Protect Massachusetts' Rivers from Drying Up

We appreciate the significant efforts that have been put into the development of ecologically based streamflow criteria, which informed the Sustainable Water Mana~ement Initiative (SWMI) proposal. However, the proposed safe yield limits permit more water tQ be taken than CUffent limits. Excessive amounts of water are already being taken in many river basins during the late summer periods of low water. We urge the EEA to make changes, water withdrawal reductions, to the SWMI Framework.

We are concerned when rivers and streams run dry due to no water recharging them from the ground. The state's safe yield determinations are proposed to be more than twice as great, more gallons per day aken, than are current withdrawals! Adding insult to ecosystem, the regulatory framework does not accoumt for the water withdrawals by thousands of private and corporate wells in Massachusetts. And, it is counterproductive for the state to allow the transfer of registrations from old wells to new ones without consideration for what this does to groundwater supply or to ecosystems.

Stream flow criteria could provide guidance for effective Water Management Act permit limits and conditions. The current draft falls short because safe yield determinations allow for higher water withdrawals than current withdrawals, baselines that extend water rights be~ond ttle terms of the WMA, registrations that DEP won't condition, and mitigation tiers that accommodate backsliding without req41ring restoration.

It is an improvement to switch from a reliance on a drought advisory to the use of water flow gauges to Qlake determinations when to mandate restrictions to non­ essential water use. However, to use the annual 7-day impacted low flow volume, as indicated by the water flow gauges, results in too little water to enact restrictions on non-essential water use. During August, rivers depend on cooling groundwater for any water flow and only ground-cooled water can hold enough oxygen to support river life.

We have made progress in conserving water in Massachusetts. Over the last two decades water usage in the MWRA service area has gone down over 100 million gallons per day. The cost of sewer bills encourages us to save water. It seems wrong for the WMA to encourage taking more water with a liberal water usage permitting process. More withdrawals not only further stress river life, more withdrawals can more greatly overwhelm sewage treatment operations. In March 2010, extraordinarily high rainfall caused approximately l S million gallons of sewage to spill from the Deer Island wastewater treatment plant into Boston Harbor. Conservation and responsible water use is good for both ends of the pipeline.
