THURSDAY, 16 MARCH, 2017 TIARA TAKES CHAMPION HK INTERNATIONAL SALE A >STAR=-STUDDED AFFAIR by Alan Carasso CHASE CROWN For many years a part of the festivities of Hong Kong International Races week, officials at the Hong Kong Jockey Club took a decision in 2014 to push the sale forward a few months, reasoning that the extra time could do a world of good for the young horses. The auction is unique, as it is exclusive to members of the Hong Kong Jockey Club and will take place with cocktail party-esque glitz and glamour in the Sha Tin parade ring Friday evening (Hong Kong time) beginning at 7:45 p.m (7:45 a.m ET--click for a live webcast). Though the sale has had its fair share of marquee results down the years, including G1 Hong Kong Mile winner The Duke (Aus) (Danehill) (HK$1.6 million purchase) and world champion and treble Hong Kong Mile hero Good Ba Ba (Lear Fan) (HK$1.7 million), >TDN Rising Star= Pakistan Star (Ger) (Shamardal) could take the event to new heights this weekend. • In Legislative Drafting
M E M O R A N D U M To: John A. C. Keith Chairman, Boyd-Graves Conference From: Committee on Using “Shall” in Legislative Drafting Date: August 16, 2018 EXECUTIVE SUMMARY This Committee was asked to study the use of the word “shall” in legislative drafting and to make appropriate recommendations. We have unanimously concluded that shall is susceptible to significant ambiguity and that the better practice in legislative drafting would be to eliminate shall altogether and to use the more precise term intended—such as must, may, will, should, is, or is entitled to. This is the so- called “ABC Rule,” named for the Australian, British and Canadian scholars who strongly advocated it in the late 1980s. The ABC Rule has been recommended by the vast majority of modern scholars of legislative drafting and was adopted in the mid-1990s by the federal Standing Committee on Rules of Practice and Procedure. The alternative approach is the so-called “American Rule,” followed by most but not all States. Under the American Rule, the term shall is used only to indicate a mandatory duty or obligation. We are informed that the Division of Legislative Services generally tries to follow that rule as well. But the Committee agrees with the scholars and the federal Standing Committee on Rules of Practice and Procedure that, notwithstanding their best intentions, lawyers and legislative drafters have not used shall with sufficient consistency to warrant continued confidence in that approach. Our conclusion is confirmed by selected examples drawn from the Code of Virginia and from the Rules of Supreme Court of Virginia.

$250,000 Pat Day Mile Presented by LG&E and KU (Grade III) 92nd Running – Saturday, May 7, 2016 (Kentucky Derby Day) 3-Year-Olds at One Mile on Dirt at Churchill Downs Stakes Record – 1:34.18, Competitive Edge (2015) Top Beyer Speed Figure – 112, Richter Scale (1997) Average Winning Beyer Speed Figure (since 1992) – 99.9 (2,398/24) Name Origin: Formerly known as the Derby Trial, the one-mile race for 3-year-olds was moved from Opening Night to Kentucky Derby Day and renamed the Pat Day Mile in 2015 to honor Churchill Downs’ all-time leading jockey Pat Day. Day, enshrined in the National Museum of Racing’s Hall of Fame in 2005, won a record 2,482 races at Churchill Downs, including 156 stakes, from 1980-2005. None was more memorable than his triumph aboard W.C. Partee’s Lil E. Tee in the 1992 Kentucky Derby. He rode in a record 21 consecutive renewals of the Kentucky Derby, a streak that ended when hip surgery forced him to miss the 2005 “Run for the Roses.” Day’s Triple Crown résumé also included five wins in the Preakness Stakes – one short of Eddie Arcaro’s record – and three victories in the Belmont Stakes. His 8,803 career wins rank fourth all-time and his mounts that earned $297,914,839 rank second. During his career Day lead the nation in wins six times (1982-84, ’86, and ’90-91). His most prolific single day came on Sept. 13, 1989, when Day set a North American record by winning eight races from nine mounts at Arlington Park.
