ORDER

1. Grievance of the petitioner is as follows. The petitioner, Smt.Sasikumari, Pournami had been the owner of the property with Sy.No.304/1/3/1 at Alimukku Junction, Piravanthoor and a temporary electric connection bearing consumer No.1146683013010 was efected to the aforementioned property of the petitioner from Electrical Section, Piravanthoor in LT VIF tarif. On 23.12.2020 the petitioner had submitted an application to the licensee for disconnecting the electric supply, and she received the reply that as one Mr.Sanal Kumar is using the electric connection for running a fsh stall in the said property, the electric supply cannot be disconnected. The petitioner stated that Mr.Sanal Kumar is carrying on business without obtaining license from the Local Panchayath and also the property is not given on rental basis to Mr.Sanal Kumar. Hence it is illegal for the petitioner to continue trading there. On 11.02.2021, the petitioner had remitted dismantling fees also, but the service connection was not dismantled. - 2 –

As the grievance of the petitioner was not redressed, she approached the Forum for relief. 2. The respondent fled a version as follows. Smt.Sasikumari, the petitioner, was the previous owner of the land in which a small bunk is situated and Smt.Suhara Saleem, is the present owner of the land. Both these persons fled requests at Electrical Section, Piravanthoor for disconnecting power supply to consumer No.1146683013010. This service connection was issued in the name of Smt.Sasikumari under LT VIF tarif. On receiving the request, notice was issued from Electrical Section, Piravanthoor to the occupier Mr.Sanal Kumar on 30.12.2020, who was trading fsh in the small bunk. He replied to the notice with an interim order IA.No.05/2020 in OS.No.25/2020 from Subordinate Judge’s Court, . The matter was brought to the higher ofcials of the licensee seeking advice. In the Court order there was no instruction to KSEB Ltd. Hence notice was again served to Mr.Sanal Kumar demanding him to submit further documents if any, for not disconnecting the supply. But he didn’t submit any documents. Smt.Sasikumari remitted the dismantling fees on 11.02.2021. Concerned ofcials had gone to the said premises on 12.02.2021 and 15.02.2021 to dismantle the service connection, but could not complete the job due to physical objection from Mr.Sanal Kumar. The electric supply was disconnected from the post on 18.02.2021, but the energy meter and WP service were not dismantled due to objection. 3. The hearing was conducted on 09.04.2021. The petitioner was absent and the respondent was present and heard the matter in detail. 4. On going through the petition and other documents in the fle, it is seen that the case is with regard to the dismantling of a temporary electric connection with consumer Number 1146683013010 under Electrical Section, Piravanthoor efected to the petitioner Smt.Sasikumari, Pournami in LT 6F tarif on 19.12.2019, in the property with Sy.No.304/1/3/1 at Alimukku Junction, Piravanthoor. Smt.Sasikumari was the previous owner of the property, but at present Smt.Suhara Saleem is the owner of the said property. A small bunk is situated in the property. Both Smt.Sasikumari and Smt.Suhara Saleem had fled requests at Electrical Section, Piravanthoor for disconnecting the power supply to the aforesaid consumer number. On receiving request from the petitioner for disconnecting the electric supply, the ofcials from Electrical Section, - 3 –

Piravanthoor visited the premises. But they couldn’t complete the job due to objection from Mr.Sanal Kumar, who was trading fsh in the premises without permisision of the petitioner. Notice was issued to him for producing documents if any, for not disconnecting the supply. But he didn’t produce any valid document. On 11.02.2021 Smt.Sasikumari had remitted the dismantling fees and on 18.02.2021 power supply was disconnected. The petitioner Smt.Sasi Kumari had informed the Forum on 24.03.2021 in writing that her grievance is already redressed and therefore she is withdrawing the complaint. During the course of hearing, the respondent also informed that the service connection efected to the petitioner is now in “Dismantled and Account Closed” status. Hence the Forum views that the petitioner has no grievance at present. 5. Considering the above facts and circumstance of the case, the Forum closed the petition and disposed the case accordingly. No order as to cost. If the petitioner is not satisfed with the above order of this Forum, he is at liberty to prefer appeal before the Electricity Ombudsman within 30 days from the date of receipt of this order.
