A fifth-grader in a San Diego classroom put it succinctly: “I like to play indoors better ‘cause that’s where all the electrical outlets are.” I believe our society is teaching young people to avoid direct experience in nature. That unintended message is delivered by schools, families, even organizations devoted to the outdoors, and codified into the legal and regulatory structures of many of our communities – effectively banning much of the kind of play that we enjoyed as children.

    I About the CoverAbout Cover Front Cover: The Tyler-Davidson Fountain The Tyler-Davidson Fountain, affectionately known as “the People’s Fountain,” after being restored, was rededicated “TO THE PEOPLE OF CINCINNATI” in May 2000. Throughout the decades, Cincinnatians have gathered at the fountain for public ceremonies, holidays, events, rallies, and the special celebrations that give community life its greatest meaning. Cincinnati philanthropist Henry Probasco commissioned the fountain based on the design of a young German sculptor named August von Kieling. The design depicted people in everyday pursuits enjoying the many uses and benefits of water. The fountain, crafted of bronze and porphyry stone, was first dedicated on October 6, 1871 on Probasco Place – later renamed Fountain Square. [Photography: City Manager’s Office.] Back Cover: Styler Davidsown Sow-tain The Big Pig Gig, which kicked-off on Fountain Square and ran from February through September 2000, was a collaborative effort of schools, businesses, non-profit organizations and area artists to unify Cincinnati’s art community and celebrate the City’s “Porkopolis” heritage. Over 400 fiberglass pigs were sponsored and later auctioned off to raise money for ArtWorks – an arts based employment and job-training program for youth in Greater Cincinnati. The Styler Davidsown Sow-tain made its debut in The Big Pig Gig in June, 2000. It bears an uncanny resemblance to the original fountain, complete with bronze coloring and water spraying from the top.     ENERGY STAR Success Story: Great American Ball Park, Cincinnati Reds Located on the winding banks of the Ohio River in downtown Cincinnati, the Great American Ball Park is home to the Cincinnati Reds, baseball's first professional franchise. The ballpark, built next door to the Reds’ former home, Riverfront Stadium, officially opened for the 2003 season. Equally as enthusiastic as their hometown fans, the ballpark’s management team continues to improve the ballpark’s energy performance and is a leader among stadiums nationwide. Energy Management with ENERGY STAR The Cincinnati Reds were one of the first Major League Baseball teams to join ENERGY STAR as a partner in 2008 and use ENERGY STAR resources to track energy usage, improve energy performance, and communicate their efforts to staff and the public. Improving energy performance is an important environmental strategy for the Reds and they have received kudos from local officials and enhanced loyalty from fans for leading by example. The ballpark operations management team benchmarks the ballpark’s energy performance using the U.S. Environmental Protection Agency’s (EPA) Portfolio Manager, an online energy tool to track whole-building energy intensity and greenhouse gas emissions. By inputting historical energy data going back to 2007, and ongoing monthly energy consumption and cost information, the Reds are able to measure progress and quantify improvements. To date, the ballpark’s energy intensity is 27 percent better than the national average for entertainment buildings1, even with an off-season construction project during the winter of 2009. As part of their energy management plan, the ballpark’s building operations management team implemented several energy conservation measures and integrated energy efficient technologies into the ballpark’s infrastructure.

Johnson Companies (S. E. Johnson) is a general contractor specializing in heavy construction, such as bridges and highways. On September 18, 2000, an employee of S. E. Johnson’s subcontractor fell 17 feet from an elevated work platform and was severely injured. On October 18, 2000, as part of its local fall emphasis program, Occupational Safety & Health Administration (OSHA) compliance officer Steven Medlock investigated the circumstances surrounding the accident (Tr. 21-22). As a result of the inspection, OSHA issued S. E. Johnson a serious citation on February 16, 2001. The Secretary alleges that S. E. Johnson insufficiently pre-planned for adequate fall protection in violation of § 1926.502(a)(2) (item 1). She further asserts that a section of guardrail had only one railing and that it was not anchored to withstand 200 pounds of force in violation of §§ 1926.502(b)(2) (item 2) and 1926.502(b)(3) (item 3). S. E. Johnson denies the allegations and asserts that if any violation occurred it was the result of the misconduct of the subcontractor’s employee. For the reasons that follow, the Secretary failed to prove a violation for oversight and fall protection planning (item 1).
