Specifically, section 1451 (b) (1) (B) of the SDWA provides that a Tribe may exercise regulatory functions under the Act provided that such functions "are within the area of the Tribal Government's jurisdiction." However, the SDWA does not provide further specific guidance regarding the types of land that may be considered to be within the area of a Tribal Government's jurisdiction. The federal regulations implementing this section of the SDWA, reiterating the broad statutory language, do not adopt a specific definition of what constitutes the "area of the Tribal Government's jurisdiction." The preamble to these regulations indicates that the extent of tribal jurisdiction must be examined on a case-by-case basis.~ As indicated Above, much of the discussion in the Attorney General's statement relates to the Navajo Nation's assertion of authority over land within the Eastern Navajo Agency. The Attorney General argues that in accordance with well-established principles of federal Indian law, the Navajo Nation possesses both civil regulatory authority and criminal authority over the Eastern Navajo Agency lands because this land constitutes "Indian country." As a result, he concludes that the Navajo Nation has; sufficient jurisdiction over the Eastern Navajo Agency to support an EPA determination to treat the Navajo Nation as a State with respect to all of those lands pursuant to section 1451 of the SDWA. In making the argument that the Navajo Nation's jurisdiction extends over all of Navajo Indian country, Attorney General Yazzie cites several instances in which EPA has previously adopted or - utilized the Indian country definition to outline either the extent of federal authority or the limits of state jurisdiction with respect to environmental regulation. -

Office of Diné Science, Math, and Technology (ODSMT): 1. The historic approval of the Diné School Accountability Plan (DSAP) in September 2016 has given “the green light” to the Department of Diné Education to begin implementing the academic contents and achievement standards to 60 BIE schools across the Navajo Nation that will be consolidated into one accountability system. Future phases of DSAP will integrate Navajo language and culture into the Navajo school accountability system. 2. DODE Administration and staff are convening planning meetings with stakeholders to implement Phase I of DSAP. A DODE team has been established to provide outreach to schools by sponsoring monthly updates, workshops, and technical assistance for schools reservation- wide, meeting with school leadership, and providing individual trainings at the school level. A Teacher Institute was sponsored by ODSMT and was attended by 75 teachers from 17 different schools. Teachers developed 13 models for school improvement for Phase I of DSAP. One model will be chosen at the next Teacher Institute and available for implementation. 3. DODE assigned staff are drafting amendments to Title 10 designed to improve accountability, transparency, and oversight of tribally-controlled schools under the authority and sanctions of the Navajo Nation. -

OCTOBER 2, 2015 BEGAYE REQUESTS FEMA PRELIMINARY DAMAGE ASSESSMENT Window Rock – President Russell Begaye yesterday formally requested a Preliminary Damage Assessment (PDA) from the Federal Emergency Management Agency (FEMA) in response to the Gold King Mine spill. A Preliminary Damage Assessment is the first step in the application process for public assistance for recovery from a disaster for eligible applicants. “The spill caused damage to the water quality of the San Juan River to such a massive extent that a state of emergency was declared by the Navajo Nation,” wrote President Begaye in a letter to EPA Associate Administrator Elizabeth Zimmerman. “All of the economic, health, cultural and other impacts to the Navajo people are not yet known. Given the significance of the San Juan River to the health, welfare economy, and culture of our Nation and people, the Navajo Nation, as a federally recognized Indian tribe, officially and specifically requests a mission assignment for Technical Assistance to complete a Preliminary Damage Assessment for damages as sustained as a result of the Gold King Mine spill.” Last month, FEMA rejected the Navajo Nation’s request for the appointment of a disaster- recovery coordinator to direct the federal government’s response to the crisis. During his testimony before Congress following the decision, President Begaye called on the federal government, and specially FEMA, to provide greater support to address the disaster caused by the Environmental Protection Agency (EPA) spill. The 22nd Navajo Nation Council — Office of the Speaker Contact: Michael Wero, Communications Director Phone: (928) 871-7160 (928) 255-3428 [email protected] March 22, 2011 www.navajonationcouncil.org FOR IMMEDIATE RELEASE Speaker Naize Looks to Economic Cooperation with Twin Arrows Groundbreaking Leupp, AZ — At Monday’s groundbreaking of the Navajo Nation’s fourth casino operation, Navajo Nation Council Speaker Johnny Naize told the audience that through economic cooperation the Nation, other Arizona tribes, and their neighboring communities can continue to grow and benefit from the native gaming industry. “Traditionally, the Navajo Nation and the city of Flagstaff haven’t had the best relations on how to allocate natural resources or how to accommodate culturally significant sites, like the San Francisco Peaks, in our search to better our economic environments,” said Speaker Naize. “I’m hoping this project, though the jobs and revenue it generates, will lead to more understanding between our communities.” Naize also reiterated that as Navajo gaming operations expand, they must also remain as a tool to generate economic opportunities for the other new and existing industries that would employ many Navajos. He noted this in the project’s commitment to reducing the high unemployment rate on the Navajo Nation. “Some have criticized the Navajo Nation’s use of its Navajo Employment Preference Law, but it has leveled the playing field for small Navajo businesses to participate in the construction of these larger projects,” said Naize. “I have been informed that, besides the Navajo employees that will go to work once this facility is completed, the primary construction company building this project will also focus on using Navajo labor.” Being the first Navajo casino operation in Arizona, Naize called on continuing a positive relationship with the state and its gaming tribes. -

Enactment of the Diné Natural Resources Protection Act of 2005 The Navajo Nation Council hereby enacts the Diné Natural Resources Protection Act of 2005. Section 2. Purpose The purpose of the Diné Natural Resources Protection Act of 2005 is to ensure that no further damage to the culture, society, and economy of the Navajo Nation occurs because of uranium mining within the Navajo Nation and the Navajo Indian Country and that no further damage to the culture, society and economy of the Navajo Nation occurs because of uranium processing until all adverse economic, environmental and human health effects from past uranium mining and processing have been eliminated or substantially reduced to the satisfaction of the Navajo Nation Council. Section 3. Amendments to Title 18 Navajo Nation Code The Navajo Nation Council hereby amends the Navajo Nation Code, Title 18, as follows: §1301. Findings A. Navajo Indians of the Southwest History Worksheets
Navajo Indians of the Southwest Americans built a fort, named Fort Defiance in Navajo territory in September 1851. The Americans seized the valuable grazing land around the fort. In 1860, when the Navajo’s livestock strayed onto pastures, U.S. soldiers slaughtered a number of Navajo horses. The Navajos raided army herds in order to replenish their losses. The Navajo eventually led two attacks against the fort, one in 1856 and one in 1860. Nearly 1,000 Navajo warriors attacked the Fort in the 1860 raid, but Maneulito (below right) and Barboncito (right) did not have enough weapons to take the fort. Navajo continued their hit and run attacks. A militia unit, the Second New Mexico Mounted Volunteers, was formed to fight the Navajos and Apaches. In January 1861, Maneulito and other leaders met with Colonel Canby to sign a new peace treaty. The Navajo were anxious to get back to their crops and livestock and signed the treaty. A second fort, called Fort Fauntleroy, was built in 1860. (Later it was renamed Fort Wingate.) Manuel Chaves became the commander of the fort. The Navajo gathered at the fort for rations and friendly horse races. There had been heavy betting. Allegations of cheating in a horse race led to a fight between Chaves’s men and visiting Navajos. Chaves ordered his men to fire at the Navajo. In all, the troops killed twelve Navajo men, women, and children and wounded around forty more. In 1862, Fort Wingate was moved. The Civil War was in full swing. Navajo raids increased. Citizens in the area complained that nearly 30,000 sheep were stolen in 1862. -
