Cameron Russell February of 1989, then Commissioner of Baseball Peter V. Ueberroth and then Commissioner of Baseball-elect A. Bartlett Giamatti initiated an investigation regarding allegations that Pete Rose, a prominent baseball player and Manager of the Cincinnati Reds, wagered on major league baseball games. Commissioner Giamatti scheduled a hearing concerning the allegations for June 26, 1989. In an effort to prevent Commissioner Giamatti from conducting the hearing, Rose filed an action in state court seeking a temporary restraining order and preliminary injunction from disciplinary proceedings against Major League Baseball, one of its teams, and Commissioner Giamatti. Giamatti sought to remove the case to federal court citing diversity jurisdiction. At issue was whether, under applicable law, the federal court had jurisdiction over the subject matter of the action. Federal district court has original jurisdiction in civil actions where the amount in controversy exceeds $50,000 and the action is between citizens of different states. A federal court, in its determination of whether there is diversity of citizenship between the parties, must disregard nominal or formal parties to the action and determine jurisdiction based only upon the citizenship of the real parties to the controversy. A formal or nominal party, in contrast to a real party, is one who has no interest in the result of the suit, or no actual interest or control over the subject matter of the litigation. The court held that the action was properly removed to federal court, and therefore had a duty to recognize and enforce jurisdiction over the matter. In reaching its conclusion, the court reasoned that Rose and Giamatti were the only real parties, and therefore disregarded Major League Baseball and its team as defendants. The court found that diversity of citizenship existed between Rose and Giamatti, and that the case was properly removed to federal court. .

Bartlett Giamatti's decision to ban Pete Rose from baseball for life. Baseball fans support the Comnissioner's action by 56-42 percent, while the entire public backs his action by a slightly closer 52-41 percent according to this Harris Poll, taken by telephone, between August 25th and 29th among a representative cross section of 1,250 adults nationwide, including 884 baseball fans. while these results show a sizable minority who would not have taken such drastic action, they represent a dramatic change of heart on the part of both the public and baseball fans from last March when the charges against the former Cincinnati Reds manager were first made. Back then, a solid 55 percent majority would have simply had the Comissioner take him to task for betting on baseball, but then would have "given [him] another chance." Now the fans believe Commissioner Giamatti was right by a 14 point margin. The reasons are evident from this special Harris Sports Survey: -- An 84 percent majority of baseball fans are convinced that Rose was guilty of betting on baseball games. Such an infraction of baseball's rules could bring him an automatic suspension from the game for one year. -- A 68-22 percent majority of baseball fans are also convinced that Rose was guilty of betting on his own team, the Reds.

Equally as enthusiastic as their hometown fans, the ballpark’s management team continues to improve the ballpark’s energy performance and is a leader among stadiums nationwide. Energy Management with ENERGY STAR The Cincinnati Reds were one of the first Major League Baseball teams to join ENERGY STAR as a partner in 2008 and use ENERGY STAR resources to track energy usage, improve energy performance, and communicate their efforts to staff and the public. Improving energy performance is an important environmental strategy for the Reds and they have received kudos from local officials and enhanced loyalty from fans for leading by example. The ballpark operations management team benchmarks the ballpark’s energy performance using the U.S. Environmental Protection Agency’s (EPA) Portfolio Manager, an online energy tool to track whole-building energy intensity and greenhouse gas emissions. By inputting historical energy data going back to 2007, and ongoing monthly energy consumption and cost information, the Reds are able to measure progress and quantify improvements. To date, the ballpark’s energy intensity is 27 percent better than the national average for entertainment buildings1, even with an off-season construction project during the winter of 2009. As part of their energy management plan, the ballpark’s building operations management team implemented several energy conservation measures and integrated energy efficient technologies into the ballpark’s infrastructure.

Cincinnati Reds 155 F.3d 828 (6th Cir. 1998) Authored by Ashley Hollan The maintenance staff working for the Cincinnati Reds (“Reds”) at Riverfront Stadium in Cincinnati, Ohio brought suit against the Reds in 1998, asserting that the baseball franchise violated § 207 of the Fair Labor Standards Act (“FLSA”), 29 U.S.C. § 207(a)(1). The maintenance staff claimed the Reds violated the FLSA when they refused to pay the staff overtime (time plus one-half) for the hours that the staff worked exceeding 40 hours per week. The Reds claimed they should not be required to pay overtime as required by the FLSA because the franchise constitutes an amusement or recreational establishment that operated for less than seven months per year under § 213(a)(3)(A) of the FLSA. The district court granted summary judgment to the Reds, agreeing that the franchise’s seasonal operation serves to exempt the Reds from paying overtime. The Sixth Circuit Court of Appeals reversed the decision, noting that the proper focus was not the duration of the baseball season, but on the fact that the Reds organization operated year-round with no fewer than 120 employees in the “off-season” and the case was remanded. In the appeal at hand the Reds challenged the decision of the Sixth Circuit Court of Appeals, arguing the seasonal operation of the franchise should suffice to exempt the Reds from paying overtime. The Reds cited § 213(a)(3), which exempts from the FLSA’s overtime provisions any employee employed by an establishment if it does not operate for more than seven months in any calendar year, or during the preceding calendar year, its average receipts for any six months of such year were not more than 33 1/3 per centum of its average receipts for the other six months of such year.

Under the clear teaching of cases like Wal-Mart Stores, Inc. v. Dukes, 564 U.S. 338 (2011), the thousands of disparate individual actions encompassed by these proceedings cannot be shoehorned into a class action for a “trial by formula” that would look nothing like a class member’s individual trial. Nonetheless, the Ninth Circuit certified these sprawling (b)(3) classes by reading this Court’s decision in Tyson Foods, Inc. v. Bouaphakeo, 136 S. Ct. 1036 (2016), to create what amounts to a wage-and-hour exception to Wal-Mart. The court then exacerbated that error by reversing the district court’s refusal to certify a (b)(2) class as not cohesive—not by disagreeing with the district court’s judgment, but by expressly discarding the cohesiveness requirement that every other circuit to consider the question has derived from Wal-Mart.

The Reds need a productive left fielder who can get on base -- preferably in a short-term situation, before prospect Jesse Winker arrives (as soon as 2016). Upton runs notoriously hot and cold, but he's averaged 24 homers with a .357 OBP the last six seasons. He'd instantly augment and balance the heart of a lineup in which Joey Votto's knee woes and Jay Bruce's disappointing '14 are big concerns moving forward.
