989 subject to proffers dated June 6, 1989. The Proffers associated with this Rezoning did not commit to the development of the property but limited the maximum permitted gross floor area of the School buildings to 382,425 square feet. Subsequently, upon application by the School Board, Proffer Condition Amendment PCA 89-D-007 was approved by the Board of Supervisors on June 7, 2016 to permit School improvements and increase the building's gross maximum floor area to 0.24. As the under Proffer 1, "Permitted Uses", of the Proffer Statement approved with PCA 89-D-007 states that the "Use of the Property shall be limited to public uses to a maximum floor area ratio of 0.24", a PCA is presently required to permit the construction by Milestone Tower limited Partnership IV of a telecommunications facility adjacent to the football stadium on the site.

Existing Conditions

The subject Property totals approximately 40.68 acres and is zoned R-3 and planned for Public Facilities, Governmental and Institutiondl Uses. The property is located immediately north and adjacent to the Fairfax County and Town of Herndon corporation line and just to the northeast of the intersection of Bennett Street and Dranesville Road. Most all surrounding properties in the County are zoned R-3 and developed with residential uses in this zoning category except for a former farm property, Coomber Hall, off Dranesville Road that is used for an events center and banquet hall (to the immediate north) and a church use immediately adjacent to the school's western border also along Dranesville Road. In addition to the surrounding R-3 zoning, there is an older R-1 zoned subdivision with 8 parcels on the west side of Dranesville Road.

Surrounding and nearby properties in the Town of Herndon to the south are zoned R-10 and R-15. While most all these properties are developed with residential uses, the Herndon United Methodist church is just to the south of the school property across Bennett Street and the Chestnut Grove Cemetery is located to the southwest on the west side of Dranesville Road.

The School property contains Herndon High School with two buildings, one to two stories in height, classroom trailers, asphalt parking areas, driveways and bus loop. The site also contains numerous athletic facilities including a lighted football field with stadium bleachers, press box and concession stand; lighted baseball and softball fields; turf practice field and tennis courts. Additional improvements and additions are currently planned for the site as approved under PCA 89-D-007.

Under this proposed application, there will be no changes to the existing uses, buildings, and outdoor areas other than to add the telecommunications facility adjacent to undeveloped property adjacent to a parking garage. The application will have no impact on the existing facility's operations or approved development pattern.

Proposed Development

Milestone has coordinated with the Fairfax County Public Schools to establish the telecommunication facilities on the Herndon High School property and to lease space on the proposed facility to wireless providers in the Fairfax County region. The monopole and compound are proposed to be located on the north side of the football field in an open area just west of the northside visitor's bleachers and between two existing stadium light poles with heights of 70 and 85 feet. It is designed to accommodate a total of five telecommunications carriers including the co-applicant Sprint. The Sprint antennas will be located on a platform at the top of the monopole with a centerline of 120 feet above ground level. A 6-foot tall lightning rod will extend above the top of the monopole. A detailed description of the telecommunications facility is provided on the Zoning Drawings entitled "Herndon High School" prepared by Entrex Communications Services, Inc. dated July 24, 2018 and included as part of this application.

Sprint will have 6 panel antennas on the 124-foot tall monopole at a rad center of 120 feet above ground level. The top of the antennas will be located at 124 feet above the ground. Space for the antennas of four future carriers is available at rad centers of 110 feet, 100 feet, 90 feet, and 80 feet. The types and sizes of the Sprint antennas are detailed on the engineering drawings, Sheet Z-8, Antenna Mounting Plan, Schedule and Notes. The antennas measure 651 mm H x 501 mm W x 245 D mm and 1220 mm H x 299 mm W x 200 mm D — there will be 3 of each (one of each per sector). The specification sheets for the antennas and radio heads are also included with this application.

The proposed monopole and the related equipment of Sprint and all future carriers will be in a compound area with a length of 91 feet and a maximum depth of 35 feet. The compound area will be enclosed by a 10-foot tall chain link fence with slats (color to be determined by

2 Fairfax County Public Schools) to secure all equipment and create a solid visual barrier. Ingress and egress to the facility will be from an existing 8-foot wide asphalt driveway on the property that will be improved to 10 feet in width and a new 10-foot wide compound entrance drive that connects with the existing driveway and the compound's gate. Full details of the compound and equipment are detailed on the Engineering Drawings Sheet Z-3, Compound Plan; Sheet Z-9, Equipment Layout Plan; and Sheet Z-10, Cabinet Details.

The proposed use is benign and will not generate noise, light, dust, glare, vibration, fumes or odors. The traffic generated will be very minimal. The proposed use does not present a threat to the public health, safety or welfare and will not impact radio, television or telephone reception. It will have no negative impact upon the air and water quality, nor will it impact any existing environmental features on the subject property.

Requirement for the Use

The proposed telecommunication facility is required to enhance in-building coverage to the residential communities in this area of the County. Growing wireless use and traffic in this area limit the capacity of neighboring sites to deliver quality and reliable service. The proposed site will relieve some of this traffic so that service does not further degrade.

Sprint will be the initial telecommunications provider at the site and is seeking to enhance coverage along Dranesville Road (Route 228), Wiehle Avenue (Route 828) and the Fairfax County Parkway (Route 286) and to provide better coverage to the residential communities surrounding the high school site. Currently this area has weak Sprint coverage and the new site will help improve Sprint's coverage and add new customers as well as satisfy existing customers. The proposed site will enhance in-building coverage in residential neighborhoods in the areas between Wiehle Avenue, Dranesville Road and the Fairfax County Parkway.

The proposed site will not only provide good coverage but will also enable good handoffs between other Sprint sites in the area thus extending the coverage and diminishing the dropped calls in the area. Commuters and residents will experience better quality voice and data services from Sprint with the new facility in place.

Compliance with the Comprehensive Plan

The proposed facility is consistent with and furthers the goals of the Fairfax County Comprehensive Plan ("Comprehensive Plan"). The proposed structure will be located on publicly-owned property, will accommodate multiple carriers and be situated on the property adjacent to other tall vertical structures to minimize visual impacts on the site and surrounding area. The proposed facility is consistent with the stated Objectives of the Policy Plan of the Fairfax County Comprehensive Plan concerning Mobile and Land-Based Telecommunication Services as described below.

3 General Guidelines

Objective 43: In order to provide for the mobile and land-based telecommunication network for wireless telecommunication systems licensed by the Federal Communications Commission, and to achieve opportunities for the collocation of related facilities and the reduction or elimination of their visual impact, locate the network's necessary support facilities which include any antennas, support structures and equipment buildings or equipment boxes in accordance with the following policies.

Policy a. Avoid the construction of new structures by locating proposed telecommunication facilities on available existing structures such as rooftops, telecommunication and broadcast support structures, electrical utility poles and towers, and water storage facilities when the telecommunication facilities can be placed inconspicuously to blend with such existing structures. (See Figures 8, 9, 10.)

The development pattern in and around the search area is comprised primarily of single- family detached residential uses with primary zoning designations of R-1 and R-3 in the County and R-10 and R-15 in the Town (these Town designations also support single family residential uses). The only non-residential buildings are two nearby 1 to 2 story church structures on smaller parcels to the west and south with low rooftop steeples and an events center to the immediate northwest of the site. The height of these buildings will not meet coverage objectives and a new telecommunications structure on the site would be more proximate to residences and public roadways. There are no other telecommunication towers or monopoles in the immediate area, or other tall structures that will accommodate the facility. To serve this area and meet the engineering and coverage requirements, it is necessary to construct a new structure of the height proposed.

Policy b. When existing structures are not available for co-location, or co-location is appropriate because of adverse visual impacts or service needs, locate new structures that are required to support telecommunication antennas on properties that provide the greatest opportunity to conceal the telecommunication facilities and minimize their visual impact on surrounding areas.

The proposed facility will be located on a large public school site consisting of 40+ total acres that provides opportunities for reducing visual impacts. The structure and compound will be adjacent to the football stadium and existing bleachers and set amongst 8 existing tall light pole structures approximately 85 feet in height used to illuminate the football field area. In addition, there are 16 other shorter pole structures approximately 60 -70 feet in height on the school property to the north and west of the football field used to illuminate three other athletic fields used for baseball and soccer. The major equipment for the facility will be in the compound area and screened by a 10-foot high fence with slats. When viewed from a distance from surrounding vantage points, the compound area will not be visible and the new 124-foot tall monopole, while taller than the other existing light structure on the School site, will visually blend with them and not appear solitary or prominent. In addition, considerable areas of existing on- and off-site trees and vegetation, and several non-residential properties surround the school property and will serve to mitigate views of the new facility from adjoining residential areas.

4 Policy c. When new structures or co-locations are required to serve residential neighborhoods, consider minimizing visual impacts on the surrounding area by utilizing camouflage structure design and/or micro-cell technologies or similar miniaturization technologies, such as distributed antenna systems (DAS), if feasible.

The proposed structure will not be camouflaged but will be located to visually blend with numerous other tall structures on the site. This will mitigate its visual presence similar to a stealth design and reduce its overall prominence. The use of DAS is not feasible to meet coverage objectives for this area.

Policy d. When multiple sites provide similar or equal opportunity to minimize impacts, public lands shall be the preferred location.

The subject property is publicly owned and operated by the Fairfax County Public School Board. The features of this public site provide an excellent opportunity to reduce the visual presence of the facility and minimize impacts. Other public lands in the area are stream valley park areas with no overall advantage for reducing visual and environmental impacts.

Policy e. Locate mobile and land-based telecommunication facilities on public property only after a lease agreement between the County, or related board or authority, and service providers has been established.

Milestone has a lease agreement with the Fairfax County School Board to construct and locate the proposed facility on the Herndon High School property.

Policy f. Ensure that the use of public property by mobile and land-based telecommunication facilities does not interfere with the existing or planned operational requirements of the public use and complies with adopted policies and plans to protect natural resources.

The Applicant has worked closely with Fairfax County Public Schools to locate the proposed structure on the school property in a way that does not interfere with the existing or planned operational requirements of the use or facility. The administrative office of the Fairfax County Public Schools has approved the location on site. The Fairfax County Public School's contact is Robert Cordova, Coordinator — Property Management, Office of Design and Construction, Department of Facilities and Transportation Services. The proposal complies with adopted policies and plans to protect natural resources.

Policy g. Co-locate mobile and land-based telecommunication facilities operated by different service providers on single sites and/or structures whenever appropriate. Locate single-use structures on a property only when a co-location structure for multiple service providers is not desirable or feasible due to technological differences, site limitations or visual impact concerns.

The proposed monopole will be designed to hold up to five telecommunication carriers. Sufficient space for related equipment will be located at the base of the structure and will be

5 located under the south side bleachers at the football stadium or screened from view by a ten-foot tall fence with slats.

Policy h. Ensure that the height of the proposed telecommunication facility is no greater than necessary to allow for co-location on the telecommunication facility based on its service area requirements while still mitigating the visual impact of the facility.

The Sprint antennas will be mounted at a rad center of 120 feet above ground level. The overall height of the monopole is the minimum required to meet Sprint's coverage objectives and technical requirements while also permitting space for up to four additional future carriers at lower positions on the structure at levels of 110, 100, 90 and 80 feet above ground level.

Policy i. When new structures, co-locations and/or technologies (such as distributed antenna systems, micro-cell technology or miniaturization technology) are necessary to meet the service area requirements for the residential neighborhood(s), ensure that the height and mass of any appropriate co-location on the telecommunication facility is in character with the surrounding residential area and mitigates the visual impact of the facility on the surrounding residential area.

The height and mass of the proposed structure is in general context with the other light poles located at the football field and will blend with these structures. The structure can accommodate additional users without impacting the character of the surrounding residential area.

Policy j: Design, site and/or landscape proposed telecommunication facilities to minimize impacts on the character of the property and surrounding areas. Demonstrate the appropriateness of the design through facility schematics and plans which detail the type, location, height, and material of the proposed structures and their relationship to other structures on the property and surrounding areas.

The attached Site Plan and related engineering drawings show the design of the monopole and compound area and their relationship to the school and nearby properties. Aerial photos and photo-simulations are also provided with the application to demonstrate the structure's relationship to the site and adjacent and surrounding properties and uses. The monopole's design will be compatible with the public school property and consistent with the other tall vertical structures on the property. The proposed structure will not negatively impact the existing school use or the character of the surrounding residential properties. The monopole will be placed amongst other tall steel poles used for field illumination and the character and extent of the new monopole will be in context with these structures and the property in general. The monopole and the equipment associated with the facility will be in a fenced compound with privacy slats.

Policy k: Demonstrate that the selected site for a new telecommunication facility provides the least visual impact on residential areas and the public way, as compared with alternate sites. Analyze the potential impacts from other vantage points in the area, especially from

6 residential properties, to show how the selected site provides the best opportunity to minimize its visual impact on the area and on properties near the proposed site.

Photo simulations of the proposed structure show its appearance from 6 vantage points in the area and demonstrate the appropriateness of utilizing this site. As seen from the distance, the new monopole will blend with the numerous other poles on the property and will not be solitary or prominent but rather another vertical element on the school property. This overall context, the structure's distance to property lines, residences and roadways, and tree and vegetation in the surrounding area will serve to mitigate views of the structure from adjacent residential properties and communities. The photo simulations show that while the structure will be visible from many areas in the surrounding area, it will be amongst the existing light poles on the property that are currently visible and will not become a prominent feature or obtrusion.

Policy I: A key concept in assessing telecommunication facilities is mitigation which is defined as actions taken to reduce or eliminate negative visual impacts. Mitigate the visual impact of proposed telecommunication facilities and their equipment, by using effective design options appropriate to the site such as:

• Design, site and/or landscape the proposed facility to minimize impacts on the character of the area;

• Locate proposed telecommunication facilities near or within areas of mature vegetation and trees that effectively screen or provide an appropriate setting for the proposed structure provided such location does not adversely impact sensitive resources or cause fragmentation of forested communities. When viewed in context, consider perspective views, relative topography and other factors, to mitigate the visual presence and prominence of the structure;

• Blend proposed telecommunication facilities with an existing pattern of tall structures;

• Obscure or block the views of proposed telecommunication facilities with other existing structures, vegetation, tree cover, or topographic features to the maximum extent feasible; and

• Replace existing telecommunication facilities with taller structures or extend their overall height to reduce the need for another structure when such height increases, or structure replacements are visually appropriate to the site, including the surrounding area and are consistent with the type, style and pattern of the existing structure.

The visual impact of the proposed 124-foot tall structure will be mitigated by its location adjacent to an existing pattern of 8 tall lighting structures used to illuminate the football field and its proximity to another 16 lighting structures on the school property used to illuminate a variety of athletic fields. Further, existing vegetation that borders the school property serves to mitigate views of the proposed facility from much of the surrounding area. Existing residences are a minimum of 340 feet from the structure and views from surrounding residential areas will be obscured in many areas by intervening vegetation and other structures and buildings. The

7 equipment compound area will be located west of the existing visitor bleachers on the northside of the stadium and will be screened from view with a ten-foot tall chain link fence with slats.

Policy m: Locate telecommunication facilities to ensure the protection of historically significant landscapes and cultural resources. The views of and vistas from architecturally and/or historically significant structures should not be impaired or diminished by the placement of telecommunication facilities.

The proposed use will not adversely impact historically significant landscapes or views or detect from any architecturally or historically significant structures in the area.

Policy n. Site proposed facilities to avoid areas of environmental sensitivity, such as steep slopes, floodplains, wetlands, environmental quality corridors, and resource protection areas.

The proposed use will be in a developed area and will not impact any environmentally sensitive areas.

Policy o. Site proposed facilities to allow for future expansion and with corresponding levels of screening to accommodate expansion.

The proposal structure and leased compound area on the school property will provide ample space for Sprint and up to four additional telecommunication carriers while maintaining levels of screening.

Policy p. Design and site proposed telecommunication facilities to preserve areas necessary for future right-of-way dedication and ancillary easements for construction of road improvements.

The proposed location of the proposed use is interior to the public school property and outside of all public road rights-of-way. The location of the structure will not impact any future right-of-way expansion and easements for road improvements should they be necessary.

Policy q. Locate and construct antennas used for purposes other than mobile and land- based telecommunication services in accordance with the same guidelines established in this "Mobile and Land-Based Telecommunications Services" section.

The proposed monopole will be used for mobile and land-based purposes.

Objective 44: Design proposed telecommunication facilities to mitigate their visual presence and prominence, particularly when located in residential areas, by concealing their intended purpose in a way that is consistent with the character of the surrounding area. (See Figures 11 and 12.)

Policy a. Disguise or camouflage the appearance of proposed telecommunication facilities to resemble other man-made structures and natural features (such as flagpoles, bell towers,

8 and trees) that are typically found in a similar context and belong to the setting where placed.

Although the monopole will not be camouflaged, it will blend with the numerous existing tall lighting features at the football stadium and on nearby athletic fields also on the school property. The pole will be in context with the other tall steel lighting poles on the School property.

Policy b. Design proposed telecommunications facilities that are disguised and camouflaged to be of a bulk, mass and height typical of and similar to the feature selected.

The bulk, mass and height of the proposed structure is consistent and will appear in context with the other 8 tall vertical light pole structures used to illuminate the football field on this portion of the public school property.

Policy c: Use other new and existing structures and vegetation of comparable form and style to establish a grouping that complements a camouflaged telecommunication facility and supports its design, location and appearance.

The facility will be set amongst and located in a grouping of 8 other existing tall structures on the school property used to illuminate the football field. These existing structures provide an established context for the property and will support the design and appearance of the new monopole. The selected location and existing site features in this area of the school property will provide context for the use and serve to obscure the facility.

Conclusion

In light of the foregoing, the Applicant respectfully submits that this Rezoning Proffered Condition Amendment application is in compliance with the Fairfax County Zoning Ordinance and Comprehensive Plan. Granting the Applicant's request will be appropriate and in the interests of the citizens of Fairfax County.

Applicant, Milestone Tower Limited Partnership IV, requests a Special Exception to allow for the construction and operation of a wireless telecommunications facility. The facility will consist of a monopole structure with an overall height of 124 feet. An associated equipment will be in a leased compound area of 3,185 square feet in area enclosed by a 10-foot tall chain link fence with slats.

Statement Describing the Proposed Use

The following section corresponds to the requirements contained in the Special Exception Application Information package and pursuant to Section 9-011, Paragraph 7, of the Fairfax County Zoning Ordinance, and fully describes the proposed use:

Type of operation

Milestone has coordinated with the Fairfax County Public Schools to establish the telecommunication facilities on the Herndon High School property and to lease space on the proposed facility to wireless providers in the Fairfax County region. The monopole and compound are proposed to be located on the north side of the football field in an open area just west of the northside visitor's bleachers and between two existing stadium light poles with heights of 70 and 85 feet. It is designed to accommodate a total of five telecommunications carriers including the co-applicant Sprint. The Sprint antennas will be located on a platform at the top of the monopole with a centerline of 120 feet above ground level. A 6-foot tall lightning rod will extend above the top of the monopole. A detailed description of the telecommunications facility is provided on the Zoning Drawings entitled "Herndon High School" prepared by Entrex Communications Services, Inc. dated July 24,2018 and included as part of this application. The Herndon High School Property is owned by the Fairfax County School Board, consists of a total area of 40.7 acres and is zoned Residential R-3. Under the Fairfax County Zoning Ordinance, the structure is allowed by a Special Exception in the R-3 District. In addition, a previous proffer made as part of PCA 89-D-007 in 2016 must be amended and a Rezoning application for a Proffer Condition Amendment. Sprint will have 6 panel antennas on the 124-foot tall monopole at a rad center of 120 feet above ground level. The top of the antennas will be located at 124 feet above the ground. Space for the antennas of four future carriers is available at rad centers of 110 feet, 100 feet, 90 feet, and 80 feet. The types and sizes of the Sprint antennas are detailed on the engineering drawings, Sheet Z-8, Antenna Mounting Plan, Schedule and Notes.

The proposed monopole and the related equipment of Sprint and all future carriers will be in a compound area with a length of 91 feet and a maximum depth of 35 feet. The compound area will be enclosed by a 10-foot tall chain link fence with slats (color to be determined by Fairfax County Public Schools) to secure all equipment and create a solid visual barrier. Ingress and egress to the facility will be from an existing 8-foot wide asphalt driveway on the property that will be improved to 10 feet in width and a new 10-foot wide compound entrance drive that connects with the existing driveway and the compound's gate. The antennas measure 651 mm H x 501 mm W x 245 D mm and 1220 mm H x 299 mm W x 200 mm D — there will be 3 of each (one of each per sector). Full details of the compound and equipment are detailed on the Engineering Drawings Sheet Z-3, Compound Plan; Sheet Z-9, Equipment Layout Plan; and Sheet Z-10, Cabinet Details. The specification sheets for the antennas and radio heads are also included with this application.

The proposed use is benign and will not generate noise, light, dust, glare, vibration, fumes or odors. The traffic generated will be very minimal. The proposed use does not present a threat to the public health, safety or welfare and will not impact radio, television or telephone reception. It will have no negative impact upon the air and water quality, nor will it impact any existing environmental features on the subject property.

Hours of Operation

The telecommunications facility will operate 24 hours per day, 365 days per year. There are no on-site employees associated with the proposed telecommunications use. The proposed wireless facility will be unmanned with approximately one monthly maintenance visit per carrier. These additional visits to the site will be easily absorbed into the day-to-day uses of the school. The proposed telecommunications use will not be hazardous or conflict with the existing and anticipated traffic in the neighborhood.

Estimated number of patrons, clients, patients, pupils, etc.

The facility is not manned and is visited for routine maintenance approximately one to two times per month for maintenance, inspection and/or repair. There will be no customers, employees or other personnel at the site.

The facility will operate as a cellular base station in the wireless telecommunications networks of Sprint and up to one additional provider. Included with the application package are Sprint's propagation maps showing the area to be covered by the new facility and the existing network coverage of Sprint in this area of Fairfax County. The facility generates only minimal traffic. Service technicians visit the site one to two times a month for each provider on the structure driving a standard size vehicle to the site. The new access drive that connects the compound area with an existing driveway at the football field will accommodate parking for service technicians visiting the site.

Vicinity or general area to be served by the proposed use

The area served by the proposed telecommunications use is depicted on Sprint's radio frequency coverage (propagation) maps included in the application package. The maps show the area presently covered by Sprint's other immediate sites in this vicinity and the improved coverage that will result with the addition of the new telecommunications facility at the Herndon High School site. In general, the site will enhance in-building coverage to the residential communities in this area of the County. Growing wireless use and traffic in this area limit the capacity of neighboring sites to deliver quality and reliable service. The proposed site will relieve some of this traffic so that service does not further degrade.

The main objective of the site is to enhance Sprint coverage along Dranesville Road (Route 228), Wiehle Avenue (Route 828) and the Fairfax County Parkway (Route 286) and to provide coverage to the residential communities surrounding the high school site. Currently this area has weak Sprint coverage and the new site will help improve Sprint's coverage and add new customers as well as satisfy existing customers. The proposed site will enhance in-building coverage in residential neighborhoods in the areas between Wiehle Avenue, Dranesville Road and the Fairfax County Parkway.

The proposed site will not only provide good coverage but will also enable good handoffs between other Sprint sites in the area thus extending the coverage and diminishing the dropped calls in the area. Commuters and residents will experience better quality voice and data services from Sprint with the new facility in place.

Description of the building facade and architecture of proposed new buildings and addition

The telecommunications facility will consist of a self-supporting galvanized steel monopole structure having a total height of 124 feet with a steel three-sided antenna platform at the top. Sprint will have 3 equipment cabinets located on an 8-foot by 10-foot steel platform and a telco and a power cabinet at the site. All equipment and the monopole will be in the compound area enclosed by a 10-foot tall chain link fence with privacy slats and a 12-foot wide access gate.

Listing, if known, of all hazardous or toxic substances to be generated, utilized stored, treated and/disposed of on-site and the size and contents of any existing or proposed storage tanks or containers

The telecommunications use will be constructed on a property owned and operated by the School Board of Fairfax County. Per the Fairfax County Zoning Ordinance, monopole structures are permitted on Public Property in the R-3 District with approval of a Special Exception.

The proposed telecommunication use will conform to the requirements of Sections 2- 514(3), 9-103, 9-104 and 9-105 of the Fairfax County Zoning Ordinance. The Applicant will address transitional screening and a waiver will be requested as necessary.

Compliance with Provisions of Section 9, Special Exceptions

The proposed facility is in compliance with the Provisions, General Standards and Requirements contained in Section 9 of the Zoning Ordinance as presented in the following:

General Standards (Section 9-006)

General Standard 1. The proposed use at the specified location shall be in harmony with the adopted Comprehensive Plan.

Applicants'Response: The 40.7-acre public school property on which the proposed monopole will be located is planned for Public Facilities, Governmental and Institutional use and is currently developed with a public high school. The facility is located on the north side of the football field in an open area just west of the northside visitor's bleachers and between two existing stadium light poles with heights of 70 and 85 feet and amongst 8 other tall light poles approximately 85 feet in height used to illuminate the football field area. These other structures, the large site size and surroundings of the property will help minimize impacts on the site and nearby residential areas and the proposed use will not adversely affect the existing or proposed uses envisioned for this general area of the County by the Comprehensive Plan. The use will also be in conformance with the provisions of the Mobile and Land Based Telecommunications section of the Public Facilities element of the Policy Plan.

General Standard 2. The proposed use shall be in harmony with the general purpose and intent of the applicable zoning district regulations.

Applicants ' Response: The proposed property is within the Residential R-3 zoning district and is developed with a public school use. The proposed use will be consistent with the lighted athletic fields and the current use of the site. The use will be removed from most residential areas by distance and mitigated by existing vegetation along the property's borders. The use will not impact watercourses, stream valleys or watersheds nor will degrade wo d, natural and scenic areas or agricultural lands. Zalzilia Evaluation Division 4 General Standard 3. The proposed use shall be such that it will be harmonious with and will not adversely affect the use or development of neighboring properties in accordance with the applicable zoning district regulations and the adopted comprehensive plan. The location, size and height of buildings, structures, walls and fences, and the nature and extent of screening, buffering and landscaping shall be such that the use will not hinder or discourage the appropriate development and use of adjacent or nearby land and/or buildings or impair the value thereof.

Applicants' Response: The proposed telecommunications use will be sited on a large public parcel with wood areas on the property edge separating it from residential area to the north, east and west. Several non-residential uses including an events center to the north on the southside of Kingstream Drive and churches along Dranesville Road to the west and Bennett Street to the south also serve to separate the facility from residential communities. The use is in harmony with the surrounding area and will not affect the existing use or operation of the public school property. The facility will be unmanned, generate no traffic, and have minimal land disturbance.

General Standard 4. The proposed use shall be such that pedestrian and vehicular traffic associated with such use will not be hazardous or conflict with the existing and anticipated traffic in the neighborhood.

Applicants' Response: The proposed telecommunications facility will be unmanned with one or two monthly maintenance visits. These additional visits will not be hazardous or conflict with the existing and anticipated traffic in the neighborhood or general area.

General Standard 5. In addition to the standards which may be set forth in this Article for a particular category or use, the Board shall require landscaping and screening in accordance with the provisions of Article 13.

Applicants' Response: The proposal will conform to the provisions of Article 13 of the Zoning Ordinance

General Standard 6. Open space shall be provided in an amount equivalent to that specified for the zoning district in which the proposed use is located.

Applicants' Response: The use will not require an open space provision.

General Standard 7. Adequate utility, drainage, parking, loading and other necessary facilities to serve the proposed use shall be provided. Parking and loading requirements shall be in accordance with the provisions of Article 11.

Applicants' Response: The facility will not require signage.

Additional Submission Requirements for Category 1 Uses (Section 9-103)

In addition to the general standards set forth above, all applications for Category 1 uses shall be accompanied by the following items:

1. Four (4) copies of a map showing the utility system of which the proposed use will be an integral part, together with a written statement outlining the functional relationship of the proposed use to the utility system.

Applicants' Response: Attached are radio frequency propagation (coverage) maps that depict the relationship of the proposed telecommunications facility to the existing or proposed Sprint sites in the area with which the proposed use will be integrated. Sprint's objective for this site is to improve wireless coverage along Dranesville Road (Route 228), Wiehle Avenue (Route 828) and the Fairfax County Parkway (Route 286) and to provide coverage to the residential communities surrounding the high school site. A written statement is included with the propagation maps.

2. Four (4) copies of a statement, prepared by a certified engineer, giving the exact technical reasons for selecting the particular site as the location for the proposed facility and certifying that the proposed use will meet the performance standards of the district in which located.

Applicants' Response: Statements prepared by certified engineers, giving the technical reasons for selecting the site and certifying that the telecommunications use will meet the performance standards of the R-3 zoning district are included in the application package.

Standards for All Category 1 Uses (Section 9-104)

All Category 1 special exception uses shall satisfy the following standards:

1. Category 1 special exception uses shall not have to comply with the lot size requirements or the bulk regulations set forth for the zoning district in which located.

2. No land or building in any district other than the 1-5 and 1-6 District shall be used for the storage of materials or equipment, or for the repair or servicing of vehicles or equipment, or for the parking of vehicles except those needed by employees connected with the operation of the immediate facility. If the proposed location of a Category 1 use is in an R district, there shall be a finding that there is no alternative site available for such use in a C or I district within 500 feet of the proposed location; except that in the case of electric transformer stations and telecommunication central offices, there shall be a finding that there is no alternative site available in a C or I district within a distance of one (1) mile, unless there is a substantial showing that it is impossible for satisfactory service to be rendered from an available location in such C or I district.

Applicants'Response: There are no alternative sites in a commercial or industrial district within 500 feet of the proposed location suitable for the facility.

4. Before establishment, all uses, including modifications or alterations to existing uses, shall be subject to the provisions of Article 17, Site Plans, in the Zoning Ordinance.

Applicants'Response: Any future modifications or alterations will comply with the provisions of Article 17 of the Zoning Ordinance.

Additional Special Exception Requirements for Mobile & Land-Based Telecommunications Facilities (Section 9-105)

1. Except for antennas completely enclosed within a structure, all antennas and their supporting mounts shall be of a material or color that closely matches and blends with the structure on which it is mounted.

Applicants' Response: Sprint's antennas will be located on a platform at the top of the monopole. The platform and antenna mounts will match the structure and the antenna faces will be painted to match the structure.

2. Except for a flag mounted on a flagpole, as permitted under the provisions of Par. 2 of Sect. 12-203, no commercial advertising or signs shall be allowed on any monopole, tower, antenna, antenna support structure, or related equipment cabinet or structure.

Applicants' Response: There will be no commercial advertising or signs on the monopole structure.

3. If any additions, changes or modifications are to be made to monopoles or towers, the Director shall have the authority to require proof, through the submission of engineering and structural data, that the addition, change, or modification conforms to structural wind load and all other requirements of the Virginia Uniform Statewide Building Code.

4. No signals, lights or illumination shall be permitted on an antenna unless required by the Federal Communications Commission, the Federal Aviation Administration or the County, provided, however, that on all antenna structures which exceed 100 feet in height, a steady red marker light shall be installed and operated at all times, unless the Zoning Administrator waives the red marker light requirement upon a determination by the Police Department that such marker light is not necessary for flight safety requirements for police and emergency helicopter operations. All such lights shall be shielded to prevent the downward transmission of light.

Applicants' Response: No signals, lights or illumination will be located on the monopole unless required by the County. The Applicant will seek a waiver to the County's requirement as specified in Zoning Section 2-514, Paragraph 3H. A steady red light marker will be located on the monopole only if required by the Fairfax County Police Department or the FAA. A waiver of this requirement will be filed with the Zoning Administrator.

5. All antennas and related equipment cabinets or structures shall be removed within 120 days after such antennas or related equipment cabinets or structures are no longer in use.

Applicants' Response: All antennas and related equipment will be removed with 120 days in the event no longer in use.

Compliance with the Fairfax County Comprehensive Plan

The property is located in the Greater Herndon Community Planning Sector (UP4), Upper Potomac Planning District, Planning Area III. On page 24 of the "Overview: District- wide Recommendations, Public Facilities, Figure 7, Upper Potomac Planning District, Existing Public Facilities", "Herndon High School" is identified under Sector UP4. There is no specific Comprehensive Plan guidance for the High School property. The Comprehensive Plan map shows the property as planned for "Public Facilities, Governmental and Institutional" use.

On page 163 of the Area III Plan, "Recommendations, Land Use", the Plan states: "The Greater Herndon Community Planning Sector is largely developed with stable residential neighborhoods. Infill development in these neighborhoods should be of a compatible use, type and intensity in accordance with the guidance provided by the Policy Plan under Land Use Objectives 8 and 14."

Mobile and land-based telecommunication services provide for the wireless transmission of voice and data and include cellular and personal communications services (PCS), paging and wireless internet services and mobile radio. These services operate from wireless networks that are dependent on antenna devices and related equipment to transmit from a sender tipçmore receivers. Such services are viewed as a public necessity that benefits the c OW§ 1nrimo economic growth and vitality. NOV 2 0 2018

Zoning 8 Evalliatico Ditsis;v3i) The proposed facility is consistent with and furthers the goals of the Fairfax County Comprehensive Plan ("Comprehensive Plan"). The proposed structure will be located on publicly-owned property, will accommodate multiple carriers and be situated on the property adjacent to other tall vertical structures to minimize visual impacts on the site and surrounding area. The proposed facility is consistent with the stated Objectives of the Policy Plan of the Fairfax County Comprehensive Plan concerning Mobile and Land-Based Telecommunication Services as described below.

General Guidelines

Objective 43: In order to provide for the mobile and land-based telecommunication network for wireless telecommunication systems licensed by the Federal Communications Commission, and to achieve opportunities for the collocation of related facilities and the reduction or elimination of their visual impact, locate the network's necessary support facilities which include any antennas, support structures and equipment buildings or equipment boxes in accordance with the following policies.

Policy a. Avoid the construction of new structures by locating proposed telecommunication facilities on available existing structures such as rooftops, telecommunication and broadcast support structures, electrical utility poles and towers, and water storage facilities when the telecommunication facilities can be placed inconspicuously to blend with such existing structures. (See Figures 8, 9, 10.)

The development pattern in and around the search area is comprised primarily of single- family detached residential uses with primary zoning designations of R-1 and R-3 in the County and R-10 and R-15 in the Town (these Town designations also support single family residential uses). The only non-residential buildings are two nearby 1-to 2-story church structures with low rooftop steeples. The height of these church buildings will not meet coverage objectives and a new structure on the site would be more proximate to residences and public roadways. There are no other telecommunication towers or monopoles in the immediate area, or other tall structures that will accommodate the facility. To serve this area and meet the engineering and coverage requirements, it is necessary to construct a new structure of the height proposed.

Policy b. When existing structures are not available for co-location, or co-location is not appropriate because of adverse visual impacts or service needs, locate new structures that are required to support telecommunication antennas on properties that provide the greatest opportunity to conceal the telecommunication facilities and minimize their visual impact on surrounding areas.

The proposed facility will be located on a large public school site consisting of 40+ total acres that provides opportunities for concealment and reduction of visual impacts. The structure will be adjacent to the football stadium and amongst 8 tall light pole structures approximately 85 feet in height used to illuminate the football field area. The major equipment for tj,jity will either be located under the south bleacher section or located in a nearby sc & Ahing addition, there are 16 other shorter pole structures approximately 60-70 feet in height on the NOV 2 0 791R

9 zoning Evaiii.a;..6,1 school property to the north and west of the football field used to illuminate three other athletic fields used for baseball and soccer. When viewed from a distance from surrounding vantage points, the new monopole will be of a consistent height and extent and visually blend with these other tall site features. In addition, considerable areas of existing on- and off-site trees and vegetation surround the school property and will mitigate views from adjoining residential areas.

Policy c. When new structures or co-locations are required to serve residential neighborhoods, consider minimizing visual impacts on the surrounding area by utilizing camouflage structure design and/or micro-cell technologies or similar miniaturization technologies, such as distributed antenna systems (DAS), if feasible.

The proposed structure will not be camouflaged but will be located to visually blend with numerous other tall structures on the site. This will mitigate its visual presence similar to a stealth design and reduce its overall prominence. The use of DAS is not feasible to meet coverage objectives for this area.

Policy d. When multiple sites provide similar or equal opportunity to minimize impacts, public lands shall be the preferred location.

The subject property is publicly-owned and operated by the Fairfax County Public School Board. The features of this public site provide an excellent opportunity for screening and buffering and an appropriate setting for the proposed tree pole structure. Other available public sites in the area with an accessible location for a telecommunications facility provide no greater advantage for screening and locating the facility and providing compatibility with existing development.

Policy e. Locate mobile and land-based telecommunication facilities on public property only after a lease agreement between the County, or related board or authority, and service providers has been established.

Milestone has a lease agreement with the Fairfax County School Board to construct and locate the proposed facility on the Herndon High School property.

Policy f Ensure that the use of public property by mobile and land-based telecommunication facilities does not interfere with the existing or planned operational requirements of the public use and complies with adopted policies and plans to protect natural resources.

The Applicant has worked closely with Fairfax County Public Schools to locate the proposed structure on the school property in a way that does not interfere with the existing or planned operational requirements of the use or facility. The administrative office of the Fairfax County Public Schools has approved the location on site. 1 0 Zoning Evaluation Division Policy g. Co-locate mobile and land-based telecommunication facilities operated by different service providers on single sites and/or structures whenever appropriate. Locate single-use structures on a property only when a co-location structure for multiple service providers is not desirable or feasible due to technological differences, site limitations or visual impact concerns.

The proposed monopole will be designed to hold up to five telecommunication carriers. Sufficient space for related equipment will be located at the base of the structure and will be located under the south side bleachers at the football stadium or screened from view by a 10-foot tall fence with slats. No landscaping is proposed.

Policy h. Ensure that the height of the proposed telecommunication facility is no greater than necessary to allow for co-location on the telecommunication facility based on its service area requirements while still mitigating the visual impact of the facility.

The Sprint antennas will be mounted at a rad center of 120 feet above ground level. The overall height of the monopole is the minimum required to meet by Sprint's coverage objectives and technical requirements while also permitting space for additional future carriers at lower positions on the structure.

Policy i. When new structures, co-locations and/or technologies (such as distributed antenna systems, micro-cell technology or miniaturization technology) are necessary to meet the service area requirements for the residential neighborhood(s), ensure that the height and mass of any appropriate co-location on the telecommunication facility is in character with the surrounding residential area and mitigates the visual impact of the facility on the surrounding residential area.

The height and mass of the proposed structure is in general context with the other light poles located at the football field and will blend with these structures. The structure can accommodate and conceal additional users without impacting the character of the surrounding residential area.

Policy j: Design, site and/or landscape proposed telecommunication facilities to minimize impacts on the character of the property and surrounding areas. Demonstrate the appropriateness of the design through facility schematics and plans which detail the type, location, height, and material of the proposed structures and their relationship to other structures on the property and surrounding areas.

The attached Site Plan and related engineering drawings show the design of the monopole and compound area and their relationship to the school and nearby properties. Aerial photos and photo-simulations are also provided with the application to demonstrate the structure's relationship to the site and adjacent and surrounding properties and uses. The monopole's design will be compatible with the public school property and consistent with the other tall vertical structures on the property. Zoning 11 Evaluation Division extent of the new monopole will be in context with these structures and the property in general. Most equipment associated with the facility will be located near the monopole and underneath the football bleachers in a fenced compound.

Policy k: Demonstrate that the selected site for a new telecommunication facility provides the least visual impact on residential areas and the public way, as compared with alternate sites. Analyze the potential impacts from other vantage points in the area, especially from residential properties, to show how the selected site provides the best opportunity to minimize its visual impact on the area and on properties near the proposed site.

Photo simulations of the proposed structure show its appearance from 6 vantage points in the area and demonstrate the appropriateness of utilizing this site. As seen from the distance, the new monopole will blend with the numerous other poles on the property and will not be solitary or prominent but rather another vertical element on the school property. This overall context, the structure's distance to property lines, residences and roadways, and tree and vegetation in the surrounding area will serve to mitigate views of the structure from adjacent residential properties and communities. The photo simulations show that while the structure will be visible from several points in the surrounding area, it will be amongst the existing light poles on the property that are currently visible and will not become a prominent feature or obtrusion.

Policy I: A key concept in assessing telecommunication facilities is mitigation which is defined as actions taken to reduce or eliminate negative visual impacts. Mitigate the visual impact of proposed telecommunication facilities and their equipment, by using effective design options appropriate to the site such as:

• Design, site and/or landscape the proposed facility to minimize impacts on the character of the area;

• Locate proposed telecommunication facilities near or within areas of mature vegetation and trees that effectively screen or provide an appropriate setting for the proposed structure provided such location does not adversely impact sensitive resources or cause fragmentation of forested communities. When viewed in context, consider perspective views, relative topography and other factors, to mitigate the visual presence and prominence of the structure;

• Blend proposed telecommunication facilities with an existing pattern of tall structures;

• Obscure or block the views of proposed telecommunication facilities with other existing structures, vegetation, tree cover, or topographic features to the maximum extent feasible; and

• Replace existing telecommunication facilities with taller structures or extend their overall height to reduce the need for another structure when such height increases, or structure replacements are visually appropriate to the site, including the surrlittfit& area and are consistent with the type, style and pattern of the existing Ilgimetfluze4, -1---:— 9 7nning

The visual impact of the proposed 124-foot tall monopole will be mitigated by its location adjacent to an existing pattern of 8 tall lighting structures used to illuminate the football field and its proximity to another 16 lighting structures on the school property used to illuminate 2 nearby baseball fields to the west and a soccer/athletic field to the north of the stadium. Further, existing vegetation that borders the school property serves to mitigate views of the proposed facility from surrounding areas. The closest residential areas are along Parkstream Terrace to the north and Kingsvale Circle to the east, with the closest house to the proposed monopole being 325 feet to the north along Parkstream Terrace. A considerable mature wooded area to the north and east runs along the periphery of the school property and separates the two land uses. Most surrounding residences in these areas will have views of the monopole obscured by trees and intervening vegetation and as well as by other structures and buildings. The equipment compound area will be screened from view with a 10-foot chain link fence with privacy slats.

Policy m: Locate telecommunication facilities to ensure the protection of historically significant landscapes and cultural resources. The views of and vistas from architecturally and/or historically significant structures should not be impaired or diminished by the placement of telecommunication facilities.

The proposed use will not adversely impact historically significant landscapes or views or detect from any architecturally or historically significant structures in the area.

Policy n. Site proposed facilities to avoid areas of environmental sensitivity, such as steep slopes, floodplains, wetlands, environmental quality corridors, and resource protection areas.

The proposed use will be located in a developed area and will not impact any environmentally sensitive areas.

Policy o. Site proposed facilities to allow for future expansion and with corresponding levels of screening to accommodate expansion.

The proposed structure and leased compound area on the school property will provide ample space for Sprint and up to four additional telecommunication carriers while maintaining levels of screening.

Policy p. Design and site proposed telecommunication facilities to preserve areas necessary for future right-of-way dedication and ancillar easements for construction of road improvements.

The proposed location of the proposed use is interior to the public school property and outside of all public road rights-of-way. The proposed monopole will be used for mobile and land-based purposes.

Objective 44: Design proposed telecommunication facilities to mitigate their visual presence and prominence, particularly when located in residential areas, by concealing their intended purpose in a way that is consistent with the character of the surrounding area. (See Figures 11 and 12.)

Policy a. Disguise or camouflage the appearance of proposed telecommunication facilities to resemble other man-made structures and natural features (such as flagpoles, bell towers, and trees) that are typically found in a similar context and belong to the setting where placed.

The monopole will not be camouflaged but its appearance will blend with the numerous existing tall lighting features at the football stadium and on nearby athletic fields also on the school property.

Policy b. Design proposed telecommunications facilities that are disguised and camouflaged to be of a bulk, mass and height typical of and similar to the feature selected.

The bulk, mass and height of the proposed structure is consistent and will appear in context with the other 8 tall vertical light pole structures used to illuminate the football field on this portion of the public school property.

Policy c: Use other new and existing structures and vegetation of comparable form and style to establish a grouping that complements a camouflaged telecommunication facility and supports its design, location and appearance.

The facility will be set amongst and located in a grouping of 8 other existing tall structures on the school property used to illuminate the football field. These existing structures provide an established context for the property and will support the design and appearance of the new monopole. The selected location and existing site features in this area of the school property will provide context for the use and serve to obscure the facility.

Conclusion

In light of the foregoing, the Applicants respectfully submit that this Special Exception application is in compliance with the Fairfax County Zoning Ordinance and Comprehensive Plan.
