To amend sections 2744.01, 2744.02, 2744.05, and 4973.17 of the Revised Code to provide a municipal corporation or county immunity from civil and criminal liability in any action that arises from a hospital police officer acting directly in the discharge of the person's duties as a police officer and that occurs on the premises of the hospital or its affiliates or subsidiaries or elsewhere in the municipal corporation or county and to modify the definition of "emergency call" and the defenses to a political subdivision's liability for a peace officer's negligent operation of a motor vehicle.

To amend sections 9.87, 2743.02, 2744.01, and 4123.68 of the Revised Code to make temporary changes related to qualified civil immunity for health care and emergency services provided during a government-declared disaster or emergency and for exposure to or transmission or contraction of certain coronaviruses, to expand the definition of "governmental function" regarding political subdivision tort liability in relation to emergency declarations, to expand state immunity to include actions undertaken under a duty during the COVID-19 pandemic, to make COVID-19 contracted by certain employees an occupational disease under the Workers' Compensation Law under specific circumstances, and to declare an emergency.

WHEREAS, Physicians at the Barbara Davis Center for Childhood Diabetes report that diabetic ketoacidosis (DKA) is one of the most common, costly, and dangerous acute complications in people with type 1 diabetes; and WHEREAS, DKA occurs when the body lacks insulin, which causes the breakdown of fat at a rate that is too fast. The liver processes the fat into a fuel called ketones, which causes the blood to become acidic; and WHEREAS, The Mayo Clinic reports that symptoms of DKA include excessive thirst, frequent urination, nausea and vomiting, abdominal pain, weakness or fatigue, shortness of breath, fruity-scented breath, and confusion; and WHEREAS, Research sponsored by the American Diabetes Association found that 30 to 46% of children in the United States experience DKA at the time of type 1 diabetes diagnosis because it is unknown that they even have this autoimmune disease; and WHEREAS, the United States Centers for Disease Control and Prevention reported that hospitalizations for DKA increased in the United States during 2009–2014 among all age groups and were highest among persons aged less than 45 years; and WHEREAS, DKA can cause complications such as low levels of potassium (hypokalemia), swelling inside the brain (cerebral edema), fluid inside the lungs (pulmonary edema), and kidney and other organ damage from fluid loss. Among all type 1 diabetes-related deaths for patients aged less than 30 years, research published in the online medical journal, BMJ Open, indicated that 54 to 76% can be attributed to DKA; and WHEREAS, Persons with type 1 diabetes need insulin constantly to stay alive, either through multiple daily injections or an insulin pump, or they will experience DKA which will result in death; now therefore be it SENATE JOURNAL, WEDNESDAY, JUNE 3, 2020 1797
