(Public) ─────────────────────────────────────── Sponsors: Representatives Michaux; and Burton. ─────────────────────────────────────── Referred to: Judiciary I. ─────────────────────────────────────── February 14, 1994 1 A BILL TO BE ENTITLED 2 AN ACT TO PROTECT PUBLIC SAFETY AND RECREATIONAL FIREARM USE 3 BY RESTRICTING THE MANUFACTURE, TRANSFER, AND POSSESSION 4 OF CERTAIN SEMIAUTOMATIC ASSAULT WEAPONS. 5 The General Assembly of North Carolina enacts: 6 Section 1. Chapter 14 of the General Statutes is amended by adding a new 7 Article to read: 8 "ARTICLE 53B. 9 "PUBLIC SAFETY AND RECREATIONAL FIREARMS USE PROTECTION 10 ACT. 11 "§ 14-409.15. Definitions. 12 The following definitions apply to this Article: 13 (1) Crime of violence. – An offense that is a felony and (i) has as an 14 element the use, attempted use, or threatened use of physical force 15 against the person or property of another or (ii) that by its nature, 16 involves a substantial risk that physical force against the person or 17 property of another may be used in the course of committing the 18 offense. 19 (2) Drug trafficking crime. – An offense committed in violation of G.S. 20 90-95(h). 21 (3) Large capacity ammunition feeding device. – The term includes the 22 following: (i) a magazine, belt, drum, feed strip, or similar device that 23 has a capacity of, or that can be readily restored or converted to accept, 24 more than 10 rounds of ammunition; and (ii) any combination of parts GENERAL ASSEMBLY OF NORTH CAROLINA 1994 1 from which a device described in this subdivision can be assembled. 2 The term does not include an attached tubular device designed to 3 accept, and capable of operating only with, .22 caliber rimfire 4 ammunition. 5 (4) Semiautomatic. – Employs gas pressure or force of recoil and 6 mechanical spring action in ejecting the empty cartridge case after the 7 first shot and in loading the next cartridge from the magazine, but 8 requires release and another pressure of the trigger for firing each 9 successive shot. 10 (5) Semiautomatic assault weapon. – Any of the following: 11 a. Any of the firearms, or types, replicas, or duplicates in any 12 caliber of the firearms known as: 13 1. Norinco, Mitchell, and Poly Technologies Avtomat 14 Kalashnidovs (all models). 15 2. Action Arms Israeli Military Industries UZI and Galil. 16 3. Beretta AR-70 (SC-70). 17 4. Colt AR-15. 18 5. Fabrique Nationale FN/FAL, FN/LAR, and FNC. 19 6. SWD M-10, M-11, M 0911/9, and M12. 20 7. Steyr AUG. 21 8. INRRATEC TEC-9, TEC-DC9, and TEC-22. 22 9. Any shotgun which contains its ammunition in a 23 revolving cylinder, including the Street Sweeper and 24 Striker 12. 25 b. A semiautomatic rifle that has an ability to accept a detachable 26 magazine and has at least two of the following: 27 1. A folding or telescoping stock. 28 2. A pistol grip that protrudes conspicuously beneath the 29 action of the weapon. 30 3. A bayonet mount. 31 4. A flash suppressor or barrel having a threaded muzzle. 32 5. A grenade launcher. 33 c. A semiautomatic pistol that has an ability to accept a detachable 34 magazine and has at least two of the following: 35 1. An ammunition magazine that attaches to the pistol 36 outside of the pistol grip. 37 2. A barrel having a threaded muzzle. 38 3. A shroud that is attached to, or partially or completely 39 encircles, the barrel and that permits the shooter to hold 40 the firearm with the nontrigger hand without being 41 burned. 42 4. A manufactured weight of 50 ounces or more when the 43 pistol is unloaded. 44 5. A semiautomatic version of an automatic firearm. A pistol grip that protrudes conspicuously beneath the 4 action of the weapon. 5 3. A fixed magazine capacity in excess of five rounds. 6 4. An ability to accept a detachable magazine. 7 "§ 14-409.16. Manufacture, transfer, possession, and identification of certain 8 semiautomatic assault weapons. 9 (a) Manufacture, Transfer, and Possession. – It is unlawful for a person to 10 manufacture, transfer, or possess a semiautomatic assault weapon. A violation of this 11 subsection is a Class I felony. 12 (b) Identification. – The serial number of any semiautomatic assault weapon 13 manufactured after the effective date of this section shall clearly show the date on which 14 the weapon was manufactured. A violation of this subsection is a Class 2 misdemeanor. 15 "§ 14-409.17. Exemptions. 16 (a) Firearms Lawfully Possessed Prior to Date of Enactment. – This Article does 17 not apply to the transfer or possession of any firearm that was lawfully possessed before 18 the effective date of this Article. 19 (b) Certain Hunting and Sporting Firearms. – This Article does not apply to any 20 of the following: 21 (1) Any firearm that (i) is manually operated by bolt, pump, lever, or slide 22 action; (ii) is an unserviceable firearm; or (iii) is an antique firearm. 23 (2) Any semiautomatic rifle that cannot accept a detachable magazine that 24 holds more than five rounds of ammunition. 25 (3) Any semiautomatic shotgun that cannot hold more than five rounds of 26 ammunition in a fixed or detachable magazine. 27 (4) Any of the firearms listed below, or replicas or duplicates of the 28 firearms listed below, as those firearms were manufactured on October 29 1, 1993: 30 Centerfire Rifles – Autoleaders. 31 Browning BAR Mark II Safari Semi-Auto Rifle. 32 Browning BAR Mark II Safari Magnum Rifle. 33 Browning High-Power Rifle. 34 Heckler & Koch Model 300 Rifle. 35 Iver Johnson M-1 Carbine. 36 Iver Johnson 50th Anniversary M-1 Carbine. 37 Marlin Model 9 Camp Carbine. 38 Marlin Model 45 Carbine. 39 Remington Nylon 66 Auto-Loading Rifle. 40 Remington Model 7400 Rifle. 41 Remington Model 7400 Special Purpose Auto Rifle. 42 Ruger Mini-14 Autoloading Rifle (w/o folding stock). 43 Ruger Mini Thirty Rifle. 44 Centerfire Rifles – Lever & Slide.
