CHAPTER 1
EXECUTIVE SUMMARY
1.1 Project and public purpose The proposed project is intended to establish an Industrial Park byKINFRAunder the IDZ scheme in Koodali, Pattannur and KeezhallurVillages of Thalassery Taluk in Kannur District. The project aims at improving the industrial facilities of the District thereby increasing the overall development of the State. This will in turn increase the employment opportunities to the populace. Establishment of industrial park can attract more investments in the state thus strengthening the economy as well.
1.2 Location
Government of Kerala had accorded administrative sanction vide to acquire a total area of 313.81 Acres of land fromKoodali, Pattannur and KeezhallurVillages of Thalassery Taluk in Kannur Districtfor establishing an Industrial Park by KINFRA.
1.3. Size and attributes of land acquisition
An extent of 313.81 acres of land under survey Nos. 84, 85, 86pt, 1pt, 2pt from Keezhallur Village, survey Nos. 73pt, 72pt, 167, 175, 176pt, 177/1, 3pt, 178pt, 179pt from Pattannur Village and survey Nos. 39pt, 40pt, 143pt, 144, 145, 146, 147, 148, 149, 150, 136pt, 134pt, 133pt, 132, 131pt fromKoodali Village in Kannur district is required for the implementation the proposed project. The proposed are is situated 7 kms away from Pazhassi Dam.
The land identified for the project of establishing the Industrial Park belongs to Around 103 families, within which around 10 residential structures are identified. The area mainly include cashew plantation and left over land after laterite stone mining. The number of houses to be acquired may change once the final plan is prepared.
1.4 Alternatives considered
The project is intended for developing various infrastructural and business ventures near to the Kannur International Airport. The implementation of the Industrial park

can cater the development of the area. As the project is intended to improve infrastructure facilities near to the airport, no other alternatives are considered.
1.5 Social impacts
The land identified for the project of establishing the Industrial Park belongs to Around 103families, within which around 10 residential structures are identified. The lion’s share of the area is rich with Cashew farms. A good portion of the area is the land remaining after mining of Laterite stones. The project area is around 28km away from District Collectorate and is bordered by the Pazhassi Dam constructed on the Irrikkur River to the south. The number of houses to be acquired may change once the final plan is prepared.
1.6 Mitigation measures
The land identified for the project of establishing the Industrial Park belongs to Around 103 families, within which around 10 residential structures are identified. The area mainly include cashew plantation and left over land after laterite stone mining. The number of houses to be acquired may change once the final plan is prepared.
However, by considering the following measures the authorities can mitigate and compensate the possible negative impacts of the land acquisition.
Compensation for the land owners as per the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013. Resettlement and Rehabilitation procedure as per the Policy issued by Revenue(B) Department, Government of Kerala vide G.O.(Ms)No.448/2017/RD dated 29/12/2017 for the rehabilitation and resettlement package for land acquisition in the state in lieu of RFCTLARR Act 2013. Reconstruction of livelihood of people is an important factor in this project. Majority of the directly affected families are relying on the project area for their livelihood through cashew farm and rubber plantations. The loss of these assets will cause them a significant impact.

The directly affected people should be considered for the job opportunities that will be created by the establishment of the proposed project. Through this, the impact of losing livelihood as a result of land acquisition can be minimised. The successful rehabilitation of the directly affected families are the other major concern in this land acquisition. The authorities should make sure that the displaced families will get proper rehabilitation.

CHAPTER 2
DETAILED PROJECT DESCRIPTION
2.1 Background of the Project including Developer’s Background and Governance/Management structure
As part of the decision to establish an Industrial Park for KINFRA, Government of Kerala (GoK) had accorded administrative to acquire a total area of 313.81 Acres of land fromKoodali, Pattannur and KeezhallurVillages of Thalassery Taluk in Kannur District for establishing an Industrial Park by KINFRA. The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (RFCTLARR) Act 2013, enacted by the Government of India, has mandated the conduct of Social Impact Assessment study prior to the land acquisition. Government of Kerala had accorded sanction vide G.O.(P) No.53/2019/RD dated 28/08/2019 to Centre for Management Development, Thiruvananthapuram to conduct SIA in this regard and to prepare a Social Impact Management Plan for the same.The entire project is designed to involve and integrate the local community in all intended developmental initiatives.The concept of the Industrial Park is to provide a single platform that brings together various infrastructural facilities and industrial assistance from the Government to the public. The project would take an environment friendly approach by conserving energy and making use of alternate technologies.
The land in Kannur district which has been proposed for the Industrial Park could be acquired due to the following reasons:
The number of stakeholders in the proposed project site is very few. Lion share of the proposed project site include cashew plantations and land remaining after laterite stone mining. Only 10 families need to be rehabilitated. The final number of families to be rehabilitated may be even less when the final pan is completed. Houses near the border may be excluded while preparing the final plan for the proposed project site.

A stone crusher plant is also situated in the proposed project site. If needed this can also be excluded.
2.2 Rationale for Project, including how the project fits the public purpose criteria listed in the Act.
The project aims in developing the district as a leading industrial hub. The industrial park can cater the social and economic development in the area. Industrialisation has resulted in a considerable rise in the standard of living of the people. Increase in job opportunities is a major advantage. As part of the decision to establish an Industrial Park for KINFRA, Government of Kerala (GoK) had accorded administrative sanction to acquire a total area of 313.81 Acres of land in Koodali, Pattannur and Keezhallur Villages of Thalassery Taluk in Kannur District for establishing an Industrial Park by KINFRA. 2.3 Details of Project size, location, capacity outputs, production targets, costs and risks
The affected area belongs to Koodali, Pattannur and Keezhallur Villages of Thalassery Taluk in Kannur District. A total area of313.81acres of land is required to be acquired for the proposed project. The land to be acquired is spread over MuttanurDesom in Koodali Village, Kunnoth and KodolipramDesoms in Pattannur Village and Theroor and EdayannurDesoms in Keezhallur Village. The proposed land is situated ½ km from the Kannur-Mattanur National Higway and 1 and ½ km north-west to Mattanur town.

2.4 Examination of alternatives

The proposed project aims at constructing facilities which is environment friendly and safe.The construction of new buildings and better infrastructure in the area is one of the factors in this process. As part of the Industrial Park construction or improvisation of roads need to be done.
2.8 Workforce Requirements (Temporary and Permanent)
Both temporary and permanent workforce will be employed with modern machineries and equipment at appropriate stages of the project implementation.
2.9 Details of Social Impact Assessment/Environment Impact Assessment if Already Conducted and any Technical Facility Reports
No Social Impact Assessment/Environment Impact Assessment has been conducted previously.
2.10 Applicable legislations and policies
The land acquisition for the proposed project is governed by the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013.

TEAM COMPOSITION, APPROACH, METHODOLOGY AND SCHEDULE OF THE SOCIAL IMPACT ASSESSMENT
3.1 List of all Team Members with Qualifications
The details of the team members involved in the SIA are given in Annexure III.
3.2 Description and Rationale for the Methodology and Tools Used to collect Information for the Social Impact Assessment
An inclusive and participatory approach through involvement of multiple stakeholders such as elected representatives and project affected people including vulnerable sections such as Scheduled Castes, Scheduled Tribes, women, and those among below poverty line, at appropriate stages of the project.
3.3 Sampling Methodology Used
Qualitative information was gathered along with the field survey through public consultation/Focus Group Discussions (FGDs) with all relevant stakeholders. The public consultation encompassed the project components as well as its socio- economic impacts. The SIA team had preliminary discussions with the key officials of the district administration and gathered information regarding the status of the government procedures, the project area and intensity of the acquisition. The team also made a preliminary site visit with the officials for physical inspection and information dissemination purposes. The existing conditions of land, status of infrastructure/structures, land use pattern and the facilities available to people residing in the project area were analysed.
The quantitative information regarding the families affected by the project was collected through household surveys, in the form of structured questionnaires. The survey was conducted in all the households of the persons affected by the project. The results of the survey provided information pertaining to the demography, socio-economic status and livelihood status of the target community, and formed the basis for development of Social Impact Management Plan.

3.4 Overview of Information/Data Sources Used
The primary data was collected directly from the representatives all affected families through face to face interview. Structured questionnaires were used for collecting the details of the affected people. The results of the survey provided information pertaining to the demography, socio-economic status and livelihood status of the target community
The secondary data was collected from the Requiring Body and the Revenue department. The SIA team had preliminary discussions with the key officials of the district administration and gathered information regarding the status of the government procedures, the project area and intensity of the acquisition.

3.6 Public Hearing
In accordance with the Section 5 of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, a Public Hearing was conducted at Anugraha Auditorium Chalode on September 08, 2020 and September 08, 2020, to collect the views and opinions of the people affected by the project. Prior intimation will be given to all the stakeholders regarding the date and venue of the public hearing through advertisements in leading newspapers, individual letters and/or over telephone.The hearing was attended by project affected people, officials from requiring agency, concerned revenue office, SIA

unit, PanchayathPresident and elected representatives. The Panchayath President briefed about the details and need for the urgency in completing the project at the earliest. Project affected people and elected representatives shared their concerns, doubts, suggestions and complaints regarding the project at the hearing. The public hearing was recorded in audio and video formats. The answers to the questions and concerned raised by the project affected people during the public hearing and in written format to the requiring agency are given in annexure no VII.

4.7 Nature, Present use and classification of Land and if Agricultural Land, Irrigation Coverage and Cropping Patterns
A major portion of the area to be acquired is rich with Cashew farms. A good portion of the area is the land remaining after mining of Laterite stones.In addition to that coconut trees and other kinds of trees are included in the area. Lion share of
the land is classified as thottam (േതാ ം), asthirapuncha (അ ിരപു ) and
sthirapuncha ( ിരപു ). Even though land is classified as Dry Land, a portion
is also identified as nilam (നിലം).
4.8 Size of Holding, Ownership Pattern, Land Distributions and Number of Residential Houses
The proposed land for acquisition is owned by almost 78 families. 10 residential structures are identified. The number of houses to be acquired may vary in the final plan.
4.9 Land prices and recent changes in ownership, transfer and use of lands over the last 3 years
As per the information received from the respondents, no land transactions were done in the proposed area for the last 3 years.

CHAPTER 5
ESTIMATION AND ENUMERATION OF AFFECTED FAMILIES AND ASSETS
5.1 Estimation of families
a) Families which are directly affected (own land that is proposed to be acquired)
Around 103familieswho have either owned residence (10 residential structures) or land in the area that is proposed to be acquired are directly affected by the project. The families are presently residing there enjoy the benefits of cashew trees and various other variants.
5.2 Family of Scheduled Tribes and other Traditional Forest Dwellers who have lost any of their Forest Rights
Not included in the proposed area.
5.3 Families which depend on Common Property Resources which will be Affected due to Land Acquisition for their Livelihood
No common property resources are affected by this land acquisition.

depend on cashew and other assets for meeting day to day expenses. The loss in these product assets will be a significant impact on the livelihood of the families who will be displaced from the proposed land for the acquisition.

As the project aims at creating least possible disruption to the balance of the area, the chances for indirect impact is relatively less.
5.6.2 Inventory of productive assets and significant lands
A large number or cashew trees, coconut trees and other various kinds of trees are included in the land which is proposed to be acquired. The site has the presence of left-over Laterite stone after mining.

6.1 Demographic Details of the Population in the Project Area
A total of Around 103 families are directly affected by the proposed land acquisition. This chapter discusses the demographic details of the owners of the properties and their dependents.

6.3 Vulnerable Group
Among the total affected family members 57 children are below the age of 18 years and there are 74 members who are aged above 60 years. Also, there 165 female members are affected by the project.
6.4 Land Use and Livelihood
A large number of cashew trees, coconut trees and other various kinds of trees are included in the land which is proposed to be acquired. These productive assets present in the area are a livelihood option for people who live in and around the project area.
6.5 Local Economic Activities
A good portion of the area is the land remaining after mining of Laterite stones. A large number or cashew trees, coconut trees and other various kinds of trees are included in the land which is proposed to be acquired.
6.6 Factors that Contribute to Local Livelihood
The families who own land in the proposed area depends on the cashew trees for livelihood.
6.7 Kinship Patterns and Social and Cultural Organization
Around10 families in the project area needs to be rehabilitated so as to acquire the land for the proposed project. The families in this area have good social and neighbourhood relations.
6.8 Administrative Organization
There are no administrative organisations are present in the vicinity of the project area.
6.9 Political Organization
Properties of any political organizations are not included in the area which is proposed for the acquisition.

No such organizations are affected by the proposed the project.

The project aims at improving the industrial facilities of the District thereby increasing the overall development of the State. This will in turn increase the employment opportunities to the populace. Establishment of industrial park can attract more investments in the state thus strengthening the economy as well.The concept of the Industrial Park is to provide a single platform that brings together various infrastructural facilities and industrial assistance from the Government to the public. Therefore, the proposed project will work towards improving the infrastructural facilities made available to the public. No historic change process is identified.
6.12 Quality of the Living Environment
The Quality of the Living Environment is good in the project area with decent livelihood options and transportation facilities with access to amenities such as Schools, Hospitals, Civil Organisations, Social Groups etc.

CHAPTER 7
SOCIAL IMPACT MANAGEMENT
7.1 Approach to Mitigation
The CMD team made use of a combination of two research approaches i.e., quantitative and qualitative, for the identification of various social impact and the mitigation measures. Adoption of a combination of both qualitative and quantitative methodology was indented to obtain a more comprehensive data and more holistic result without excluding any important area of assessment.
7.2 Measures to avoid, mitigate and compensate impact
An extent of 313.81 acres of land from Keezhallur, Pattannur and Koodali Villages of Kannur district is required for the implementation of the proposed project.The land identified for the project of establishing the Industrial Park belongs to Around 103 families, within which around 10 residential structures are identified.The lion’s share of the area is rich with Cashew farms. A good portion of the area is the land remaining after mining of Laterite stones. Around 10 families in the project areaare using this land for residential purposes. Other families are also getting their income from the proposed project area as they rely on these productive assets as a means of livelihood. However, by considering the following measures the authorities can mitigate and compensate the possible negative impacts of the land acquisition.
Compensation for the land owners as per the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013. Resettlement and Rehabilitation procedure as per the Policy issued by Revenue(B) Department, Government of Kerala vide G.O.(Ms)No.448/2017/RD dated 29/12/2017 for the rehabilitation and resettlement package for land acquisition in the state in lieu of RFCTLARR Act 2013. their livelihood through cashew farm and rubber plantations. The loss of these assets will cause them a significant impact. The directly affected people should be considered for the job opportunities that will be created by the establishment of the proposed project. Through this, the impact of losing livelihood as a result of land acquisition can be minimised. The successful rehabilitation of the directly affected families are the other major concern in this land acquisition. The authorities should make sure that the displaced families will get proper rehabilitation.
7.3 Measures that are included in terms of Rehabilitation and Resettlement and Compensation as outlined in the Act
The Rehabilitation and Resettlement package as per the Policy issued by Revenue(B) Department, Government of Kerala vide G.O.(Ms)No.448/2017/RD dated 29/12/2017 for the rehabilitation and resettlement package for land acquisition in the state in lieu of RFCTLARR Act 2013 shall be provided to the affected people.

CHAPTER 8
SOCIAL IMPACT MANAGEMENT PLAN INSTITUTIONAL FRAMEWORK
8.1 Description of institutional structures and key person responsible for each mitigation measures
The Government of Kerala vide G. O. (P) No. 649/2015/RD dated 04/12/2015 had appointed Special Tehsildar (LA), Chalode to perform one or more functions of the collector under in the Right to Fair Compensation and Transparency in Land Acquisition, Resettlement and Rehabilitation Act (RFCTLARR), 2013 within their area of jurisdiction.
Also vide G. O. (P) M. No. 590/2015/RD dated 11 November 2015, Government of Kerala, in line with the sub-section (1) of section 43 of the Right to Fair Compensation and Transparency in Land Acquisition, Resettlement and Rehabilitation Act (RFCTLARR) 2013 and sub-rule (1) of rule 21 of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Kerala) Rules, 2015, the Deputy Collector (Land Acquisition) in each district has been appointed as the Administrator for Rehabilitation and Resettlement, for performing the functions under the said act and Rules in respect of involuntary displacement of persons due to requisition of land. The Administrator shall be responsible for the formulation, execution and monitoring of the Rehabilitation and Resettlement scheme in respect of land acquisition.
Vide G. O. (P) M. No. 589/2015/RD dated 11 November 2015, in exercise of the powers conferred by sub-section (1) of section 44 of the Right to Fair Compensation and Transparency in Land Acquisition, Resettlement and Rehabilitation Act (RFCTLARR), 2013, the commissioner for Rehabilitation and Resettlement supervising the formulation of Rehabilitation and Resettlement scheme or plans, proper implementation of the same and post implementation of social audit.

SOCIAL IMPACT MANAGEMENT PLAN MONITORING AND EVALUATION
10.1 Key monitoring and evaluative indicators
Monitoring is a long-term process, which should begin from the starting of the project and should continue throughout the life of the project. Its purpose is to establish benchmarks so that the nature and magnitude of anticipated social impacts can be continually assessed. Monitoring involves the continuous or periodic review to determine the effectiveness of recommended mitigation measures. The types of parameters that can be monitored may include mitigation measures or design features, or actual impacts. All the mitigation measures stated in Chapter 7 should be considered as the indicators for evaluation.
10.2 Reporting mechanisms and monitoring roles
Rehabilitation and Resettlement procedures as stated in the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement act, 2013 will be applicable.

ANALYSIS OF COSTS AND BENEFITS AND RECOMMENDATION ON ACQUISITION
11.1 Final conclusions on:Assessment of public purpose, less displacing alternatives, minimum requirements of land, the nature and intensity of social impacts, and viable mitigation measures and the extent to which mitigation measures will address costs
The Government of Kerala has initiated the construction ofIndustrial Park by KINFRA under the IDZ schemein Koodali, Pattannur and Keezhallur Villages of Thalassery Taluk in Kannur District. The project aims at improving the industrial facilities of the District thereby increasing the overall development of the State. This will in turn increase the employment opportunities to the populace. Establishment of industrial park can attract more investments in the state thus strengthening the economy as well.
An extent of 313.81 acres of land under survey Nos. 84, 85, 86pt, 1pt, 2pt from Keezhallur Village, survey Nos. 73pt, 72pt, 167, 175, 176pt, 177/1, 3pt, 178pt, 179pt from Pattannur Village and survey Nos. 39pt, 40pt, 143pt, 144, 145, 146, 147, 148, 149, 150, 136pt, 134pt, 133pt, 132, 131pt fromKoodali Village in Kannur district is required for the implementation the proposed project. The proposed are is situated 7 kms away from Pazhassi Dam.
The land identified for the project of establishing the Industrial Park belongs to Around 103 families, within which around 10 residential structures are identified. The area mainly include cashew plantation and left over land after laterite stone mining. The number of houses to be acquired may change once the final plan is prepared.
The alignment of the proposed project was designed with an effort to reduce the number of people who will be affected with the land acquisition. However, through the proper measures as per RFCTLARR Act 2013 the negative impacts of land acquisition should be mitigated.

11.2 The above analysis will use the equity principle as a framework of analysis for presenting a final recommendation on whether the acquisition should go through or not.
Comparing/weighing the positive against the negative impacts, it can be observed that even though rehabilitation of displaced families and the recreation of livelihood are needs to be provided to the directly affected people, the implementation of the project will result in improving the overall development of Kannur district.The project will attract business ventures and other developments all around the world and further it will create more livelihood opportunities for the local people in the area. The owners of the land are supporting the project and they stated that they have no issues to handover the land if they get proper compensation and rehabilitation.
Thus, it can be concluded that the former outweighs the latter reaffirming the identified site as the most suitable and apt one for the project of establishing the Industrial Park. The families that are affected would require adequate and fair compensation and proper rehabilitation. The area which is considered for acquisition is mainly used for cashew plantation as well as for mining laterite stones. So, the authorities should make proper action plan to reconstruct the livelihood opportunities for the people who solely relied on the project area for livelihoodactivities. It is observed that many of the negative impacts highlighted can be minimized or reduced with effective and relevant mitigation measures and strategies mentioned. Thus the study recommends the acquisition of land by providing proper compensation to the affected people.
