III. Antitrust Statement - Information only Leonard Murphy, Vice President and General Counsel

The Property & Liability Resource Bureau intends to prevent any violation of antitrust laws at all its meetings and conferences.

Advisory Board members must remember that their respective firms are competitors in the marketplace and that the McCarron-Ferguson Act and the laws of some states provide the insurance industry with only a very limited immunity from federal antitrust scrutiny. Therefore, Advisory Board members must exercise care in their discussions since even innocuous discussions of certain topics might later be misinterpreted as evidence of collusion.

Staff requests that, at the meeting of the Advisory Board and the events connected with this meeting, there be no discussion or agreement, formal or informal, expressed or implied, as to any matters which might give rise to an allegation of violation of antitrust laws. Subjects to avoid include:

a. Rates; b. Underwriting policies; c. Marketing strategies; marketing responses to legislative, regulatory, or other developments; d. Prices or costs of any products or services offered for sale by insurers or purchased by insurers; e. Individual insurance company positions on coverage issues and other matters of insurance policy interpretation; agreements or understandings relating to claim practices, policies, or positions. f. Standards by which the performance of any insurer could or should be judged; codes or ethics; g. Advantages or disadvantages of doing business in certain states; h. Refusal to deal with, or boycott of, potential insureds or suppliers of products or services; use of particular supplies of products or services; and, i. Cost or profits of any aspect of any of the above.

IV. PLRB Mission Statement - Information only

The PLRB is organized to operate exclusively for the following purposes:

1. To concern itself with, and to encourage productivity and efficiency in, the property and liability loss and claim adjustment process of its members and the property and casualty insurance industry as a whole; 2. To disseminate information on property and liability issues among its members and within the property and casualty insurance industry; 3. To promote education and new and beneficial developments within the property and casualty industry; and 4. To engage in any and all lawful activities that may be incidental or reasonable related to the foregoing purposes.

2016 President's Report to the PLRB Advisory Board

Trend Spotting

There is a long history at the PLRB of producing high-quality products and services that are need and used by the member companies. The PLRB is a major source of data, information, and training for the members. The PLRB Search database and the Catastrophe database are loaded with useful and important information. The Conferences, Webinars, Distance Learning Modules, and the associated educational materials are important elements in the professional development of adjusters.

What I have mentioned above relates to events or things that have occurred. While the staff excels on making sense of the past, it also has enormous talent to spot emerging trends. They are strategically positioned to identify potential trends that would affect future claims operations.

The property and liability legal department coverage attorneys respond to thousands of coverage questions annually. Those inquires, combined with analysis of what is being researched online in PLRB Search, allows the staff to spot emerging trends. Some of these trends include:

• Cyber security; • Unmanned Aerial Vehicles (UAV), also known as drones; • Driverless cars; • Sharing economy, such as ride and residence sharing; • Internet of things; and • 3D printing.

Staff also regularly receives advice and counsel from member company claims executives and managers. The willingness of member company leadership to meet with PLRB's senior staff to discuss observations of potential emerging trends helps us develop a strategic overview of an issue.

This meeting of the PLRB Advisory Board will conclude the planning process for development and delivery of new items to be added to our inventory of products and services available to your staff. The recommendations coming from this meeting will be analyzed, digested, and discussed by the PLRB staff. We will look at staff availability to undertake and complete a new project, determine the costs, establish priorities, and then report the finding to the Board of Directors in November, along with a set of recommendations.

The PLRB staff understands that the data, information, and education we provide the member company claims people is needed for them to do their jobs well. It is a responsibility that we take seriously. We all work hard to continue earning the trust of you and your staff. Our search for emerging trends is on-going. It never ends.

You are a critical component in PLRB's success. On behalf of the staff, as well as the member companies, I thank you for the time and talent that you are sharing with us today.

1. PLRB Enewsletters - Refresh and update 2. PLRB Meetings Website - Redesign each website, including the registration systems 3. Google Search Appliance - Monitor and possibly transition to Google Cloud 4. PLRB Search and PLRB Website - Continuous improvements.

B. Property Legal Services Jeff Kerensky, Vice President, Property Legal Services

Proposed 2017 Projects - The following proposals were submitted to the Products and Services Committee for consideration and discussion at its 2016 meeting.

1. Terrorism - Staff proposes to review and update, as needed, the PLRB discussions on terrorism coverage.

2. Zika Virus - Prepare a white paper on possible coverage issues arising from the issues associated with it.

3. ISO Personal and Commercial Lines Endorsements - Annotate, or create annotations, of the common forms.

4. Crime Form Q & A - Prepare a publication that is similar in format to the one created for the Inland Marine forms.

Additional PSC Recommendations

1. PLRB Search - Develop a new search method using policy language terms. 2. Endorsement annotations a. Computer fraud and funds transfer, CP 04 57; b. Sewer back up/sump overflow, possibly related to equipment such as a siphon pump; c. Limited fungi; and d. Mechanical breakdown coverage, HOS 03 66. 3. ISO Crime Form Annotation; 4. Decomposing bodies; and 5. State-by-State Annotations a. Overhead and profit for general contractors; and b. Loss of use.

Casualty Case Law, Trends and News Items - A new attorney has been added to the Casualty Resource staff to enhance the flow of new information that is provided to the member companies. What, if any, additional developing areas should be monitored and reported in addition to the PLRB's current new casualty case law and related industry news?

Additional PSC Recommendations

1. Coverage - Information on coverage issues for people living in the U.S. illegally; 2. Annotation - State-by-state annotation regarding triple net lease issues. 3. CGL Policy- Additional Insured Endorsements - Assistance for future endorsements due to hold harmless/indemnity agreements that may arise from future "Internet of Things" exposures.

11 D. Catastrophe Services Hugh Strawn, Vice President, Catastrophe Services Peter Balingit, Director Catastrophe Services

Proposed 2017 Projects - The following proposals were submitted to the Products and Services Committee for consideration and discussion at its 2016 meeting.

Focused Maps and Apps - Create additional maps and apps as needed, including: • App with perimeters and multi-spectral imagery; • Near real-time severe weather reports; • Historical radar search; • Risks App for seismic, sinkholes, storm surge, sea level rise, flooding and wildfire; • Sale tax boundaries; and • Demonstration App in the App store that contains limited data, such as severe weather reports from one week back to present date of use.

No additional projects were suggested by the PSC.

12 2. Claims Conference a. Eliminate the printed program book in 2017 and replace it with a one page reference sheet that refers to the Conference App for more information; b. Provide a pre-test to serve as a bench mark to help evaluate what training is needed; c. Provide testing with technical subjects; d. Provide certification for: 1. Ethics sessions; 2. Water mitigation sessions; and 3. Roofing sessions. e. Possible session regarding large increases of the assignment of benefits by policyholders to public adjusters for covered water damage in Florida, as well as other states. 3. Webinar Subjects a. F. Building Code Services

Proposed 2017 Projects - The following proposals were submitted to the Products and Services Committee for consideration and discussion at its 2016 meeting.

1. Duty Created Under Building Codes and Ordinances - Create a 50 state-by-state publication listing whether a violation of a building code is negligence per se, creates a rebuttable presumption of negligence, etc.

2. Visually Assisted Research - Develop a graphical research interface to assist insurance professionals in finding common code requirements for specific areas of a structure, such as a roof or stairs. E.g. mouseover caused pop up information when a user points to a drop edge or stair tread, and a click causes a launch to more information.

Additional PSC Recommendations

1. Roofing Specifications - Prepare a discussion on the impact of building code requirements regarding the manufacturer's specifications for roofing replacements and repairs; 2. Enforcement - Develop a definition of enforcement regarding the building code and roofing requirements; 3. Permit Information - Using GIS, create a search method to locate property permit history, as well as real estate information;
