OVERVIEW

The Emergency Alert System (EAS) provides the President with the capability to relay immediate communications and information to the general public at the national, state, and local area levels during periods of national emergency. The EAS may be used to provide the heads of state and local government, or their designated representative, with a means of emergency communication to the public in their state or local area via electronic media. The Federal Communication Commission (FCC) has published information on the EAS in several handbooks for radio, television and cable operators. They are available at the FCC’s website, https://www.fcc.gov/general/emergency-alert-system-eas-0 .

This is the Emergency Alert System Plan for the State of Delaware. This plan is a Federal Communications Commission (FCC) mandated document that provides guidelines for Delaware broadcasters, cable television operators, and other EAS participants (as provided by 47 CFR Sec. 11.2), as well as designated government officials, to relay emergency information and instructions throughout the state. This plan is an adjunct to the FCC EAS Rules and is not meant to be a substitute. Part 11 of the FCC Rules contain the general rules regarding the Emergency Alert System. This plan was developed by the Delaware State Emergency Communications Committee (DE SECC).

Governance Requirements of the FCC –

(1) What are your SECC's duties and responsibilities?

Recruit volunteers for the committee, track rule changes and FCC recommendations and requirements on EAS, discuss and work with setting up the best Local Primary stations so we have a working daisy chain to distribute EAS messages throughout the state, and work out a plan everyone can use to guide them in the dissemination of emergency messages to the public in their area. The SECC members also help EAS participants with EAS problems being experienced. The committee will also contact EAS participants about information they need to know, and provide notices of meetings.

(2) How are the SECC Members and leaders selected? Do your SECC's members represent all alert originators in your state?

Members may volunteer to help, and/or are nominated, and are selected by a vote at the annual meeting. The committee members are elected and choose a chairperson to recommend to the FCC. The Delaware SECC represent all EAS participants and include all alert originators in the state.

(3) What is your SECC's administrative structure? (e.g., How are decisions made in your SECC?)

The Delaware State Emergency Communications Committee (DE SECC) has approved a set of Bylaws and follows those rules in making decisions for the Delaware State EAS Plan. The structure is: Chairperson, Vice Chairperson(s), Secretary, Emergency Management Representative.

PLAN SUMMARY

This Delaware EAS statewide plan contains basic operational procedures for national, state, and local activations, the EAS Monitoring Matrix, testing procedures, and script samples that may be used by stations.

To understand FIPS Code setup: First number is subdivision, next two numbers state, last three county, or area. Subdivisions – (0=all, 1 NW, 2 N central, 3 NE, 4 W central, 5 Central, 6 East central, 7 SW, 8 South central, 9 SE.) Subdivisions are not always used, but could help indicate smaller area(s) affected.

*The future of warning will be able to include fast graphic warning zones using HD TV and ASTC 3.0 standards. Like what is being used in WEA warnings now, it will then be possible to warn just people in or near the danger area. As zip codes are already well known, it is believed that it will be needed for quick home warning set up. So we are including them here to assist with future warning development. Probably not all zips included will be needed. A future extension of this listing would be able to use the zip codes to help determining what locations fit into what subdivision.

Note on change of designation for some stations from SR to LP -

State Relay (SR) has a new national definition – the route a state or local authority uses to activate the EAS for state or local events. This superceeds the commonly accepted definition of a station who relays EAS messages for another downstream station who can not easily receive one of the designated LP stations directly. So to make it easier for the stations who need the extra assistance the old style SR will now be listed as additional LP stations.

Alerting Procedures – List and describe all procedures by which state officials, the NWS, and EAS Participants use the EAS to transmit information to the public during an emergency.

State/Local Designated public officials have the authority to activate EAS, as identified in local memorandums of understanding or county EAS Plans. Participation in the state and/or local area EAS is voluntary for EAS participants. EAS participants sending and receiving messages must carry them in their entirety, including all beginning and ending digital information so the end of message (EOM) tones are transmitted and received by all participants.

 Broadcast and Cable Stations can decide on a local individual basis, whether to broadcast a voluntary EAS alert. It is recommended that such announcements be included in local programming in a timely manner.

 Delaware Emergency Management Agency (DEMA) is the Governor’s designated representative and may issue emergency alerts for statewide emergencies. Verification or authentication is accomplished through the EMnet System provided by DEMA to the Local Primary sources (LP-1s). See EMnet section on page 16 for more information. EAS can be activated on the state level by DEMA, or the Delaware State Police (DSP).

 State Public Safety Answering Points (PSAPs) 911 Centers have the authority and capability to activate EAS, but only for an Amber Alert activation, when a failure of the Delaware State Police (DSP) Headquarters Communications Center (HQCC) EMnet equipment has occurred. DSP must authorize such activations, or the significant loss of the ability of the public to contact the 911 center (with a TOE alert). In which case activation alerting the public of phone failure will be limited to radio/cable/TV stations for the particular county 911 Center affected. The 911 Centers are located in each county (Minquadale in New Castle County, Dover in Kent County, and Georgetown in Sussex County).

All EAS event codes can be sent through NOAA Weather Radio if desired. To do this the activating agency needs to provide the following information to the National Weather Service (NWS): The event code, the area affected (county, and community in the county if it is a smaller area), the text of the message, and the duration for the activation (meaning the length of time the emergency will present a public danger) as this lets the broadcast and internet community who will carry the alert information on the air or in a web page, determine how long they should do it. This can be provided by the NWS field office by telephone or fax. Please note: the NWS will send the message only to NOAA Weather Radio that serve the affected area.

Monitoring for National Weather Service Alerts in Delaware -

It is recommended that EAS Participants monitor alerts from the National Weather Service (NWS) to provide timely warnings for their audience. To the event that other methods besides monitoring NOAA Weather Radio (NWR) may be faster, we encourage EAS participants to use faster resources. Stations with EMnet equipment can use EMnet to provide weather information, and this is one of the fastest ways. A private satellite service might be another way. Or IPAWS/CAP messages, which all EAS participants are required to have the capability to receive. It is recommended that only one source for NWS alerts be used as the use of more sources might cause duplicate interruptions for the same alert. Also some methods send alerts in a different fashion, or provide information only for a specific zone. It is up to the EAS participant to choose the method that they want to use. Event codes the Delaware SECC recommends are listed with the event codes.

We would like to encourage that Mt. Holly NWS Forecast Office for our area use IPAWS/CAP messaging as much as possible as this allows multiple language warnings to be done more easily.

EMnet [EMERGENCY MESSAGING NETWORK]

The Delaware Emergency Management Agency (DEMA) is the lead agency in the state for EMnet. EMnet is a messaging system that uses satellite and internet communications links to tie users together. It can be used for secure messaging between users, as a tool to activate the state’s EAS and the state’s AMBER and Code Blue Plans.

911 Supervisors and EOC Managers are responsible for the security and use of EMnet hardware and software. These Supervisors and Managers are also responsible for ensuring that there is no misuse of the EMnet capabilities. Failure to ensure these protocols may result in the removal of EMnet equipment from the offending location.

Trouble with EMnet equipment shall be reported to the Delaware Emergency Management Agency (DEMA), Robert Pflaumer, EAS/EMnet Coordinator at [email protected]. DEMA will make the appropriate contacts to have the equipment repaired, if possible, however all costs are the responsibility of the radio or television station, or cable operator.

AMBER: {AMERICA’S MISSING: BROADCAST EMERGENCY RESPONSE}

The AMBER plan was originally started in Texas in 1996 after the abduction and murder of nine- year-old Amber Hagerman. Responding to this tragedy, the Dallas/Ft. Worth law enforcement community and the Association of Radio Managers pioneered the “AMBER Plan.” The Amber Plan is a warning system available for use by law enforcement to alert the public through the Emergency Alert System, when a child has been abducted and police believe the child is in imminent danger of serious bodily injury or death. Under the Plan, radio and television stations will timely broadcast information about the child abduction so that the general public might assist in the child’s recovery. Since 1996 more than 830 children have been safely returned as a result of this system.

When child abduction occurs anywhere in the State of Delaware, law enforcement and broadcasters will work together and proceed with a common goal in mind: the swift and safe return of the abducted child.

The Delaware state authority for activating EAS for AMBER alerts is the Delaware State Police Public Information Officer (DSP PIO). Following the AMBER Plan, police agencies will contact the DSP PIO who will assure the request meets the plan protocol. When that is established, the DSP PIO will contact DSP Communications, who will activate the alert using their EMnet equipment. The DSP PIO will coordinate and monitor all AMBER activations and will be responsible for their accuracy, as well as the event ending message.

The state has an AMBER Plan Committee to review all Delaware AMBER Plan activations within 30 days of each activation. This committee includes a representative from each of the following agencies: Attorney General’s Office, Delaware Police Chief’s Council, DEMA, Delaware State Police, Delaware’s Missing Children Information Clearinghouse, /CD/Delaware Broadcaster’s Association, and the Governor’s office.

AMBER PLAN (AMERICA’S MISSING: BROADCAST EMERGENCY RESPONSE)

REQUIREMENTS FOR PARTICIPATING LAW ENFORCEMENT AGENCIES AND BROADCASTERS

1. Initial reporting officer responds to call and takes detailed information. 2. Initial reporting officer notifies detective in large agency or chief/captain in smaller agency with details of abduction. 3. Detective or chief confirms abduction. 4. Detective or chief/captain notifies Delaware State Police Public Information Officer who makes decision whether initiating the AMBER Plan is appropriate. 5. Delaware State Police Public Information Officer notifies Delaware State Police Communications (DEMA building) by fax, radio and telephone with all relevant information. 6. Delaware State Police Communications will immediately notify media outlets. 7. Media outlets will broadcast alert through the Emergency Alert System to all participating radio and television stations within fifteen minutes of its receipt. This alert should be broadcast every 15 minutes for the first two hours and every 30 minutes for the next three hours. This alert should include a contact telephone number and conclude with the statement that person(s) who may locate the abductor should take no action other than call the police as soon as possible and provide them with the location. 8. Media outlets should be updated as more information becomes available, including child’s photograph. 9. The law enforcement agency responsible for the investigation should have a 24-hour telephone number prepared to give out to the public during the alert message. The agency must be able to field numerous complaints at the same time. 10. Delaware State Police Public Information Officer should notify National Center for Missing and Exploited Children and Delaware’s Missing Children Information Clearinghouse so that information can be made available through their website (www.dsp.delaware.gov). 11. If the child is recovered or the alert becomes unnecessary, reporting agency must immediately notify Delaware State Police Public Information Officer, who informs Delaware State Police Communications, who relays that information in the same fashion as the initial alert. 12. Officer enlisted with obligation of determining the necessity of activating AMBER Plan should receive training on a yearly basis. All officers can benefit from watching AMBER Law Enforcement and Broadcaster Guide video. 13. AMBER Plan Committee should be formed to review all Delaware AMBER Plan activations within 30 days of alert activation. Title 11, Chapter 85 of Delaware Code, Subchapter VIII establishes the Blue Alert Program for Apprehension of Persons Suspected of Killing or Injuring Law-Enforcement Officers. The Code mandates that each investigating law-enforcement agency shall implement an alert program and may promulgate necessary rules and regulations to implement the program. As stated in the subchapter:

(a) The Blue Alert Program shall be activated when a suspect for a crime involving the death or serious injury of a law-enforcement officer has not been apprehended and may be a serious threat to the public. Upon notification by an investigating law-enforcement agency that a suspect in a case involving the death or serious injury of a peace officer has not been apprehended and may be a serious threat to the public, the investigating law-enforcement agency shall activate the Blue Alert system and shall notify appropriate participants in the Blue Alert system, as established by reg- ulations promulgated pursuant to this subchapter, when the investigating law-enforcement agency believes that:

(1) A suspect has not been apprehended;

(2) A suspect may be a serious threat to the public; and

(3) Sufficient information is available to disseminate to the public that could assist in locating and apprehending the suspect.

(b) When a Blue Alert is activated pursuant to subsection (a) of this section, the investigating law-enforcement agency shall provide the descriptive information to the Delaware Criminal Justice Information System and the National Crime Information Center system. The investigating law-enforcement agency shall also notify the Delaware Information Anal- ysis Center, which shall make all necessary notifications and provide appropriate assistance to the investigating law- enforcement agency.

(c) When an investigating law-enforcement agency receives notice that a law-enforcement officer has been seriously injured or killed, the agency shall send an alert to designated media outlets in Delaware. The alert must include all ap- propriate information that may assist in the speedy apprehension of the suspect, including a statement instructing any person with information relating to the incident causing the serious injury or death of the law-enforcement officer to contact the investigating law-enforcement agency.

(d) The investigating law-enforcement agency shall assess the appropriate boundaries of the Blue Alert based on the nature of the suspect and the circumstances surrounding the crime. The Blue Alert area may be less than statewide if the investigating law-enforcement agency determines that the nature of the event makes it probable that the suspect did not leave a designated geographic location.

A Blue Alert is terminated in the following manner:

(a) The investigating law-enforcement agency shall terminate the Blue Alert with respect to a particular suspect when the suspect is located or the incident is otherwise resolved, or when the investigating law-enforcement agency deter- mines that the Blue Alert system is no longer an effective tool for locating and apprehending the suspect.

(b) The investigating law-enforcement agency shall notify other law-enforcement agencies, Delaware Criminal Justice Informa- tion System, National Crime Information Center, the Delaware Information Analysis Center, and other appropriate participants in the Blue Alert system, when a Blue Alert for a particular suspect has been terminated. The investigating law-enforcement agency shall also notify the designated media outlets when a Blue Alert for a particular suspect has been terminated.

Alerting Procedures –

Describe all procedures used by your state to conduct special EAS tests and RMTs.

EAS TESTING

Weekly Local Tests are to be made once weekly:  on random days  at random times

Monthly Schedule During odd months tests will be performed during the day and during even months test will be performed at night.

 Jan-Mar-May-July-Sept-Nov Daylight hours (8:30 am to sunset)  Feb-Apr-June-Aug-Oct-Dec Night/Overnight (sunset to 8:30 am)

The Delaware Test is done on random days of the month. It is done between the 10th and 20th day of the month.

National Tests

All EAS participants (regulated by the FCC) are required to transmit any national EAS tests received immediately. These tests are usually designated with the EAS event code “NPT”. They are scheduled tests that are announced ahead of the test event to prevent panic. For national tests participants must also file reports of these tests, which does require registration ahead of time. So be sure to file all the parts.

REPORTING AND RESOLVING EAS ISSUES

Stations should contact issuing SP or LP to report missing or garbled tests and activations. Ask for a written response as to the root cause, as required for all EAS logs. If no response from SP or LP, escalate the issues to the SECC and/or our DEMA Representative.

Rules for How to handle a False EAS Alert -

Anytime a false EAS message is released to the public, the agency issuing the alert will have to issue an “all clear” message to the public via EAS to address the situation for the benefit of the public and EAS participants.

This will be done using the CEM code.

The message will entail that:

(1) A [type of alert] alert was issued at [the time of the original alert], (2) The alert was issued by mistake, (3) There is NO actual EMERGENCY. (4) We apologize for the inconvenience that this may have caused, and (5) Thank you for your understanding.

This message must be done as quickly as possible, immediately after it is realized that it went out to the general public.

New FCC rule on False Alerts broadcast to the public -

Broadcasters and Cable Operators are to report any false alerts issued within 24 hours after discovering the false alert was distributed to the public.

The report that a false EAS alert was issued must be sent to the FCC Ops Center at:

The email should include: information informing the Commission of the event, and any details that the EAS Participant may have concerning the event.

CAP Alerting Procedures – Describe how CAP-formatted messages will be aggregated and distributed to to EAS participants within your state. If desired, you may attach relevant IPAWS, governmental, or vendor documentation to supplement your answers, as needed below.

COMMON ALERTING PROTOCOL (CAP)/IPAWS

The FCC requires that all broadcasters and cable operators have EAS equipment that allows the reception of Emergency Messages via an internet connection using the Common Alerting Protocol (CAP).

This is the IPAWS server to receive emergency messages via the internet. Currently a region wide Required Weekly Test (RWT) is sent every Monday at 11:00 AM for recipients in the Eastern Time Zone. The Required Weekly Test (RWT) and Required Monthly Test (RMT) messages received are logged from your assigned LP stations; these IPAWS/CAP messages also must be logged in your EAS records.

Delaware has fully compliant CAP capability via EMnet equipment. EMnet EAS messages have fully embedded CAP messages with a full referenced mp3 digital audio file, so it can be a potential source for CAP, as well as the normal EAS activation and audio. EMnet is a CAP-based Emergency Messaging system and it will allow our submission of EAS messages into the IPAWS system. This enables the message to be used in many ways to warn others as well as serving as the way Delaware currently does EAS with a full audio alert from the LP station in the relevant area.

EAS participants may use any alert received by your EAS equipment that is appropriate for the outlet’s audience, including those from IPAWS. IPAWS does not currently have audio capability, but it does have the ability to reference a location on the internet for an audio file containing the recorded vocal alert message that can be retrieved. This audio file will have better quality than using text to speech. In order to use an IPAWS text message without the extra audio file, you must have a method of performing text to speech that can be understood and is acceptable to the FCC. FCC rules require the audio be of good quality and easy to understand.

COMMERCIAL MOBILE ALERT SYSTEM (CMAS) AND WIRELESS EMERGENCY ALERTS (WEA)

The Commercial Mobile Alert System (CMAS) is the system interface to the Wireless Emergency Alerts (WEA) service that wireless carriers began to roll out nationwide in 2012. CMAS is a partnership between FEMA, the Federal Communications Commission (FCC), and wireless carriers, to enhance public safety. The rules for CMAS are published by the FCC at 47 CFR 10.

CMAS allows public safety authorities to use FEMA’s Integrated Public Alert and Warning System (IPAWS) Open Platform for Emergency Networks (IPAWS-OPEN) to send geographically targeted, text-like Wireless Emergency Alerts to the public. WEAs will relay Presidential, AMBER, and Imminent Threat alerts to mobile phones using cell broadcast technology that will not get backlogged during times of emergency when wireless voice and data services are highly congested.

CMAS/WEA complements the existing Emergency Alert System (EAS) which sends warnings to television and radio via broadcast, cable, satellite, and wireline communications pathways.

The State of Delaware is a participant in the CMAS/WEA system.

SECC Recommendation to use IPAWS for Activations - (proposed)

The SECC would like to recommend the use of IPAWS/CAP for all State and Local EAS activations. It provides an extra route of connection, the potential of clearer audio, and a faster, more inclusive method of message distribution.

Multilingual Alerting

In accordance with the guidance provided in Public Notice, 33 FCC Rcd 3568, DA 18-358, EB Docket 04-296 (Apr. 11, 2018) (“FCC 2018 PN”) issued by the FCC, Public Safety and Homeland Security Bureau Informs State Emergency Communications Committees How to Prepare and File Summaries of Multilingual EAS Activity Received from EAS Participants, the Delaware SECC compiled information submitted by EAS broadcast and cable participants regarding their current and future actions to provide emergency alert content to the non-English speaking public in languages other than English “to ensure that the Commission has sufficient and accurate information on any existing and planned activities by EAS Participants to provide EAS alert content in languages other than English to their non-English speaking audiences.”

The following information has been updated since the May 2018 deadline for providing information to the Commission:

◦ There are approximately 40 broadcast EAS participants in Delaware. When the Delaware SECC conducted a survey relating to multilingual alerting, the Delaware SECC received responses from approximately 37 EAS Participants.

◦ Less than 1% of Delaware stations broadcast in a language other than English, and in all cases the programming is in Spanish.

◦ No respondents to the Delaware SECC’s survey are currently providing EAS alerts in a language other than English.

◦ No Delaware EAS Participant respondents have indicated that that they have current plans to provide, in the future, EAS alerts in a language other than English.

The Delaware SECC also received feedback from EAS participants that any effort to establish expectations for multilingual alerting must address criteria and guidelines for the generation and transmission of non-English alerts.

Local Area Plans –

Local Area Plans contain procedures for local officials of the NWS to transmit emergency information to the public during an emergency using EAS. Does the state wish to include information from one or more LECCs to its State EAS Plan? This is where a local area plan would be added.
