EX PARTE PRESENTATION OF THE COMMUNITY BROADCASTERS ASSOCIATION

1. In accordance with Sections 1.1200. J. J202 and] .1206(a) ofthe Commission's rules regarding ex parte communications in non-restricted proceedings, the Community

Broadcasters Association C'CBA") hereby submits this ex parte presentation to support its position in the Sixth Further Notice a/Proposed Rule Making in the above-captioned proceeding. As noted in CBA's own original comments in this proceeding, CBA is the trade association ofthe nation's low power television C'LPTV") stations. It conducts various activities on behalfofLPTV and represents the interests of the I,PTV industry in public policy forums.

2. Back~round. In its earlier comments and in ex parte meetings with the FCC staff since tiling those comments, CBA has expressed concern that the LPTV industry is being largely and unnecessarily ignored hy the Commission in proposing rules and procedures for the implementation ofdigital television ("DTY"). Puhlic interest mandates that the local service

CRA noted. inter alia, that LPTV stations should be considered and protected when finalizing and implementing the channel allotment table which will he used to effect the transition to DTV.

CRA urged the Commission to open the DTV technical standards to the public and provide time for LPTV operators to find a technically feasible DTV channels for their stations in the proposed allotment table before being displaced by existing full power licensees.

3. CBA's Recent Efforts. In recent months, at the urging of the Commission that the LPTV industry determine how low power television stations can be accommodated in the digital implementation process, CRA has started and is currently still in the process of developing an ATV allotment table that takes low power television stations into account when designating digital channels for all television stations operating on NTSC channels.

Initially. in order to consider LPTV stations when developing a new ATV table ofallotments. it was necessary for CRA to determine how many of those stations were truly operating nationwide. Because in many instances (and at the staffs own admission) the FCC's own LPTV database does not accurately reflect which LPTV stations are operating across the United States.

CRA sent out a survey to every low power station that it could locate nationwide in order to determine which LPTV stations are on the air and thus which ones should he considered when developing a new ATV allotment table to avoid their displacement by neighboring full power stations. eBA received survey responses from approximately 600 LPTV operators who asserted that they are now on the air in their respective communities and wish to be considered in the digital implementation process.:

CBA's next step was to incorporate those operating LPTV stations, along with all full power stations, into a computer program that would enable CBA to develop an ATV allotment table that gives each full power station a technically sound digital channel with 100% service area replication (all in accordance with the Commission's own technical standards), while preventing from displacement as many LPTV stations as possible. In order to create the least amount of change to the Commission's efforts, CBA started with the FCC's own computer program, along with the FCC's technical parameters. to develop a new ATV allotment table that considers the current channel placement of LPTV stations when allocating digital channels to full power stations in an effort to prevent from displacement the maximum number of LPTV stations.

5. Because of the magnitude of the project, CBA hired an independent consulting engineer who, along with the continuous help of several others, began to run the computer program initially for the Southeast region of the country. The result of that run of the full power and LPTV stations in the Southeast is attached in Exhibit A-2. The attached computer run of the Southeastern states accommodates over 80 LPTV stations in the southeast region of the country while still allowing 100% replication of service area for over 90% of approximately 300 full power stations in the same region. CBA proposes to use realistic changes in technical parameters of the stations, as proposed in its previous comments in

The list ofthose who responded to CBA's survey is attached in Exhibit A-I.

J response to issues raised in the Sixth Further Notice in this proceeding, to produce 100%

replication for the remaining full power stations.

6. CBA is currently running the computer program in the same way for the rest of

the country to develop a similar ATV table of allotments that will accommodate all full power

stations and as many low power stations as possible for areas outside the Southeast. However.

as the Commission knows from its own experience. a project of such magnitude takes time.

What has taken the Commission several years to develop without considering low power

stations at all, CBA has developed for full power and low power stations in approximately six

months. Furthermore, while the full power industry has been accommodated in the digital

implementation process at the government's expense. CBA members have spent over $50.000

of their own private money to develop a solution that will accommodate both full power

stations and low power stations. The fact that CBA has considered and saved from

displacement those low power stations in the Southeast region of the country is evidence that

such a feat is possible (f it is attempted in the first place. which was not the case with the

Commission's table as proposed in the Sixth Further Notice in this proceeding. In fact, such a

result is highly likely to happen throughout the rest of the country if only CBA is given time to finish the job that the government itself has chosen not to do.

7. In recent meetings with Commission staff, CBA has learned that the

Commission is also running the computer program that considers LPTVs to determine how many of those stations can be accommodated in the final ATV table of allotments and how many will be displaced While CBA certainly applauds any effort by the Commission to consider LPTV stations in the ATV implementation process. the Commission's efforts in this

4 regard will almost surely fail because the basic premise on which the Commission is basing its computer run is flawed. According to FCC staff members involved in the run, the

Commission's computer run allots digital channels to all existing full power stations across the country, without considering the current NTSC channel position of LPTV stations, and then goes back through the process to insert as many low power television stations as possible into the remaining channels without creating interference to the full power allotments. Thus, a far too widespread result of the Commission's method is that an LPTV station is displaced by the digital assignment of a full power station to the low power station's NTSC channel, where the full power could have just as easily moved to another digital channel in the area (without a technical problem) and the low power would not have heen displaced. The flaw in the FCC's method is that if the low power stations are never put into the computer run initially, the resulting table (which allots the channels randomly based on the technical parameters presented to it) will inevitably result in the digital assignment of some full power stations on channels where low power stations currently operate, resulting in displacement of the low power stations.

8. CBA's computer run, on the other hand, starts with all full power and low power stations on an even playing field and allows the computer to generate a table of allotments that takes all of those stations into consideration. As indicated above, the result has been extremely positive in the Southeast, where over 80 low power stations have been accommodated and CBA has every reason to believe it will be no different in other regions of the country. Therefore, the Commission should delay issuing an ATV allotment table that does not prevent from displacement the majority of low power stations across the country until

5 CBA has had the opportunity to complete and present its own computer run to the Commission

as an alternative to the FCC's allotment table, a process which CBA has already indicated will

require approximately 60 more days.

9. Timetable for Commission Action, In light of the above, the Commission's

issuance of a decision that includes a final ATV table of allotments which displaces many

LPTV stations before CBA can present its own nationwide table of allotments which saves the

majority of LPTV stations from displacement is unjustifiable and against the public interest.

However, CBA is fully aware of the pressure that the FCC is receiving from various sources

to implement a move to digital television as soon as possible, Thus, if the FCC feels that it

must for whatever reason issue a decision in the above-captioned proceeding before CBA can

submit its completed allotment table that accommodates the majority of LPTV stations, at the

very least, CBA urges the Commission to adopt a decision that only pertains to the technical and substantive issues in the proceeding other than the allotment table. In that way, CBA can present its own table as soon as its computer run is complete which will consider and prevent from displacement LPTV stations that are not considered and are currently threatened in the

Commission's allotment table.

10. Flexibility in Any Adopted Table. Alternatively, CBA urges that any ATV allotment table that is adopted before CBA has the opportunity to present its own table be flexible enough to be changed once CBA submits its table which will take into account LPTV stations. For instance, if the Commission adopts an implementation plan that requires full power stations in the top ten markets to switch to digital within 18 months, CBA requests that it at least be given the opportunity to work with the allocations table with respect to the

6 remaining markets to account for LPTV station presence in those areas, thereby allowing ATV implementation to begin but saving as many LPTV stations as possible from unnecessary displacement.

II. Additionally. ifa final table that displaces any LPTV stations is adopted, those displaced stations should be allowed to independently come to the Commission with a technically sound channel they have found to which they can move their operation and the

Commission should allow that displaced station to use the replacement channel for its operation without the station being subject to competing applications or comparative hearings for the substitute channel. This process will allow many LPTV station licensees to prevent their stations from going offthe air even ifthe Commission chooses not to or cannot prevent the initial displacement.

12. Use of Frequency Coordination Committees. In the Sixth Further Notice in this proceeding, the FCC sanctioned broadcasters' use of industry assignment coordinating committees to evaluate proposals for post-assignment changes to the ATV table of allotments. i

However, presumably because it is not in the best interest of many full power stations to involve their low power competitors in those committee discussions, many low power stations have not been able to gain access to them, and thus are not considered when full power stations in a particular area agree to alter the FCC's ATV table of allotments in some way. This anticompetitive and unfair practice must stop. CBA urges the Commission to require that full power and LPTV stations alike be given notice of and access to these coordination committee

7 meetings and discussions in order to prevent unnecessary displacement of low power television stations in many areas across the country.

13. Conclusion. For the reasons set forth above. the Commission should consider the results of CBA's efforts as described herein and as attached in Exhibit A in order to preserve the interests of LPTV stations when implementing rules and policies which govern the transition from NTSC to DTY. CBA is not advocating any preference of low power stations over full power stations, merely that the Commission begin with an even playing field in developing a tinal ATV allotment table so that the fewest number of low power stations will be displaced as possible in the process ofconverting U.S. broadcasters to digital television. There is no excuse for the Commission's turning its back on a solution Ihal has every chance oj"working as long as it is considered in response to political, industry and other pressure to implement a transition to digital television as soon as possible; the result will undoubtedly be a quick and unjustifiable death blow to the majority of low power television stations who provide quality local programming across the country. In the scope ofan entire proceeding that has spanned nearly a decade. sixty days is not a long time to wait to avoid such a disastrous result.
