FINAL REGULATIONS Agenda Item 11 – Chapter W-9 - “Wildlife Properties” – 2 CCR 406-9 Open for final consideration of regulations including, but not limited to: • Creating property-specific regulations pertaining to methods of take on Copper Gulch State Trust Land (STL). • Creating property-specific regulations pertaining to safety zones and methods of take on Lost Creek STL. • Clarifying regulations pertaining to the discharge of firearms on Rosita STL. • Including Dry Creek STL within Whiterock STL in Appendix B.2. DRAFT REGULATIONS Agenda Item 12 – Chapter W-16 - “Park and Wildlife Procedural Rules” – 2 CCR 406-16 Open for consideration of regulations including, but not limited to, modifying general refund procedures, the restoration of preference points, and the Director’s disaster relief authority. DRAFT PWC POLICY – NON-REGULATORY Agenda Item 13 – Citizen Petitions to Initiate Rulemaking - Colorado Parks and Wildlife Commission Policy Open for consideration of modifications related to withdrawing a petition once a petitioner submits it to the Division. ISSUES IDENTIFICATION Agenda Item 14 – Chapter P-1 - “Parks and Outdoor Recreation Lands” 2 CCR 405-1 Open for annual review of the entire chapter including, but not limited to, generally-applicable and property-specific requirements for, or restrictions on use of, parks properties controlled by Dan Prenzlow, Director, Colorado Parks and Wildlife • Parks and Wildlife Commission: Carrie Besnette Hauser, Chair • Charles Garcia, Vice-Chair Luke B Schafer, Secretary • Taishya Adams • Betsy Blecha • Marie Haskett • Dallas May • Marvin McDaniel • Duke Phillips, IV • James Jay Tutchton • Eden Vardy Colorado Parks and Wildlife. Specific regulatory changes include, but are not limited to, the following: • Updating swimming regulations to allow swimming in state-park-managed areas with some exceptions and changing the age restrictions for swimming unaccompanied by an adult from 12 to 13 years old. • Creating a wakeless day (Wednesday) for boaters at Highline Lake State Park. Agenda Item 15 – Chapter P-7 - “Passes, Permits and Registrations” - 2 CCR 405-7 Open for annual review of the entire chapter including, but not limited to, regulations pertaining to eligibility requirements and fees for individual and vehicle park passes, use permits, vessel, snowmobile and off-highway vehicle registrations and license agent requirements. Specific regulatory changes include, but are not limited to, the following: • Changing the replacement fee for an annual affixed parks pass and Aspen Leaf annual pass to half the cost of the original pass, if proof of eligible replacement need is not provided. • Eliminating the replacement fee for the Columbine, Centennial, Blue Spruce and Independence parks passes. • Updating the camping and day-use cancellation and change regulations. Agenda Item 17 – Chapter P-8 - “Aquatic Nuisance Species” 2 CCR 405-8 Open for annual review of the entire chapter including, but not limited to, regulations pertaining to inspections, decontaminations and impounding of vessels or other floatation devices, as well as establishing monitoring, identification and reporting procedures for suspected aquatic nuisance species. Specific regulatory changes include, but are not limited to, the following: • Adding regulations to clarify that defacing or tampering with a watercraft inspection and decontamination seal or seal receipt is unlawful. Agenda Item 18 – Chapter W-0 - “General Provisions” - 2 CCR 406-0 Open for consideration of regulations including, but not limited to, the following: • Raising the fee for the Federal Duck Stamp and adding the fee for the Federal Duck Stamp to Appendix F of Chapter W-0. Agenda Item 19 – Chapter W-3 - “Furbearers and Small Game, Except Migratory Birds” 2 CCR 406-3 Open for consideration of regulations including, but not limited to, the following: • Closing the 2021 hunting season for greater sage-grouse in Game Management Unit 10 pursuant to thresholds set forth in the Northwest Colorado Greater Sage-grouse Conservation Plan. CONSENT AGENDA (Agenda Item 28) ISSUES IDENTIFICATION Agenda Item 28.1 - Chapter P-1 - “Parks and Outdoor Recreation Lands” 2 CCR 405-1 Open for annual review of the entire chapter, including, but not limited to: • Modifying seasonal restrictions for peregrine falcons at Fishers Peak State Park to correspond with Colorado Parks and Wildlife’s Recommended Buffer Zones and Seasonal Restrictions for Colorado Raptors. CITIZEN PETITIONS Agenda Item 28.2 - Chapter W-2 – “Big Game” – 2 CCR 406-2 At its July meeting, the Parks and Wildlife Commission will consider whether it should adopt the Director’s written recommendation to DENY a petition for rulemaking requesting that the Commission revise big game regulations, as follows: • A Citizen Petition for Rulemaking requesting the method of calculating weighed preference for moose, sheep and goat licenses be revised. 6060 Broadway Denver, CO 80216 P 303-866-3203 TO: Members of the Colorado Parks and Wildlife Commission FROM: Krista Heiner, Regulations Manager RE: Chapter W-9 Final Regulations for the July 2021 Parks and Wildlife Commission Meeting DATE: July 2, 2021 Final regulatory changes for Chapter W-9 are summarized below. Agenda Item 11: Chapter W-9 - “Wildlife Properties” 2 CCR 406-9 (Step 2 of 2) • Creating property-specific regulations pertaining to methods of take on Copper Gulch State Trust Land. Copper Gulch State Trust Land (STL) has an intermittently used gravel pit on the northeast boundary, and a sub-division is located along the property’s north boundary. A large heavily timbered ridge acts as a barrier between the sub-division and the interior of the parcel. Limiting the discharge of firearms to hunting with muzzleloaders, shotguns, and rimfire rifles only on this parcel helps to address safety concerns, while allowing hunting to take place in a manner that is safe and ethical. • Creating property-specific regulations pertaining to safety zones and methods of take on Lost Creek State Trust Land Lost Creek STL provides opportunities for small game and deer hunting. Lost Creek STL has an oil and gas train transport depot to the west, a large dairy to the southwest, as well as oil and gas wells and agricultural equipment in the southeast corner of the property. Additional restrictions on the discharge of firearms to hunting with muzzleloaders, shotguns, and rimfire rifles only helps ensure that hunting on the property is done safely without affecting neighboring landowners, oil and gas structures, and agricultural equipment. Additionally, hunting has been prohibited in designated safety zones along the western and southwestern boundaries, as well as along the oil and gas and agricultural equipment on the southeastern corner of the property. • Clarifying property-specific regulations pertaining to discharge of firearms on Rosita State Trust Land To maintain consistency with the property-specific regulations pertaining to the discharge of firearms on Copper Gulch and Lost Creek STLs, the wording of the property-specific regulations pertaining to the discharge of firearms on Rosita STL has also been clarified. • Including Dry Creek STL within Whiterock STL in Appendix B.2 To reduce confusion with similar property names, Dry Creek STL in Appendix B.2 has been included as a part of Whiterock STL in Appendix B.2. DEFINITIONS 1. “Youth mentor hunting” means hunting by youths under 18 years of age. Youth hunters under 16 years of age shall at all times be accompanied by a mentor when hunting on youth mentor properties. A mentor must be 18 years of age or older and hold a valid hunter education certificate or be born before January 1, 1949. B. Public Access to State Trust Lands Leased by Colorado Parks and Wildlife 1. Public access is prohibited from March 1 through August 31, unless otherwise posted. 2. All newly enrolled properties are closed to public access until September 1 of the year of enrollment, unless otherwise posted. 3. Public access is prohibited from one-half (1/2) hour after sunset to one-half (1/2) hour before sunrise, except as posted, in accordance with the lease agreement with the State Land Board. 4. Public access is restricted to hunting and fishing, and where specifically authorized in #903, watchable wildlife activity. 5. Public access is prohibited for all persons 16 years of age and older who do not hold: a. a hunting license valid for the current license year, or b. a valid fishing license. Annual hunting licenses, including all big game hunting licenses, small game hunting licenses, turkey hunting licenses, and annual fishing licenses are only valid for the individual specified on the license, and, subject to #902.B.1. and #903, authorize such individual to enter, use or occupy any State Trust Lands leased by the Division or portion thereof from March 1 through March 31 of the following year, also known as the current license year.
