Subject: Declaration as Surplus Parcel of Vacant Land Located at the Rear of 39 Newcastle Street (“Mimico GO”) (Ward 6 – –Lakeshore)

Purpose:

To declare the property surplus to municipal requirements.

Financial Implications and Impact Statement:

Revenue will be generated from the eventual sale.

Recommendations:

It is recommended that:

(1) all of the City’s interest in the property located at the rear of 39 Newcastle Street, being Part of Lot 11, Plan 83, also designated as Part 1, Plan 64R-11339 and shown as Part 1 on PS-Sketch No. 2003-031, be declared surplus to the City’s requirements and that the Commissioner of Corporate Services be authorized to invite an offer to purchase from the Greater Transit Authority;

(2) all steps necessary to comply with Chapter 213 of the City of Toronto Municipal Code be taken; and

(3) the appropriate City Officials be authorized and directed to take the necessary action to give effect thereto. - 2 -

Background:

The Greater Toronto Transit Authority (“GO Transit”) has leased several City-owned properties for use as part of its commuter parking for its Mimico, Scarborough, Eglinton and Stations and has expressed an interest in acquiring same for the continued use of its commuter parking, together with another City-owned property located at 370 Birchmount Road which is required to accommodate future rail corridor improvements. This report deals with the property located at the Mimico GO Station.

The property located at the rear of 39 Newcastle Street, containing an area of approximately 3148.35 m² (0.778 acres), was acquired through the Municipal Tax Sales process. The Notice of Vesting, registered on March 29, 2000, reserved out mineral rights as set out in Instrument No. TB411752. GO Transit has leased the property from the City for use as part of its commuter parking for the Mimico GO Station since March 1, 2001. The term of the lease is for 5 years and is to expire on February 28, 2006. It should be noted that it is City staff’s intention to require appropriate legal documentation as part of any sale transaction to ensure the entire property is improved for and continues to be utilized for GO Transit parking purposes.

Comments:

A circulation to the City’s Agencies, Boards, Commissions and Departments was undertaken to ascertain whether or not there is any interest in retaining the property for municipal purposes. No municipal interest was expressed. Staff of the Shelter, Housing and Support Division of Community and Neighbourhood Services have determined that there is no interest in the property for affordable housing under the Let’s Build program. Accordingly, this report recommends that the property be declared surplus. The Property Management Committee has reviewed this matter and concurs with the recommendations of this report. In order to proceed with the disposal of the subject property, the City must comply with the procedures governing disposal of property. Section 268 of the Municipal Act, 2001, requires that, before selling any property, Council must declare the property to be surplus by by-law or resolution, give notice to the public of the proposed sale and obtain at least one appraisal of the market value of the property, unless exempted from doing so.

Conclusions:

As no municipal interest has been expressed in retaining the property located at the rear of 39 Newcastle Street, City Council should declare all of the City’s interest in the property surplus to the City’s requirements and the Commissioner of Corporate Services be authorized to invite an offer to purchase from GO Transit.
